Ready, City Manager BY: Director of Public Works SUMMARY Section 7.04.040 of the Palm Springs Municipal Code enables the City Manager to declare an emergency in defined circumstances. When such an action is taken, the code requires the action to be reported to the City Council for confirmation and requires the reporting of transactions over $25,000 made pursuant to the declaration of the emergency. This staff report requests such confirmation and contains the report of emergency traffic signal repairs authorized for the Ramon Road and Crossley Road intersection. RECOMMENDATION: 1. Approve Minute Order "CONFIRMING THE CITY MANAGER'S DECLARATION OF A PUBLIC SAFETY EMERGENCY." 2. Receive and file a report of emergency purchase over $25,000 relating to the declared emergency. I STAFF ANALYSIS: I During the final stages on construction of the Wal-Mart Center, construction crews damaged a pull box and related conduit containing wiring for the traffic signals and lights at the Ramon Road and Crossley Road intersection. On various occasions in December 2005 and January 2006, the traffic signal failed placing the signals in a flashing red/4-way stop mode or having some of the indications go out completely and seriously impacting traffic on Ramon Road. Investigation by staff revealed that conductors were shorting and conduit was in need of replacement. This I iTEMI NO.cl. City Council Staff Report February 15, 2006 -- Page 2 Ramon--Crossley Emergency Repairs work was scheduled as part of this year's Protected-Permissive Modification Project, but the repeated failure of the signal resulted in the emergency declaration. Staff/Contract staff was able to get the traffic signal back into operation but, because an insufficient number of working conductors remain after the damage to the conduit, only at the cost of sacrificing lighting and some signal functionality. Staff immediately began to search for contractors willing and able to provide quotes to the City for repairing the intersection wiring. Staff had difficulty finding firms able to respond. In order to ensure public safety and to facilitate the acquisition of necessary repair services in a timely manner, staff requested the City Manager declare an emergency. Pursuant to Section 7.04.040 of the Municipal Code, the City Manager made such a declaration in January 2006. FISCAL. IMPACT: IFinance Director Review: City has entered into a contract for signal repairs with L.. Signal in the amount of $54,075. The only other City informal bid staff was able o obtain was from Sierra Pacific Electrical Contracting in the amount of $65,279. A majority of this work is scheduled to be funded 33% by Wal-Mart, 33% by the City of Cathedral City and 33% by the City of Palm Springs. New loop detectors costing $3,000, and included in the above total, are also proposed for construction to be funded 50% & 50% between the City of Cathedral City and the City of Palm Springs. �JC3— DAVID J. Ready, City Manager SUBJECT: Ramon @ Crossley Traffic Signal At the request of the Public Works Department and Procurement I have declared an emergency with respect to the operation of the traffic signal at the referenced intersection. The emergency was declared in order to allow immediate repairs to the conductors and conduit in order to continue the effective operation of the traffic signal. We propose to utilize unallocated Gas Tax Funds to be placed in our account 133-4298-50204 which will allow the Public Works Department to contract for this repair.
