SUBJECT: APPROVAL OF A RESOLUTION AUTHORIZING THE DIRECTOR OF
PUBLIC WORKS/CITY ENGINEER TO APPLY TO THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD FOR FUNDS
AVAILABLE TROUGH SB 1346 RUBBERIZED ASPHALT CONCRETE
GRANT PROGRAM, FY 2005/2006.

SUMMARY
Every year, the Public Works and Engineering Department strives to program an
Asphalt Rubber Hot Mix (ARHM) Overlay project for selected City streets that require
additional maintenance improvements that a typical slurry seal will not adequately
address. The State, through the SB 1346 Program, offers funding assistance to cities
that schedule ARHM overlay projects that utilize rubberized asphalt concrete.
RECOMMENDATION:
1. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA AUTHORIZING THE DIRECTOR
OF PUBLIC WORKS/CITY ENGINEER TO APPLY TO THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD FOR FUNDS AVAILABLE
THROUGH THE SB 1346 RUBBERIZED ASPHALT CONCRETE GRANT
PROGRAM, FY 2005/2006."
2. Authorize City Manager to execute all necessary documents.
STAFF ANALYSIS:
The California Integrated Waste Management Board (CIWMB) receives an annual
appropriation from the California Recycling Management Fund (Tire Fund) to administer
the Tire Recycling Act (Act) and related legislation. As part of the Act, the CIWMB is
offering the Senate Bill (SB) 1346 Rubberized Asphalt Concrete Grant Program, to
encourage the reduction of landfill disposal and stockpiling of California Waste tires.

The CIWMB has proposed funding allocation of $1,663,000 for fiscal year 2005/2006.
These funds are available on a competitive basis to all cities, counties, special districts,
and other local government agencies that fund public works projects using rubberized
asphalt concrete. The Program reimburses applicants at rate of $2.50 per ton of
rubberized asphalt concrete used in their project.
This year, the Public Works and Engineering Department has proposed an ARHM
overlay of the following roads:
- Golf Club Drive from 34th Street to HWY 111 (East Palm Canyon)
- 34th Avenue from Golf Club Drive to Easterly City Limits
- Indian Avenue from 20th Street to Northerly City Limits.
This Overlay Project will cover approximately 543,000 square feet of paving using
approximately 4,920 tons of rubberized asphalt concrete, and a minimum of 59 tons of
crumb rubber made from California waste tires recycled and saved from being wasted in
California landfills.
Although the SB 1346 program is highly competitive, we are hopeful that our application
will be received and approved. If funded, our ARHM overlay project will be eligible for
reimbursement of up to $12,300 from the CIWMB. Although the total reimbursement
available to the City only represents 2.2% of the total cost, it is an opportunity to
participate in the SB 1346 Program and continue our City-wide recycling efforts.
The SB 1346 Program requires that agencies applying for grant funds submit an
authorizing resolution by the agency's legislative body. The proposed resolution will
allow staff to submit the required application for SB 1346 funding for the City's proposed
ARHM overlay project.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF PALM
SPRINGS, CALLIFORNIA, AUTHORIZING
THE DIRECTOR OF PUBLIC WORKS/CITY
ENGINEER TO APPLY TO THE CLIFORNIA
INTEGRATED WASTE MANAGEMENT
BOARD FOR FUNDS AVAILABLE THROUGH
THE SENATE BILL 1346 RUBBERIZED
ASPHALT CONCRETE GRANT PROGRAM,
FISCAL YEAR 2005-2006.
WHEREAS, Public Resources Code Section (PRC) 42872.5 allows California Integrated
Waste Management Board (CIWMB) to award grants to public entities for funding of
public works projects that use RAC; and
WHEREAS, the CIWMB has been delegated the responsibility for the administration of
the RAC grant program, setting up necessary procedures governing application by local
governments under the program; and
WHEREAS, said procedures established by the CIWMB require the applicant to certify,
by resolution, approval of the application before submission of said application to the
State; and
WHEREAS, if awarded a grant, the applicant will enter into an agreement with the State
of California for development of the project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs
as follows:
1. That submittal of an application to the CIWMB for an SB 1346 Rubberized Asphalt
Concrete Grant is hereby authorized; and
2. That the Director of Public Works/City Engineer of the City of Palm Springs is
hereby authorized and empowered to execute in the name of the City of Palm
Springs all necessary applications, contracts, agreements, amendments, and
payment requests hereto for the purposes of securing grant funds and to
implement and carry out the purposes specified in the grant application.
