Ready, City Manager BY: James Thompson, City Clerk SUMMARY The City Council will consider the introduction of an ordinance increasing the number of members on the Measure "J" Oversight Commission to nine members and two alternate members. RECOMMENDATION: Waive the reading of the full text of the Ordinance, and introduce by title Ordinance No. , "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.59.010 AND 2.59.020 OF THE PALM SPRINGS MUNICIPAL CODE, INCREASING THE NUMBER OF MEMBERS ON THE MEASURE "J" OVERSIGHT COMMISSION TO NINE AND TWO ALTERNATE MEMBERS." STAFF ANALYSIS: At its meeting of April 19, 2012, the City Council, by unanimous vote, directed staff to prepare an ordinance to increase the number of the members on the Measure "J" Oversight Commission to nine members and two alternate members. The proposed ordinance increases the members to nine, and provides for two alternate members that participate in all discussion of the Commission, but not vote, and allows alternate members to be appointed to subcommittees created by the Commission. AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.59.010 AND 2.59.020 OF THE PALM SPRINGS MUNICIPAL CODE, INCREASING THE NUMBER OF MEMBERS ON THE MEASURE "J" OVERSIGHT COMMISSION TO NINE AND TWO ALTERNATE MEMBERS. City Attorney Summary The current number of members to the Measure "J" Oversight Commission is seven (7) members. This Ordinance would increase the number of members to nine (9) members and two (2) alternate members. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS: SECTION 1. Section 2.59.010 of the Palm Springs Municipal Code is amended to read: 2.59.010 Creation and Membership. A. There is created within the City of Palm Springs the Measure "J" Oversight Commission consisting of nine (9) members, appointed by the City Council, to serve at the pleasure of City Council. B. Two (2) alternate members may be appointed by the City Council and serve at the pleasure of the City Council. C. The membership of the Measure "J" Oversight Commission may include, but is not limited to, residents with accounting or financial backgrounds and expertise. 2.59.020 Term; Vacancies; Vote. A. Members and Alternate Members of the Commission shall serve for the term provided by Chapter 2.06 of the Palm Springs Municipal Code, except that in order to ensure a stagger of appointees, the initial appointments shall be for staggered terms as determined by the City Clerk. B. A vacancy in the Commission shall not impair the right of the remaining members to exercise the powers of the Commission pursuant to this chapter. Four members shall constitute a quorum of the Commission, and any ruling, decision or other action of the Commission may be taken by a majority of those members present, provided a quorum is present. 003 Ordinance No. Page 2 C. Alternate Members of the Commission appointed pursuant to Subsection B of Section 2.59.010 shall participate in all discussion of the Commission, but not vote, and may be appointed to any subcommittees created by the Commission. SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provision of law, and this Ordinance shall take effect thirty (30) days after adoption.
