Ready, City Manager BY: Department of Community & Economic Development SUMMARY This action approves the 2013-2014 Community Development Block Grant (CDBG) Budget and the 2013-2014 Annual Action Plan. The resolution also authorizes the City Manager to execute all agreements with U.S. Department of Housing & Urban Development (HUD) as well as the CDBG program's subrecipients, including City Departments. The Annual Action Plan is prepared by the City in response to requirements set forth by HUD which mandates that units of government receiving federal housing and community development assistance must prepare its annual plan to implement its 2010- 2015 Consolidated Plan as a coordinated strategy. The Consolidated Plan is the blueprint for community development activity in the City. The sequester reductions are anticipated to be as much as 8.2%, but at least 5.4%. Palm Springs is an "entitlement city," meaning that it is a direct recipient of CDBG funds. The CDBG Program was adopted by Congress thirty-nine years ago to provide a flexible funding source for local governments to meet the community development needs of their low and moderate-income persons. CDBG enables local governments to fund three National Objectives: benefiting low and moderate income persons; preventing or eliminating slums or blight; and meeting urgent need. The federal statute requires that at least 70% of CDBG expenditures must benefit low and moderate income persons. There are also statutory limitations on the percentage of CDBG funds that may be utilized for administrative purposes, at no more than 20% of the entitlement, and Public Services, at no more than 15% of the entitlement. The remaining funds are to be utilized for other categories, including Public Facilities and Capital Improvements and Housing Rehabilitation. This coming fiscal year funding will consist of an estimated $311,205 in new entitlement funding and $70,000 in reprogrammed dollars, totaling $381,205. The total funds available for 2013-2014, by eligibility category, are as follows: Public Facilities & Improvements $272,283. Public Service is calculated at 15% of new entitlement funding. * Administration is calculated at 20% of new entitlement funding. 02 City Council Staff Report March 20, 2013— Page 3 of 9 CDBG 2013—2014 Program Year Consolidated Plan Compliance In 2010, the City adopted its required 2010-2015 Consolidated Plan, which was approved by HUD. The Consolidated Plan is the required blueprint for meeting the housing and community development needs of the city and provides a description of existing housing and community development needs, a long-term strategy to address those needs and an action plan for coming years. The City is responsible for preparing an Annual Action Plan update, which reiterates the City's CDBG goals and objectives contained in the Consolidated Plan, and incorporates the proposed projects and funding for the new fiscal year. A key component of the 2010-2015 Five-Year Consolidated Plan is a Strategic Plan, which includes the goals and objectives included in Attachment "A". The 2013-2014 Annual Action Plan contains programs that make progress toward the stated goals and the proposed accomplishments. New Annual Action Plans are prepared and updated annually. Each Annual Action Plan must contain projects and programs that will enable the City to meet its five-year goals that are in the adopted Consolidated Plan. As a part of the Consolidated/Annual Plan planning process, and a requirement of the CDBG program in general, HUD requires local governments to include citizen participation in the process. The following community participation activities were undertaken: • CDBG Request for Proposals (RFPs) were made available on December 18, 2012 through the City's website registration, and in turn, a fill-in Request For Proposal was e- mailed to those on-line registrants. The fill-in Microsoft Word format helped make the application process easier for all potential respondents. In all, postcards and e-mail announcements were sent to nearly 300 organizations and individuals, including previous CDBG Subrecipients, last year's applicants, City Departments, and those organizations requesting to be placed on the mailing list. • The Legal Notice was published twice, January 5tn and January 27th, in The Desert Sun, and a press release was faxed to all Coachella Valley electronic and print media which provided information to the community about the availability of CDBG funds. • Staff conducted a formal RFP Workshop on January 28th that provided technical assistance and responded to applicants' questions. There were four (4) organizations represented and staff continued to provide technical assistance on an as needed basis, including direct assistance to two City departments. Eight new organizations secured RFPs. The RFP submittal deadline was February 11th. Sixteen (16) RFPs were distributed. The City received nine (9) funding requests totaling $673,500. This compares to seventeen (17) proposals last year at $1.4 million requested. • The Citizens Advisory Committee held its public hearing on February 215t. Staff briefed the Committee on the past year's CDBG activities, including the status of projects; agencies' accessibility for all residents — able-bodied and disabled; the Consolidated Annual Performance & Evaluation Report; the potential coming year's CDBG allocation reduction; the Administration's