�pF ?A L Al SP4 �2 r c CITY COUNCIL STAFF REPORT Z m DATE: November 16, 2011 NEW BUSINESS SUBJECT: THE CHARLES COMPANY IS REQUESTING AMENDMENTS TO THE PREVIOUSLY APPROVED SIGN DISTRICT FOR "THE SPRINGS" SHOPPING CENTER LOCATED AT 5200 EAST RAMON ROAD (THE SPRINGS). PLANNING CASE 5.0984 PD-291-A AND SP 11-005. FROM: David H. Ready, City Manager rn C BY: Department of Planning Services rn r SUMMARY The City Council will consider amendments to a previously approved Special Sign District, which is permitted under Section 93.20.05(C)(8) of the Palm Springs Zoning rn Code (PSZC). The proposed amendment is to allow signage that is not currently permitted for the "Ross Dress for Less" retailer at 'The Springs" shopping center and Z includes the following: 1. A main sign of 414 square feet in size (225.75-square foot sign is permitted); 2. A letter height of six feet (no more than four foot height is allowed for tenants of this size by the sign district); 3. A third secondary wall sign (only two are permitted by the sign district); 4. Various temporary banners (one grand opening sign of twenty square feet is permitted). RECOMMENDATION: 1 . Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DENYING AMENDMENTS TO A — PREVIOUSLY APPROVED SIGN DISTRICT FOR THE ROSS DRESS FOR C7 LESS RETAIL TENANT LOCATED AT 5200 EAST RAMON ROAD." Z On July 22, 2009, the City Council reviewed and approved the following amendments to Z The Springs' Special Sign District: Ill Addendum #1. New Menu Board. A preview menu board for Jack in the Box is permitted. Addendum #2. Modified text to specify that the Planning Director approves exceptions that do not meet the Sign District criteria. Addendum #3. Allowed Temporary Signage. The following signs were permitted to be displayed during construction and for up to sixty days after m certificate of occupancy for Bed, Bath & Beyond: a. Two wall banners b. Two site billboard signs m c. Two banners on hiring trailer Addendum #4. New Monument Sign for Individual Tenant. Wells Fargo was r permitted its own monument sign. Addendum #5. Existing Monument Sign Panels. The existing monument signs were allowed to have sign panels that are painted a different color other than the approved "El Dorado Tan" color. On September 26, 2011 , the Architectural Advisory Committee (AAC) reviewed the m proposed amendments to the Special Sign District and unanimously voted to restudy Z the proposal based on the following comments: 1. Reduce size of main sign; 2. No neon face for main sign (prefer backlit signage); 3. Background of main sign not be white color; 4. Remove oval signs on both sides of store entry; p 5. Allow blade sign below overhang; _ 6. Remove all temporary grand opening signs and allow only one grand opening sign as permitted by the sign district and zoning code; 7. Provide exhibits on proposed monument signage; 8. Provide exhibits on any proposed directional signage; 9. Provide information on proposed wall lighting. Q i City Council Staff Report November 16,2011—Page 3 of 6 5.0984 PD-291-A—Minor Amendment for Special Sign District(SP 11-005) r STAFF ANALYSIS: D Background Z The Springs Shopping Center project consists of the development of approximately Z 393,000 square feet of commercial development anchored by The Home Depot on a roughly 37-acre site at the northeast corner of Ramon Road and Gene Autry Trail. The M project site is located adjacent to the Airport to the west, commercial and industrial uses 0 to the south and east, and single family dwellings to the north. Project Description According to the Palm Springs Zoning Code 93.20.5.C.8, "special sign districts' may be v established by the City Council for commercial and industrial projects, as follows: m 8. Special Sign Districts. < Nothing in this section shall prohibit the city council from adopting special sign M districts as part of a specific plan, redevelopment plan, planned development district or the like when special sign provisions are necessary or appropriate to r implement general plan provisions and goals. 0 A Special Sin District was previously approved b the Council on November 11 2007. P 9 P Y Pp Y , An amendment to the District was approved by the City Council on July 22, 2009. The applicant is now proposing another amendment to the sign district to allow larger and more signage for a Major Tenant, "Ross Dress For Less". The proposal includes the m following: Z 1. A main sign of approximately 414 square feet in size with letter heights of up to --I six feet; 2. A double-faced pedestrian sign below the entry overhang of approximately 7.3 square feet in size; 3. Two "ROSS" oval logo signs, each 8 square feet in size and located on the block wall adjacent to glazed entry area; _ 4. Temporary signs, as follows: a. One Opening Soon banner that is 48 square feet in size and located below the proposed main wall sign; b. Multiple Opening Soon posters that are 14 square feet in size and located on the storefront windows (2 minimum); c. One Now Hiring banner that is 45 square feet in size and located on the building elevation; Zoning Analysis The proposed amendment to the Sign District creates design criteria for permanent and temporary signs. This sign was approved under the original sign district proposal and was permitted due to the Anchor being Z three to four times the size of any other single tenant in the center. Staff believes that Z the proposed main sign for Ross Dress for Less is excessive at 414 square feet in size with six foot high letters. The AAC also noted the sign as being too large and believed m the overall proposal was excessive. 