Tahquitz Canyon Way Palm Springs CA Via: [land Delivery Dear Members of City Council: The Deepwell Power Line Committee would like to thank City Council for taking the time to reconsider whether to use the City's Rule 20A Funds to bury power lines on E Palm Canyon along mostly vacant commercial land or on S. Sunrise and Ramon Road along residential communities. In an ideal world, both projects should be done. However, given limited resources, we believe public policy supports S. Sunrise and Ramon Road over E Palm Canyon. Rule 20A funds are automatically collected through our electric bills. There are over 2,000 homeowners in residential communities bordering S. Sunrise and Ramon who have contributed to the fund and are negatively impacted by the existing utility lines. They can reasonably expect to benefit from the fund. In contrast, the vacant commercial properties along E. Palm Canyon have never contributed to the fund and typically would be required to underground their utility lines as a condition of future development. If these lines were undergrounded now, the value of that property will simply go up and Rule 20A funds available for other projects will go down by the same amount. Since homeowners contributed these funds, in effect, money would come out of their pockets into the wallets of vacant commercial landowners rather than benefiting the citizens of Palm Springs. Further, portions of E Palm Canyon are located in a redevelopment zone, so the Redevelopment Agency is another source of funds for undergrounding these lines. In contrast, S. Sunrise and Ramon are not in a redevelopment zone and cannot access these funds. Ezge 1.3 We understand one homeowner on S. Sunrise built his home a few years ago and signed a covenant to pay for the cost of undergrounding the power lines on his property. City Council has indicated that it does not want to set a bad precedent by waiving such covenants. Our committee met with City Engineer David Barakian and Assistant City Manager Tom Wilson on various ways the covenant could be handled that would delay its enforcement without waiving it. Since this individual has lanes on both the front and back of his property, we suggested the covenant on Sunrise be enforced only in conjunction with the covenant on the back of the property some time in the future. The covenant would not be waived, setting no precedent, and the project could proceed without burdening the homeowner at this time. Of course, enforcing this covenant would be the surest way of not setting a precedent, but we urge the City to consider our suggestion before making a final decision. We also mentioned to Mr. Barakian that there are only three electric poles left on Mesquite Avenue just off of Sunrise. Mr. Barakian thought it may be possible to include these poles in the project since there are oNy three of them and we hope the City will look into their removal. We have enclosed a list of additional reasons why public policy supports S. Sunrise and Ramon Road over E. Palm Canyon. Twenty volunteers have distributed over 2,000 of these brochures to inform the community. There are a number of people in the audience tonight and even more watching their televisions at home who are hoping City Council will do the right thong and approve the project for S. Sunrise and Ramon Road. Thank you. The Deepwell Powerline Committee Rage 2 nf3 PUBLIC POLICY SUPPORTS SUNRISE AND RAMON OVER EASE" PALM CANYON ALONG VACANT COMMERCIAL PROPERTY 1. The City will lose a significant source of funds for DuMc use if it undergrounds the lines on East Palm Canyon (near Gene Autry now rather than later. i. The commercial vacant land along E. Palm Canyon currently does not have covenants to pay for undergrounding. Developers would typically be required to complete the undergrounding or sign covenants to do so later once commercial projects are approved, thereby giving the city more funds for undergrounding in the future. Several of these lots have real estate signs indicating that they have been sold or are pending sale so development of these properties in the near future is a realistic possibility thereby offering additional funding sources for undergrounding utilities. ii. Since portions of the E. Palm Canyon project are located in a redevelopment project area, the Redevelopment Agency is another source of potential funds for undergrounding the lines. These funds are not available to the S. Sunrise or Ramon Road project since they are not located in a redevelopment project area. 2. Using Rule 20(A) funds on E. Palm Cannon now would be a windfall to its vacant commercial land owners. And the money will come right out of the Dockets of the City's homeowners. Since there are currently no covenants on the E. Palm Canyon vacant land, the value of that property will go up by an amount equal to or greater than the cost of undergrounding the lines if they are done now. This will reduce by the same amount the Rule 20(A) funds available for other projects. Since homeowners contributed these funds through their electric bills, in effect, money is coming out of the pockets of homeowners into the wallets of the vacant commercial landowners rather than being used to benefit the citizens of Palm Springs. 3. With limited funds the city should spread the use of funds around the City. The last area to be undergrounded was on E. Palm Canyon west of Farrell. To be equitable, S. Sunrise and Ramon Road should take precedent over another E. Palm Canyon project this time. 21. Rule 20(A) funds should benefit those who have contributed to the fund over those who have not. There are over 2,000 homeowners in Deepwell Estates, Deepwell Ranch, Tahquitz River Estates, and Residential Developments bounded by Ramon Road, El Cielo, Palm Canyon and South Sunrise which are negatively impacted by the existing utility lines. Ali of these homeowners have contributed Rule 20(A) funds through their electric bells. In contrast, the vacant commercial properties along E. Palm Canyon have never contributed to the fund and typically would be required to accept covenants or actually complete the undergrounding of their utility lines as a condition of future development. 