FROM: David Ready, City Manager BY: Palm Springs Police Department SUMMARY It is recommended that the City Council authorize the City Manager to accept $125,000.00 in OTS grant funding for the Police Department to utilize for a Selective Traffic Enforcement Program. The total grant amount will be $125,000.00. The grant funds will be used to conduct DUI checkpoints, conduct saturation patrols, warrant sweeps, multimedia presentations at our local schools, and acquire equipment which is used to prevent DUI violations. Grant funds will also concentrate on the enforcement of speed and red light violations. RECOMMENDATION: 1. Accept $125,000.00 in grant funding from the California Office of Traffic Safety for a Selective Traffic Enforcement Program. 2. Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The Police Department rigorously enforces DUI laws by conducting DUI checkpoints, saturation patrols, warrant sweeps, and developing awareness programs such as multimedia presentations at our local schools. The Police Department also enforces speed and red light violations by conducting operations at intersections and streets with disproportionate numbers of traffic collisions. The Police Department plans to conduct 76 special operations during this grant period. The department has been successful in obtaining grant funding to pay for the personnel and equipment costs for these programs. The Police Department was able to successfully solicit OTS grant funding for this community safety project and was awarded$125,000.00 in grant funding. This grant period is for a Selective Traffic Enforcement Program between 10/1/11 and 9/30/12. FISCAL IMPACT: No fiscal impact. This is a reimbursable costs grant program. The press releases and media advisories, alerts, and materials must be emailed to the OTS Public Information Officer at pio@ots.ca.gov, and copied to your OTS Coordinator, for approval 14 days prior to the issuance date of the release. 2 225 To send all grant-related activity press releases, media advisories, alerts and general public materials to the OTS Public Information Officer(PIO)at pio@ots.ca.gov, with a copy to your OTS Coordinator. Describe current traffic unit complement (number of personnel and classifications). If applicable, describe how the size of the traffic unit has fluctuated in the past five years and why. The Palm Springs Police Department is comprised of 86 sworn police officers; seven of whom are assigned to the traffic unit. The PSPD traffic unit is comprised of one sergeant, one traffic investigator, one DUI enforcement officer and four motor traffic enforcement officers. Although the City's population fluctuates dramatically throughout the year; the traffic unit staffing remains the same, and has remained the same throughout the past five years. The City of Palm Springs is an international resort destination community with an international airport and an estimated 2 plus million visitors each year. In 2009, the census listed the population of Palm Springs as 48,184; but these numbers fluctuate to over 100,000 during a typical winter weekend. With nearly 80,000 calls for service last year and increases in calls for service every year; uniformed patrol officers keep very busy handling these calls, not allowing significant time for traffic and DUI enforcement. Traffic unit officers handle nearly every traffic collision and they are responsible for nearly 90% of all citations issued throughout the City of Palm Springs. The DUI enforcement officer was responsible for approximately 20%of all DUI arrests in the City last year. 2. In 2009,for example, there were 171 collisions with excessive speed as a PCF. 62 of those collisions (or 36%) resulted in injuries. There are similar numbers for failure to yield the right-of-way as PCF. In the same year, there were 69 collisions with red light running(21453 CVC) as the PCF;43 of those (or 62%) resulted in injuries. In 2010,there were similar figures.There were 134 collisions with speed as the PCF. 54 of these (or 40%) resulted in injuries. In the same year,there were 49 collisions with with 21453 CVC as the PCF; 33 of those (or 67%) resulted in injuries. For the past five years, there were 310 collisions with 21453 CVC as the PCF;222 of those (or 72%) resulted in injuries. In summary; although red light running is not the most common PCF for collisions in Palm Springs; this violation is a significant cause of injury collisions in the City. 8. How many"texting" while driving citations did your department issue between October 1, 2009 and September 30,2010? 5 METHOD OF PROCEDURE Phase I: Program Preparation,Training and Implementation(1st Quarter of the Grant Year) • The police department will develop operational plans to implement the "best practice" strategies outlined in the objectives section. • A draft news release will be submitted to OTS to announce the grant program. • All training needed to implement the program will be conducted this quarter. • All grant related purchases needed to implement the program will be made this quarter. • In order to develop the "Hot Sheets", research will be conducted to identify the "worst of the worst" repeat DUI offenders with a suspended or revoked license as a result of DUI convictions. The Hot Sheets may include the driver's name, last known address, DOB, description, current license status, and the number of times suspended or revoked for DUI. Hot Sheets will be updated and distributed to traffic and patrol officers every three to four weeks. • Implementation of the STEP program will be accomplished by deploying personnel at high collision locations. • DUI/Driver's License checkpoint site locations will have a history of significant alcohol involved collisions and/or DUI arrests. Phase Il: Community Awareness(Throughout Grant Period) • The police department will work to create media opportunities throughout the grant period to call attention to the innovative program strategies and outcomes. The Grantee Agency shall actively encourage all relevant law enforcement personnel in the State to follow the guidelines established for vehicular pursuits issued by the International Association of Chiefs of Police that are currently in effect. (23 USC 402 (b) (1)(E) Other Federal Requirements Cash disbursements and balances will be reported in a timely manner as required by NHTSA. (49 CFR 18.21) The same standards of timing and amount, including the reporting of cash disbursement and balances, apply to grantees as they do the State. Making it a requirement that each employee engaged in the performance of the grant be given a copy of the statement required by paragraph (a). d. Notifying the employee in the statement required by paragraph (a)that, as a condition of employment under the grant,the employee will: 1. Abide by the terms of the statement. 2. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction. e. Notifying the agency within ten days after receiving notice under subparagraph (d) (2)from an employee or otherwise receiving actual notice of such conviction. f. Clear justification for the purchase of non- domestic items must be in the form of a waiver request submitted to and approved by the Secretary of Transportation. Political Activity(Hatch Act) The Grantee Agency will comply, as applicable,with the provisions of the Hatch Act(5 U.S.C. §§ 1501-1508 and 7324- 7328)which limit the political activities of employees whose principal employment activities are funded in whole or in part with Federal funds. Adopt and enforce workplace safety policies to decrease crashes caused by distracted driving including policies to ban text messaging while driving- a. Company-owned or—rented vehicles,or Government-owned, leased or rented vehicles;or b. Privately-owned when on official Government business or when performing any work on or on behalf of the Government. 2. Conduct workplace safety initiatives in a manner commensurate with the size of the business,such as- a. Establishment of new rules and programs or re-evaluation of existing programs to prohibit text messaging while driving; and b. Education, awareness, and other outreach to employees about the safety risks associated with texting while driving. Environmental Impact The Grantee Agency official has reviewed the Grant Agreement and hereby declares that no significant environmental impact will result from implementing this traffic safety program.
