Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY Parcel Map 7883, Book 25, Page 15, offered portions of El Cielo Road for public use and street purposes, shown as Parcel 1 and Parcel 2 on said parcel map. The City Clerk did NOT accept the dedication pending completed street and sidewalk improvements along El Cielo Road. Street and sidewalk improvements for El Cielo Road have been completed in 1976 as part of a City Project, after parcel map was recorded, and is attached as Exhibit "A". City Council approval is required to accept the public right-of-way offered by Parcel Map 7883. The Streets & Highways Code of the State of California requires a resolution by the City to accept a city street or road into the city street system for maintenance. RECOMMENDATION: 1) Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACCEPTING RIGHT-OF- WAY FOR PORTION OF EL CIELO ROAD, SHOWN AS PARCEL 1 AND PARCEL 2 ON PARCEL MAP 7883, BK 25/15, WITHIN SECTION 18, TAS., R.5E.; FILE R 13-10" STAFF ANALYSIS: Street improvements for El Cielo Road were completed as part of City Project 79-21, and are hereby attached as Exhibit "B". Division 2.5 "City Streets", Chapter 1 "Construction and Maintenance", of the California Streets and Highways Code outlines the process to follow for accepting city streets into the city street system for maintenance. In accordance with Section 1806 (b) of the Code, no public or private street or road shall become a city street or road until the governing body, by resolution, has caused the street or road to be accepted into the City street system. DEDICATIONS October 2, 2013 Page 2 only adopt a Resolution citing specific facts that allows for the dedication of the street right-of-way; a Public Hearing is not required. The City of Palm Springs General Plan, adopted in 2007, designates this portion of El Cielo Road between Tahquitz Canyon Way and Ramon Road as a Major Thoroughfare with a minimum right-of-way width of 100 feet (50 feet half -width). Said Parcel Map 7883 widens and completes the dedication of a portion of El Cielo Road to its ultimate right-of-way half -width from 40 feet to 50 feet. Staff recommends that the City Council adopt the attached Resolution, which will accept the right-of-way for a portion of El Cielo Road, shown as Parcel 1 and Parcel 2 in Parcel Map 7883, BK 25/15, found in Section 18, Township 4 South, Range 5 East. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACCEPTING RIGHT-OF- WAY FOR A PORTION OF EL CIELO ROAD, SHOWN AS PARCEL 1 AND PARCEL 2 ON PARCEL MAP 7883, BK 25/15, WITHIN SECTION 18, TAS., R.5E.; FILE R 13-10. WHEREAS, the County of Riverside, California, approved and recorded Parcel Map No. 7883 on June 14, 1976, said map being in a portion of the Southwest one -quarter of the Southwest one -quarter of Section 18, T.4 S., R.5E., San Bernardino Base and Meridian. WHEREAS, said Parcel 1 and Parcel 2 were offered for dedication on said Parcel Map No. 7883, Map Book 25, Page 15, but NOT accepted by the City Clerk of the City of Palm Springs until street improvements along EL CIELO ROAD had been completed and accepted by the City Council; WHEREAS, curb, gutter, and pavement widening street improvements to EL CIELO ROAD were completed as part of City Project 79-21. WHEREAS, Division 2.5 "City Streets", Chapter 1 "Construction and Maintenance", of the California Streets and Highways Code (Section 1806 et. seq.), outlines the process to follow for accepting city streets into the city street system for maintenance. WHEREAS, Pursuant to Section 1806 (b) of the California Streets and Highways Code, no public or private street or road shall become a city street or road until the governing body, by resolution, has caused the street or road to be accepted into the City street system THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Palm Springs, hereby accepts the offer of dedication made for public use and street purposes, and public utility purposes, on that portion of EL CIELO ROAD, represented by Parcel 1 and Parcel 2 on Parcel Map No. 7883, Book 25/15, recorded June 14, 1976 and attached as Exhibit "A" and made a part thereof. SECTION 2. Pursuant to Section 1, the City of Palm Springs declares that the acceptance of the offer of dedication to the City of Palm Springs on behalf of the public for said purposes that said portion of EL CIELO ROAD is hereby recommended for acceptance by the City Engineer of the City of Palm Springs. SECTION 3. Pursuant to Section 1806 (b) of the California Streets and Highways Code, the City Council hereby accepts that portion of EL CIELO ROAD, represented by Parcel 1 and Parcel 2 on Parcel Map No. 7883, Book 25/15, recorded 1E Resolution No. Page 2 June 14, 1976, into the City street maintenance system. SECTION 4. The City Clerk shall record a certified copy of this Resolution in the Office of the Riverside County Recorder. ADOPTED this 2nd day of October, 2013. David H.
