My name is Ken Alan, I'm Senior Vice President of Kaminsky Productions
here in Palm Springs.
I'd like to extend my enthusiastic support for tonight's resolution to suspend
film and location permits.
There's a good reason the New York Mayor's Office of Film, Theater and
Broadcasting requires no permits or fees for unintrusive film and television
production —those images sell New York tourism. You can hardly watch
an evening of television without seeing images of New York. And it's free
advertising— with payoffs that last decades.
I had friends making their first time trip to New York tell me they wanted to
see the Macy's flagship store because of fond memories of the holiday
classic "Miracle on 34th Street." That film has been selling New York for
65 years.
For a big budget Hollywood film, the cost of permits, unbillable time to
handle the paperwork and the high cost of liability insurance are a small part
of the budget. But for our local projects, and for independent filmmakers,
these are a deal-breaker.

Dear Council Members:
I'm sorry not to be able to join your meeting, but I'm filming in Los Angeles.
Having shot a feature film in New York,I can vouch for the lure that city
cooperation is to a production. New York offered me free permits,free police,
free special parking permits and location assistance. These elements are a vital
spoke in any production wheel. Having these incentives definitely helps sway
decisions of where a film or television show are shot.
I do hope that Palm Springs and other cities in the Coachella Valley wake up
and make it easier and more affordable for us film makers.

SUBJECT: SUSPENSION OF FILM AND LOCATION PERMIT FEES

SUMMARY
In the late 1980's the City established fees for Commercial Filming and Still
Photography pursuant to Resolution 16319, as amended. Through the years various
production companies have filmed in Palm Springs by obtaining the appropriate permits
and paying the appropriate fees based on their production. In addition to permit and
location fees, production companies have also paid for City services such as police, fire,
facility use, etc.
City staff is recommending a one (1) year suspension of film and location permit fees to
encourage production companies to shoot in Palm Springs. Fees will still be charged
for expenses for City personnel, equipment, and vehicle expenses incurred by the City
to assist a film project. All of those fees will be actual costs to the City.
RECOMMENDATION:
Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA, SUSPENDING FILM PERMIT
AND LOCATION FEES FOR ONE (1) YEAR.
STAFF ANALYSIS:
The City has a Comprehensive Fee Schedule, which regulates what fee can be charged
for various City services and facilities. The Parks and Recreation Department has fees
regulated by the Comprehensive Fee Schedule.
In order to promote Palm Springs as a film friendly community, City staff is
recommending that the film permit and location fees be suspended for one (1) year.

FISCAL IMPACT:
Recent revenues from film and location fees were not a substantial source of revenue
for the City. City revenues in 2010 were $14,478 and $15,955 in 2011.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, SUSPENDING
FILM AND LOCATION PERMIT FEES FOR ONE (1) YEAR
WHEREAS on May 17, 2006, the City Council adopted Resolution No.
21578; approving the Comprehensive Fee Schedule and
WHEREAS the City Council desires to encourage production companies
to shoot within the City; and
WHEREAS, the suspension of said fees would encourage the companies
to shoot in the City.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY
FINDS AND DETERMINES THAT:
SECTION 1: Findings
In order to promote the City as the most film friendly city in Southern California,
that it hereby suspends the permit and location fees for one (1) year.
SECTION 2. Fee Suspension.
The fees as set forth below are suspended for one (1) year.

SECTION 3. Severability
Each component of the fees and all portions of this Resolution are severable.
Should any individual component of the fee or other provisions of this Resolution
be adjudicated to be invalid and unenforceable, the remaining provisions shall be
and continue to be fully effective, and the fee shall be fully effective except as to
that portion that has been judged to be invalid.
SECTION 4. Effective Date.
The fees shall be effective March 1, 2012 through February 28, 2013, after the
adoption of this Resolution.
