HERO" SCULPTURE FOR PLACEMENT AT A FIRE STATION FACILITY. FROM: David H. Ready, City Manager BY: Community and Economic Development SUMMARY Pursuant to Palm Springs Municipal Code § 2.06.030, the City Council will review the decision of the Public Arts Commission to decline the donation of artwork titled R. Hero, by artists Karen and Tony Barone. RECOMMENDATION: 1. Open the public hearing and receive public testimony. 2. Review the decision of the Public Arts Commission regarding the donation of the sculpture R. Hero to the Public Art Collection and uphold, modify or reverse the decision. STAFF ANALYSIS: On April 10, 2014, the Public Art Commission considered an Application for Donation of Artwork submitted by artists Karen and Tony Barone, created by the artists to honor fire fighters and first responders. The proposal was for the donation of a sculpture a red R. Hero by a philanthropist and local patrons and philanthropist. The proposed artwork is similar to the blue R. Hero in the City's current art collection, as described in the attached application. The Commission reviewed and discussed the application submitted by the artists. The Commission considered the requirements set forth in the Palm Springs Public Municipal Code § 3.37.090(a)(7) which provides artwork to be displayed in the City represent Diversity — "The Public Arts Program should strive for diversity of style, scale, media, artists — including ethnicity and gender and equitable distribution of artworks and art ITEM NO. �� City Council Staff Report May 21, 2014-- Page 2 Public Arts Commission Decision places throughout the City." Upon consideration, the Commission recommended that the sculpture donation not be accepted for the following reasons: 1. The Commission discussed at length where to place the R. Hero donation; having one R. Hero sculpture in the Public Art collection and there may be a better place for the sculpture in the Community. 2. The Commission has the responsibility to provide as many expressions to as many people as possible in the community; and found the Barones' artwork is well represented in Palm Springs. The Commission found there is a limited public arts budget for conservation, restoration and installation; the expressions in the Barones' work are unique and bold; there are other communities that could also benefit from the R. Hero program. 3. The Commission found Palm Springs currently has representation from the artists — the Commission did not want to decline a donation, but concluded the addition of another piece by the artists maybe over saturation. Four Barone sculptures in the City may be one too many; having three is sufficient and the Commission concluded to provide the opportunity for another community to benefit from the donation. The Public Arts Commission unanimously took action as follows: "Respectfully decline this generous donation, we cannot make interpreted use of this piece at this time in this community, but we hope they can find another community nearby to make interpreted use of it." The City currently owns three Barone sculptures including a blue R. Hero Dalmatian puppy that was installed and dedicated in November, 2013 at Fire Station No. 3. The donation is conditioned upon: (i) the City place the artwork in front of a Fire Station in the City of Palm Springs; (ii) install a plaque acknowledging the generosity of the donors; and (iii) letter to the donors acknowledging the donation of the artwork. ALTERNATIVES: The City Council may consider the following action: 1. Overturn the decision of the Public Arts Commission, accept the donation of the sculpture, and authorize the City Manager to prepare and execute a contract for the donation of the artwork to the City of Palm Springs Public Art collection. 2. Affirm the decision of the Public Arts Commission to decline the donation of artwork. 02 City Council Staff Report May 21, 2014--Page 3 Public Arts Commission Decision FISCAL IMPACT: The proposed artwork to be donated to the Public Arts collection is valued at $17,820. Should the City Council accept the donation of the artwork the estimated cost to install the sculpture is approximately $5,000 which includes site preparation, lighting, artwork delivery and installation by an arts preparator. The installation costs may be paid from the Public Arts Fund. Ongoing maintenance costs are estimated to be approximately $700 per year, and will be paid from Public Arts Fund.. Racquet Club. 03 CITY OF PALM SPRINGS PUBLIC ARTS PROGRAM APPLICATION FOR DONATION OF ARTWORK ----------------------------------------------------------------------------------------------------------- The purpose of the Palm Springs Public Arts Program is to develop and maintain a visual arts program for the residents and visitors of Palm Springs; to add to the economic viability of the community; and to enhance the environment and unique character of Palm Springs. The Public Art Ordinance No.1479 authorizes the donation of works of art to be placed at appropriate locations within the City in a manner, which encourages public access and viewing of artwork. The City encourages applicants to submit an application to the City's Arts Administrator. The requirements and procedures for the Donation of Artwork to the City is as follows: Application Procedures The prospective donor shall submit, to the Public Arts Administrator, the following information as part of the Donation of Artwork Application: (a) Sketches, photographs or