SUSPENSION OF CERTAIN REGULATORY ORDINANCES TO NBC
"AMERICAN DREAM BUILDERS" FOR SUNDAY, OCTOBER 6 THRU
SATURDAY, OCTOBER 12, 2013 FOR 24-HOUR 7 DAY PER WEEK
FILMING AND REHABILITATION OF TWO HOMES LOCATED AT 2680
AND 2730 STARR ROAD.

SUMMARY
The City Council will consider the granting of the film permit and authorizing the
suspension of certain regulatory ordinances for filming the rehabilitation of two homes
on Starr Road for 24-hours per day for 7 days.
RECOMMENDATION:
1. Authorize the issuance of a Film Permit, pursuant to Palm Springs Municipal
Code Section 5.76.070, to NBC "American Dream Builders" to film the major
renovation of two homes located at 2680 and 2730 Starr Road, from
October 6, 2013 through October 12, 2013, including 24-hours per day filming
and construction.
2. Authorize the City Manager to close Starr Road from East Desert Willow Circle to
Francis Drive, and Sycamore Circle and East Laurel Circle, with access allowed
only by residents and invited guests.
3. Approve the suspension of Palm Springs Municipal Code Chapter 11.96 [Parking
RV's on the street in the residential area, Chapter 11.74 [Noise and Construction
Noise Hours], and Chapter 93,21.00 [Lighting Ordinance].
STAFF ANALYSIS:
The City's Film Permit Office has received an application from NBC "American Dream
Builders" to film the major renovation of two homes located on Starr Road. The permit

Film Permit Issuance
seeks filming and construction 24-hours per day for 7-days, Sunday, October 6 through
Saturday, October 12, 2013. [See attached Film Permit Application]. The production
would also require the City Council to suspend certain regulatory ordinance such as RV
parking on residential streets, noise, construction hours and dark sky lighting ordinance.
Such a request may potentially have an impact to the residents in the immediate area,
and a severe impact to certain properties nearest the proximity to the filming and
construction area. The request includes the closure of streets for production vehicles
including 5 generators, 20 vehicles and trucks, 10 RV's, and 150 film and construction
personnel in the immediate area.
City Staff requested the Producer commence with a neighborhood notification, including
personal contact to the extent reasonable under the circumstances, and an acceptance
procedure prior to considering the issuance of a permit. Attached is the information as
submitted by the Producer regarding the outreach and community acceptance of the
request and issuance of a permit.
Generally, the film permit request was accepted by a majority of the surrounding
community. Two owners of the properties located at 503 and 580 E. Laurel Circle, two
of the properties that would be the most negatively impacted by the activities, have not
consented to the permit, and have expressed concerns to City Hall regarding the
issuance of the permit.
The film permit has been vetted through the SEPT process and has been preliminarily
approved by Fire, Police and other City Departments affected by the issuance of the film
permit. However, the Police Chief remains concerned about the impacts of a 24-hour
operation.
FISCAL IMPACT:
NBC American Dream Builders will be responsible for all costs incurred by the City for
Police and Traffic Street Closures, and on-call Building Inspection Services. The City
Council has currently waived filming permit fees as a component of the Film Friendly
Program.
The Producer has submitted information that indicates how the Producer will highlight
and acknowledge the City of Palm Springs, and the Economic Impact in terms of hotels,
catering and other expenditures within the City and surrounding area will be

of both of them. I have offered them monetary compensation for their signatures and use of property
during production. I have also offered accommodations during the week, should they choose to accept,
that would be in the form of a vacation rental through a local company called Oranj Palm vacation Rentals.
The response from the offer above is still pending.

Met one of the residents. He manages commercial properties in LA and lives there during the week, only
coming out to Palm Springs on various weekends, sometimes for three or four days. He is pretty business
savvy about Hollywood. Part of his reason for declining to sign is because he "wants to get away from the
noise of LA" when he comes out here, the other reason is that he doesn't trust that we'll be responsible
and clean up after ourselves (he was very descriptive about how other film shoots he's been around leave
a mess behind). I have assured him that we will be a courteous and responsible crew.
I have offered offsite accommodations, but he declined. I have also offered monetary compensation for his
signature and use of property during production, to which he replied that he would speak with his partner
about it and get back to me. As of now he hasn't gotten back to me, but I remain hopeful that we can
reach an agreement of some sort.
The blue square is a resident at 2522 N. Starr, whom I've been told by several neighbors to stay away
from. I have not met this resident but have been told Palm Springs PD will have a file on him. He is away
from the build sites but we should have a plan in place should he approach from up the street.
2. Community and Economic Impact
By bringing "American Dream Builders" to Palm Springs, we hope to have a lasting positive impact on the
neighborhoods and communities we visit. Homes will be renovated at no cost to the homeowners and
adjacent property values should get a boost as well, following completion. Our estimated economic
impact to the City of Palm Springs during our week of production should also be significant and can be
broken down as follows:

