Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY Fire Station 1, located at 277 North Indian Canyon Drive, does not have access to an alternate power source in the event of an unexpected electrical service interruption or catastrophic emergency. On May 16, 2012 Council approved the purchase of a new 50 KW, 80 amp, diesel fuel generator which has been manufactured and delivered to the City. Award of this project will allow staff to proceed with the installation of the generator the construction of all necessary site work and utility connections. RECOMMENDATION: 1) Approve Agreement No. in the amount of $34,500.00 with G&M Construction, Inc. for Fire Station 1 Emergency Generator Installation, City Project 11-09; and 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: Fire Station 1 requires a source of emergency power in order to maintain operational readiness in the event of electrical interruption or long term power outage. Currently the station has a battery back-up system capable of powering the department's emergency radio system. However, these batteries are not capable of operating the numerous electrical systems necessary for the station to operate at its full capacity. Should the station experience an unexpected power outage, the station's emergency response and functional capabilities could be affected. ITEM NO. I-M _ City Council Staff Report December 5, 2012-Page 2 Fire Station 1 Emergency Generator Installation (CP 11-09) The City of Palm Springs utilized MRC Engineering, Inc. to determine the electrical demands for the station and design all necessary site accommodations for the installation of an emergency generator. It was determined that a 50 KW 80 amp diesel generator with a 300 gallon on-board fuel tank would be capable of providing emergency power to ensure full operation of all fire station systems for up to 72 hours. Based on this recommendation, the City issued an RFQ for the purchase of the generator and received 6 bids in response. Brudvik Electric, 600 Eugene Road, Palm Springs, CA was determined to be the lowest bidder and with council approval the generator was purchased at a cost of $25,845.00. This generator has now been manufactured and delivered to the City for installation. This action is for the installation of the generator. The Public Works and Engineering Department along with MRC Engineering Inc. prepared plans and specifications for installation of the new generator. On September 30 and October 7, 2012, the project was advertised for bids, and at 3:00 p.m. on October 30, 2012, the Procurement and Contracting Division received construction bids from the following contractors: 1. G&M Construction; Palm Springs, Ca; $34,500.00 2. Brudvik, Inc.; Palm Springs, CA; $51,438.00 3. Joe Putrino General Contractor; Yucca Valley, CA; $55,953.00 4. Atom Engineering; Hemet, CA; $64,398.00 5. Genesis Construction; Hemet, CA; $75,777.00 6. T&G Construction; Mojave, CA; $90,175.00 The apparent low bidder with a bid of $34,500.00 was G&M Construction. The Engineer's estimate for this project was $30,000. G&M Construction is a local Palm Springs Company and has successfully completed many projects for the City and others throughout Palm Springs. The generator will be installed in the northwest corner of the Fire Station parking lot and includes construction of new electrical conduits, conductors and electrical equipment necessary to convey power from the new generator to the existing electrical panel inside the Fire Station. In addition, an engineered concrete foundation with required fuel spill containment and 8 foot high masonry block screen walls will be constructed. The installation of the generator requires a Minor Architectural Application (MAA) approved at City Staff level. The approved MAA is attached. The historic designation for Fire Station No. 1 only includes the building. As such only alterations to the building are subject to HSPB review. Approved MMA 03 AGREEMENT THIS AGREEMENT made this day of in the year 201, by and between the City of Palm Springs, a charter city, organized and existing in the County of Riverside, under and by virtue of the laws of the State of California, hereinafter designated as the City, and hereinafter designated as the Contractor. The City and the Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1 --THE WORK The Contractor shall complete the Work as specified or indicated under the Bid Schedule(s)of the City's Contract Documents entitled: FIRE STATION 1 EMERGENCY GENERATOR INSTALLATION CITY PROJECT NO. 11-09 The Work is generally described as follows: Installation of a new Generac Model 5D050 50 kW 80 amp generator with 300 gallon fuel tank (furnished by City); construction of concrete pad and fuel containment area, construction of masonry screen walls and gate, installation of transfer switch(furnished by City), electrical panel, conduits, pull boxes, junction boxes and Conductors in order to connect new generator and transfer switch to the existing main panel. Installation and connection (to utility operators satisfaction), of new electrical service/main switchboard equipment. Work is inclusive of all materials and labor necessary to ensure a complete and fully functional emergency generator system in accordance with project plans, specifications and applicable building codes and regulations. ARTICLE 2— COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall commence on the date specified in the Notice to Proceed by the City, and the Work shall be fully completed within the time specified in the Notice to Proceed. The City and the Contractor recognize that time is of the essence of this Agreement, and that the City will suffer financial loss If the Work is not completed wfthin the time specked In Article 2, herein, plus any extensions thereof allowed in accordance with applicable provisions of the Standard Specifications, as modified herein. They also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the City if the Work is not completed on time. Accordingly, instead of requiring any such proof, the City and the Contractor agree that as liquidated damages or delay(but not as a penalty), the Contractor shall pay the City the sum of$700.00 for each calendar day that expires after the time specified in Article 2, herein. ARTICLE 4--THE CONTRACT DOCUMENTS The Contract Documents consist of the Notice Inviting Bids, Instructions to Bidders, the accepted Bid and Bid Schedule(s), List of Subcontractors, Non-collusion Affidavit, Bidder's General Information, Bid Security or Bid Bond, this Agreement, Worker's Compensation Certificate, Performance Bond, Payment Bond, Standard Specifications, Special Provisions, the Drawings, Addenda numbers to , inclusive, and all Change Orders and Work Change Directives which may be delivered or issued after the Effective Date of the Agreement and are not attached hereto. ARTICLE 5-- PAYMENT PROCEDURES The Contractor shall submit Applications for Payment in accordance with the Standard Specifications as amended by the Special Provisions. Applications for Payment will be processed by the Engineer or the City as provided in the Contract Documents. ARTICLE 6--NOTICES Whenever any provision of the Contract Documents requires the giving of a written Notice, it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address known to the giver of the Notice. ARTICLE 7--MISCELLANEOUS Terms used in this Agreement which are defined in the Standard Specifications and the Special Provisions will have the meanings indicated in said Standard Specifications and the Special Provisions. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically, but without limitation, monies that may become due and monies that are due may not be assigned without such consent(except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. The City and the Contractor each binds itself, its partners, successors, assigns, and legal representatives, to the other party hereto, its partners, successors, assigns, and legal representatives, in respect of all covenants, agreements, and obligations contained in the Contract Documents.
