HomeMy WebLinkAbout23377 RESOLUTION NO. 23377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, MAKING CERTAIN FINDINGS AND APPROVING AN ENERGY SERVICES CONTRACT WITH CHEVRON ENERGY SOLUTIONS COMPANY. WHEREAS, California Government Code Sections 4217.10 through 4217.18, authorize the City Council to enter into an energy services contract for the implementation of energy related improvements if the City Council finds that it is in the best interest of the City to enter into such energy services contract and that the anticipated cost to City for thermal or electrical energy or conservation services provided by the energy conservation facility under the contract will be less than the anticipated marginal cost to the City of thermal, electrical, or other energy that would have been consumed by the City in the absence of those purchases; and WHEREAS, The cost to the City for the energy services contract by and between the City and Chevron Energy Solutions Company for the implementation of certain energy measures for thermal or electrical energy or conservation services will be less than the anticipated marginal cost to the City of thermal, electrical, or other energy that would have been consumed by the City in the absence of the implementation of the improvements under the energy services contract. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: SECTION 1. That (1) it is in the best interest of the City of Palm Springs, California to enter into an energy services contract with Chevron Energy Solutions Company for the implementation of certain energy related improvements to City facilities, and (2) the anticipated cost to City for thermal or electrical energy or conservation services provided by the energy conservation facility under the contract will be less than the anticipated marginal cost to the City of thermal, electrical, or other energy that would have been consumed by the City in the absence of those purchases. SECTION 2. The City Council approves in substantially the form presented at this meeting, with such insertions, omissions and changes as shall be approved by the City Manager, subject to final review and approval of the City Attorney, and authorizes the City Manager to execute the energy services contract by and between the City and Chevron Energy Solutions Company for the implementation of certain energy related improvements to City facilities in accordance with these findings and California Government Code Sections 4217.10 through 4217.18.
