The first thing we were told was that there was no extension, even though we had been told there was one, and the next thing was that the city council was going to vote on this issue at tonight's full meeting, even though we were told that the vote wouldn't be until July 11th. We have an e-mail dated 6/17/12 from David Ready to confirm that. At the meeting on 6/12/12, we were told by councilwoman Foat and councilman Mills that if a majority of the homeowners were still opposed to the bridge at any time, the project would be abandoned. After polling the neighbors (again), we reached and exceeded the majority, even though many residents have left town for the summer. We have e-mails, letters and signatures to confirm the numbers if you wish to see them. Knowing there was no longer an extension and anticipating a vote on 6/20/12, Gene Williams, one of our appointed committee chairpersons, read a statement, that after much consideration we, the majority, are still opposed to this bridge and gave a number of reasons why. It then went on to say that we, the majority, wish to stop it before it goes anyfurther. We believed, that based on the promise from the previous week's meeting, they would recommend that the project be abandoned. Instead, we were told that "We never said that, you must have misunderstood." We had 15 to 20 people in attendance at the first meeting on 6/12/12, many who returned to last night's meeting and we all heard the same thing. We obviously felt as though we had been blind-sided. Ms. Foat asked if we had sent the statement we read to them to everyone in the neighborhood because the purpose of the neighborhood organizations was to keep everyone informed. We told her that we had not, but would, and did so last night after the meeting. Also present at yesterday's meeting,were several people from Araby Commons neighborhood, who were there to object to the bridge. They were told that their concerns were not important because they don't have "safety issues" regarding ingress and egress through Araby wash. We've heard from over 30 residents of Araby Commons who think that, in addition to dealing with two plus years of construction traffic and noise, they are concerned that the bridge will be shelter for vagrants like the nearby bridge at Highway 111. They consider that to be a MAJOR "safety"-concern. From that point on there was a lot of discussion about what had been said and what we felt were promises that were broken. The staff indicated they want to vote to proceed with acceptance of the grant which would allow them to pursue alternatives to a bridge in the preliminary process. They said no money would be spent for 2 - 3 months. After hearing this over and over, we still don't understand how you can use money from a 100 year BRIDGE application to find ALTERNATIVES to a BRIDGE and still keep a promise, possibly years in the future? We were hoping the city council would not accept the 10 Million Dollar Grant of Federal Aid to build an unnecessary bridge that is not environmentally or fiscally responsible tonight, June 20th. Our elected officials, city staff and Cal Trans did not investigate the need or information given on the grant application. To build a 100 year flood bridge is not the correct way to proceed. Our Araby Neighborhood Association was told on Tuesday, June 12th in a sub-committee meeting by City Manager David Ready, and Council members Ginny Foat and Chris Mills that if our neighborhood at a majority of 51%did not want the Araby Bridge they would not build a bridge, and stated "We have other projects to do and to not accept the grant was not a problem." We stand strong at 80+% against accepting the grant to build a 100 year flood bridge. The grant is a mismatch to our Araby Cove neighborhood. In addition Dave Barakian, our City Engineer was asked by David Ready to contact Cal Trans for an extension of time to accept the Grant and to check into the fact that the information given to Cal Trans in the grant was false as below in my letter to Richard Hill. Araby Drive Bridge at Palm Canyon Wash Grant City Project No. 11-02, Federal Aid Project No. BR-NBIL (521) Last night we were told the City of Palm Springs has to accept the grant, vs. resubmit with the correct information as they would possibly be sued by an Araby citizen if the police and fire response time was effected due to not having an all weather crossing. Our responsible citizens found it was 30 seconds more to go up Rim Road and there are less than 200 cars a day crossing on Araby Drive. We are 80% against accepting the grant but were all misinformed on June 12th. We live here for the appealing environment and a 100 year flood bridge would destroy our peaceful, safe and united neighborhood. There has never been a safety issue or any incident in Araby Cove in the previous 70 years to date. In addition in an email to Dave Barakian from Savat Khamphou, District Local Assistance Engineer stated: "Technically, the corrected ADT does not affect HBP eligibility." Dave Barakian spoke last night at our meeting and said Cal Trans did not care if 2000 or 200,000 or 2 cars utilize the bridge and copied us on the email sent Tuesday, June 19th at 10:54 AM from Savat Khamphou. It is beyond my imagination that the grant was granted on false information, including that the residents did not have an alternative public road to get out in an emergency when the road might be flooded or closed. We have a prescriptive easement on Rim Road and if Chris Mills can state last night that the owner can lock the gate, 1 r maybe the City should be responsible to purchase and maintain the road at a cost of below 10 Thousand Dollars vs. 12 Million Dollars for a bridge to nowhere. Our elected officials, city staff and Cal Trans did not investigate the need or information given on the grant application. I believe the City of Palm Springs should be worried if accepting the grant they could be sued for giving false information to Cal Trans, Cal Trans could be sued for not checking the information on the grant application, and the grant should be denied to avoid any further law suits. Do not fix what is not broken and be irresponsible to accept the 10 Million Dollar Grant of Federal Aid to build an unnecessary bridge that is not environmentally or fiscally responsible. Would you have your Cal Trans attorneys look into this? As a citizen of the United States if I falsified information I would be libel, but it seems more and more if government agencies and elected political officials lie it is accepted. It is a very sad environment for us and our children that there is "no honest politician" a goal my daughter wanted and was told by a political leader that it would be impossible for her to be an honest politician. Her opinion of this bridge to nowhere: "The money is needed to fix our educational system here at Palm Spring Unified School District, so we have informed and educated citizens. 