CALIFORNIA, AMENDING SUBSECTIONS 92.16.01
D2 (M-1-P ZONE) AND 92.17,01.01 D.3 (M-2 ZONE)
OF THE PALM SPRINGS ZONING CODE,
MODIFYING THE REQUIREMENTS FOR
LOCATION OF AMBULANCE SERVICES IN THE
PLANNED RESEARCH DEVELOPMENT PARK AND
MANUFACTURING ZONES OF THE CITY
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS ORDAINS:
SECTION 1. Subsection D.2 of Section 92.16.01 of the Palm Springs Zoning
Code is amended to read:
2. Ambulance services and accessory uses customarily incident to the
permitted use; provided that the site is located at least five hundred
(500) feet from any property zoned residential.
SECTION 2. Subsection D.3 of Section 92.17.1.01 of the Palm Springs
Municipal Code is amended to read:
3. Ambulance services and accessory uses customarily incident to the
permitted use; provided that the site is located at least five hundred
(500) feet from any property zoned residential.
SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary
thereof, to be published and posted pursuant to the provisions of law and this
Ordinance shall take effect thirty (30) days after passage.

SUMMARY
The Council is asked to consider a Zoning Ordinance Text Amendment that would
amend the text of the M-1-P and M-2 zones to allow ambulance services by Conditional
Use Permit provided they are further than five hundred feet away from any residential
zoned property.
RECOMMENDATION.

5,1114 ZTA Findings for a Minor Modification
STAFF ANALYSIS.
This amendment is proposed in order to bring consistency among the City's industrial
zones regarding the treatment of ambulance services Prior to 2004, the only restriction
placed on the location of ambulance services was that they must abut a major or
secondary thoroughfare.
On May 5, 2004, the City Council adopted a Zone Text Amendment changing the text of
the M-1 zone to allow ambulance services in the M-1 zone by Conditional Use Permit so
long as there was no residentially zoned property within a five hundred foot radius of the
proposed service site.
The issue that was resolved with the 2004 Zone Text Amendment was that of potential
noise nuisance in the adjacent residential neighborhoods caused by ambulance and
emergency vehicle sirens. However the issue remains unresolved in the M-1-P and M -
2 zones. These zones are often located as buffers between the airport and adjacent
residential zones.
The current Zane Text Amendment is initiated to resolve the problem in the remaining M
zones where ambulance services are allowed by Conditional Use Permit, by bringing
the standards of the M-1 zone into the M-1-P and M-2 zones
By adopting the proposed Zone Text Amendment, staff has determined that the
regulations would.
1. Assure consistency in all M zones,
2. Prevent ambulance service centers from being located too close to abutting
residential zones,
3. Allow greater flexibility within the zone by removing the requirement for
placement on a major or secondary thoroughfare.
On July 12, 2006 the Planning Commission reviewed the proposed Zone Text
Amendment and voted to recommend approval by the City Council. (See attached
Planning Commission Meeting Minutes dated July 12, 2006).
ENVIRONMENTAL ANALYSIS AND NOTIFICATION
This project has been declared categorically exempt from environmental review per
Section 15305 (Minor Alterations in Land Use Limitations) of the California
Environmental Quality Act (CEQA).

WHEREAS, the Palm Springs Zoning Code allows ambulance service centers in

zones in a manner consistent with the requirements established for the M-1
zone,
WHEREAS, notice of a public hearing of the Planning Commission of the City of
Palm Springs to consider the Case 5.1086 ZTA was given in accordance with
applicable law; and
WHEREAS, on July 12, 2006, the Planning Commission conducted a duly
noticed public hearing on said project at which hearing the Commission carefully
reviewed and considered all of the evidence presented in connection with the
public hearing on the project, including but not limited to, the staff report, and all
written and oral testimony presented, and voted unanimously to recommend to
City Council the adoption of the proposed Zone Text Amendment, and
WHEREAS, notice of a public hearing of the City Council of the City of Palm
Springs to consider the Case 5.1086 ZTA was given in accordance with
applicable law; and

