Subject: GRANT APPLICATION FOR BICYCLE LANES (CLASS II), PRIORITY 1
UNDER THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION
PROGRAM

SUMMARY
This item will initiate the required resolution for the submission of a grant application for
funding of Class II Bicycle Lanes of Priority 1 throughout the City of Palm Springs under
the Coachella Valley Association of Governments (CVAG) Non-Motorized
Transportation Plan Update adopted by the Palm Springs General Plan adopted in
September 2011.
RECOMMENDATION:
1) Adopt Resolution No. "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA APPROVING THE
APPLICATION FOR GRANT FUNDS FOR THE
ENVIRONMENTAL ENHANCEMENT AND
MITIGATION PROGRAM UNDER THE SECTION
164.56 OF THE STREETS AND HIGHWAYS CODE
FOR THE FOLLOWING PROJECT: BICYCLE
LANES (CLASS ll), PRIORITY 1"
STAFF ANALYSIS:
The City of Palm Springs will be applying for grant funds from the Environmental
Enhancement Mitigation Program under Section 164.56 of the Streets and Highways
Code. The Legislature of the State of California has enacted AB 471 (Chapter 106 of
the Statues of 1989), which is intended to provide $10 million annually for a period of 10
years for grant funds to local, state and federal agencies and nonprofit entities for
projects to enhance and mitigate the environmental impacts of modified or new public

transportation facilities. This type of grant has a maximum amount of $300,000 if
awarded and does not require a match. Currently, the City has adopted to fund Bicycle
Lanes of Class II which of are of Priority 1 according to the CVAG Non-Motorized plan.
Class II bike lanes cost approximately $120,000/mile. On September 19, 2012, City
Council authorized Priority 1 Class II bike lanes for Avenida Caballeros from Techevah
Dr. to San Rafael Dr. (1.5 miles), Baristo Rd from Avenida Caballeros to El Cielo Rd.
(1.5 miles), and Via Escuela from Indian Canyon Dr. to Sunrise Way (1 mile). Current
budget from Sustainability account will only allow us to do one (1) or two (2) streets
selected by the City Council, but with the addition of the grant funds, it will allow us to
do, potentially, all three (3) locations.
The grant application deadline is January 4, 2013. The California Transportation
Commission (CTC) expects to grant the award in September 2013. An agreement
between Caltrans and the City will need to be established and approved by City
Council, and Construction of the project would commence within two months shortly
after advertise and bidding.
FISCAL IMPACT:
Approval of this action is the first step to applying for the grant. If the grant is awarded,
this will have a positive impact to the City's funding of projects. The following amounts
from the Sustainability accounts are available for Class II bike lanes construction; 138-
1270-50000 ($50,000) and 138-1270-58033 ($50,000). Total available funding for bike
lanes is $100,000 from the Sustainability accounts. An additional $300,000 from the
grant would make it $400,000. Although estimates are higher than funding availability,
the economic trend of low bids may make up the difference.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA APPROVING THE
APPLICATION FOR GRANT FUNDS FOR THE
ENVIRONMENTAL ENHANCEMENT AND MITIGATION
PROGRAM UNDER THE SECTION 164.56 OF THE
STREETS AND HIGHWAYS CODE FOR THE FOLLOWING
PROJECT: BICYCLE LANES (CLASS II), PRIORITY 1
WHEREAS, the Legislature of the State of California has enacted AB 471
(Chapter 106 of the Statutes of 1989), which is intended to provide $10 million
annually for a period of 10 years for grant funds to local, state and federal
agencies and nonprofit entities for projects to enhance and mitigate the
environmental impacts of modified or new public transportation facilities; and
WHEREAS, the Natural Resources Agency has established the
procedures and criteria for reviewing grant proposals and is required to submit to
the California Transportation Commission a list of recommended projects from
which the grant recipients will be selected; and
WHEREAS, said procedures and criteria established by the Natural
Resources Agency require a resolution certifying the approval of application by
the Applicant's governing body before submission of said application to the State;
and
WHEREAS, the application contains assurances that the Applicant must
comply with; and
WHEREAS, the Applicant, if selected, will enter into an agreement with the
State of California to carry out the environmental enhancement and mitigation
project.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
1. Approves the filing of an application for the Environmental Enhancement
and Mitigation Program for grant assistance in the amount of $300,000.
2. Certifies that said Applicant will make adequate provisions for operation
and maintenance of the project.
3. Appoints DAVID H. READY, CITY MANAGER, or designee, as agent of
the CITY OF PALM SPRINGS to conduct all negotiations, execute and

submit all documents, including, but not limited to applications,
agreements, amendments, payment requests and so on, which may be
necessary for the completion of the aforementioned project.
