Ready, City Manager BY: Douglas Holland, City Attorney SUMMARY This is a proposal to approve a public utility easement on a strip of land (APN 502-100-013) owned by the City on the south side of East Civic Drive, west of North Civic Drive. The establishment of a public utility easement on this strip of land would allow public utility providers such as SCE to install service connections in this strip of land subject to the terms and conditions of their respective franchise rights under state and local law. The provision of a public utility easement on this property will also accommodate future undergrounding of the overhead utilities located on a public utility easement that burdens single family homes south of the City's property. RECOMMENDATION: Approve the proposed Public Utility Easement on City owned property (APN 502-100- 013) generally located on the south side of East Civic Drive and west of North Civic Drive and authorize the City Manager to execute the Public Utility Easement in a form approved by the City Attorney ANALYSIS The City was approached by home owners of property south of East Civic Drive to grant SCE an easement over City owned property between their property lines and the East Civic Drive right-of-way. SCE is proposing to underground utilities along a portion of east Civic Drive. In lieu of granting an easement to SCE, this Office is proposing the City Council approve a public utility easement be recorded on this City property (APN 502-100-013). The City would retain ownership of the land and public utilities such as SCE would be able to locate facilities in this property subject to existing franchise rights granted under state and local law.