12 million dollars would provide the needed technology in our classrooms and we would be investing in our future." The City of Palm Springs applied for a grant on August 2011 claiming 2000 cars pass the Palm Canyon Wash vs. the possible truth of 200—250 cars per day. In addition the grant application claimed 100 +bikers and hikers per day vs. 10 bikers and hikers. Wow x 1000X increase in untruths. Would you please help me understand if the City of Palm Springs falsified a grant for a bridge over the Palm Canyon Wash at Araby Drive, Palm Springs, CA 92264. Should the City of PS resubmit with the correct information and would they be denied? Our wonderful Mayor and City Council want answers to these questions, but the engineering department in my opinion is not to be trusted. Closure of Araby Drive restricts all residential and emergency traffic accessing the Araby Cove community to a narrow private, poorly maintained road (Rim Road), increasing the response time of emergency vehicles to the Araby Cove community. This flooding and the resulting road closures have a direct impact on the public's health and safety. Repeated flooding of the Palm Canyon Wash in recent years has required the Department to consider alternatives to maintaining the existing low water crossing. Considering the public's health and safety, and in response to increasing concerns to frequent closures of the low water crossing from the community, the Department determined that replacement of the low water crossing with a new elevated bridge is the only permanent (and the safest) solution of the repeated problem lof flooding within the Palm Canyon Wash, as a way to ensure all-weather access is maintained to the Araby 02 Cove community. i f City Council Staff Report June 6, 2012 - Page 3 Araby Drive Bridge at Palm Canyon Wash Some photos of recent flooding in the area are shown in the following pages. That land and the entire area along with the couple of parking spots could be called The Preserve at Araby Cove or something along those lines. I am quite sensitive to my neighbors "drum beating' and I don't want an ugly bridge either but I am thinking also of the future. While these folks don't want to be disturbed or don't want change the fact of the matter is that the City is changing and growing. As we grow there will be more hikers and walkers and cars to the area. There will be more rain storms and the road will wash out for sure. Will it take the loss of life during one of these events to make everyone realize that we really need a safe place to cross the wash. To pass on this federal money when we have a chance to build an esthetically pleasing safe water crossing bridge and possibly incorporate a couple of parking spots that lead to the "Preserve at Araby Cove" to me is not a very prudent or forward way to plan. I regret not being able to attend the city council meeting of June 6t' as I will be out of town then. But I would very much like to make my comments about the proposed Araby Dr. bridge Project. I am a resident of Araby Cove and feel strongly about this project for an assortment of reasons. 1. The City Council never brought this up with the people in Araby Cove previous to requesting the grant. We feel like the City just "ran over" us. 2. In these economic times spending this much on an unnecessary project sends a message indicating a lack of financial responsibility much the same as an individual family taking an expensive vacation when they are having problems paying the rest of their bills. 3. Since we do have a secondary access road into the area which we have been using for quite some number of years (at least 60) which is fine with almost all of us why fix something that isn't broken? 4. The people living near the wash would end up having an ugly view of this bridge instead of what they are used to, which is a serene and natural desert landscape. Also, these same residents would end up with a big bridge in their front yard, just about. The rest of the residents up here in the cove may not be as directly affected this way, but since we don't really need this bridge anyway, why create such a thing for the people living here and are perfectly happy with the way things are? 5. The area does not seem worthy of such an expensive and seemingly unnecessary project due to three things: once people go over the bridge, there isn't really anywhere else to go and the roads are tiny. Since there are only 80 residents here it would equal 137,500 per residence to do the project. It just does not seem to make financial sense. And item#3. 6. It just seems there would be so many better places to spend this much money. If asked, we would have given invaluable input to the planners on this issue. Then everybody could have been happy. 