On March 8, 2008 the City Council granted a Resolution of Public Convenience and Necessity to the sell beer and wine for off premise consumption (Type 20 ABC License). The retailer has applied to upgrade its current Type 20 license (beer and wine) to a Type 21 (beer, wine, and distilled spirits) for off premise consumption. Currently the store has a section set aside for the sale of beer and wine and the introduction of distilled spirits is planned to complement existing merchandise and will not increase the size of the alcohol department. Cost Plus does not intend to compete with liquor and grocery stores but does intend to offer its customers unique, authentic and high quality spirits from around the world. They intend to identify with small local artisans/distilleries making high quality unique spirits and exclusive brands. The hours of operation shall be the normal store hours from 9:00 AM to 9:00 PM seven days a week. ANALYSIS: The applicant has applied for a "Type 21" license through the State of California Department of Alcoholic Beverage Control (ABC) for the proposed alcohol sales. The ABC summarizes the "Type 21" license as follows: (Package Store) Authorizes the sale of beer and wine and distilled spirits for consumption off the premises where sold. 02 City Council Staff Report July 2, 2014— Page 3 Case No. 5.1050 PCN —Cost Plus—World Market The proposed liquor license is located within a Census tract that exceeds the amount of off-sale licenses normally permitted; this is known as an "undue concentration" and is specifically defined by Section 23958.4 of the Business and Professions Code: As to off-sale retail license applications, the ratio of off-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of off-sale retail licenses to population in the county in which the applicant premises are located. The subject property is located within Census Tract #0448.07, which is bounded by East Palm Canyon Drive to the north, the Mountains to the south, Toledo Avenue to the west and Tribal Section 30 to the east (see attached census map). This tract currently has three (3) active off-sale liquor licenses. Two licenses are authorized for the tract based on its population. The ABC can only issue the proposed liquor license if the Council determines that the public convenience or necessity would be served. Cost Plus — World Market is located within the Smoke Tree Commons Shopping Center along with two other Type 21 licensed establishments (Jensen's, and Walgreen's). Proposed merchandise at the World Market will have a high price point focusing on local distilleries distinguishing themselves from nearby retailers. FISCAL IMPACT: No fiscal impact. Request for PUN for Type 21 License To Whom It May Concern: Cost Plus, Inc. opened its Cost Plus World Market store located at 2465 East Palm Canyon Drive, Building 4 in Palm Springs in mid-2008. This store sells a wide variety of home living and entertaining merchandise for the home as well as pre-packaged gourmet foods for off premise consumption and beer and wine for off premise consumption. Cost Plus, Inc. has applied to upgrade its current Type 20 beer and wine license to a Type 21 license to sell beer, wine and spirits for off premise consumption. In order for the license to be granted by the Department of Alcoholic Beverage Control, Cost Plus must first obtain a Letter of Public Convenience and Necessity (PCN letter) from the City of Palm Springs. In addition to the PCN letter, the ABC also requires the city to complete and sign Part 3 of the enclosed ABC-245. Attached please find a fixture plan that shows the primary location(in a red bubble) of the current beer and wine department in the store. Some beer and wine is also cross merchandised in other areas of the store to compliment other merchandise. The addition of spirits to the product mix will not cause an increase in the size of the department. Some of the fixtures within the department will be changed in order to properly accommodate the spirits but the department size will not change. The core principle of the Cost Plus World Market position statement is to offer its customers unique home furnishings, decor, seasonal gifting and home entertaining merchandise. As Cost Plus searches for wine and beer from around the globe to offer unique products and brands it strives to do the same for its spirits assortment. All chosen alcohol products fit into the company's strategy to provide its customers with special home entertaining and gifting merchandise. Cost Plus is a destination for home entertaining. Providing solutions for cocktails and authentic traditional drinks from many cultures is not only a natural extension of its assortment but one that its customers frequently request. It is the company's goal to provide for the customers who desire to have a selection of spirit products in a store environment that is friendly and not at all like shopping in a typical "liquor store" or"grocery store". Cost Plus does not intend to compete 07 with liquor stores and grocery stores but does intend to offer its customers unique, authentic and high quality spirits from aCId the world and for a good price. Thf.)neral price point would be between$12.00 and$35.00. As a retailer Cost Plus closely identifies with small local arlisans/distilleries making high quality unique spirits. Cost Plus will continue to develop more private label and exclusive brands for its customers. These products have a strong appeal to customers looking for gifts. The normal hours of store operation are from 9am to 9pm Monday through Saturday and from 1 Oam to 8pm on Sunday. During the holiday shopping seasons the stores open earlier and stay open later. All employees receive excellent alcohol beverage training that includes a review of the state and local alcohol rules and regulations pertaining to receiving, stocking, displaying and selling beer and wine. There is a beverage manager for each store who is very knowledgeable about the alcohol sold in the store and can assist all customers' requests. Cost Plus is very diligent in checking for valid identification to ensure that all customers purchasing alcohol are at least 21 years of age. In addition to training its employees, Cost Plus has installed special software which prevent: its cash registers from allowing an alcohol sale until the customer's date of birth (showing the customer to be 21 years of age or older)is entered. Attached please find a list of some of the ultra-premium and specialty brands of spirit products Cost Plus would like to offer in its Palm Springs store. This list also shows spirit products commonly sold in a liquor store and in a grocery store but not to be sold in a Cost Plus World Market store. I am also enclosing a check for$877.00 as the fee that was quoted to me from your office for the PCN letter. I am also enclosing a copy of the PCN letter that was issued in April 2008 in order to obtain approval of the store's original Type 20 off premise beer and wine license.
