At their February 1, 2006 meeting, the Palm Springs International Airport Commission unanimously voted (noting the absence of Commissioner Albert) that the City Council consider amending Section 2.16.020 of the Palm Springs Municipal Code to change the voting status for the cities of Indio, Desert Hot Springs and Coachella from rotational to regular voting member status. The following is an excerpt of the minutes from that meeting and the existing code section: IV. AD HOC COMMITTEE RECOMMENDATION RELATIVE TO DESIGNATING THE CITIES OF INDIO, DESERT HOT SPRINGS AND COACHELLA FROM ROTATIONAL MEMBER STATUS TO REGULAR MEMBER STATUS. Chairman Elsner stated that the Ad Hoc Committee met and asked Commissioner Betancur to give a brief oral report. Commissioner Betancur stated that the Ad Hoc Committee is recommending that the Airport Commission recommend City Council change the rotational voting member status to regular voting member status for the cities of Indio, Desert Hot Springs and Coachella. The Airport Commission discussed and/or commented on the following with respect to changing the rotational voting member status to regular voting member status for the cities of Indio, Desert Hot Springs and Coachella. ACTION: Airport Commission recommended City Council amend the ordinance concerning Municipal Code 2.16.020 and change the rotational voting member status to regular voting member status for the cities of Indio, Desert Hot Springs Item No. 2 . D . and Coachella. Motion Commissioner Spicer, seconded by Betancur and unanimously carried. AYES: Ahlstrom, Barnes, Betancur, Bizzell, Bowman, Callahan, Doria, Duncan, Johnson, Kessler, Packer, Sherman, Spicer and Elsner. NOES: None. ABSTAIN: None. ABSENT: Albert. Palm Springs Municipal Code Section 2.16.020 There is created in the city an international airport commission, which shall consist of fifteen members. The fifteen members shall be appointed in the following manner: eight regular members, appointed by the mayor of Palm Springs in accordance with Section 2.04.060 of the Palm Springs Municipal Code; five regular members, one appointed by each of the cities of Palm Desert, Cathedral City, Indian Wells, Rancho Mirage, La Quinta, in the manner which each city shall determine; a regular member appointed by the board of supervisors, Riverside County; and a rotational member appointed in turn by the cities of Indio, Desert Hot Springs and Coachella, in the manner which each city shall determine. The determination of permanent and rotational members is based on consideration of population, hotel rooms, hotel sales and distribution of trips to the airport and may be adjusted from time to time by amendment of this section as circumstances warrant. The Palm Springs appointees serving on the Palm Springs airport commission as of the adoption of the ordinance codified in this chapter shall serve out their appointments on the commission created by the ordinance codified in this chapter. At the January 9, 2006 Human Rights Commission meeting, the Commission voted 5-0- 1 that the City Council adopt the attached Resolution designating Palm Springs as a "Hate Free City" and to approve and fund a work plan for a Hate Free City Campaign. Attachments: Proposed Resolution Work Plan PROPOSED RESOLUTION AS SUGGESTED BY THE HUMAN RIGHTS COMMISSION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AUTHORIZING PALM SPRINGS TO BE DESIGNATED AS "A HATE FREE CITY" AND AUTHORIZING THE CITY TO FUND THE ESTABLISHMENT OF A PROGRAM FOR THE DEVELOPMENT OF "A HATE FREE CITY" CAMPAIGN WHEREAS, the City has reviewed the Work Plan for the Hate Free City Campaign; and WHEREAS, the City supports the goals and objectives of the Hate Free City Campaign to build unity through a membership campaign to support the proposition that the City of Pahn Springs has zero tolerance for bigotry and is dedicated to educating the business community, non-profit organizations, government, religious centers, neighborhood groups and schools about how to keep their City free of hate; and WHEREAS, the City supports the involvement of local law enforcement in the efforts to make Palm Springs a Hate Free City, and WHEREAS, the City will authorize the use of monies in the Human Rights Commission budget at the discretion of the Human Rights Commission for start-up costs of the Hate Free City CAC to implement the Hate Free City campaign; and WHEREAS, the City will declare Palm Springs a Hate Free City upon presentation to the City that sixty percent (60%) of the community, as defined by the Hate Free City CAC, have pledged to support the goals of the Hate Free City Project; and WHEREAS, the City will provide signs and recognition for completion of the Hate Free City campaign and support a celebration of Palm Springs as a Hate Free City. CITY OF PALM SPRINGS WORK PLAN FOR THE HATE FREE CITY CAMPAIGN SPONSORED BY THE PALM SPRINGS HUMAN RIGHTS COMMISSION PURPOSE: To form a Hate Free City Community Action Committee ("CAC") dedicated to building unity through an education and membership campaign to support the proposition that the City of Palm Springs has zero tolerance for bigotry and have the City declared