CASE SP 06-084 SIGN PROGRAM AMENDMENT APPEAL FROM: David H. Ready, City Manager BY: Department of Planning Services SUMMARY Best Signs, Inc., representing Lundin Development Co., is requesting that the City Council reject certain conditions that the Planning Commission imposed on May 9, 2012, when approving the revised design of the two proposed monuments signs for the Ralphs CVS / Pharmacy Center located at 425 South Sunrise Way. This appeal is related to an appeal that was recently granted by the City Council on April 18, 2012, for Case SP 06-084 Sign Program Amendment, which allowed enlarged monument signs with additional tenant identification but required a redesign with approval by the Planning Commission. RECOMMENDATION 1. Open the public hearing and receive public testimony; 2. Determine if monument sign design is acceptable at proposed size; 3. Adopt Resolution No. "A RESOLUTION OF THE CITY (COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING PORTIONS OF THE APPEAL BY BEST SIGNS, INC. TO ALLOW REDESIGNED MONUMENT SIGNS UNDER THE APPROVED SIGN PROGRAM AMENDMENT FOR THE RALPHS CVS PHARMACY CENTER LOCATED AT 425 SOUTH SUNRISE WAY." ITEM NO._1�L— City Council Staff Report June 6,2012—Page 2 SP 06-084 AMEND—Sign Program Amendment Appeal Ralphs CVS Pharmacy Center PRIOR ACTIONS On December 27, 2011, the Architectural Advisory Committee (AAC) reviewed the proposed amendment and restudied the project with the following comments: 1. Propose new monument signs that are in keeping with the same vernacular of the shopping center architecture; or 2. Use way-finding sign within center to direct traffic to tenant locations. On January 23, 2012, the AAC reviewed the revised sign program amendment and by a vote of 4-3 recommended approval to the Planning Commission, subject to allowing different font types but no logos for the tenant signage on the monument signs. On February 22, 2012, the Planning Commission reviewed the amendment and by a vote of 4-2 denied the proposal (Commissioners Munger and Roberts opposed the denial). On April 18, 2012, the City Council overturned the Commission's decision and approved the appeal, subject to the following: 1. Allow modification of two monument signs; 2. Monument signs may be larger than fifty square feet in size per side for a better quality design; 3. Each tenant sign shall be individually identified and not be a placard-type sign; 4. Only tenants without street frontage shall be allowed on the monument signs; 5. Design of monument signs shall be reviewed by the Architectural Advisory Committee with final approval by the Planning Commission. On May 7, 2012, the AAC reviewed the redesigned monument signs and voted 7-0 to recommend approval to the Planning Commission, subject to the following: 1. Sign to be scaled down twenty percent in size; 2. Tenant signs to match on both sides of the monument sign; 3. Any non-street fronting tenant to remove signs on street front buildings if identified on either monument sign (this was based on a reference to the frozen yogurt tenant on the north side of the center which has signage on the building facing the street at the southeast corner of the center); 4. Change slate tile material to a tan stucco that matches existing buildings in center; 5. Terminate vertical supports of tenant signage at top of placard'sign; 6. Blank tenant space signs shall be placed at bottom slots; 7. Individual tenant placard signs shall not include a logo; 8. Grasses adjacent to monument signs to be removed and replaced with Carissa species. 02 City Council Staff Report June 6.2012—Page 3 SP 06-084 AMEND—Sign Program Amendment Appeal Ralphs CVS Pharmacy Center On May 9, 2012, the Planning Commission voted 6-1 to approve the redesign subject to the AAC recommendations above and the requirement that each tenant placard-sign shall not be larger than the CVS Pharmacy sign. On May 9, 2012, an appeal was filed by the applicant to reject three conditions imposed by the Planning Commission. STAFF ANALYSIS: Best Signs, Inc., has submitted an appeal of the May 9, 2012, Planning Commission conditional approval of the redesigned monument signs (which were approved in concept under appeal by City Council on April 18, 2012) at the Ralph's CVS Pharmacy Center located at 425 South Sunrise Way. The redesign was reviewed by the AAC and Planning Commission as a result of the City Council overturning the Commission's decision to deny the proposed sign program amendment. The April 18, 2012, Council approval of the amendment included the following: 1. Allow modification of two monument signs; 2. Monument signs may be larger than fifty square feet in size per side for a better quality design; 3. Each tenant sign shall be individually