RECOMMENDATION: Waive further reading and adopt Ordinance No. 1683, "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING SUBSECTION 6.1 TO SECTION 5.02.010 AND SUBSECTION (g) TO SECTION 5.02.075 OF THE PALM SPRINGS MUNICIPAL CODE RELATING TO SUSPENSION OF THE CIVIL PENALTY ASSESSED ON A SECOND FALSE ALARM OCCURRING IN A 365-DAY PERIOD." STAFF ANALYSIS: At its February 15, 2006, meeting the City Council introduced on first reading the proposed ordinance. This report provides for the City Council to waive further reading and adopt the ordinance. The ordinance shall be effective 30-days from adoption. es Thompson David H. (There is no charge for the first false alarm.) This Ordinance allows the Chief of Police or the Fire Chief to suspend the imposition of the civil penalty for a second false alarm occurring in any 365 day period on specified grounds. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Subsection (6.1) is added to Section 5.02.010 of the Palm Springs Municipal Code to read: (6.1) "Diversion Program" means any seminar, training, class, or course, approved by the Chief of Police or the Fire Chief, designed to educate and train persons in the proper installation, maintenance, and operation of alarms. SECTION 2. Subsection (g) is added to Section 5.02.075 of the Palm Springs Municipal Code to read: (g) The Chief of Police or the Fire Chief may suspend a fee required to be assessed for a second false alarm occurring with any 365 day period pursuant to the provisions of subsection (a) or (b) of this Section, if the person liable for such assessment successfully completes a Diversion Program. ®rr� ,TT, Ordinance No. 1683 Page 2 SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
