AND CHARGES FOR THE AVIATION, POLICE, FIRE, AND PUBLIC WORKS
DEPARTMENTS AND ADOPTING THE COMPREHENSIVE FEE SCHEDULE FOR
FISCAL YEAR 2006-07:
Honorable Mayor and Members of the Council,
The Building Industry Association has had the opportunity to review the City of Palm
Springs' proposed fee changes for Fire Permits/Services for fiscal year 2006/2007. An
electronic copy of last year's nexus study prepared by MuniFinancial was sent, by Deputy
Kathy Hart, to aid us in the ability to make the connection in the changes to the fee schedule
for Fire Services. Further information was provided by Assistant City Manager Troy
Butzlaff and Chief Goetz. With their assistance and documentation provided, the BIA is
satisfied that a reasonable nexus has been established and that the fees are appropriate to
meet the legislated standard of Government Code 66000.
We appreciate the professionalism and candor of the City of Palm Springs Administration
and look forward to working with the City Staff and Council in the future.

(ASP) and/or the Airport Certification Manual (ACM).
Each company/individual, including City T-hangar tenants, who are required to obtain the aforementioned permit shall receive two (2) permits at no cost.

Fee Refunds
1 . The building official may authorize the refunding of any fee paid hereunder which was erroneously paid
or collected.
2. The building official may authorize the refunding of not more than 80 percent of the permit fee paid when
no work has been done under a permit issued in accordance with this code.
3. The building official may authorize the refunding of not more than 80 percent of the plan review fee paid
when an application for a permit for which a plan review fee has been paid is withdrawn or canceled before
any plan reviewing is done.
4. The building official shall not authorize the refunding of any fee paid, except upon written application filed
by the original permittee not later than 180 days after the date of fee payment.

e) Assessment Districts
The sewer facility fee to be paid for premises with service made available by an assessment district shall be the
fee in effect at the time a petition representing 60% sufficiency is filed with the City, provided said connection
occurs during the course of construction but in no event later than 30 days after filing of notice of completion of
the assessment district. Should a permit not be secured within the time frame set forth herein, the facility fee to
be paid shall be that fee in effect at the time the permit for connection is secured.

f) Properties adjacent to City
Properties outside of the City shall pay a sewer facility fee equal to twice the rate established for properties within
the City limits.
Sewer Main Surcharge Fee
In addition to Sewer Street Main Charge, Inspection Fee and any other applicable fees, when a sewer reimbursement
agreement requires the collection of a Sewer Main Surcharge Fee, the Building Division shall collect and remit the amount
prescribed by such agreement, (including interest, if required by the subject agreement).
Sewer Street Main Charges
In addition to the inspection fee and any other applicable fees, when a property connecting to a City sewer has
not paid its share of the cost of said sewer, there shall be paid a street main charge. Said street main charge
shall be determined by the Building Division, based upon one of the following formulae, whichever is the greater:
(1) Sixteen dollars ($16) per lot front foot along said sewer, or(R20362) 16.00 per foot
(2) At the rate established in a sewer reimbursement agreement adopted by resolution of the City Council for sewers
constructed by a developer, or
(3) At the rate established by resolution of the City Council for sewers and/or sewage collection system constructed
by the city in a specified applicable area.
Said street main charges shall be deposited in the Sewer Fund, except for those charges collected through
a sewer reimbursement agreement wherein the original costs plus interest are reimbursed to the second
party of said agreement.

6. Animal Placement Fees: Any of the animal placement fees may be waived in whole or in part by the City Manager, or his designee, under special circumstances as he may determine, where the
public and City's interest may be served thereby.
7. Drainage fees shall apply to all existing vacant properties which are not part of an existing subdivision or that are legal lots of record having been part of a subdivision recorded prior to the effective
date of this Resolution. For properties smaller than one (1) acre, a per square foot fee shall be established based on the acreage fee for a given subdrainage area. A drainage fee shall be required
for all developed properties when an addition of hard surfaced area exceed 50% of the existing hard surfaced area.
8. If it is found upon review and revision of the Master Drainage Plan, that the revised plan can be implemented at lesser cost than the original plan, then the base fee will be lowered. In cases where
developments have previously been assessed the higher fee, the difference between the fee paid and such revised fee will be refunded

