HomeMy WebLinkAboutA5623 - CVAG MULTI AGENCY COOP AGR FOR POLICING OF OFF-HIGHWAY VEHICLE ACTIVITY COACHELLA VALLEY ASSOCIATION of GOVERNMENTS AMENDMENT NUMBER ONE TO MULTI-AGENCY COOPERATIVE AGREEMENT FOR POLICING OF OFF-HIGHWAY VEHICLE (OHV) ACTIVITY BETWEEN THE COACHELLA VALLEY ASSOCIATION OF GOVERNMENTS AND PARTIES INCLUDED IN THE OHV TASK FORCE FOR THE PURPOSES OF OFF HIGHWAY VEHICLE ENFORCEMENT The Multi-Agency Cooperative Agreement for policing of Off-Highway Vehicle (OHV) Activity (the "Contract"), by and between the Coachella Valley Association of Governments (CVAG) and the Cities of Cathedral City, Desert Hot Springs, Indio, and Palm Springs, the Bureau of Land Management (BLM), the Riverside County Sheriff's Department, Palm Desert Station and the Riverside County Sheriffs Department, Indio Station, referred to with all listed parties as the "Task Force" for the term beginning March 26, 2007, is hereby amended as follows 1) The term of the contract is extended and shall continue on a month to month basis as to all parties until and unless a party shall give the other parties thirty (30) days notice of that party's intent to withdraw from the contract (after which the contract shall continue in effect as to all other parties) or until all funds relative to the contract are expended and there are no new funds. The parties acknowledge that this amendment shall be retroactive to March 27, 2008, and shall bind the parties hereunder for the entire term of the contract in the same manner as if this amendment had been executed prior to or on March 27, 2008 2) All other terms and conditions shall remain the same as stated in the original contract. INDIO STATION: By: Dated: Stanley Sniff, Sheriff- Coroner BUREAU OF LAND MANAGEMENT: By: Dated: J n Kalish, Field Manager V ZH=VAG OHV MULTI-AGENCY AGREEMENT.AMENDMENT MIME GR ONE eoc 09I29/0n l• I MULTI-AGENCY COOPERATIVE AGREEMENT FOR POLICING OF OFF-HIGHWAY VEHICLE (OH'" ACTIVITY THIS COOPERATIVE AGREEMENT ("Agreement") is made this 26"' day, of March. 2007 by and between the CITIES OF CATHEDRAL CITY, DESERT HOT SPRINGS, INDIO, and PALM SPRINGS (collectively, the "Cities"), the COACHELLA VALLEY ASSOCIATION OF GOVERNMENTS ("CVAG"), the BUREAU OF LAND MANAGEMENT (`BLM"), the RIVERSIDE COUNTY SIERIFF'S DEPARTMENT -- PALM DESERT STATION ("Palm Desert Station"), and the RIVERSIDE COUNTY SHERIFF'S DEPARTMENT—1NDIO STATION ("Indio Station"). All the parties to this Agreement are collectively referred to below as the "Task Force." 1.0 PURPOSE The propose of this Agreement is to facilitate a_joint agency response to illegal off- highway vehicle activity using partial funding available through an$80,000 grant ofColmac Funds. 2.0 RESPONSIBILITIES 2.1 Lead Agencv. CVAG shall provide in-kind staff support and coordinate meetings of the Off Highway Vehicle(OHV)Task Force,as well as manage and disburse the grant funds consistent with this Agreement and the terms of the Colmac Grant. 2.2 Manpower for Patrol and Other Activities. BLM, Riverside Sheriff Palm Desert Station, Indio Station, and the Cities shall collectively provide enforcement personnel for approximately 20 eight-hour patrols. Each agency shall endeavor to provide one fully-equipped and trained,sworn employee for each deployment so that, ideally, each patrol shall consist of seven sworn personnel. One connnunity services officer, equivalent non-sworn staff person and/or volunteer will also be assigned for each patrol deployment for equipment security and public outreach duties. Each member shall also endeavor to participate in a similar manner in any Off-Highway Safety Workshops scheduled by the 'fask Force. 2.3 Relevant Enforcement Criteria. Prior to any patrol activity within the geographical jurisdiction of any Task Force member,that member shall have submitted to the Task Force all relevant laws and procedures specifically applicable, if any, to OHV enforcement activities within that member's jurisdiction. All patrol activities shall be conducted consistent with the pre- submitted enforcement criteria for the jurisdiction. This will allow the multi- agency deployment to provide enforcement that is consistent with goals and OHV Coop Agreement—3/26/07 1 0 0 objectives of the jurisdiction in which they are operating_ 2A Training. Sworn personnel shall receive approved training, through BLM, Riverside Sheriff, or other sotuces approved by the OFIV Task Force Committee,prior-to participating in OHV enforcement actions so as to ensure that all Task Force members demonstrate responsible OHV use. 3.0 PATROL PARAMETERS 3.1 Areas. Consistent with the OHV activities within the region,the appropriate areas of deployment shall be determined prior to the patrols, with the assigned supervisor(see next subsection)having final authority with respect to the starting site of each patrol. 