WHEREAS, on July 26, 2006, the City Council conducted a duly noticed public
hearing on said project; and
WHEREAS, the proposed Zone Text Amendment has been evaluated and has
been declared categorically exempt from environmental review per Section
15305 (Minor Alterations in Land Use Limitations) of the California Environmental
Quality Act (CEQA), and
WHEREAS, the City Council has carefully reviewed and considered all of the
evidence presented in connection with the public hearing on the project, including
but not limited to, the staff report, and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
ORDAIN AS FOLLOWS;
Section 1: The adoption of the proposed Zone Text Amendment is consistent
with the City's General Plan in that
a. General Plan Objective 5.21 requires adequate physical and visual
buffers between land uses characterized by differing functions,
intensity and/or density to ensure their compatibility and avoid conflicts,
and
b. General Plan Objective 621 requires minimized impact of traffic-
generated noise on residential and other noise-sensitive land uses.
C. General Plan Policy 7.1.3 requires driveway and/or local street
intersection consolidation along major thoroughfares.
Section 2: The proposed Zone Text Amendment is consistent with the intent of
the Zoning Ordinance in that medical and similar office use and associated
support facilities are encouraged in Industrial zones, and within the Airport land
use area those uses that are reasonably necessary for the proper operation of an
airport are encouraged. An ambulance service center is consistent with these
policies.
Section 3: Based upon the foregoing, the City Council does hereby amend the
Palm Springs Zoning Code as follows;
a. Section 92.16.01 (D 2) of the M-1-P Zone is amended to read:

b. Section 92.17.1.01 (D 3) of the M-2 zone is amended to read:

NOW, THEREFORE, BE IT ORDAINED that, based upon the foregoing, the City
Council does hereby approve Zone Text Amendment#5.1086.

PROJECT DESCRIPTION:
This project is comprised of two items, (1) a Zone Text Amendment and (2) a
Conditional Use Permit Both are related to ambulance service centers and are thus
presented together herein.
The proposed Zone Text Amendment (ZTA) would alter the text of the M-1-P and M-2
zones to allow ambulance services by Conditional Use Permit provided they are further
than five hundred feet from any residentially zoned property. Approval of this Zone
Text Amendment will correct an unintended conflict created by a similar zone text
amendment that was approved May 5, 2004 for the M-1 zone and prevent possible
noise nuisance by restricting the distance between an ambulance service center and
any adjacent residential zone.

The Conditional Use Permit application by American Medical Response is requesting
permission to use an existing facility at 1111 Montalvo Way for an ambulance service
center. Approval of this CUP will allow American Medical Response to use the subject
parcel for their ambulance service in conformance with the Zone Text Amendment
noted above, and would only be effective if the Zone Text Amendment is approved by
City Council.
RECOMMENDATION:
1.) That the Planning Commission adopt the draft resolution attached to this report
recommending approval to the City Council of Case 5 1086, the adoption of a Zone Text
Amendment reading as follows
a. Section 92 16.01 (D 2) of the M-1-P Zane is amended to read:
Ambulance services, and accessory uses customarily incident
to the permitted use, provided that the site is located no closer
than five hundred (500) feet from residentially zoned property,
b. Section 92 17.1.01 (D 3) of the M-2 zone is amended to read:
Ambulance services, and accessory uses customarily incident
to the permitted use, provided that the site is located no closer
than five hundred (500) feet from residentially zoned property,
2.) That the Planning Commission approves a Conditional Use Permit conditioned on the
approval of the Zone Text Amendment by City Council, for American Medical Response
to operate an ambulance service center from an existing facility at 1111 Montalvo Way
subject to the conditions of approval in the proposed resolution attached to this report.

The current Zone Text Amendment is initiated to resolve the problem in the remaining M
zones (M-1-P and M-2) where ambulance services are allowed by Conditional Use
t Permit. Pending adoption by City Council of this Zone Text Amendment, the attached
Conditional Use Permit would enable American Medical Response to operate their
ambulance service from a location that is compliant with this amendment.