In those cases where the developer elects to construct the improvements, actual costs which City validates developer has incurred for design and/or construction of storm and/or drainage
improvements as shown in the Master Drainage Plan, shall be credited towards the drainage fee otherwise due. In the event such costs exceed the fee otherwise due, the City will enter into an
agreement to reimburse the developer for the excess cost. Such reimbursement shall be made from drainage fees when collected from other projects within the basin area within which the
development occurred.
9. When any property not within the City limits request approval for sewer connection, whether existing prior to May 18, 1983 or constructed thereafter, which will result in the contribution of sewage
flows to Lift Station No. 1, that Sewer Surcharge Lift Station No. I Fees be determined by the City Manager, and that such fee be approved by the City Council in conjunction with the issuance of
authorization to connect to the City's sewer system; and
10. Such fees shall be collected at the time of issuance of a building permit for construction or in the case of development at the time such connection is authorized. Such fee shall be in addition to the
inspection fee, sewer facility fee, street main charge, and any other applicable fees, and shall be deposited into the Sewer Fund.
11. Facility Rental Notes:
1. Rental fees as determined by the Special Activities Supervisor will vary according to service levels required by the proposed use.
2. Extended, multiple day, and multiple facility use fees will be set by the Special Activities Supervisor.
3. Additional Leisure Services Division facilities are available for rent with fees established by the Division based on activity and service levels required.

13. Use of the facility shall be limited to non-profit organizations for meetings which are open to the general public, and available only as an alternative to other City facilities.

15. The developer may be required to pay to the City a fee in-lieu of making the dedication computed pursuant to Ordinance No. 1632, Section IV. The in-lieu fee shall be computed by multiplying the
area of park to be dedicated by the fair market value of the land being developed plus the cost to acquire and improve the property plus the fair share contribution, less any credit given by the City, as
may be reasonably determined by the City, based upon the formula contained in Ordinance No. 1632, 8-13-03.
16. On July 1st of each year, the applicable fees shall be automatically adjusted by an amount equal to the percentage of increase or decrease in the consumer price index for this region, as last
computed before the July 1st date pursuant to Resolution No. 20849 Section 2.C. and Resolution No. 21317 Section 2.D.
17. A person subject to the fee imposed by the Resolution may apply to the City Council for adjustment to that fee, or a waiver of that fee, or reimbursement of part or all of the fee, solely by following the
written protest procedure in the time and manner prescribed by Government Code Section 66020 and detailing the reasons for the adjustment, waiver or reimbursement pursuant to Resolution No.

and adopt the 2006-07 Comprehensive Fee Schedule.
RECOMMENDATION:

STAFF ANALYSIS:
Local governments are funded from a variety of sources, with the primary sources being
taxes, subventions, fees, special charges, fines and grants. As the traditional provider
of basic services, cities are relying more and more heavily on user fees that are charged
for various public services
State law requires that fees charged by local agencies be reasonably related to the
actual cost of providing the service. User fee services are those services performed by
a governmental agency on behalf of a private citizen or group. The assumption

uinderlying most fee recommendations is that the cost of services benefiting individuals,
aind not society as a whole, should be borne by the individual receiving the benefit(s).
In 2004 for the Development Services Departments, and in 2005 for other Departments;
the City retained a consultant, MuniFinancial, to prepare a User Fee Study. This study
was to ensure that the City was recovering the full cost of providing various public
services and that fees were reasonably related to the estimated reasonable cost of
providing the type of service for which the fee is charged. Fees were substantially
updated at that time.
It is the City's intent to retain a consultant approximately every five-years to prepare a
comprehensive User Fee Study and thoroughly review all fees. These time/material
studies and overhead calculations and allocations are expensive and very time-
consuming for staff. During the interim, staff requests all fees be increased (or
decreased) by the local CPI index, to ensure fees remain reasonably related to costs
and keep pace with increased costs without having to prepare a comprehensive study
each year.
Additionally, every year, each Department Director, reviews the current fee schedule
and may recommend modifications to certain fees.
This year the Aviation, Police, Public Works and the Fire Departments are requesting
codifications to certain user fees. Each Department prepared a Departmental Fee
Request and Justification, which outlines the particulars of each request, and are
attached to this report for individual review and consideration.
Staff is requesting the City Council adopt the Comprehensive Fee Schedule increasing
fees by the Consumer Price Index, All Urban Consumers for the Los Angeles-Riverside-
Orange Counties as last published by the U.S. Department of Labor a ,3.6%.
FISCAL IMPACT: IFinance Director Review:
All modifications to fees will be incorporated in the 2006-07 Proposed Budget presented
to the City Council on June 7, 2006. However the 2006-07 Preliminary Budget
presented to the City Council on April 26, 2006 included $100,000 revenue from the
proposed Fire Department Multi-Unit Fire Inspection Fee.
General CPI increase to current fees of 3.6%, will result in an increase in
projected General Fund revenue of approximately $155,000.
Increase in revenue for modified fees as follows:

easements and public right-of-way usually during the development or engineering
process. The procedures of these vacations and easements are stipulated in the