by its City Council a Hate Free City. The CAC will reach out to the business cormmunity, non-profit organizations, govenunent leaders, religious centers, neighborhood groups and schools and seek their pledge to support the purpose of the CAC. Completion of the campaign is based on 60% participation by groups and individuals that fairly represent the City. A. RESPONSIBILITIES OF HATE FREE CITY CAC The Hate Free City CAC shall be a leadership team including leaders from business community, government officials, religious centers, non-profit organizations, neighborhood groups, schools and representatives from Hate Crime Task Force , and GLSEN to lead the Hate Free City campaign. It shall be responsible for the following: --Sponsor "kick-off' event for Hate Free City Campaign; --Determine the segments of the City that represent the 60% campaign goals; --Develop a system for identifying and tracking campaign goals of identified groups; --Works with the Hate Crime Task Force of Palm Springs and Gay Lesbian Straight Educational Network and other organizations to review existing and develop new educational tools; and --Sponsor community celebration when Palm Springs is eventually declared a Hate Free City. MEMBERSHIP REQUIREMENTS INCLUDE --Lifetime membership donation (no dollar amount has been established yet) (Funds support local efforts and victims of hate crimes--contributions to Hate Crimes Task Force.) --Members will sign the Hate Free City Pledge either individually or as an organization. --Members will post Hate Stops Here decals and plaques. --Members will display Hate Crime Task Force literature --Members will participate in Hate Crime Prevention and Response Training CITY OF PALM SPRINGS --Passes Resolution in support of Hate Free City Project. --Supports the involvement of local law enforcement. --Supports efforts of Hate Free City Community Action Committee. --Provides signs and recognition for completion of Hate Free City campaign. OF PALM S V n C9ZIIF0R14\P COMMISSION/BOARD REQUEST DATE: March 1, 2006 TO: Mayor and Members of the City Council FROM: VillageFest Board SUBJECT: Establishing Certified Farmers' Market at VillageFest ACTION: Receive and File The VillageFest Board requests that City Council establish a Certified Farmers' Market within the weekly VillageFest street fair. At its February 14 regular meeting, the VillageFest Board unanimously voted (5/0) to recommend that City Council establish a Certified Farmers' Market within the weekly VillageFest street fair. Staff investigated the certification requirements for creating a Certified Farmers' Market with the Riverside County Agricultural Commissioner's Office and reported the findings to the VillageFest Board. Specific and ongoing compliance requirements for certification are attached. Aside from recruiting certified farmers to participate at VillageFest, certain administrative functions need to be created and adhered to by the City. Staff will work with the VillageFest Board to adopt a set of Certified Farmers' Market rules and will seek adoption of those rules at a future date when the entire VillageFest Rules and Regulations are brought forth to City Council for amending. Every week, staff will be required to monitor each farmer's certification status and collect a 600 market participation fee on behalf of the Department of Food and Agriculture. Each vendor must submit a load sheet every week, noting what products that vendor will sell that evening. These load sheets and the weekly market participation fees are then submitted to the Department of Food and Agriculture on a quarterly basis. The administrative impact of this is unknown at this time. It is expected to be minimal and worth the added value that a Certified Farmers' Market will bring to VillageFest. The City will be required to pay an annual certification fee to the Department of Food and Agriculture of $54. Attachments: 1. The Palm Springs Municipal Code Section 2.22.050, Functions, power and duties, stipulates that the board serves in an advisory and administrative capacity to the City Council. The board's primary duties are to review and jury vendor applications and interpret the VillageFest rules as needed. The board is seeking to broaden its scope of authority by creating committees (list attached) to oversee functions; the oversight responsibility is current assigned to City staff. To satisfy the board's desire to become more involved in promoting VillageFest, City staff has given the board administrative oversight of all marketing and advertising functions this past year, in addition to substantial budget increases to accommodate its enhanced promotion for the event., In reviewing the list of proposed committees, Department of Parks and Recreation staff, in accordance with the opinions of the City Attorney and City Clerk, believes this action would create standing committees within the VillageFest Board and exceed the functions, powers and duties as set forth in the Municipal Code. Standing committees can be subject to the provisions of the Brown Act and all committee meetings would then require posting, minute taking, and attendance by City staff.
