Judy Deertrack 1333 South Belardo Road, Apt 510 Palm Springs, CA 92264 To the City Council Wednesday, December 4, 2013 Palm Springs, California Re: Item No. 1A/City Council Agenda 12.04.13 Amendment to Ordinances 94.02 & 94.10 To the Honorable City Council: Public Notice Requirements My request to the City Council is to first thank you for responding to the need for better public notice provisions. This new ordinance was your response, and I and many others are grateful. I am asking for one additional consideration that was excluded in the new ordinance, and that is notice to renters; and particularly where either the applicant or the landowner of the project has tenants affected by that project. Notice in that circumstance seems a matter of fairness. Public notice provisions should include renters because renters are equally, if not more, impacted than land owners by the results of land development. Landowners do not always live at their property location. Impacts are by no means exclusively economic, but are most often quality of life; noise, disturbance, visual intrusion, compatibility between residential and commercial. Renters are also often are under long- term leases where they do not have the option of leaving an area during construction noise or after significant changes have occurred. This happened with the nearby Dakota Project, where distressed tenants met with their landowner (also the developer), and expressed they wanted the right to leave if the project developed. Renters are also generally in a lower socio-economic group from landowners. Excluding them from notice has a disproportionate impact on low-income people, on senior citizens, and on minority populations, because these groups often rent rather than buy. Public notice is an important public right, and should be extended to all income groups equally. We now have another project next to Tahquitz Mesa Villas just approved under an Architectural Permit, the Hacienda Cabana and Beach Club Project, next to the Creekside Inn Restaurant. This project may be under appeal ONLY because no tenants were notified under the ordinance, and we did not get the right to question (1) why it did not proceed under a Use Permit and go to the Planning Commission, and (2) what the neighborhood impact will be of a commercial pool, two bocce courts, 90 cabanas, special events areas, and outside bar. That is a lot of outdoor activity, and no nearby renters were notified, even though the project is surrounded by multi-family residential and mobile home parks. For all of these reasons, I hope the City will reconsider its notice provisions. Land Use Permits (LUP's) currently only require administrative review. Currently the types of uses allowed by LUP include temporary parking areas, circus, carnivals, seasonal sales such as pumpkins and trees, daycare and similar types of uses. Within individual zones there are additional uses that may be approved by LUP. The proposed change adds notification via e-mail to neighborhood organizations within 1/2 mile of the proposed site so if there are neighborhood issues they may be brought to the attention of city staff. Also, a new section of the code regarding procedures is proposed to be added to ensure that all cases that are submitted together as part of one project are processed together through to City Council. By current code, for example, if a project has a GPA, Rezone, CUP and Major Architecture, only the first two go through to the City Council. The latter two only go to the Planning Commission and are not heard unless they are appealed. With this text amendment all cases will be brought forward together for consideration. The City Council will have the opportunity to review all aspects of a case together at one time. ENVIRONMENTAL DETERMINATION The City of Palm Springs, in its capacity as the Lead Agency, under the California Environmental Quality Act (CEQA) has determined that the proposed zoning code text amendment is Categorically Exempt under Section 15305 of the State CEQA Guidelines. Section 94.12.00 is added to the Palm Springs Municipal Code to read: 94.12.00 Concurrent Processing All applications for any permit or entitlement for any property or project as provided in this Chapter and Article 9 of this Code shall be processed, reviewed, and heard concurrently. Notwithstanding any provision to the contrary, the final decision making body shall be the Planning Commission so long as each application for a permit or entitlement is not required to be heard by the City Council or is appealed to the City Council. In the event one or more of the permits or entitlements applied for are required to be heard of the City Council, or in the event of an appeal,the City Council shall be the final decision making body on all applications for the affected property or project. Section 3. The City Council determines that the proposed zone text amendment(Case 5.1312 ZTA) is Categorically Exempt from the provisions of CEQA under Section 15305 (Minor Alterations in Land Use Limitations) of the Guidelines for the California Environmental Quality Act because the proposed zone text amendment proposes only insignificant changes to the title and provides for increased notification for LUP's and requiring concurrent review of cases. 03 ORDINANCE NO.