identified and not be a placard-type sign; 4. Only tenants without street frontage shall be allowed on the monument signs; 5. Design of monument signs shall be reviewed by the Architectural Advisory Committee with final approval by the Planning Commission. The applicant redesigned the proposed monument signs by (1) eliminating the corrugated metal material, (2) adding slate tile material, (3) proposing individual cabinets for tenant identification in a vertical fashion, (4) increasing the height from eight feet to ten-and-a-half feet and (5) enlarging the overall sign area from fifty square feet to eighty square feet. The redesigned proposal was reviewed by the AAC and Planning,Commission on May 7th and 9th, respectively. The Planning Commission accepted the AAC's recommendation as part of their approval and added one more requirement. The Commission's approval included: 1. Sign to be scaled down twenty percent in size; 2. Tenant signs to match on both sides of the monument sign; 3. Any non-street fronting tenant to remove signs on street front buildings if identified on either monument sign (this was based on a reference to the frozen yogurt tenant on the north side of the center which has signage on the building facing the street at the southeast comer of the center); 4. Change slate tile material to a tan stucco that matches existing buildings in center; 5. Terminate vertical supports of tenant signage at top of placard sign; 6. Blank tenant space signs shall be placed at bottom slots; 7. Individual tenant placard signs shall not include a logo; 8. Grasses adjacent to monument signs to be removed and replaced with Carissa species. 9. Each tenant placard-sign shall not be larger than the CVS Pharmacy sign. The applicant has appealed the Planning Commission's approval and has requested that the Council reject three of the above requirements (nos. 1, 2 and 7). The applicant requests that the Council consider the following: f. This is unacceptable. With this condition the new monument would only be 8'in height and reduced back down to 50 square feet, not any larger then original proposed sign that City Council reviewed and did not like the design. The new monument design would require our proposed 10'-6" height in order for the sign to look proportionally appealing, and we were granted a larger sign by "CITY COUNCIL" to accomplish this. Please note the new proposed sign is only 2'-6" over what is allowed in the sign ordinance which is why we went thru the Sign Program Amendment process and Appeals process TWO TIMES. Now, AAC and Planning Commission both approved of the NEW sign design (just not the size ) which is why we are appealing that condition back to City Council for approval of the larger proposed sign. 2. Our client requests that the "City" not dictate what tenant name goes where on the monuments. (Other than Commission's condition #3) T This is not acceptable. Various shopping centers in Palm Springs currently allow CORPORATE LOGOS without restrictions. Why would we start now? Why on this shopping center? Is this something that the City Attorney was to clarify? 04 City Council Staff Report June 6,2012—Page 5 SP 06-084 AMEND—Sign Program Amendment Appeal Ralphs CVS Pharmacy Center Since the Council decided a larger sign would be allowed on April 18, 2012, staff seeks Council direction in determining if the design of the monument sign is acceptable to merit the increased size, and either accept or reject the Commission's first condition of approval. Should the Council determine the monument sign design is acceptable, staff recommends that the Council accept all of the other conditions imposed by the Planning Commission. Staff has prepared a draft resolution which accepts the proposed design at the proposed size (rejecting the Planning Commission's first condition) and requires compliance with all other Planning Commission conditions including: 1. (Staff recommends deletion) 2. Tenant signs to match on both sides of the monument sign; 3. Any non-street fronting tenant to remove signs on street front buildings if identified on either monument sign (this was based on a reference to the frozen yogurt tenant on the north side of the center which has signage on the building facing the street at the southeast comer of the center); 4. Change slate tile material to a tan stucco that matches existing buildings in center; 5. Terminate vertical supports of tenant signage at top of placard sign; 6. ("Applicant") filed an application with the City pursuant to Section 93.20.00 of the Zoning Code for a sign program amendment, Case SP 06-084 AMEND, to allow additional tenant identification on the existing monument signs for the Ralph's CVS Pharmacy shopping center located