7. We,the Araby Cove Neighborhood Organization,believe that the proposal contained in the Application does not fit the intent and guidelines of the Federal Highway Bridge Program. To meet the goal of upgrading our Nation's infrastructure,federal money is more appropriately spent on highways, highway bridges,and highway intersections. We believe further that the approval by the City Council and Caltrans was based on the erroneous statements(see Appendix)that there is heavy traffic on Araby Drive across the wash, that local traffic circulates through the Araby Cove neighborhood,and that there is no other access to the Araby Cove neighborhood during flooding in the wash. In truth,the lightly traveled Araby Drive leads to and dead ends in our small residential community of about 80 houses nestled against the foothills. Rim Road provides a year round alternative access. Since Caltrans was not requested to conduct a field review,we believe it did not have the full,true "picture"when it approved the Application. The estimated cost of the Project was said to be$11,413,000,of which S1,300,000,is to be borne by the City of Palm Springs. We believe this expenditure to be unnecessary and fiscally irresponsible,compared with the occasional cost of clearing sand from part of the wash crossing,and very infrequently,making repairs to the asphalt road. We understand that the crossing has had only one major repair in the last 5o years. In addition,there would be non-trivial maintenance costs once the bridge is built. Per The Desert Sun of 5-20-12,the cost to repair 4 small bridges in Indio,including the one over the storm channel on Indio Blvd.near Clinton St., is expected to be s8,000,000. A bridge will attract graffiti and homeless people,which will require additional maintenance and increase security issues in our neighborhood. Sand will still have to be removed under the bridge by the City after periods of flooding in the wash to maintain proper flow of water and clearance for equestrians. The Araby Cove Neighborhood Organization was not solicited for input until the City's Application had been submitted to and approved by Caltrans. I grew up here in the desert on Clancy Lane in Rancho Mirage from 1959, over 50 years ago. My wife and I have lived in Araby Cove since Jan. 1995 and are involved with the Araby Cove Neighborhood Organization. I want to speak against the project. In regard to the proposed bridge over Araby wash the first thing I want to say is how disappointed I was to find out the city had started this project without any outreach efforts to the people that live in this neighborhood that would be affected by it even though the city does know we have a neighborhood organization. We have a fantastic group of people willing to have meetings with the city but were never notified or asked for our input. Next, in regard to the application for $10,000,000 of Federal funds which was granted, there were a few of what seems to be misrepresentations in the request and our group wants to point them out. I will start with this one. On page 1, Paragraph 2, there is a statement that says "Closure of Araby Drive low water crossing due to flooding essentially isolates the entire Araby Cove Community" The fact is that for over 60 years the residents here have successfully used Rim Road as a secondary access to the area and use it both when Araby has been flooded as well as just for normal daily use. The application to Cal Trans insinuates that the residents are isolated and stranded when Araby is flooded. The city has a picture of the Rim Rd. entrance being flooded once, as depicted on page 5 figure 2 of the application for funds but this was the only time this has ever happened to anybody's recollection and was due to a lack of maintenance to an inadequate culvert there (see exhibit A) that was designed by the city to direct this water run-off into the wash. But its only about 20 inches in diameter. (umbrella) Flooding there should never be an issue if this culvert is adequate for the purpose and properly maintained. We would be glad to take a city representative there to show you. Furthermore, in these financially stressed times it seems to be a gross mis-use of this amount of money, plus another 1,300,000 from other tax-payer sources for a project that is basically unnecessary. You know, ten million here, ten million there, and pretty soon you're into some real money. But if it is available and needs to be used for this kind of purpose it seems it would be so much better spent on Vista Chino, Gene Autry or Indian Ave. wash crossings where traffic flow in the entire area is completely disrupted during flooding instead of a little road into a small area with only 80 residents that rest of the people in the city almost never use. I urge the council to take some time to consider alternatives, THAT DO EXIST, to this unnecessary bridge project before moving forward. I will not be able to be at the meeting but wanted to added a few more comments to my previous testimony. While the NORG has done a great job in beating the drum to the reasons as to why the bridge should not be built (newspaper/tv/radio/letters to the editors etc etc) the small percentage of us have been largely ignored, and there have been a large number of residents who have not even responded. I really don't see what the downside to the bridge is. It has been brought up that it will cause crime to go up, a bridge, really? It has been brought up that the values in property will decline, really? It has been brought up that many of the native plants will be destroyed - there are not that many in this Federal waterway to begun with, so that's not true either. I really think we have a unique opportunity to create a eco-friendly bridge that serves the purpose for safe water travel for not only the residents of upper Araby Cove but also the service people and workers that use the road everyday too. It has also been stated that there really are not that many hikers, also a falsehood. I see people who walk up Araby every day and night as well as use the trails that abut the wash headed to the East. I also jog the wash on a frequent basis so I see this first hand. I live almost at the bottom of the street (third house up East side) so this really does effect me more than others - and I think there is way to make this work correctly before we throw the baby out with the bathwater so to speak. In addition the land that has been donated to the City of Palm Springs (I think about 20 acres or so) to be designated as open space I believe - this could be incorporated into a preserve or something to that nature. I certainly don't want an eyesore either but I do think this is necessary for us and for FUTURE generations - will you just throw 11mm to the wind? Finally the reason that the NORG was formed and why we became part,of PSNIC was to try and preserve the neighborhood and keep development along the wash. If the bridge is built maybe something more palatable as a trade off would be to finally vacate the streets that are along the wash (not constructed or built on) and then the drum beating might subside.
