HomeMy WebLinkAbout23571 RESOLUTION NO. 23571 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, UPHOLDING THE DECISION OF THE HISTORIC SITE PRESERVATION BOARD DENYING THE REQUEST TO AMEND THE SIGN PROGRAM AT THE EL PASEO BUILDING, A CLASS 1 HISTORIC SITE, LOCATED AT 800 NORTH PALM CANYON DRIVE, ZONE C-1 (CASE SP 09-001 AMND, HSPB-27). WHEREAS, El Paseo Holdings ("Applicant') filed a sign program amendment, Case 09- 001, to include one double sided internally illuminated blade sign equaling 7.5-square feet located on the Palm Canyon Drive elevation at 800 North Palm Canyon Drive, Zone C-1, Section 15; and WHEREAS, notice of public meeting of the Historic Site Preservation Board of the City of Palm Springs to consider Case 09-001 AMND was given in accordance with applicable law; and WHEREAS, on April 7, 2014, the Architectural Advisory Committee reviewed a sign program amendment request for a 9.33-square foot blade sign. After carefully reviewed and considered all of the evidence presented on the project, including but not limited to the staff report, and all written and oral testimony presented and voted 7-0 to table discussion until a further date; and WHEREAS, on April 8, 2014, the Historic Site Preservation Board reviewed a sign program amendment request for a 9.33-square foot blade sign. After carefully reviewed and considered all of the evidence presented on the project, including but not limited to the staff report, and all written and oral testimony presented and voted 6-0 to deny the request; and WHEREAS, on May 13, 2014, the Historic Site Preservation Board reviewed a revised sign program amendment request for a 7.5-square foot blade sign. After carefully reviewed and considered all of the evidence presented on the project, including but not limited to the staff report, and all written and oral testimony presented and voted 4-1 to deny the request; and WHEREAS, El Paseo Holdings ("Applicant' and "Appellant') has filed an appeal, pursuant to Chapter 2.05 of the Municipal Code, of the Historic Site Preservation Board decision to deny Case 09-001; and WHEREAS, on June 18, 2014, a public meeting on the appeal was held by the City Council in accordance with applicable law; and Resolution No. 23571 Page 2 WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the appeal hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Municipal Code Section 2.05.030, the appellant's stated grounds for the appeal includes the following: "The Client was prepared to make concessions with regard to size, location and overall design to allow harmony between the sign and the Class 1 historic building. However, there was very little discussion on how to make the sign work within the space. Instead it was suggested that no additional sign be added to the Palm Canyon elevation" "Approving the blade sign will allow a tenant with Palm Canyon frontage to have a presence visible from Palm Canyon. It is our contention that business in the downtown zone need reasonable signage identification on the streets they front." SECTION 2. In response to the above, the City Council finds as follows: the review of a sign program amendment application is discretionary and requires input and discussion gathered through a public hearing process. The Historic Site Preservation Board held a public meeting to obtain information regarding the proposal and determined that a 7.5- square foot double sided internally illuminated blade sign is not appropriate on the El Paseo Building a Class 1 historic site. The Historic Site Preservation Board in rendering a denial decision exercised its regulatory control through the Certificate of Approval process. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby denies the appeal and upholds the Historic Site Preservation Board decision to deny Case SP 09-001 AMND, HSPB 27 an amendment to the approved sign program.
