SUBJECT: APPROVAL OF DOWNTOWN AND UPTOWN BUSINESS DISTRICT
TEMPORARY PUBLIC RESTROOM PROGRAM

SUMMARY
Staff recommends the City Council approve the Downtown and Uptown Temporary
Public Restroom Program, which authorizes the City to subsidize expenses for
restroom maintenance, cleaning and supplies to up to ten participating business in the
Downtown and Uptown Business District in return for allowing public access to their
restroom facilities during business operating hours. Also included is a Budget
Resolution appropriating $100,000 from Fund Balance of the General Fund for the first
year's program.
RECOMMENDATION:
1. Approve Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA APPROVING THE DOWNTOWN
AND UPTOWN TEMPORARY PUBLIC RESTROOM PROGRAM GUIDELINES
AND APPLICATION/AGREEMENT."
2. Approve a Budget Resolution in the amount of $100,000 from Fund Balance of
the General Fund to establish the program.
3. Authorize the City Manager and/or his designee to execute all necessary
documents.
STAFF ANALYSIS:
The City of Palm Springs was petitioned by Main Street Palm Springs to open and
maintain Public Restrooms in the downtown and uptown business district. There are
currently no City-owned public restroom facilities within the Downtown Central
Business District or Uptown District, and this has put a burden on local merchants who

are frequently asked by the public to use their facilities. A petition for public restrooms
with over 500 signatures was delivered to the City Clerk's office requesting that the City
of Palm Springs take action to provide public restroom facilities to improve the
experience of our uptown and downtown visitors.
Staff has investigated the cost of renovating existing restrooms at Plaza Las Flores and
determined that the cost of retrofitting the restrooms to make them suitable for heavy
public use would be in excess of $150,000. The annual cost of cleaning and
maintenance, plus security would cost an additional $100,000 per year.
The construction of new restroom facilities would be a major project requiring
significant funds and months to complete, if a suitable site could be located. This
alternative has the significant disadvantage of being a single location to serve an area
which extends for more than a mile.
A Temporary Downtown and Uptown Public Restroom Program is proposed to provide
the public more immediate access to restrooms throughout downtown and uptown
Palm Springs. The Temporary Public Restroom Program is proposed to begin in
October 2011, when the tourist season begins, and continue for one year when the
program will be evaluated.
The program consists of a City subsidy offered to selected business locations which
are willing to allow public access to restroom facilities during business operating hours.
The purpose of the subsidy is to offset expenses associated with maintenance,
cleaning and supplies as a result of increased usage. The program is voluntary and
would be based on a review of applications by downtown and uptown businesses to
participate. Criteria that would need to be met by each participating business would
include:
• The establishment must be open at least from mid-day through evening hours a
minimum of 5 days per week, including the weekend;
• The restroom facilities must be accessible for all individuals as required under
the Americans with Disabilities Act;
• Businesses would assume responsibility for daily cleaning, ongoing
maintenance and supplies of their restrooms to meet the public need;
• Business staff would be required to maintain a log sheet on the back of the entry
door to the public restroom(s) identifying maintenance and cleaning times and
schedule of restocking of supplies and these log sheets would be maintained on
file at the premises for the duration of the program;
• Display a window decal to be provided by the City identifying the establishment
as a public restroom facility.
In addition to the mandatory program criteria identified above, other desirables that
would be considered in the selection of participating businesses would include: separate

men's and women's facilities and multiple stalls; well lighted, convenient and easy to find
establishments; a location that serves most traveled areas and provides maximum
coverage in relation to other selected locations; and maximum number of hours open for
business. The City would reserve the right to select participating businesses.
Participating businesses would reserve the right to refuse service or usage of restrooms
based on abuse of the facility. Abuse would include excessive use by any individual or
group, deliberate waste of supplies, disrespect for the property and any act that would be
detrimental to the operation of the business.
The objective of the temporary program is to select up to ten businesses at various
locations in the uptown and downtown to maximize coverage and provide a convenient
public access to restrooms. Staff will prepare a written and emailed notice to businesses
within the uptown and downtown business district inviting them to submit an application
to participate in the program.
It is expected that applications would be received through August 2011. The City staff
would evaluate and select locations and finalize agreements with the businesses by
September 15, 2011. The Downtown Administrator would review each location for
program criteria compliance and process payments to businesses on a monthly basis
from October 2011 through September 2012.
FISCAL IMPACT:
The cost of the program to the City is projected to be $100,000, which is based on a
payment of $500 per month per participating business over a full year beginning
October 1, 2011 and assuming that there will be a total of ten public restroom locations
selected. Part of the cost would be a potential grant of up to $1,000 per business for
minor modifications to restrooms to ensure ADA compliance and other factors. Also
included in the cost would be some administrative and marketing costs to assist the
public in learning about the program.

WHEREAS, there are no City-owned public restroom facilities within the

OVERVIEW
The program is designed to provide the public access to restrooms
throughout Downtown/Uptown Palm Springs from October 2011 through
September 2012. The City will offer a subsidy to approved locations that
are willing to allow public access to their business for use of their restroom
facilities. The subsidy is offered to offset expenses in cleaning,
maintenance and supplies of restroom facilities. The program is being
offered to a maximum of ten businesses within t eligible area (see

WHEREAS, Resolution No. 22926 approving the Budget for the Fiscal Year
2011-12 was adopted on June 1, 2011; and
WHEREAS the City Manager has recommended, and the City Council desires to
approve, certain amendments to the budget for Fiscal Year 2011-12.
