Engineers Adage: "If anything can go wrong it will."
The attached pictures clearly show the start of mud washing beneath large rocks behind
2233 Milo. This "washing out" has occurred in less than a years time since the rocks
were"set' in place. When (not if) this "washing out" occurs with time (I have been in this
house for 27 years and hope to be here at least another 27) there can be little doubt that it
will continue. I have been asked by friends "are you not fearful of these rocks falling
down?" my affirmative answer has sparked dreams in my sleep of falling rocks. I believe
it is just a question of time.
Liquefaction: a norm meaning liquefied, as in a liquid transformation from a heavy rain.
The phase transformation from a solid to a liquid is somewhat figurative when applied to
the boulders behind 2233 Milo. But as a boat rocks and moves in stormy seas so will
these rocks encased in mud; especially if an earthquake occurs while they are still wet, an
unlikely scenario but recall my opening statement "if anything can go wrong it will."
I am an expert at tribology, the science of friction and wear. Many principles and laws
governing this field can be applied to these rocks. One such law allows us to assume that
the angle of inclination that allows a sliding of a rock to occur is the same independent of
the mass or size of the rock. A simple test to establish this angle was performed on a
family of two DRY rocks. The angle of repose is 22 degrees. The slope of the collection
of rocks behind 2233 Milo is 80 degrees.
What is right and wrong in this situation?Nature, time and physics have combined to
produce the slope of Vista Chino canyon close to 23 degrees. The danger presented by
mankind "strategically" aligning the rocks at an angle greater than 22 degrees; so close to
a private residence is tantamount to murder. At the very least a study of the unique
situation of Milo Drive, Little Tuscany and Vista Chino Canyon and endangerment
presented to the residents by falling rocks should be made known to the residents before
further development.
Conclusion: In all probability some of those rocks that have been "set' in place will face
the angle of repose when the sand washes out. They could possibly fall. Who as an
engineer could approve of this potential problem? I have read the report by Sladden
Engineering that stated the"rocks were strategically aligned." This is in contradiction to
the pictures provided from 2233 Milo.

Good evening, councilmembers and mayor....
Tonight you will discuss the formation of a new homeless
task force, streamlining the membership of the existent force
to the exclusion of about 60% of the concerned citizens who
have attended faithfully for many, many months. I think this
is a mistake. A more beneficial plan might be to refocus the
procedure of the meetings from being more-or-less
reportorial/information to being more proactive....giving
people actual jobs which can be done in the effort to find
solutions to the ever-growing and sorrowful problem.
The people with whom I have been attending these meetings
are there because they wish to DO something, they wish to
help. It is a community wide problem and should include a
broad representation of the community in order to solve it.
Otherwise, when it comes down to the decision of where to
place the shelter, and a committee of seven or eight or nine
are the ones to make the proposal, once again it will look like
"business as usual" to the citizens of this town and there will
come the inevitable outrage with "why weren't we allowed to
be part of this decision".
I sincerely suggest that you reformat the sitting task
Force; do not, once again, shut concerned community
members out of such an important process. It sends the
message that the "public input, public involvement is not
wanted at Palm Springs City Hall".

'SEC. 274. (a) Criminal Offenses and Penalties-
'(1) PROHIBITED ACTIVITIES- Whoever--
'(A) assists, encourages, directs, or induces a person to come to or
enter the United States, or to attempt to come to or enter the United
States, knowing or in reckless disregard of the fact that such person is
an alien who lacks lawful authority to come to or enter the United
States;
'(B) assists, encourages, directs, or induces a person to come to or
enter the United States at a place other than a designated port of entry
or place other than as designated by the Secretary of Homeland
Security, regardless of whether such person has official permission or
lawful authority to be in the United States, knowing or in reckless
disregard of the fact that such person is an alien;
'(C) assists, encourages, directs, or induces a person to reside in or
remain in the United States, or to attempt to reside in or remain in the
United States, knowing or in reckless disregard of the fact that such
person is an alien who lacks lawful authority to reside in or remain in
the United States;
'(D) transports or moves a person in the United States, knowing or in
reckless disregard of the fact that such person is an alien who lacks
lawful authority to enter or be in the United States, where the
transportation or movement will aid or further in any manner the
person's illegal entry into or illegal presence in the United States;
'(E) harbors, conceals, or shields from detection a person in the United
States knowing or in reckless disregard of the fact that such person is
an alien who lacks lawful authority to be in the United States;
'(F) transports, moves, harbors, conceals, or shields from detection a
person outside of the United States knowing or in reckless disregard of
the fact that such person is an alien in unlawful transit from one
country to another or on the high seas, under circumstances in which
the person is in fact seeking to enter the United States without official
permission or lawful authority; or
'(G) conspires or attempts to commit any of the preceding acts,
shall be punished as provided in paragraph (2), regardless of any official
action which may later be taken with respect to such alien.
(2) CRIMINAL PENALTIES- A person who violates the provisions of
paragraph(1) shall--
'(A) except as provided in subparagraphs (D)through(H), in the case
where the offense was not committed for commercial advantage,
profit, or private financial gain, be imprisoned for not more than 5
years, or fined under title 18,United States Code, or both;
'(B) except as provided in subparagraphs (C)through (H), where the
offense was committed for commercial advantage, profit, or private
financial gain--
'(i) in the case of a first violation of this subparagraph, be

imprisoned for not more than 20 years, or fined under title 18,
United States Code, or both; and
'(ii) for any subsequent violation, be imprisoned for not less
than 3 years nor more than 20 years, or fined under title 18,
United States Code, or both;
'(C) in the case where the offense was committed for commercial
advantage, profit, or private financial gain and involved 2 or more
aliens other than the offender, be imprisoned for not less than 3 nor
more than 20 years, or fined under title 18, United States Code, or
both;
'(D) in the case where the offense furthers or aids the commission of
any other offense against the United States or any State, which offense
is punishable by imprisonment for more than 1 year, be imprisoned for
not less than 5 nor more than 20 years, or fined under title 18, United
States Code, or both;
'(E) in the case where any participant in the offense created a
substantial risk of death or serious bodily injury to another person,
including--
'(i) transporting a person in an engine compartment, storage
compartment, or other confined space;
'(ii) transporting a person at an excessive speed or in excess of
the rated capacity of the means of transportation; or
'(iii)transporting or harboring a person in a crowded,
dangerous, or inhumane manner,
be imprisoned not less than 5 nor more than 20 years, or fined under
title 18, United States Code, or both;
'(F) in the case where the offense caused serious bodily injury (as
defined in section 1365 of title 18, United States Code, including any
conduct that would violate sections 2241 or 2242 of title 18, United
States Code, if the conduct occurred in the special maritime and
territorial jurisdiction of the United States) to any person, be
imprisoned for not less than 7 nor more than 30 years, or fined under
title 18, United States Code, or both;
'(G) in the case where the offense involved an alien who the offender
knew or had reason to believe was an alien--
'(i) engaged in terrorist activity(as defined in section
212(a)(3)(B)); or
'(ii) intending to engage in such terrorist activity,
be imprisoned for not less than 10 nor more than 30 years, or fined
under title 18, United States Code, or both; and
'(H) in the case where the offense caused or resulted in the death of
any person, be punished by death or imprisoned for not less than 10
years, or any tenn of years, or for life, or fined under title 18, United
States Code, or both.
