SUBJECT: CONFLICT OF INTEREST CODE 2012 BIENNIAL NOTICE PURSUANT TO
THE POLITICAL REFORM ACT

SUMMARY
The City Council will receive and file the 2012 Local Agency Biennial Notice and direct
staff to make amendments to the City's Conflict of Interest Code for adoption.
RECOMMENDATION:
1. Receive and File the 2012 Local Agency Biennial Notice.
2. Direct staff to promulgate the necessary amendments and return to the City Council
in December for adoption pursuant to the Political Reform Act.
STAFF ANALYSIS:
The Political Reform Act requires every local government agency to review its Conflict of
Interest code biennially. On June 6, 2012, the City Council adopted Resolution No. 23151,
directing staff to review the City's Conflict of Interest Code and file the requisite 2012
Biennial Notice prior to September 19, 2012.
City staff reviewed the Conflict of Interest Code and noted areas that may require
amendments, as noted on the 2012 Local Agency Biennial Notice.
The City Council is the code reviewing body for the City. Therefore, staff is requesting the
City Council receive and file the 2012 Local Agency Biennial Notice, and direct staff to
make appropriate amendments for City Council adoption prior to December 30, 2012, as
required by the Political Reform Act.

to help ensure public trust in government. The biennial review examines current programs
to ensure that the agency's code requires disclosure by agency officials who make or
participate in making governmental decisions.

Verification
The agency's code accurately designates all positions that make or participate in the making of
governmental decisions, the disclosure categories assigned to those positions accurately require the
disclosure of all investments, business positions, interests in real property, and sources of income that may
foreseeably be affected materially by the decisions made by those holding the designated positions; and the
code includes all other provisions required by Government Code Section 87302.