other documentation of sufficient descriptive clarity to indicate the nature of the proposed artwork, to be donated. (b) Additional samples of artist's work other than the proposed donation. (c) Background information about the Artist who created the proposed donation. (d) An appraisal or other evidence of the value of the proposed artwork, including acquisition and installation costs, if available. (e) Provide a description of maintenance procedures to maintain first class appearance and permanence of the artwork. (f) 8" X 10" photographs, 35 mm slides, digital pdf or jpg formats, graphics, or illustrations depicting several views of the artwork. (g) Provide evidence that (i) the Art is original; (ii) at the time of transfer hereunder, Donor is the sole owner of the Art and of all rights it possesses therein including copyright, trademark, and other proprietary rights; (iii) Donor has and will have full and sufficient right to assign all rights granted herein and to waive all rights relinquished herein;(iv) Donor is not under any obligation to transfer or sell any of the Art to any third party; (v) the Art has not been and will not be published under circumstances which have or will cause a loss of any copyright, trademark, or other proprietary rights therein; and (vi)the Art does not and will not infringe any patent, copyright, trademark, or other proprietary rights, privacy rights, or other rights of any third party, nor has any claim (whether or not embodied in a legal action, past or Revised 08-13-12 1 04 present) of such infringement been threatened or asserted, nor is such a claim pending, against Donor(or, insofar as Donor is aware, against any entity from which Donor has obtained any rights). Approval Criteria (a) Artwork shall be judged on artistic merit and appropriateness of the artwork to be placed at a site within the City. (b) Artwork shall be a one-of-a-kind piece. (c) Artwork shall be appropriate in scale, material, form and content for the immediate, general, social and physical environments with which they relate. Consideration shall be given to structural and surface integrity, permanence, and protection against theft, vandalism, weathering, excessive maintenance and repair costs. Approval Procedures (a) The proposed donation will be considered at a monthly public meeting of the Palm Springs Public Arts Commission. A subcommittee may be designated to consider all details of the proposed artwork, if necessary. (b) All details of the proposed donation, including the feasibility and expense of placing and caring for the work of art will be considered. (c) The commission will review and discuss the donation and will direct the Arts Administrator as to any questions to be asked of the Donor or Artist. A personal appearance of the Artist may be requested. (d) The Commission reserves the right to visit the artist to view the proposed donation. (An appointment will be made prior to visit.) (e) When all issues pertaining to the artwork are addressed, then the Commission will meet and vote on the acceptance or rejection of the artwork donation. (f) Commission reserves the right to refuse the piece at any time if artwork does not meet standards portrayed in the approved proposal. (g) An Agreement between the City and the Donor spelling out all requirements, For Transfer Of Artwork Ownership And Assignment of All Rights In Artistic Work, shall be executed prior to the City's formal acceptance of the Donation. Chair Sheehan thanked Ms. Wheeler for her time. 3. Sculpture Donation from Artists Karen and Tony Barone Discuss Acceptance of R. Hero Sculpture for Placement at a City Facility RECOMMENDATION: Direct Staff as Appropriate Ms. Henning gave a brief overview — The Barone's have contacted Ms. Henning to donate another R. Hero sculpture (this would be the 2n' R. Hero to be placed, if approved). Donna MacMillan has contacted the Barone's regarding acquiring the R. Hero sculpture to donate to the City. The sculpture is a 6' 2", dalmation puppy (fire engine red); the sculpture honors firefighters and first responders; they would like it placed in front of a Palm Springs Fire Station. The MacMillan's will be joined by Bunni and Rick Benaron in donating this gift to the City. In November of 2013, the first R. Hero sculpture was installed at Fire Station No. 3; prior to R. Hero being approved, the City purchased two other sculptures from Karen and Tony Barone for placement at the Palm Springs Animal Shelter, Mademoiselle Cocoa and Monsieur Pompadour. Commissioner Sand — very thankful to the donors to spend the energy and the money to make this effort toward public art; having said that, there was a lot of discussion and back and forth as to where to place the first R. Hero donation. Feels having one R. Hero in our collection suits the City; there may be a better place for it in the Community. Commissioner Edmundson — Feels three pieces of Barone art are very good for our collection, wonderful to have an offer of another donation; turning it away may not be the right path; kids would probably love this dog if installed at a school; would like to give this more thought. Commissioner Rowe—thank you to Donna MacMillan and the Barone's for their generosity, feels that as a public art commission our responsibility is to provide as many expressions to as many people as possible in this community; feels their work is well represented in Palm Springs at this time. We have a limited budget for