PRIOR ACTIONS:
On November 23, 2005, the Planning Commission authorized the Planning Department
to initiate a Zone Text Amendment to the ambulance service standards of the M-1-P
and M-2 zones to be consistent with the requirements established for the M-1 zone.
ANALYSIS:
The analysis of this project is two-fold, first to assess the conditions relating to the Zone
Text Amendment and second, to assess the findings that a Conditional Use Permit,
including findings related to the proposed Zone Text Amendment Approval of the CUP
is contingent on the City Council first approving the Zone Text Amendment.
ZONE TEXT AMENDMENT:
Ambulance services are an allowable use with a Conditional Use Permit in all M zones.
However these zones often abut residential zones, (there are approximately forty-nine
M-1-P parcels that are within five-hundred feet of residential property) and the Planning
Commission has become aware that when this activity is allowed to exist in close
proximity to those residential zones, noise nuisances from the sirens on the ambulances
becomes an acute problem This Issue was addressed in 2004 with a Zone Text
Amendment to the M-1 zone that prohibited ambulance services from locating in an M-1
zone if It was within 500 feet of an abutting residential zone
In reviewing the possible locations currently available to ambulance services in the M-1-
P zone, a substantial number of the sites within five hundred feet of residential
development also abut a secondary or major thoroughfare. In applying the current
ordinance, the majority of parcels allowing ambulance services are located across the
street from, and within five hundred feed of, established residential development. In
other words, the current standard sets up the possibility for noise related nuisances in
the adjacent residential zone.
The proposed ordinance change would continue to allow ambulance services to be
located in the M-1-P and M-2 zones, however it would require such uses to be located
further away from residential land uses, (consistent with the M-1 zone), thereby
reducing the likelihood of noise-related nuisance caused by incompatible adjacent land
uses.

In evaluating the proposed change, staff notes that, pursuant to the Zoning Ordinance,
the M-1-P zone "is intended to provide for and encourage planned industrial districts
compatible with surrounding or abutting residential zones and which would not in any
way depreciate the character of the resort community " The majority of M-1-P zoned
property is found buffering the airport from surrounding land uses or else adjacent to
Interstate 10.
Staff also notes that, pursuant to the Zoning Ordinance, the M-2 zone is intended to
provide for the development of industrial uses Which. do not in their maintenance,
assembly, manufacture or plant operation create by-products to any degree which will
adversely affect the resort-open-space environment of the city." The only areas zoned
M-2 within the City limits are north of Interstate 10 Currently, ambulance services are
allowed in the M-2 zone by Conditional Use Permit provided they are located on a major
or secondary thoroughfare The M-2 zones only abut a viable thoroughfare on Indian
Avenue north of the interstate. There are no M-2 zoned properties that are within five
hundred feet of residential property.
By adopting the proposed Zone Text Amendment, staff has determined that the
regulations would:
1. Assure consistency in all M zones,
2. Prevent ambulance service centers from being located too close to abutting
residential zones,
3. Allow greater flexibility within the zone by removing the requirement for
placement on a major or secondary thoroughfare.
CONDITIONAL USE PERMIT.
American Medical Response serves Palm Springs, the International Airport and
Riverside County with emergency ambulance and non-emergency transportation
services As growth in population has continued; they have outgrown their facility at
560 Williams Road They have located a leasable existing facility at 1111 Montalvo
Way that would accommodate their business needs and Is geographically well located
for their needs The parcel on which this facility is located is zoned M-1-P and is
designated land use "A" (airport) on the 1994 General Plan
As noted above, ambulance services and accessory uses are currently permitted in the
M-1-P zone with a Conditional Use Permit provided the site is located on a major or
secondary thoroughfare. Montalvo Road Is a local street and the site in question is 0.22
miles from the nearest major thoroughfare of Gene Autry Trail.

The Findings for approving a Conditional Use Permit are as follows;
The commission shall not approve or recommend approval of a conditional use
permit unless it finds as follows.
a That the use applied for at the location set forth in the application is
properly one for- which a conditional use permit is authorized by this Zoning
Code;
Section 92.16 01 (D 2) allows ambulance services as a conditional use in the M-1-P
zone.
b That the use is necessary or desirable for the development of the
community, is in harmony with the various elements or objectives of the general
plan, and is not detrimental to existing uses or to future uses specifically
permitted in the zone in which the proposed use is to be located,
Ambulance services are a necessary and desirable use in the City. The M-1-P zone is
intended to provide for planned industrial districts compatible with surrounding or
abutting residential zones and which would not in any way depreciate the character of
the resort community The added provision regUiring ambulance uses be located a
minimum of five hundred (500) feet from abutting residential uses further assures the
proposed use will not be detrimental to adjacent land uses.
C. That the site for the intended use is adequate in size and shape to
accommodate such use, including yards, setbacks, walls or fences, landscaping
and other features required in order to adjust such use to those existing or
permitted future uses of land in the neighborhood,
The parcel at 1111 Montalvo is adequate to accommodate the requested use
d That the site for the proposed use relates to streets and highways
properly designed and improved to carry the type and quantity of traffic to be
generated by the proposed use,

