SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 1823,
REGARDING REGULATIONS PERTAINING TO FIRE COMMAND CENTER
REQUIREMENTS

SUMMARY:
The City Council will consider adoption of Ordinance No. 1823.
RECOMMENDATION:
Waive the reading of the full text of the ordinance and adopt Ordinance No. 1823, "AN
ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, REPEALING SUBSECTION
21 OF SECTION 8.04.510 OF THE PALM SPRINGS MUNICIPAL CODE, PERTAINING TO
FIRE COMMAND CENTER REQUIREMENTS."
STAFF ANALYSIS:
On June 19, 2013, Ordinance No. 1823 was introduced for first reading, by the following vote:
ACTION: 1) Waive the reading of the ordinance text in its entirety and read by title only; and 2)
Introduce on first reading Ordinance No. 1823, "AN ORDINANCE OF THE CITY OF PALM
SPRINGS, CALIFORNIA, REPEALING SUBSECTION 21 OF SECTION 8.04.510 OF THE
PALM SPRINGS MUNICIPAL CODE, PERTAINING TO FIRE COMMAND CENTER
REQUIREMENTS FOR BUILDINGS." Motion Mayor Pro Tern Mills, seconded by
Councilmember Hutcheson, and carried 4-1 on a roll call vote.
AYES: Councilmember Hutcheson, Councilmember Lewin, Mayor Pro Tern Mills, and
Mayor Pougnet.
NOES: Councilmember Foat.
This report provides for the City Council to waive further reading and adopt the ordinance. The
ordinance shall be effective 30-days from adoption.

AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, REPEALING SUBSECTION 21 OF SECTION
8.04.510 OF THE PALM SPRINGS MUNICIPAL CODE,
PERTAINING TO FIRE COMMAND CENTER REQUIREMENTS
City Attorney Summary
The current provisions of the Palm Springs Fire Code require the
provision of a fire command center in buildings over 60 feet in
height. Section 508.1 of the State Fire Code requires a fire
command center in buildings over 75 feet in height. This Ordinance
repeals the local fire code requirement for buildings over 60 feet in
height; however, the minimum State Fire Code Section 508.1
requirement remains in effect and fire command centers in
buildings over 75 feet in height will continue to be required.
The City Council of the City of Palm Springs ordains:
Section 1. Subsection 21 of Section 8.04.510 of the Palm Springs Municipal Code is
repealed.
Section 2. The Mayor shall sign and the City Clerk shall certify to the passage and
adoption of this Ordinance and shall cause the same, or the summary thereof, to be
published and posted pursuant to the provisions of law and this Ordinance shall take
effect thirty (30) days after passage.
PASSED AND ADOPTED THIS DAY OF 2013.