Furniture $ 10,000.00
Trades & Materials $150,000.00
Police/Fire $ 15,000.00 (2 officers @ $71/hr x 15 hrs/day x 7 days)

3. Exposure for Racauet Club Estates and the City of Palm Springs
"American Dream Builders" will be featuring unique architectural challenges each week for the design
teams competing on the show. In the case of our episode in Palm Springs, nationally known for its Mid
Century Modern homes, there will be onscreen exposure for Racquet Club Estates and the community as a
whole, with emphasis on the architecture featured.
We intend to showcase many positive aspects of the surrounding Palm Springs area on camera, including
sending our designers into the shopping district in downtown to visit local merchants, speaking about Palm
Springs as a vacation "dream destination," and capturing b-roll footage of many of the city's iconic places
for inclusion on the show (these could include the City of Palm Springs sign, the tram ride, the Marilyn
statue, etc. but have not yet been identified).
I hope this email provides the kind of information we can all fee comfortable with presenting to the city
council. I believe the overwhelming support I've been afforded in the Racquet Club Estates neighborhood
should warrant the council granting us the permission we seek for the lifting of the noise ordinance and
our permit request, although I do understand that there is more work to do and I will strive to obtain the
necessary missing signatures.
Should this information be presented to the city council, on what date will the meeting topic be discussed?

Dear Racquet Club Estates residents,
Two of your neighbors,at 2680 and 2730 N.Starr Road,may be selected to appear on NBC's new prime time television
show"American Dream Builders." Our proposal to you,the residents of the community,is for our show to send two
teams of professional builders,architects,and interior designers to work around the clock,24 hours per day for six days,
to renovate their homes.
This is a very exciting event and should have a lasting positive impact on your neighborhood. As this would be a large
project,done in one week,we hope for the support of your neighborhood to execute an undertaking of this size. Should
our proposal move forward,please know that we intend to hire local craftspeople,shop in your community,and support
the local economy as much as possible.
Our scheduled start date is Sunday,October 6th. Production vehicles would arrive in the morning and set up during the
day. Construction on the homes would begin the following day,Monday,October 7th,and continue non-stop for the
following six days,with completion at the end of the day on Saturday,October 12th.
Please note that we will apply to the City of Palm Springs for road closures and posting of"No Parking"signs to facilitate
the safe and timely delivery of equipment and materials to the job sites. We will also work with local law enforcement to
ensure public safety on the roadways. The closures would be in effect from Sunday,October 6th,through Saturday,
October 12th,on the following streets:
- Closure: N. Starr Road between E. Desert Willow Circle and E. Francis Drive, including East
Laurel Circle and Sycamore Circle.
- Traffic control points: "No Through Traffic" &"Resident Traffic Only"signs will be in place on
N. Starr Road between E. Racquet Club Road and E. Francis Drive.
All residents living within the closures would be given passes for their vehicles and will be able to enter and exit
their homes without interruption. Neighborhood services like mail delivery,trash pickup,gardeners,and the like
would not be affected. The closures would only apply to through traffic and non-residents.
As this would be a full-scale construction project,it brings with it some inconveniences. Noise,lights,and vehicle traffic
would be present throughout the renovation schedule. We will do our best to address these inconveniences and hope for
your support so that the residents at 2680 and 2730 N.Starr Road may realize their opportunity of a newly renovated
home.
We would like to speak with you in detail about what it would mean to film this show in your neighborhood. Please call
us at your convenience so that we can answer any questions you may have and explain the nature of our show in detail.

As a resident of Racquet Club Estates,I would like to demonstrate my support for the
residents at 2680 and 2730 N. Starr Road and the attempt to bring the show"American Dream
Builders" to our neighborhood.
I understand that in order for these residents to receive makeovers for their homes, a
construction crew will propose to work around the clock, 24 hours per day,beginning Sunday,
October 6th,and continuing through Saturday,October 12th,for a total of seven (7) days. As this
will be a full-scale construction project, I am aware that it brings with it certain inconveniences. I
am willing to be inconvenienced by the noise,lights, and vehicle traffic so that the residents of
our neighborhood may realize their dream of a newly renovated home.
I also understand that a production crew will be on site to film the activity for the duration
of the project and that it will be necessary to restrict traffic flow and parking on N. Starr Road and