5. Using the funds on S. Sunrise and Ramon rather than on E. Palm Canyon will have no adverse affect to its vacant landowners or anv future Droposed commercial project on E. Palm Canyon. Since everyone already knows the City will require covenants from commercial projects approved on the land, the value of the land is already set. So doing nothing on E. Palm Canyon will have no adverse affect on the current property values nor will it enhance nor,detract from the commercial projects. City Council Staff Report March 1, 2006 Public Hearing for Three(3) Rule 20A Utility Undergrounding Districts STAFF ANALYSIS: On February 1, 2006, City Council continued a public hearing for the Rule 20A utility undergrounding district on East Palm Canyon Drive to March 1, 2006. On February 15, 2006, City Council approved two Resolutions of Intention to conduct public; hearings on March 1, 2006 for Rule 20A utility undergrounding districts on Sunrise Way and Ramon Road. Written notices were mailed to all property owners along Sunrise Way and Ramon Road within the limits of the two districts as authorized by said Resolutions of Intention. Property owners along East Palm Canyon Drive were also notified prior to the previous public hearing. ,Attached for City Council's consideration are three (3) resolutions which would form the districts. The staff report and resolutions of intention passed on February 15, 2006, maps and legal descriptions for each proposed district and the cost estimate for each proposed district. According to estimates from the Southern California Edison Company, the City is eligible to use approximately $2.2 to $2.4million of Rule 20A Funds. This will allow for establishment of either the East Palm Canyon Drive district or a combination of the Sunrise Way and Ramon Road districts, BUT NOT ALL THREE. Using Rule 20A Funds for the East Palm Canyon Drive district or a combination of the Ramon Road and Sunrise Way districts will"mortgage"the City's Rule 20A monies fora period of approximately five years, meaning that for five years subsequent to this project the City will not have a positive balance in the Rule 20A funds. Another Rule 20A undergrounding project will not be possible for a minimum of five years. Should Council pass the East Palm Canyon Drive or Sunrise Way or Ramon Road resolutions, staff will begin the process of calling covenants from the property owners within the appropriate district. This covenant provides that the property owner is responsible for their fair share of the costs of the utility undergrounding across the frontage of their respective properties. Covenants exist for one property totaling approximately 100 front feet along a portion of Sunrise Way between East Palm Canyon Drive and Sunny Dunes Road. Covenants also exist for one property totaling approximately 630 front feet along a portion of East Palm Canyon Drive. There will be no cost to the remaining property owners, nor to any of the property owners should the district on Ramon Road be formed. The cost for the property on Sunrise Way is estimated at $30,000, while the cost for the property on East Palm Canyon Drive is estimated at $280,000. FISCAL IMPACT: I Finance Director Review: All construction costs are being paid by SCE and reimbursed from Rule 20A allocations, except for property owner contributions as required by covenant and no local general funds are required for the work. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA ESTABLISHING A RULE 20A UTILITY UNDERGROUNDING DISTRICT ON THE SOUTH SIDE OF EAST PALM CANYON DRIVE FROM GENE AUTRY TRAIL TO PALM CANYON WASH 'WHEREAS, by Resolution No. 21496 a public hearing was called for February 1, 2006 at 6:00 p.m. at City Council Chamber in City Hall located at 3200 East Tahquitz Canyon Way, Palm Springs, California to ascertain whether the public necessity, health,safety orwelfare requires the removal of poles, overhead,wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service in the area on the south side of East Palm Canyon Drive from Gene Autry Trail to Palm Canyon Wash; and WHEREAS, a notice of such hearing has been given to all affected property owners as shown on the last equalized assessment role and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons have been given an opportunity to be heard. 'THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. THE CITY COUNCIL FINDS AND DETERMINES that the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service for the south side of East Palm Canyon Drive from Gene Autry Trail to Palm Canyon Wash as depicted on attached District Boundary Map, the boundaries of which are described on the attached legal description, both of which are hereby referred to and made a part of as fully as if it were set out at length herein. City Council further finds that; a)the street eight-of-way is extensively used by the general public and carries a heavy volume of vehicular traffic and b) the street is considered a major thoroughfare on the City's General Plan. Section 3. That service laterals shall be financed through the Rule 20A Underground Utility District Funds and that Staff is directed to begin the process of calling all existing covenants for utility undergrounding currently recorded against properties within this proposed District. That all poles,overhead wires and associated structures shall be removed and underground installations made in said underground utility district within the following times; 1) underground installation by utility companies and reconnections not laterthan February 2008. 