Subject: DISCUSSION OF LIQUIDATED DAMAGES AND APPROVAL OF
CONTRACT CHANGE ORDER No. 12 FOR THE BELARDO ROAD
BRIDGE AND ROADWAY, CITY PROJECT NO. 89-49.

SUMMARY
Approval of Contract Change Order No. 12, provides for an addition of 23 working days
for the placement of rock excavation as required by the Riverside County Flood Control
District (RCFCD) adjacent to the roadway and channel. The work has been completed
within the contractual time frame and no liquidated damages are proposed to be
assessed.
RECOMMENDATION:
1) Approve Change Order No. 12 to Agreement No. 6129 with G&M Construction at
no additional cost to the City but granting 23 additional working days.
2) Authorize City Manager to execute all necessary documents.
STAFF ANALYSIS:
Staff met with representatives of G&M Construction on January 9 along with Dokken
Engineering, the City's consultant contract administrator and inspector. At that meeting
G&M informed staff that the rock placement was required by RCFCD and agreed to by
the Tribe. City staff was not in on this discussion between G&M and RCFCD. Given that
placement after bridge construction was required, rather than rock removal prior to,
granting of additional time would be appropriate. Staff reviewed project records to
determine that 23 days should be granted and confirmed with RCFCD that the
placement was indeed required.

FISCAL IMPACT:
None, as Change Order No. 12 has no cost. Payment for the quantity of rock was
granted by Change Order No. 10.

Increase in Working Days due to Additional "Rock Excavation" (Item 14)
This Change Order No. 12 provides an adjustment of the time due to the increased quantity of Item 14, 'Rock
Excavation".
By reason of this order, the time of completion will be adjusted as follows: 23 Working Days Extension.
SOURCE OF FUNDS:
No additional funds are required by action of this Contract Change Order.
REASONS FOR CHANGE:
Increase in Working Days due to Additional "Rock Excavation" (Item 14)
It has been discovered that Contract Change Order No. 10 did not allow for G&M Construction additional
working days due the increased quantity of Item 14, "Rock Excavation". Contract Change Order No. 10
provided adjustment for the change in cost and an allowance for working days was not made because
placement incorporation into the job site was not required. However given that RCFCD requested rock be
placed in and adjacent to the channel additional working days are appropriate. It is noted that this Change
Order No. 12 provides for the completion of Item 14, and no additional work, cost, or time will be considered for
incidental costs incurred for these additional 23 working days.
