Ready, City Manager BY: Department of Parks and Recreation SUMMARY At its February 28 meeting, the VillageFest Board juried Out of Africa Experience, Inc. as a general vendor applicant and is recommending that City Council waive certain provisions of the VillageFest Rules and Regulations to allow the applicant to participate in the event. RECOMMENDATION: 1) Adopt Minute Order No. waiving Rules II. A. 1 and 2 to allow Out of Africa Experience, Inc.to sell commercially-available wire woven items and not require it to have the artisans present at Villagefest. STAFF ANALYSIS: At the February 28 VillageFest Board meeting, Out of Africa Experience, Inc. made a presentation and sought approval to sell handmade African wire baskets and handbags at the street fair. According to the applicant, these products are the outgrowth of the African AIDS Empowerment Program (AEP), which provides assistance and a local income source to various African tribes that have been devastated by the AIDS virus. The artisans' material (the colored telephone wire) is donated to the Kwa-Zulu Tribe of Natal, South Africa by Telkom SA. The wire is then woven into artistically- designed baskets and handbags by the women of the various tribal villages, who use the designs provided by the applicant, Oenonie O'Reilly, a textile design artist and graduate of the Michaelis Art School in Cape Town, South Africa. Through their affiliation with the AEP, a cultural and artistic development program in South Africa, the tribal women are paid by AEP for each individual piece they weave. The applicant is a sales broker on behalf of AEP and paid on a commission basis. The proceeds from the retail sales of the artisans' merchandise help to provide funding for the local AEP programs in South Africa. Item No. 2 . 0 . DATE: April 5, 2006 SUBJECT: WAIVER OF CERTAIN VILLAGEFEST RULES AND REGULATIONS PAGE: Two The income derived from the sales of this merchandise helps to provide families with a steady income stream in rural African areas. These tribal villages are totally impoverished and devoid of other local income sources due to the destruction of their local cultures and economies from the AIDS virus in South Africa. The proceeds from the retail sales of the artisans' merchandise help to provide the ongoing funding needed to operate these local AEP programs in South Africa. At the February 28 meeting, several board members expressed a desire to have this applicant participate at VillageFest due to the high quality of the wire-woven items and the assistance the AEP programs would receive from the sales. Following the February 28 meeting, staff received one e-mail, ostensibly objecting to the recommendation made by the VillageFest Board regarding Out of Africa Experience, Inc. The objection was that a commercial vendor was being recommended to participate in VillageFest and that the artists would not be present at the point of sale, despite specific VillageFest rules and regulations to the contrary. To date, no other objections have been brought to staff's attention regarding this matter. Based upon the board's recommendation, which passed unanimously (5/0), staff agreed to present this issue to the City Council for its consideration.