2) removal of poles, overhead wires and other associated structures not later than February 2009. Section 5. DEFINITIONS; Whenever in this Resolution the words or phrases hereinafter in this section defined are used, they shall have the respective meaning assigned to them in the following definitions: a) "Commission" shall mean the Public Utilities Commission of the State of California b) "Underground Utility District'or"District"shall mean that area in the City within which poles, overhead wires, and associated overhead structures are prohibited pursuant to the provisions of this Resolution. c) 'Person"shall mean and include individuals,firms, corporations, partnerships, and their agents and employees. d) "Poles,overhead wires and associated overhead structures"shall mean poles, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers,insulators,cutouts,switches,communication circuits,appliances, attachments and appurtenances located above-ground within a district and used or useful in supplying electric, communication or similar associated service. e) "Utility" shall include all persons or entities supplying electric, communication or similar associated service by means of electrical materials or devices. f) "Non-Utility"shall include all persons orentities supplying communication,T.V. cable or similar associated service by means of cable materials or devices. Section 6. UNLAWFUL ACTS, Whenever the Council creates an Underground Utility District and orders the removal of poles, overhead wires and associated overhead structures, it shall be unlawful for any person or utility or erect, construct, place, keep, maintain, continue, employ or operate poles, overhead wires and associated overhead structures in the District after the date when said overhead facilities are required to be removed by such Resolution. EXCEPTION, EMERGENCY OR UNUSUAL CIRCUMSTANCES, Notwithstanding the provisions of this Resolution, overhead facilities may be installed and maintained for a period not to exceed ten (10) days, without authority of the City Engineer in order to provide emergency service. The City Engineer may grant special permission, on such terms as the City Engineer may deem appropriate, in cases of unusual circumstances, without discrimination as to any reason or utility,to erect, construct, install, maintain, use or operate poles, overhead wires and associated overhead structures. Section 8. OTHER EXCEPTIONS, The following are exempted: a) Any municipal facilities or equipment installed underthe supervision and to the satisfaction of the City Engineer b) Poles, or electroliers used exclusively for street lighting. c) Overhead wires (exclusive of supporting structures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a District, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited. d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. e) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. f) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. g) Equipment appurtenant to underground facilities, such as surface mounted equipment, pedestal mounted terminal boxes, transformers, switches, and meter cabinets, and concealed ducts. h) Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. Section 9 NOTICE OF PROPERTY OWNERS AND UTILITY COMPANIES, Within ten 1:10) days afterthe effective date of a resolution adopted pursuant to Section 1, hereof, the City Engineer shall notify all affected utilities and all persons owning real property within the District created by said Resolution of the adoption thereof. Section 10 RESPONSIBILITY OF UTILITY COMPANIES, If underground construction is necessary to provide utility service within a District created by this Resolution,the supplying utility shall furnish that portion of the conduits, conductors and associated equipment required to be furnished by it under its applicable rules, regulations and tariffs on file with the Commission. Section 11 RESPONSIBILITY OF CITY, City shall remove, at its own expense, all City- owned equipment(if any) from all poles required to be removed thereunder in ample time to enable the owner or user of such poles to remove the same within the time specified in this Resolution. The City shall waive all permit fees, and study costs required by this project. Section 12 EXTENSION OF TIME, In the event that any art required by this Resolution thereof cannot be performed within the time provided on account of shortage of materials, war, restraint by public authorities, strikes, labor disturbances, civil disobedience, or any other circumstances beyond the control of the actor, then the time within which such act will be accomplished shall be extended for a period equivalent to the time of such limitation. Section 13 PENALTY, It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this Resolution. It is a misdemeanor to violate any provision of this Resolution or fail to comply with any of its requirements. ,ADOPTED THIS day of 2006. David H. That service laterals shall be financed through the Rule 20A Underground Utility District Funds and that Staff is directed to begin the process of calling all existing covenants for utility underground ing currently recorded against properties within this proposed District. DEFINITIONS; Whenever in this Resolution the words or phrases hereinafter in this section defined are used, they shall have the respective meaning assigned to them in the following definitions: a) "Commission" shall mean the Public Utilities Commission of the State of California b) "Underground Utility