3.2 Patrol Supervision. The Task Force shall develop a schedule so that each jurisdiction shall be responsible for assigning a supervisoz for the planned patrols on a rotating basis. The pre-assigned supervisoz for each patrol shall be responsible for the following: a. Establishing an initial briefing location and start time for the deployment, and communicating that with the other agencies; b. Providing a non-sworn staff person or volunteer to secure the trailers and other equipment and interact with the public at the site; C. Coordinating the enforcement activities at the site to insure all participants are cooperating in an effective manner,have participated in BLM training, and are demonstrating responsible OHV riding skills; d. Initially dealing with any complaint arising at the time of the patrol, and forwarding that information to the proper agency; e. Keeping statistical records of the day's activities, including (i) number of riders encountered/contacted; (ii) locations patrolled; (iii) citations/warnings given; (iv) arrests made; (v) public education contacts; and (vi) any other relevant statistics, as determined by consensus ofthe OHV Task Force Committee. 3.3 Policies and Procedures of Participating Jurisdictions. Each participating entity agrees that although functional supervision of the enforcement tearn will be rotated, as individuals, each member must adhere to the policies and procedures of his/her employer. 3.4 Parade Participation. To publicize the Task Force's efforts, members may ride in parades or other public events, an example of which would be the Date Festival Parade on February 19,2007. The participation in such events would be subject to prior approval by the OHV Task Force Committee, OHV Coop Agreement—3/26/07 2 0 0 3.5 Patrol Schedules. Although the deployrnent locations are yet to be determined, and may include multiple areas in a single day, the following dates have been tentatively scheduled based on historical activity. (Additional dates will be added for the beginning of the 2007/2008 OHV season.) a. 1/20/07 b. 1/28/07 c. 2/3/07 d. 2/11/07 e. 2/18/07 (President's Day IIoliday Week-end) f. 2/19/07 (Date Festival Parade) g. 3/4/07 h. 3/18/07 i. 4/7/07 (Easter Holiday Week-end) j. 4/8/07 (Easter Holiday Weed-end) 4.0 PUBLIC AWARENESS AND EDUCATION 4.1 As with most enforcement actions, voluntary compliance is the goal of this Task Force. Public awareness and education is a key factor in attaining that goal. 4.2 The Task Force will work through CVAG to publicize the multi-agency effort in a manner that presents a unified front for enforcement of OHV violations throughout the valley. 4.3 It is the intent of the Task Force to hold one and possibly two Off Highway Safety Workshops. At these workshops, civilian riders would learn safety laws, lawful riding areas, safe riding habits, and other pertinent information from the Task Force members in an interactive atmosphere. Participants will also be educated on responsible riding practices as they relate to habitat preservation and dust control/reduction. Locations of these workshops will be set by group consensus. 4A At the time of each patrol, a community services officer, equivalent non- sworn staffer a volunteer participant shall man an information table setup in the patrol area to provide OHV literature to and interact with the public. 