SUMMARY
Numerous existing small commercial spaces fronting Palm Canyon and Indian Canyon
remain vacant due to limited parking space and options. This code amendment would
allow changes of use to be approved through the Land Use Permit process with waivers
from parking requirements typically imposed on changes of use.
RECOMMENDATION:
1. Open the public hearing and receive public testimony.
2. Waive the reading of the ordinance text in its entirety and read by title only; and

BACKGROUND INFORMATION
The City typically requires additional parking to be provided when a change of use of
existing buildings occurs. Palm Springs Zoning Code Section 92.26 also allows for the
payment of in-lieu fees to the off street parking fund for properties on Palm Canyon and
Indian Canyon Drives.
ANALYSIS:
Properties both north and south of downtown continue to have significant vacancies.
Retail opportunities are limited whereas the need for hospitality industry uses is strong.
The City and the market favor reuse of existing structures.
However, the intensification of use requires additional parking by code. Because the
area is nearly fully developed there are not immediate opportunities to provide
additional parking.
The City is becoming more biking and walking friendly. With the intensification of uses,
especially hotels, there are more opportunities to patronize many shops and
eating/drinking establishments on foot. The trolley expected to be available in fall, will
greatly enhance the opportunity for restaurant and assembly uses without the need for
additional parking.
The proposed ordinance would allow re-tenanting of existing buildings with Palm
Canyon and Indian Canyon frontage outside of the downtown parking combining zone
to be approved through the land use permit process with a waiver of parking
requirements typically associated with changes of use. Buildings within a commercial
center of three or more acres or in buildings with 20,000 square feet or more would not
be eligible nor would buildings within a Planned Development District.
ENVIRONMENTAL DETERMINATION:
Pursuant to the California Environment Quality Act (CEQA) guidelines, the project is a
Class 1 exemption and is categorically exempt per Section 15301 (Existing Facilities).
NOTIFICATION
A public hearing notice was published. The Planning Department has not received
correspondence reg ding this issue.

City Attorney's Summary
The City's current zoning code requires that changes in use
of any existing building will require that the new use comply
with the current parking requirements applicable to the new
use. This Ordinance allows changes of use of certain
existing buildings along Palm Canyon and Indian Canyon
Drives, not within the `D" Downtown Parking Combining
Zone to be approved pursuant to the City's land use permit
process and waive all or a portion of such additional parking
requirements.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, FINDS:
A. The proposed amendment is considered a "project" pursuant to the terms
of the California Environmental Quality Act ("CEQA"), and the proposed amendment be
determined to be Categorically Exempt from the provisions of CEQA under Section
15301 (Existing Structures) of the Guidelines for the California Environmental Quality
Act because the proposed zone text amendment proposes only insignificant changes to
the title and only provides for relatively minor intensification of use without additional
parking for certain properties within a defined area of the City.
B. A notice of public hearing of the City Council of the City of Palm Springs,
California for Case 5.1343 ZTA (Zone Text Amendment) was given in accordance with
applicable law; and
C. On July 16, 2014 a public hearing of the City Council was held to review
said case, and at said hearing the City Council reviewed and considered all of the
evidence presented in connection with the hearing on the project, including, but not
limited to, the staff report, and all written and oral testimony presented.
D. Pursuant to PSZC Section 94.07.01 (Zoning Ordinance Text Amendment),
the City Council finds as follows:

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold a
public hearing at its meeting of July 16, 2014. The City Council meeting begins at 6:00 p.m. in the
Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider Case 5.1343 ZTA, an application by the City of Palm
Springs, to amend Palm Springs Zoning Code (PSZC) 93.06.00 — Off-Street Parking and 94.02.01 —
Land Use Permits to allow existing, smaller retail stores and offices located on Palm Canyon Drive
and Indian Canyon Drive, north of Alejo Road and south of Ramon Road, to re-tenant with more
intense uses without providing additional parking upon approval of a Land Use Permit.
ENVIRONMENTAL DETERMINATION: The City of Palm Springs, in its capacity as the Lead
Agency, under the California Environmental Quality Act (CEQA) has determined that the proposed
zoning code text amendment is Categorically Exempt under Section 15305 (Minor Alterations in Land
Use Limitations) of the Guidelines for the California Environmental Quality Act since the proposed
zone text amendment proposes only insignificant changes to the land use designations provisions.
REVIEW OF INFORMATION: The staff report and other supporting documents regarding this matter
are available for public review at City Hall between the hours of 8:00 a.m. and
6:00 p.m., Monday through Thursday. Please contact the Office of the City Clerk at

constitute exceptional benefits to the city.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS:
Section 1. Sub-Paragraph f is added to Paragraph 94.02.01.C.2 of the Palm
Springs Municipal Code to add the following use as a use permitted by a land use
permit:
f. A change of use for an existing commercial/retail building on property with
frontage on Palm Canyon Drive (including East Palm Canyon Drive and South Palm
Canyon Drive) or Indian Canyon Drive, will be eligible for a waiver of all or a portion of
additional parking that would otherwise be required for such change of use so long as:
i. The property is not within a Planned Development District;
ii. The property is not more than three acres in total area;
iii. The existing building is less than 20,000 square feet; and
iv. The property is not within "D" downtown parking combining zone;
and
v, The building existed prior to October 3, 2014.

The purpose of the hearing is to consider Case 5.1343 ZTA, an application by the City of Palm
Springs, to amend Palm Springs Zoning Code (PSZC) 93.06.00 — Off-Street Parking and 94.02.01 —
Land Use Permits to allow existing, smaller retail stores and offices located on Palm Canyon Drive
and Indian Canyon Drive, north of Alejo Road and south of Ramon Road, to re-tenant with more
intense uses without providing additional parking upon approval of a Land Use Permit.
ENVIRONMENTAL DETERMINATION: The City of Palm Springs, in its capacity as the Lead
Agency, under the California Environmental Quality Act (CEQA) has determined that the proposed
zoning code text amendment is Categorically Exempt under Section 15305 (Minor Alterations in Land
Use Limitations) of the Guidelines for the California Environmental Quality Act since the proposed
zone text amendment proposes only insignificant changes to the land use designations provisions.
REVIEW OF INFORMATION: The staff report and other supporting documents regarding this matter
are available for public review at City Hall between the hours of 8:00 a.m. and
6:00 p.m., Monday through Thursday. Please contact the Office of the City Clerk at
(760) 323-8204 if you would like to schedule an appointment to review these documents.
COMMENTS: Response to this notice may be made verbally at the Public Hearing and/or in writing
before the hearing. Written comments may be made to the City Council by letter (for mail or hand
