I appreciate your taking my letter yesterday evening for the City Council meeting. It also was 74-W �G(,,�tf�
very educational see our local goverrunent at work. As I had stated yesterday within the letter
that I made available, I am submitting this request to be excluded from any moratorium that may
or may not be passed on July 26`h, 2006 at this Emergency meeting.
At the beginning of April, 2006 we wrote a Contract on the property known as 588 San Lorenzo
Rd, as well as the Vacant lot portion of the North/East Conner of San Lorenzo and Random. One
of the options that makes the most sense on this properly is Condo Conversion.
I accompanied my client down to the planning department at the City of Palm Springs while he
(being the CEO of Foundations Financial Enterprise Group, LLC) Thomas Bauer investigated
what it would take to do a Condo Conversion as it pertains to the cities requirements.
No person had voiced any concerns about my client doing this condo conversion. The concerns
were merely Density/Carport requirements and Set Back restrictions.
The only way to make this whole thing work was to buy the vacant lot next to 588 San Lorenzo
in order to obtain the necessary lot Square Footage for converting the existing 13 units. This took
us months to finally have this lot available for sale.
Though the buyer, Foundation Enterprise Group, LLC has submitted no official application for
this conversion we did go down to the city in the later part of April, 2006 to see what the
requirements were. We signed in at the Planning desk which was very busy as usual, and David
working the counter at the time was very helpful and infonuative, extended copies of the
required Set-Backs, Density, and Carport requirements.
As of today after speaking with Douglas Holland, City Attorney... it is our understanding that
there will be no Emergency meeting for a Moratorium on such Condo Conversions at this time,
and that it is being investigated as to how the city and it's citizens would like to proceed to
protect large scale affordable family dwelling units from bein; converted into Condo's and to
have a greater understanding of bow Condl-lotels which bring in TOT tax for the City should be
approached etc...
As per the advise of the city, and to help ensure our case for exclusion from such a moratorium
on Condo Conversions, we are moving forward and trying to submit ASAP the applications for
this simple conversion, or essentially a face lift for the building itself.
In short we want to voice our concern for the properties known as 588 San Lorenzo, and
Parcel# 508-191-015 Lot 19 of which are already under contract and approximately two weeks
from closing escrow, in which the buyer has already released Contingencies based upon their
investigation of city requirements for said conversion.
It puts Foundations Enterprise Group, LLC, at a potentially bad liability situation if this escrow
which is due to close on August 5`", 2006 does not close due to such a moratorium and investor
pull outs.
We appreciate your consideration in this matter, and hope that you can relate too, and appreciate
our precarious situation of needing this exclusion.
We look forward to submitting our formal application for this conversion and wanted to be put
on file for this potential scenario, and believe that this conversion will make a great improvement
in that particular area of South Palm Springs for it's visitors and residence.