1111 Montalvo is sited on the corner of Tachevah Road and Montalvo Way. Both
streets are fully improved with a 40 foot paved width, curb to curb. Vehicular access is
adequately accommodated on these streets. The distance from the TachevahlMontalvo
corner to Gene Autry is two-tenths (0.2) of a mile. The Montalvo parcel is well suited for
this use in that it allows vehicles from the ambulance service center Immediate access
onto the local street without having to deal with congestion or traffic of a larger
thoroughfare and allows efficient access to both northbound and southbound movement
on Gene Autry by entering this major thoroughfare at an Intersection, rather than mid-
block.
e. " That the conditions to be imposed and shown on the approved site
plan are deemed necessary to protect the public health, safety and general
welfare..."
Conditions of approval are included in the proposed resolution.
CONCLUSION:
The proposed ordinance change allows the placement of ambulance services within
multiple zones in the City while ensuring a reasonable buffer to minimize noise-induced
nuisance in residential areas. Furthermore, it resolves an unintended conflict between
the M-1 zone and M-1-P and M-2 zones by establishing the same criteria for evaluating
the location of such services in all M zones within the City. Staff is recommending
adoption of a resolution recommending approval tc the City Council of Case 5.1086 —
ZTA.
The Conditional Use Permit is consistent with the zone, conforms to the above
recommended zone text amendment, and meets the findings required for approving a
CUP in this zone Staff is recommending adoption of a resolution approving CUP
application Case number 5 1086, subject to conditions
ENVIRONMENTAL DETERMINATION:
An Environmental Initial Study was prepared for this project under the guidelines of the
California Environmental Quality Act (CEQA), and it has been determined that this
project will not have an adverse effect on the environment, and therefore a Negative
Declaration has been prepared.
NOTIFICATION:
As the proposed Zoning Ordinance amendments are citywide, the number of property
owners to be noticed exceeds 1,000, pursuant to California Government Code Section
65091, a 1/8 page advertisement for the proposed amendments was placed in the

Desert Sun. The Conditional Use Permit Is parcel specific, and thus notice was given to
adjacent property owners within a 400 foot radius of the subject parcel. In addition, the
Negative Declaration was circulated to local agencies and interested parties for their

Vice Chair Hochanadel requested clarification on the conditions not
allowing paging systems.
M/S/C (Hutcheson/Ringlein, 4-0, 3 absent/Cohen, Roath, and
Shoenberger) To approve the Major Architectural and recommend the
approval of the Zone Text Amendment and General Plan Amendment to
City Council, with the following modifications:
-Authorization must be obtained with the City of Palm Springs for any
changes to the frontage road by the applicant and new owner.
-Condition #17, to read as follows: No sirens, paging systems or any type
of signalization will be permitted, except approved alarm sytems.
5. Case 5.1086 ZTA / CUP - An application for a Zone Text
Amendment to amend the text for the M-1-P and M-2 Zones to allow
ambulance services, and a Conditional Use Permit for American
Medical Response to operate an ambulance dispatch and service
deployment center located at 1111 Montalvo Way, Zone M-1-P,
Section 7. To recommend approval of the Zone Text Amendment to
City Council and approve the Conditional Use Permit.
Associate Planner, Ken Lyon, gave background information as outlined in
the staff report dated July 12, 2006. He gave further details relating to the
M-1-P and M-2 zones.
Chair Marantz opened the Public Hearing.
Wayne Ennis, Operations Manager, gave additional information and
commented that they have outgrown the building and accessibility to the
major thoroughfare is difficult.
There being no further comments, the Public Hearing was closed.
Vice Chair Hochanadel commented this site is perfect and requested
clarification on the type of mechanic work performed.
