O� PALM IAA V N �� 4yyne 41FoIL City Council Staff Report DATE: March 19, 2014 Consent Calendar SUBJECT: THE CITY OF PALM SPRINGS GENERAL PLAN AND HOUSING ELEMENT 2013 ANNUAL REPORT TO THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT (HCD) FROM: David H. Ready, City Manager BY: Department of Planning Services SUMMARY The City Council will review a 2013 annual report in response to the State of California Code Section 65400 which requires each government body to prepare an annual report on the status and progress in implementing the jurisdiction's General Plan, including the Housing Element. The 2013 annual report includes the following: • Information on the jurisdiction's progress in addressing the regional housing needs allocation (RHNA), including the number of housing units permitted by income level. • The status of progress on programs (goals, policies and action items) listed in the housing element and, • Progress reports on efforts to remove governmental constraints to the production of affordable housing. • General Plan Amendments processed in 2013. • Major development applications processed in 2013. No action is required on these reports by the City Council, this is for information only. RECOMMENDATION: Receive and file. RELATED PRIOR ACTIONS: Rela>fed'Fte0ev it Prior AcfbM 10.24.07 The City Council adopted the updated Palm Springs General Plan, including a Housing Element. 02.17.10 The City Council adopted the 2010 Housing Element and was certified by California Department of Housin & Community Development on March 3, 2010 01.24.13 The City of Palm Springs submitted its 2011 & 2012 Housing Element Annual Progress Re ort (APR), to the Department of Housing & Community Development 01.15.14 The City Council adopted the current Housing Element of the General Plan and has been certified by the California Department of Housing & Community Development. ITEM NO.. City Council Staff Report March 19,2014 General Plan Annual Report Page 2 of 4 STAFF ANALYSIS: Housing Element.- The Housing Element contains policies and action items, many of which relate to encouraging the production of affordable housing and removing governmental impediments to the production of affordable housing. The annual report provides an opportunity for the State and interested members of the public to monitor the City's progress in achieving its stated goals and policies related to removing impediments and promoting the production of affordable housing of all kinds. This Annual Report covers the planning period of 2013. Many of the policies and action items within the Housing Element require changes and upgrades in the City's zoning Code, Municipal Code and other documents. These changes may include zone text amendments, change of zone, and/or general plan amendments that resolve inconsistencies between them. Below are some recent activities that staff has undertaken in support of the housing element policies: • An affordable housing webpage was developed on the City of Palm Springs website that provides a directory of resources for those seeking affordable housing and related services. • On December 31, 2009, the Roy's Desert Resource Center (DRC), was opened as the first comprehensive homeless center built in the western Coachella Valley. Roy's DRC is located in Palm Springs and offers emergency shelter and several supportive services • On July 11, 2011, the City Council approved a Participation Agreement for $80,000 to rehab Nightingale Manor as a 10 individual studio apartment units for permanent supportive housing program. The project has an affordability covenant of 55 years for low income households (less than 60% of medium income). The Project was completed in June 2013 and clients moved in the latter part of summer 2013. General Plan Amendments: The General Plan was amended four times in 2013. The four amendments were all related to the Land Use Element of the General Plan. Three of the amendments were initiated by the City and the last one was applicant-driven. The amendments included the following: • 5.1252-GPA: An applicant-driven text amendment to the General Plan to allow renewable energy uses within the "D" (Desert) Land Use designation and to construct and operate a 5.0-megawatt solar energy conversion system consisting of 17,000 PV panels on approximately 39.7 acres of a 134.3-acre site located at 5400 North Indian Canyon Drive. • 5.1294-GPA: This General Plan Map Amendment was initiated by the City to reclassify approximately 18.8 acres from their various General Plan designations to HDR (High Density Residential) to allow up to thirty (30) units per acre. The amendment was required to increase and facilitate the production of affordable housing, consistent with the city's goals, objectives, and policies. • 5.1299-GPA: This map amendment was initiated by the City to change the land use designation from "O" (Office) to "MDR" (Medium Density Residential) for zoning 2 City Council Staff Report March 19,2014 General Plan Annual Report Page 3 of 4 consistency on a roughly 35,766 square foot parcel located at the northeast corner of East Tahquitz Canyon Way and North Cerritos Road. • 5.1301-GPA: The text amendment was initiated by the City and it involves land use categories to eliminate closed ranges and retain higher density caps. Major Development Applications Processed: There were several applications processed by the City in 2013, three of these applications can be considered as major. The projects include the following: • The Garnet Solar Power is a 5.0 megawatt solar energy conversion system consisting of 17,000 photovoltaic panels on approximately 40-acre land. • The PS Sol is a Planned Development District consisting of 46 single-family residential units on individual lots in a gated community. The development is a subdivision of approximately 7.11 acres of 46 single family residential lots, private roadways, and shared private open space. • The Dolce Hotel is a 150-room hotel, 50 residential units and a parking structure on approximately 10.47 acres located at the northwest corner of Avenida Caballeros and Amado Road. CONCLUSION: Staff has identified additional issues that may require Council consideration within the year. The issues include such things as: • Amending the Zoning Code to redefine accessory units and make the development standards for these units consistent with State Law • Amending the Zoning Code to allow residential densities up to 70 units per acre for mixed use/multi use projects in the downtown core consistent with the General Plan. • Amending the Zoning Code to define and permit small residential care facilities serving six or fewer people in all residential zones and group homes for seven or more persons in zoning designations of R-2, R-3, and R-4 with a CUP. • Update the Zoning Map to make all properties consistent with the General Plan Land Use Map. • Create a density bonus ordinance and incentive program consistent with State Law that would encourage production of affordable residential units. The above listed programs that are part of the approved Housing Element represent the City's commitment to bringing its policies in line with State Housing Law and its adopted General Plan.
