HomeMy WebLinkAbout23002 RESOLUTION NO. 23002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE DOWNTOWN AND UPTOWN TEMPORARY RESTROOM PROGRAM GUIDELINES AND APPLICATION AGREEMENT. WHEREAS, there are no City-owned public restroom facilities within the Downtown Central Business District or Uptown District; and WHEREAS, a Temporary Downtown and Uptown Public Restroom Program would provide the public more immediate access to restrooms throughout downtown and uptown Palm Springs; and WHEREAS, a Temporary Downtown and Uptown Public Restroom Program would take effect October 1, 2011 through September 30, 2012 and afford staff the opportunity to evaluate the program in addition to other alternatives. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: 1. The Guidelines and Application/Agreement for the Downtown and Uptown Temporary Restroom Program are hereby approved, attached as Exhibit A. 2. ABSTAIN: None. mes Thompson, City Clerk �/�s /ZD� � ity of Palm Springs, Californi Exhibit A Downtown/Uptown Temporary Public Restroom Program Guidelines OVERVIEW The program is designed to provide the public access to restrooms throughout Downtown/Uptown Palm Springs from October 2011 through September 2012. The City will offer a subsidy to approved locations that are willing to allow public access to their business for use of their restroom facilities. The subsidy is offered to offset expenses in cleaning, maintenance and supplies of restroom facilities. The program is being offered to a maximum of ten businesses within the eligible area (see attached map). The maximum subsidy to be offered is $500 per month. BUSINESS PARTICIPATON CRITERIA: • Open from mid-day through evening, a minimum of 5 days per week, including weekends. • Meets Americans with Disabilities Act (ADA) Accessibility requirements. • Provide daily cleaning, maintenance and supplies of public restroom. • Display of maintenance times and restocking of supplies via log sheet on back of entry door to restroom facilities. • Log sheets to be retained on file at premises for duration of program. • Display of 6" x 6" participation window decal. NOTE: Business shall reserve the right to refuse service or usage of restroom based on abuse of facility. Wherein access is deemed by the business as excessive by any individual or group and/or a detriment to business operations, business reserves the right to refuse access. CITY OF PALM SPRINGS WILL PROVIDE: • Subsidy of up to $500 per month over the period between October 1, 2011 through September 30, 2012 made in monthly payments to the establishment by the 15th of each month. • Log sheets for recording of cleaning and supply times to restroom facilities. • Participation window decals. PROGRAM LAUNCH TIMELINE: 1. Downtown Administrator works with City staff to draft criteria and notice businesses within Downtown/Uptown of program opportunity by August 1, 2011. 2. City staff to record and receive applications through August 2011. 3. Administrator and staff to select locations and finalize agreements with businesses by September 15, 2011. 4. Program window decals and log sheets delivered for start date of October 1, 2011. 5. Administrator to review locations for criteria compliance and process payments to businesses. Exhibit A AGREEMENT (name of establishment) will provide public access to our restroom facilities during our operating hours. In participating in the downtown and uptown temporary public restroom program, I agree to the following: ❑ Restrooms will be stocked with paper supplies and soap and will be cleaned and maintained daily. ❑ Log sheet will be maintained on back of entry door of restrooms and maintenance, cleaning and restocking of supplies will be documented on a daily basis. ❑ Log sheets will be collected and retained on file at the premises for the duration of the program. ❑ 6" x 6" participation decal to be provided by the City of Palm Springs will be posted on exterior windows of business for the duration of the program. City of Palm Springs agrees to provide the following: ❑ 6" x 6" participation window decals indicating that the business provides public restrooms; ❑ Log sheets for recording maintenance, cleaning and restocking of supply times to participating business; ❑ Payment to participating business in the amount of per month to subsidize expenses for additional cleaning, maintenance and supplies as a result of increased restroom usage by non-customers and employees.