District" or"District' shall mean that area in the City within which poles,overhead wires, and associated overhead structures are prohibited pursuant to the provisions of this Resolution. c) "Person" shall mean and include individuals, firms, corporations, partnerships, and their agents and employees. d) "Poles, overhead wires and associated overhead structures"shall mean poles, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators,cutouts, switches, communication circuits, appliances, attachments and appurtenances located above-ground within a district and used or useful in supplying electric, communication or similar associated service. e) "Utility"shall include all persons or entities supplying electric, communication or similar associated service by means of electrical materials or devices. f) "Non-Utility" shall include all persons or entities supplying communication, T.V. cable or similar associated service by means of cable materials or devices. Section 6. UNLAWFUL ACTS, Whenever the Council creates an Underground Utility District and orders the removal of poles, overhead wires and associated overhead structures, it shall be unlawful for any person or utility or erect, construct, place, keep, maintain, continue, employ or operate poles, overhead wires and associated overhead structures in the District after the date when said overhead facilities are required to be removed by such Resolution. 0 _V'! EXCEPTION, EMERGENCY OR UNUSUAL CIRCUMSTANCES, Notwithstanding the provisions of this Resolution, overhead facilities may be installed and maintained for a period not to exceed ten (10) days, without authority of the City Engineer in order to provide emergency service. The City Engineer may grant special permission, on such terms as the City Engineer may deem appropriate, in cases of unusual circumstances,without discrimination as to any reason or utility, to erect, construct, install, maintain, use or operate poles, overhead wires and associated overhead structures. Section 8. OTHER EXCEPTIONS, The following are exempted: a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer b) Poles, or electroliers used exclusively for street lighting. c) Overhead wires (exclusive of supporting structures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a District, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited. d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 84,500 volts. e) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. fl Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. g) Equipment appurtenant to underground facilities, such as surface mounted equipment, pedestal mounted terminal boxes,transformers,switches,and meter cabinets, and concealed ducts. h) Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. Section 9 NOTICE OF PROPERTY OWNERS AND UTILITY COMPANIES,Within ten (10) (Jays after the effective date of a resolution adopted pursuant to Section 1, hereof, the City Engineer shall notify all affected utilities and all persons owning real property within the District created by said Resolution of the adoption thereof. ITEM NO,-3' C" City Council Staff Report February 15, 2006- Page 2 Resolution of Intention for Rule 20A Utility Underoroundino Districts STAFF ANALYSIS: On April 21, 2005 Staff met with representatives of the Southern California Edison Company (SCE), regarding undergrounding of existing overhead utilities. Rule 20 is the Edison Company's tariff rule approved by the California Public Utilities Commission (CPUC)for the conversion of overhead electric facilities to underground facilities. Rule 20 specifies the circumstances and the role of general rate payer versus applicant involvement in the payment for the conversion of overhead electric facilities. Rule 20A criteria was established in order to maintain a general public benefit, while recovery of the costs of an undergrounding project are included in electric rates. An allocation concept was developed in order to ensure equitable treatment for every local government as well as a fairdivision of SCE funds. The formula was developed by SCE along with the League of California Cities and was approved by CPUC. In 2002 the CPUC approved a decision which modified the ability of local governments to mortgage their annual allocation up to a five year amount. Staff's meeting with SCE staff yielded the information that the City of Palm Springs was eligible for an approximately$2.2million utility undergrounding project. In order to qualify a project for Rule 20A funding, there must be 1) a heavy concentration of electric facilities, 2) a heavy volume of pedestrian or vehicle traffic or 3) civic areas, recreation areas and scenic areas, in addition to the lines being along a arterial or major collector roads. Meeting any one of the criteria qualifies the project for Rule 20A funding. On December 7,2005 a public hearing was held to discuss forming utility undergrounding districts for this portion of Sunrise Way along with another portion of Sunrise Way north of Vista Chino. Council did not form either district and instructed staff to return with alternate locations. On February 1, 2006 a public hearing was scheduled to discuss forming a district on the south side of East Palm Canyon Drive between Gene Autry Trail and Palm Canyon Wash. That hearing was continued until March 1 and staff was directed to bring back Resolutions of Intention of forming districts on Ramon and South Sunrise. All three proposed district public hearings are to be scheduled for March 1, 2006. Letters of Notice will be mailed to all property owners along Sunrise Way and Ramon Road within the limits noted above, as authorized by the attached Resolutions of Intention. Meeting notices will also be published in The Public Record.