next fiscal year (2014) proposed CDBG flat funding; and, timely expenditure scrutiny by HUD. The public hearing was held to receive testimony about proposed 2013-14 CDBG activities and from organizations submitting proposals which allowed the Committee members to question the respondents. In some instances, even though a project met the Consolidated Plan goals, the Committee may not have recommended the program for funding due to other concerns. Below is a description of all of the proposals reviewed, including area/clientele to be served, average Evaluation Criteria Score and recommended allocations for 2013-2014 CDBG funding. PROJECTS RECOMMENDED FOR FUNDING — Public Facilities & Improvements: 1. City of Palm Springs Public Works & Engineering —Arnico Tract Sewer Improvements: The proposal is an additional phase in the extension of sanitary sewer to a subdivision which was developed in the 1980's as a part of the unincorporated County, with private septic tanks, and later annexed to the City in 1991. The main sewer line and associated sewer lateral connections are being recommended for funding. 19 Households; 19 UM; 19 PS Households; 28 Eval Score; Requested $341,800 Recommended $159,083 2. Desert AIDS Project— Energy-Efficiency Retrofitting: DAP's proposal is the continuation to phase their facility's energy-efficiency upgrades. These upgrades will replace the older asphaltic-type roof with a single-ply elastomeric 'cool-roof' which has insulating and solar reflective properties as well as installation of heat radiated dual-pane windows and doors, resulting in energy cost savings and preserving funds for direct client services. 2,304 East County; 2,279 UM; 1,220 PS Residents; 34 Eval Score; Requested $90,000 Recommended $90,000 3. Mizell Senior Center — Energy Conservation Improvements: Mizell's proposal is the continuation of the re-roof of the remaining portion of their facility. The Fair Housing Council requested these funds to provide comprehensive services which affirmatively address and promote fair housing (anti-discrimination) rights and landlord/tenant services to the City of Palm Springs. This CDBG activity is eligible to be funded under Public Services. 600 City-wide; 595 L/M; 600 PS Residents; 24 Eval Score; Requested $40,000 Recommended $15,000 11.AIDS Assistance Program — Food Voucher Program: AAP requested funds to reduce their waiting list of eligible clients for their Food Voucher program, which serves adults and children living with HIV/AIDS who are of extremely low-income. 25 City-wide; 25 UM; 25 PS Residents; 29 Eval Score; Requested $28,200 Recommended $16,681 The following list is a brief description of the other RFPs received and reviewed by the CAC, which were not recommended for funding because they did not meet the CDBG eligible activities, Consolidated Plan goals, other administrative concerns or because of limited funding. WHEREAS, as a Community Development Block Grant entitlement community, the City of Palm Springs is required to prepare and submit a Five Year Consolidated Plan and Annual Action Plan for the use of the federal funds received; and WHEREAS, the City of Palm Springs is eligible to receive an entitlement of $311,205 of Community Development Block Grant funds under the U.S. Department of Housing & Urban Development regulations; and WHEREAS, the City of Palm Springs has reprogrammed Community Development Block Grant funds of$70,000; and WHEREAS, the funds must be used for eligible activities which principally benefit low and moderate income persons; and WHEREAS, pursuant to the requirements of including citizen involvement in the allocation process, a Citizens Advisory Committee was established and a public hearing was held on February 21, 2013 to receive citizen input on the allocation of these funds; and WHEREAS, the proposals have been reviewed by the CDBG Citizens Advisory Committee based on the needs of low and moderate income persons and the other National Objectives to benefit the maximum number of people; and WHEREAS, the City Council held a public hearing on March 20, 2013 to receive public input on the allocation of these funds; and rQ Resolution No. Page 2 of 3 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Manager or his designee is authorized to submit the Plan to the United States Department of Housing & Urban Development, which accurately reflects the 2013-2014 CDBG budget and projects approved by the City Council, and authorizes the City Manager to appropriately adjust the 2013-14 CDBG Budget amount, and the respective Subrecipient Agreements. SECTION 2. The goal of the plan is to integrate housing, economic, human and community development in a comprehensive fashion so that community living may be enhanced. The City's Five-Year Consolidated Plan (ConPlan) integrates the application, planning and citizen participation for the CDBG program. The ConPlan was completed in May 2010 and will be updated every five years. An Annual Action Plan is required every year to describe the housing and community development policies and programs to be undertaken by the City using federal, state, local and private funds for the next year. A public hearing will be conducted on Thursday, February 21, 2013 before the Citizens Advisory Committee (CAC) to provide Palm Springs citizens, community organizations & other interested parties an opportunity to offer comment regarding the City's Annual Action Plan.
