PALM SPRINGS, CAA. 92263 2002 MAY 14 PM 12* 16
I RECEIVED YOUR LETTER DATED APRIL 13,2012. WHEN I BOUG IM nfEV
HOUSE IN 20041 DIDN'T MOVE IN FOR 6 WEEKS. I WAS ORDERING
FURNITURE WINDOW COVERINGS AND STAYED IN THE HOUSE I
ALREADY HAD. THERE WAS NOT ANY TRASH OR RECYCLED ITEMS
PLACED AT THE CURB DURING THIS TIME. NOTHING WAS EVER
PICKED UP. WHEN I MOVED IN I ORDERED THE DISPOSAL SERVICE BE
PUT IN MY NAME. THEY SAID I HAD TO FURNISH A COPY OF THE
GRANT DEED AND THEY BACK CHARGED ME FOR 6 WEEKS. I CALLED
THE SERVICE AND EXPLAINED THE PROBLEM. THEY WERE NOT
SYMPATHIC AND WOULD NOT CHANGE THE BILL.
THE MORTGAGE CO., INDYMAC, SENT LETTERS 8 TIMES THAT THEY
WERE GOING TO FORECLOSE ON THE PROPERTY ON 6/8/2011. SOME OF
THESE LETTERS WERE REGISTERED AND ALSO IT WAS PUBLISHED IN
THE DESERT SUN TWICE. I MOVED OUT ON 6/7/2012 AND CANCELLED
THE UTILITIES AND THE DISPOSAL SERVICE AND TOLD THEM WHY.
YOU HAVE BEEN SENDING ME BILLS EVER SINCE. I HAVE CALLED YOU
AND EXPLAINED SEVERAL TIMES. INDYMAC MORTGAGE DOESN'T
WANT TO MAINTAIN THE PROPERTY SO THEY DON'T SIGN UP FOR THE
SERVICE OR UTILITIES. NO ONE HAS LIVED THERE FOR ALMOST A
YEAR AND THERE HAS NOT BEEN AND TRASH PUT OUT OR PICKED UP
AT THE ADDRESS. MY NEIGHBORS ALL KNOW THIS.
I THINK BOTH PALM SPRINGS DISPOSAL SERVICE AND INDYMAC MTG.
BOTH NEED TO BE COMPLETELY OVERHAULED. IT IS UNFAIR TO
CHARGE PEOPLE FOR SERVICE THAT IS NOT RECEIVED.
IN ADDITION, I FILED BANKRUPTCY AND IT WAS DISCHARGED IN DEC.
2011 AND I CHARGED OFF YOUR BILLS THAT I HAD AT THE TIME I
TURNED THE BANKRUPTCY IN. I WOULD LIKE YOU TO RESOLVE THE
PROBLEM PROMPTLY AND SEND ME A LETTER THAT I DON'T OWE ANY
MORE MONEY. IF THIS ISN'T TAKEN CARE I SERIOUSLY BELIEVE THIS
IS A MATTER FOR THE PEOPLE TO KNOW ABOUT THROUGH THE
MEDIA,INCLUDING NEWSPAPER AND TALK RADIO. AT ONE POINT
INDYMAC TOLD ME THEY HAD CHANGED THE LOCKS ON THE HOUSE
AND GARAGE DOOR OPENER.

Mr. Thompson-
I have received several bills from Palm Springs Disposal
Services. I have not paid any of them because I, along with my
two sisters, sold this house in March of 2011 to Mr. and Mrs.
Robert Callan. I have called Palm Springs Disposal Services, and
have written to them, to inform them of this, but they continue to
send bills and now have escalated this to your attention.
I would appreciate it if you would inform Palm Springs
Disposal Services that we do not own the property and to contact
the owners at 1275 Via Estrella, Palm Springs.
Thank you.

Cg41FORNp City Council Staff Report
DATE: May 16, 2012 PUBLIC HEARING
SUBJECT: DELINQUENT WASTE DISPOSAL CHARGES
FROM: David H. Ready, City Manager
BY: Director of Public Works/City Engineer
SUMMARY
All residential properties, in accordance with the Municipal code, must have trash
collection services and pay a mandatory waste disposal fee, unless granted an
exemption from the City. Annually, the City receives a list from its franchised waste
hauler, Palm Springs Disposal Services, of all properties that have not paid their waste
disposal fee. In order to collect the unpaid charges, Palm Springs Disposal Services,
pursuant to their franchise agreement with the City, has requested that these properties
be placed on the County Property Tax Rolls for collection. The waste hauler has made
all reasonable efforts to diligently pursue and collect all fees and charges due to them.
However, several accounts still remain unpaid as indicated in the list on file in the City
Clerk's Office. This action is consistent with past practice and the applicable legal
requirements for placement of a lien against property.
RECOMMENDATION:
1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA DETERMINING CERTAIN WASTE
DISPOSAL ACCOUNTS TO BE DELINQUENT AND DIRECTING THE
PLACEMENT OF THESE ACCOUNTS ON THE COUNTY PROPERTY TAX
ROLLS FOR COLLECTION.
2. Authorize the City Manager to execute all documents necessary to effectuate this
action.
STAFF ANALYSIS:
The City requires all residential properties to have trash collection services and to pay a
mandatory waste disposal service fee, unless granted an exemption as provided under
Palm Springs Municipal Code Section 6.04.200(d). The collection of trash from all
inhabited properties is essential to maintaining the health and safety of the community
at large. For this reason, solid waste charges, if unpaid, are considered a civil debt.
ITEM NO.
City Council Staff Report
May 16, 2012-- Page 2
2012 Delinquent Waste Disposal Charges
Each year Palm Springs Disposal Services provides a list of all delinquent accounts to
the City for placement on the property tax rolls. Collection of delinquent solid waste
charges through the tax rolls is authorized under Palm Springs Municipal Code Section
6.04.215 pursuant to Sections 38790.1 and 25831 of the California Government Code.
This year, a total of 1,164 delinquent accounts have been identified. In April, Palm
Springs Disposal Services mailed notices, pursuant to Government Code Section
25831(b), to all delinquent accounts advising them that unless payment was
immediately received the delinquent charges would be placed on the property tax rolls
for collection.
Notification of this hearing was mailed to each property owner on the delinquent list on
April 13, 2012. Since mailing of these notices, Palm Springs Disposal Services has
received payment in full from 204 accounts. This leaves a balance of 960 delinquent
accounts representing approximately $279,143.37 in lost revenues to the waste
disposal company. A list of all delinquent accounts is on file with the City Clerk's Office
for public inspection.
A final list, with any payments, credits and other adjustments received after the public
hearing, will be submitted to the County Auditor-Controller's Office on June 30, 2012.
Any account still delinquent after this date will be placed on the County property tax rolls
for collection. All amounts collected by the County will be remitted to the City. Palm
Springs Disposal Services has agreed to pay the City 10% of the total amount collected
as reimbursement of its cost to place these accounts on the tax rolls.
The proposed hearing is consistent with past practice and applicable legal
requirements. Action to collect debts through the tax roll process is a cost effective and
efficient method of debt collection. Moreover, if Palm Springs Disposal Services is
unable to collect from these delinquent accounts, the service fees for all other
customers may have to be increased to cover the bad debt.
FISCAL IMPACT:
Since the City receives franchise, administrative, recycling and diversion facility fees
from Palm Springs Disposal Services, collection from all delinquent accounts should
provide an additional $27,914.34 in revenues to the City. In addition, Palm Springs
Disposal Services has agreed to pay the City 10% of the total amount collected as
reimbursement of its expenses for placing these delinquent accounts on the tax roll.