In 2004 the City performed a time, cost and materials analysis. This analysis and the

Explanation of Fee:
In accordance with the California Health and Safety Code Section 17921, the City will
annually conduct fire and life safety inspections of Multi-Dwelling Occupancies defined
as hotels, motels, lodging houses, apartment houses, dwellings and congregate
residences containing three or more dwelling units. Single family detached residences
are not required to be inspected.
A typical fire and life safety inspection at these facilities includes, but is not limited to,
checking fire alarm systems, fire sprinkler systems, fire extinguishers, common areas
for fire hazards, exiting and fire access issues.
The California Health and Safety Code Section 13146 provides cities the legal authority
to charge property owners to recover reasonable costs of providing these annual
inspections.
The fire department recommends that Low and Very Low Income properties as defined
by the City of Palm Springs Community Redevelopment Agency be exempt from the fire
inspection fees, however the inspection will still be conducted.
The most cost effective method for collecting these fees is via the secured property tax
roll.
The fire department will hire one, non-safety Fire Prevention Specialist (Range 42) to
conduct these fire inspections on an annual basis.
Justification/Analysis to modify Fee:
Due to increased emergency fire and EMS activity over the past 8 years, coupled with
the demand for firefighter training, the Fire Chief has determined that these fire and life
safety inspections have not been conducted on a regular basis as required by the State
Fire Marshal.
Due to the number of multi unit occupancies requiring fire inspections, coupled with the
high visibility tourism nature of the city, a fire in one of these occupancies leading to
injury or loss of life could have an adverse effect on our tourism industry (as evidenced
by the 1980 MGM Hotel Fire in Las Vegas).

Explanation of Fee:
The Fire Department should conduct a fire and safety inspection whenever a new
business license is issued to anyone that is conducting business from commercial
address in Palm Springs, pursuant to Section 301 et. seq. of the California Fire Code.
The Fire Department proposes to add a New Business License Fire Inspection Fee of
$86.00 for all new business license applications that will conduct business from a
commercial property address in Palm Springs. Home Occupation businesses and out
of town business do not require a fire inspection and will not be charged a fee. Once
the fee is collected, a Deputy Fire Marshal will visit the business when they are fully
occupied and operating (or ready to operate) and will conduct the fire and life safety
inspection.
After the initial inspection by the Deputy Fire Marshal, tri-annual courtesy fire
inspections will be conducted by engine company personnel at no charge to the
business owner(as is currently done).
Justification/Analysis to modify Fee:
Once a new business opens in the City of Palm Springs it may be several years before
an engine company can schedule a courtesy fire inspection due to the sheer number of
businesses in the city. It is important for the business owner and the public that fire
safety measures are in place from the opening of that business to ensure that it is
operating in a safe environment.
Under the current system of fire inspections, the engine companies conduct fire
inspections on a 3 year schedule. Engine company personnel have less experience
and training in conducting detailed fire inspections than the Deputy Fire Marshals. It is
prudent to conduct a through fire inspection with an experienced Deputy Fire Marshal
upon the opening of that business.

Explanation of Fee:
The current Fire Department user fees provide for specific and defined inspections. The
Fire Chief has determined that many services requested by the public for inspections,
special events standby and special purpose fire services should be include in the
Comprehensive Fee Schedule.
The current Comprehensive Fee Schedule does not provide for requests of the Fire
Department for user services and requests that could be charged to a business, entity
or person for providing inspections or a special service.
This fee allows the Fire Department to charge for special inspections and/or special
services at the fully burdened hourly rate. The services are not specifically identified
since many of them are unknown.
Justification/Analysis to modify Fee:
In 2005, the Council adopted a User Fee Study and Cost Allocation plan that included
an analysis of the Fully Burdened Hourly Rates for employees in the fire department.
This study was the basis and provided the legal framework for setting the current fees.
Since the 2005 User Fee Study and Cost Allocation plan, Department salaries have
increased by approximately 3% for Cost of Living Increases later approved in 2005 and
estimated 2006, so that the user fees are reasonably related to the actual cost of
providing the service.
Therefore the Department used the fully burdened hourly rate as listed below then
modified by 3%. Additionally, two new position classifications have been added and the
fully burdened rate analysis/calculations is provided.