at 425 South Sunrise Way, Zone NC (Neighborhood Commercial — Section 14 Specific Plan), Section 14; and WHEREAS, on February 22, 2012, a public meeting was conducted by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission carefully reviewed and considered all of the evidence presented in connection with the meetings on the project, including but not limited to the staff report, and all written and oral testimony presented and voted 4-2 to deny the application; and WHEREAS, on March 8, 2012, Best Signs, Inc. We believe the project should be approved and that the Planning Commission's decision be overturned for the following reasons: • Our client was denied approval from Planning Commission for a larger sign that was encouraged by and approved by the City of Palm Springs City Council. • The new proposed sign design was approved by AAC and Planning Commission. • The height of the new sign is at a minimum height(10'-6")to achieve proper proportions for all text and logos. • Corporate logos were not allowed on tenant panels. Our client would like to have approval for this. *Please see Petco at Smoke Tree Commons. • The Ralph's CVS shopping Center sign program amendment was brought before the Palm Springs Planning Commission on February 22, 2012. Comments were made in regards to the initial sign program application from years ago. It seems as though there was some type of controversy and compromise in the approval of the monument signs. These comments seem to persuade the commission to deny the sign program amendment. The economy today is well different than the economy from years ago when the sign program was approved. Small business today face a number of challenges and exposure is a must. • This center has a nine year history over which the landscape has blossomed causing additional lack of visibility for businesses located at the back of the center away from the streets. This has contributed to the failure of many businesses within the shopping center. 17 • Most of the business failures within the center have come from strong national brand name companies such as Papa John's, PostNet, Check N Go, and Taco Del Mar. Had these businesses had more visibility,this would not have happened. • Although these spaces have been replaced with new businesses,they continue to struggle. They along with their adjacent neighbors complain that..."People don't know we are here..." Consumers are more apt to utilize the services these businesses have to offer if they knew they were there and accessible. Ralph's and CVS do not bring in enough traffic and exposure for these small businesses to survive. I have ached a photo of the new proposed signage at the Ralph's CVS Shopping Center for your review. The new monument design would require our proposed 10'-6" height in order for sign to look proportionally appealing, and we were granted a larger sign by"CITY COUNCIL" to accomplish this. Please note the new proposed sign is only 2'6"over what is allowed in the sign ordinance which is why we went thru the Sign Program Amendment process and Appeals process TWO TIMES. Now,AAC and Planning Commission both approved of the NEW sign design (just not the size ) which is why we are appealing that condition back to City Council for approval of the larger proposed sign. 2. Tenant signs to match on both sides of the monument sign; Our client requests that the"City" not dictate what tenant name goes where on the monuments. (Other than Commissions condition#3 ) 3. On April 18, 2012, the City Council overturned the Commission's decision and approved the appeal, subject to the following: 1. Allow modification of two monument signs; 2. Monument signs may be larger than fifty square feet in size per side for a better quality design; 3. Each tenant sign shall be individually identified and not be a placard-type sign; 4. Only tenants without street frontage shall be allowed on the monument signs; 5. Design of monument signs shall be reviewed by the Architectural Advisory Committee with final approval by the Planning Commission. The applicant has redesigned the proposed monument signs and provided a preferred option which is shown on the first three pages of the attached exhibit. Three alternative options are shown on the fourth page of the attached exhibit. The preferred option is approximately 10'-6" tall and 80 square feet in area per side. The anchor tenant identification on the monument is approximately seven square feet in size per side, and all other tenant identification signs are five square feet or less in size. The materials include a wall tile used on the pharmacy building and the existing stacked stone base. This item will be reviewed by the Architectural Advisory Committee on May 7, 2012.