5.0 DISTRIBUTION OF GRANT FUNDING 5.1 The Colmac Grant is limited to use for "overtime, equipment and other related costs that cannot be covered by already established budgets." OHV Coop Agreement—3/26/07 3 0 0 52 Task Force members shall subunit requests for reimbursement of actual, allowable overtime payroll expenses arising out of a Task Force activity to CVAG. The request shall be made in a form acceptable to CVAG,and shall be submitted with documentation as requested by CVAG. 5.3 No reimbursement of expenditures for equipment, supplies or other non- payroll (overtime) expenses shall be trade except as pre-approved by the Task Force and CVAG. 5.4 The Task Force shall endeavor to ensure that the Colmar Grant is distributed among the members in approximately equal proportion to their respective participation in the Task Force patrol and education efforts, provided, however,that CVAG shall have the final authority with respect to the manner of distribution. 6.0 CVAG OFF-HIGHWAY TASK FORCE, COMMITTEE In addition to the patrol activities, the members shall continue to participate in connnittee meetings as scheduled by group consensus. In addition to the parties to this Agreement, the Committee shall include interested community members, such as representatives from the California Wilderness Coalition,the Sky Valley and other interested Community Councils, Supervisor Wilson's office, and others upon request. Except with respect to CVAG's authority to administer the grant funds,all decisions required to cant'out the intent of this Agreement shall be made by consensus of the Cornmittee participants. 7.0 HOLD HARMLESS Notwithstanding the rotation o Csupervision among the members,each jurisdiction is responsible for the acts and omissions of that jurisdiction's ennployee/volunteer. Eachparty shall save and keep harmless and inderimify the other parties and their elected officials, officers, employees, agents and volunteers, against any loss, demand, cause of action, or other legal liability or economic loss that occurs in any way incident to, connected with, or arising directly or indirectly out oC the acts and/or omissions of the indemnifying party, its elected officials, officers, employees, agents, or volunteers. Each parry will maintain ownership of their ovm equipment. Each party shall maintain insurance as is normal for their own organization and be responsible for their own personnel, actions and equipment. 8.0 TERM 8.1 Term. Unless earlier terminated in accordance with Section 8.2 below, the teen of this Agreement shall commence on the date this Agreement is entered into and terminate one (1)year thereafter. OHV Coop Agreement—3/26/07 4 0 8.2 Termination Prior to Expiration of Tenn. Any party may terminate its participation in this Agreement at anytime with or without cause,upon thirty (30) days written notice to CVAG. 9.0 MISCELLANEOUS 9.1 Severability. The invalidity,illegality or unenforceabilityof any provisionOf this Agreement shall not render the other provisions unenforceable,invalid or illegal. 9.2 Governing Law. This Agreement shall be interpreted and enforced pursuant to the laws of the State of California. 9.3 Modifications. This Agreement can only be modified by a written instrument executed by all parties. 9.4 Entire�einent. This Agreement contains the entire understanding of the parties related to their interests,obligations,and rights in connection with the subject matter set forth herein. All prior communications, negotiations, stipulations, and understandings, whether oral or written, are of no force or effect, and are superseded, except as referenced herein. 9.5 Assigns and Successors. This Agreement shall be binding upon,and inure to the benefit of, the assigns or successors-in-interest of the parties herein. 9.6 No Third Patty Beneliciaiy. The parties to this Agreement do not intend to create any third party beneficiaries to this Agreement,and expressly deny the creation of any third party beneficiary rights hereunder toward any person or entity. 9.7 Time. Time is of the essence in the performance of each and every term of this Agreement. 9.8 Waiver. The waiver or failure to declare a breach as a result of the violation of any term of this Agreement shall not constitute a waiver of that term or condition and shall not provide the basis.for a claim of estoppel,forgiveness or waiver by any party. 9.9 Attorneys' Fees. If it shall be necessary for any parry hereto to commence legal action or arbitration to enforce the terms and provisions of this Agreement,the prevailing party shall be entitled to reasonable attorneys'fees, expenses and costs incurred therein.