The Fire Department currently has a "Fire Plan Inspection Fee" in place for new
construction projects. In 2005, the fee was uncollected by the Building Department
because the fee description was unclear to the Building Department and the customer.
The name of the fee (Fire Plan Inspection Fee) implied that field inspections are
included as part of this fee. That is not the case, and the Fire Department recommends
modifications to the fee to simply state the plan review fee, and reference that the field

APPROVING CERTAIN USER FEES AND CHARGES AND
ADOPTING THE COMPREHENSIVE FEE SCHEDULE FOR
FISCAL YEAR 2006-07
WHEREAS, the City, under various statutory provisions under California
Government Code, may set and collect fees for the costs of providing various public
services to the community; and
WHEREAS, from time to time, the City Manager has recommended and the City
Council desires to approve certain amendments to said user fees; and
WHEREAS, a duly-noticed public hearing was held on May 17, 2006 in
accordance with the provisions of the California Government Code; and
WHEREAS, the supporting data was available for public inspection and review
for ten (10) days prior to the public hearing; and
WHEREAS, the City Council has considered any verbal and/or written testimony,
and has reviewed and considered the information provided at the public hearing by staff
and the public.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY
FINDS AND DETERMINES THAT:
Section 1: Findings.
A. City staff has completed an analysis of certain user fees.
B. The current user fees are insufficient to cover all the City's costs and
expenses associated with providing the various public services.
C. The cost of such services should be borne by those who are the special
beneficiaries rather than the citizenry at large.
D. There is a reasonable relationship between the amount of the fee and the
estimated reasonable cost of providing the type of services for which the fee is imposed.
E. The fees do not exceed the estimated reasonable cost of providing the
service for which the fee is charged.
Section 2: Fees Imposed.
A. The City Council modifies and approves the user fees and charges as set
forth in Exhibit A attached to this Resolution.

B. The City Council adopts the Comprehensive Fee schedule as set fourth in
E=xhibit B attached to this Resolution
C. Each person requesting a service in the City of Palm Springs for which a
user fee or charge is imposed shall pay the new fees as set forth in the City's
Comprehensive Fee Schedule.
E. On July 15t of each year, all service fees and charges shall be
automatically adjusted by an amount equal to the percentage of increase or decrease in
the Consumer Price Index for this region, as last computed for the previous 12-month
period.
F. The user fees and charges may also be adjusted if the City conducts a
public hearing to implement a new or revised fee or fees based upon a new study or
analysis.
G. The adoption of this Resolution does not affect the ability of the City to
request an agreement between an applicant and the City to pay extraordinary
processing costs and to establish deposit accounts.
Section 3. Severability.
Each component of the fees and all portions of this Resolution are severable. Should
any individual component of the fee or other provision of this Resolution be adjudicated
to be invalid and unenforceable, the remaining provisions shall be and continue to be
fully effective, and the fee shall be fully effective except as to that portion that has been
judged to be invalid.
Section 4. Effective Date.
The fees shall be effective sixty (60) days after the adoption of this Resolution.

COMPREHENSIVE FEE SCHEDULE
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs,
California, will hold a public hearing at its meeting of Wednesday, May 17, 2006. The
City Council meeting begins at 6:00 PM, in the Council Chamber at City Hall, 3200 E.
Tahquitz Canyon Way, Palm Springs.
The purpose of this hearing is to solicit and consider public comments on the proposed
modifications to user fees and charges prior to the adoption of a Resolution revising and
updating the City's Comprehensive Fee Schedule. Under state law all fees charged by
the City must be reasonably related to the actual cost of providing various public
services.
Proposed changes to the following Fire Department: Renewable Permits Fees, New
Business License Fire Inspection, Multi-Residential Occupancy Fire Inspection Fee, Fire
Plan Review and Inspection Fee, Fire Inspection/Standby/Special Services Fees; Public
Works and Engineering: Street Vacation; Police Department: Rental Charge for Police
Library Facility; Aviation Department: Rental Car Overflow Parking/Storage, Rental Car
Ready Return Lot; CPI adjustment to fees in the Comprehensive Fee Schedule.