0 AAC Discussion On September 26, 2011, the Architectural Advisory Committee (AAC) reviewed the proposed amendments to the Special Sign District and unanimously voted to restudy the proposal based on the following comments: M 1. Reduce size of main sign; < 2. No neon face for main sign (prefer backlit signage); 3. Background of main sign not be a white color; M 4. Remove oval signs on both sides of store entry; r 5. Allow blade sign below overhang; 6. Remove all temporary grand opening signs and allow only one grand opening Q sign as permitted by the sign district and zoning code; 7. Provide information on proposed wall lighting. m Based on the above comments, the applicant reduced the size of the main sign from Z 458 to 414 square feet in size. The applicant requested that the proposal be brought forward to the City Council for final action without another review by the AAC. This effectively changes the AAC recommendation to a denial. CONCLUSION: v The applicant is requesting a main sign that is larger in both letter height and area than the Sign District allows for the "Ross Dress For Less' retail tenant. Staff analyzed the N proposed main sign with previous approvals in the center and this would be the largest main sign of any of the other retail tenants that are comparable in size. Furthermore, many of the proposed temporary signs exceed the requirements of the Zoning Code W and Sign District. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1: Pursuant to Section 93.20.5.C.8 of the Palm Springs Zoning Code, the City Council finds that the proposed amendment to the approved Special Sign District includes special sign provisions that are excessive and do not implement general plan provisions and goals, as follows: Community Design Element CD 18.6: Develop a consistent sign program that encourages distinctive and high-quality design within the overall theme of the retail center. Conformance will be strictly enforced. Any installation of non-conforming or unapproved signs shall be brought into conformance at the expense of the tenant. A. GENERAL REQUIREMENTS 1. Each Tenant shall submit to the Landlord/Property Owner, drawings to be reviewed for conformance with this sign program and overall design quality. Approval or disapproval of sign submittals based on aesthetics of design shall remain the sole right of the Landlord/Property Owner. 2. Each Tenant shall submit for approval, in Landlord's/Property Owner's sole and absolute discretion, before fabrication at least three copies of detailed drawings (on 11"x 17" sheets) indicating the location, size, layout design and color of the proposed signs, including all lettering and/or graphics,prior to submitting to the City of Palm Springs for review and approval. 3. Landlord/Property Owner has ten(10) days to review and notify Tenant of approval, conditions of approval or denial. 4. All permits for signs and their installation shall be obtained and comply with local planning, building, and electrical codes. These permits shall be obtained by Tenant or Tenant's representative prior to installation. 5. Tenant's sign contractor will be responsible for obtaining all required city approvals. 6. No exposed lamps, crossovers, conduits, conductors, transformers or similar devices shall be permitted. 7. All Tenants must have installed approved signs before opening for business. 8. Any damage to the building fascia or sign area resulting from the installation or removal of any sign by Tenant will be repaired by the Landlord/Property Owner at the Tenant's expense. 9. All signs shall meet U.L. specifications. 10. Tenants shall be responsible for the fulfillment of all the requirements and specifications set forth in this sign program. 11. Before commencing work on property, sign contractor will provide to Landlord/Property Owner an original Certificate of Insurance naming the Landlord/Property Owner as "Additional Insurer I." 1 CTt I B. GENERAL SPECIFICATIONS 1. Tenant's sign contractor shall have a C-45 license and be insured by an admitted carrier for the total aggregate of$1,000,000.00 and provide proof acceptable to Landlord/Property Owner that Landlord/Property Owner is named as an additional insured on the certificate of insurance. 2. No projection above or below the sign will be permitted. Sign must be within dimensional letter limits as indicated in this sign program. 3. Tenant shall be responsible for the installation and maintenance of its sign. 4. Tenant shall be fully responsible for the operations of the Tenant's sign contractor. 5. Tenant's sign contractor shall repair under Landlord's/Property Owner's supervision, any damage caused by installation. 6. Electrical service to all signs will be connected to Tenant's electrical meter. C. CONSTRUCTION REQUIREMENTS 1. No labels will be permitted on the exposed surface of signs, except those required by local ordinance, which shall be placed in an inconspicuous location. 2. Design, layout, and materials for tenants' signs shall conform in all respects with the sign design drawings included with this sign program. 3. Tenant's sign contractors are encouraged to consider the architectural style of the fagade, the scale of the proposed sign, viewing angles and sight lines when designing. All architectural elements can be limited within the maximum sign height and lengths which may differ from the general guidelines within the criteria.