conservation, restoration and installation; their expressions are unique and bold; would be nice to find another path for it; there are other communities that could benefit from the R. Hero program. Commissioner West—feels the same as Commissioner Rowe; love the art we have from the Barone's; appreciate the donation from Ms. MacMillan, in all fairness to our community, we have a great representation from these particular artists even though I would not want to turn something down, but we don't want to be saturated either. Vice Chair Romeo —agree with the prior comments of all the commissioners; four in the City of this size might be the tipping point of one too many; love the Barone's work and Donna MacMillan has been nothing but gracious around this whole valley, feels having three is sufficient and maybe it's time to let another community benefit from this. Chair Sheehan —agreed with all commissioners. Chair Sheehan called for a motion to deny the donation. 14 City of Palm Springs-Public Arts Commission Regular Meeting Minutes April 10,2014 Page 7 MOTION: by Commissioner Rowe, second by Vice Chair Romeo, to respectfully decline this generous donation, we cannot make interpreted use of this piece at this time in this community, but we hope they can find another community nearby to make interpreted use of it; unanimously carried 4. 2014-15 Public Art Budget Review Discussion Regarding Funding Allocations RECOMMENDATION: Direct Staff as Appropriate Mr. John Raymond, Director of Community and Economic Development addressed the commission regarding the 2014-15 proposed budget; very similar to the current budget year. Mr. Raymond spoke regarding developers fees (revenue), which is now up over the recession years, the projected revenue for the new budget is $180,000; the City budgets conservatively on the revenue side. Mr. Raymond briefly discussed personnel costs; materials, supplies and services, and special charges. (the commission was given a copy of the proposed 2014-15 budget). Chair Sheehan — asked about upcoming projects that will contribute to revenue in developer's fees; is anything being waived? Mr. Raymond — there are significant hotel projects that Council has just approved; Port Lawrence, final development plans were approved last week and they anticipate beginning to pull building permits at the end of this year. Dolce Hotel is in the same size category and in the same condition. There are other downtown projects (other than the mall); there are a number of fairly large mixed-use projects at the south end —the old Fairfield site next to the Rock Garden and across the street at the Cameron Center. In addition, the commission also receives revenue from residential developers; new home building is coming back fairly strong. Mr. Ready—The budget will not go for approval for a couple of months; leaves time for any comments or concerns the commission may have. Mr. Ready also advised the commission that the museum has stated that approximately 40,000 people have visited the museum due to the contribution made by the commission. Mr. Ready suggested forming a subcommittee or inviting museum staff to come to the commission to discuss the benefits of the annual contribution. Chair Sheehan thanked Mr. Raymond for his time. C. UNFINISHED BUSINESS 5. Discuss the Acquisition of the Artwork Shapes 11 by Artist Ted Denton for the Amount of $12.500.00, for Permanent Placement at the Palm Springs Chamber of Commerce, 190 West Amado. RECOMMENDATION: Direct Staff as Appropriate Ms. Henning — gave a brief overview, in September the commission approved acquiring this sculpture for permanent placement at the Chamber; the piece was originally installed as a loan and the agreement was between the artist and the Chamber. If we acquire the piece, the agreement will be between the City and the Chamber for a set amount of time. The Chamber, Ms. Nona Watson, has advised they are interested in having public art at their location, but not necessarily this piece. Staff informed the commission that if this piece is acquired they will need to find a new location for installation. Also, at this time there are 15 Palm Springs Municipal Code Public Arts Fee, Fund and Program 3.37.090 Criteria for artwork selection. (a) Eligible requirements for each project will be established by the public arts commission. Specifically excluded are artworks done by students under the supervision of art instructors to satisfy course requirements and artists who are members of the public arts commission. The following criteria shall be considered in the selection of artwork: (1) Quality of the artwork; (2) Media. All visual art forms may be considered, subject to limitations set by the selection jury or the arts commission; (3) Style. Artworks of all schools, styles, and tastes should be considered for the city collection; (4) Environment. Artworks and art places should be appropriate in scale, material, form and content for the immediate, general, social and physical environments with which they relate; (5) Permanence. Consideration should be given to structural and surface integrity, permanence, and protection against theft, vandalism, weathering, excessive maintenance, and repair costs; (6) Elements of Design. Consideration should take into account that public art, in addition to meeting aesthetic requirements, also may serve to establish focal points, terminate areas, modify, enhance, or define specific spaces, or establish identity; (7) Diversity.
