Our neighborhood of 350 homes now has 48 vacation rentals. One out of every 7 houses with more on the way! A portion of these houses repeatedly disrupt the neighborhood with noise and traffic. The impact orr our quality of life is significant; noisy parties with amplified music, shouting drunks, rude people, increased traffic, and parking congestion that leads to safety concerns over the passage of emergency vehicles. The City of Palm Springs has a vacation rental ordinance. It is not being enforced. Despite hundreds of calls to the hotline each year, NO fines have ever been levied against owners, guests or property management companies other than for "non- response." There is no accountability and the problems continue. Deepwell property deeds restrict property use to private residences. No business use is permitted. We have a right to expect the City to protect us from the assault of noisy vacation rental homes. These violators rob us of the right to the peaceful enjoyment of our homes and may ultimately impact property values. WE NEED YOUR HELP. Please enforce the vacation rental ordinance. I've been visiting Palm Springs for 50 years and am a 15 year resident of Deepwell. I was drawn to this neighborhood because of its quiet, friendly character and am concerned by the negative impact of vacation rentals. We feel besieged. Bad vacation rentals are like your worst neighbor imaginable. Big parties. Amplified music that can be heard inside the house when windows and doors are closed. Shouting drunks. Rude people. Traffic congestion. It really robs us of our right to enjoy our own homes. I understand that there is a vacation rental ordinance. It is not being enforced, and despite hundreds of calls to the hotline each year, no fines have ever been levied against owners, guests, or property management companies for noise or loud outdoor music. There needs to be much better enforcement. Occupancy needs to be limited to two persons per bedroom, PERIOD. No more "plus 2". This creates over-occupancy of these properties. We need to define what is an "actionable offense" and figure out a way to deal with it so it does not continue to occur weekend after weekend. Residents should not be subjected to repeated loud partying and music next door. In addition to being an intrusion, it has the ability to destroy a thriving residential neighborhood and impact property values. Finally, both Palm Desert and Rancho Mirage have significantly better vacation rental ordinances than PS. WHY? Strong neighborhoods are the heart of a healthy city. Please protect Palm Springs neighborhoods by creating and enforcing a vacation rental ordinance which specifies offenses and creates real penalties for misbehavior. We need your help. Ellen Lockert 1147 Paseo de Marcia Testimony to Palm Springs City Council RE: Noise Ordinance for Palm Springs, CA December 18, 2013 This evening, I am speaking on behalf of a neighbor, Lilly Joseph who has lived in Deepwell for over 35 years. Lilly is unable to attend this evening. "I have lived in Deepwell since 1978 and it has always been a haven of tranquility, until recently when the noise emanating from the many vacation homes that are now our neighbours has totally destroyed our peaceful environment.. We appeal to the Palm Springs City Council Men and Women we have just elected to do a better job at enforcing an Ordinance to punish the irresponsible noisemakers whose Boomboxes and loud voices ruin our area with such ease and lack of punishment for their trespasses...It is time to act forcefully and not ignore our pleas... Respectfully, LilliJoseph". That letter comes from just one of so many senior citizens who live in the Deepwell neighborhood and who just want an ordinance to have some teeth to it so that the offending homeowners, management companies and renters will have real financial consequences for their irresponsible behavior that results in the neighborhood being rocked by not only loud music and voices but vehicles speeding, honking and at times blocking road access for emergency vehicles. From what I can tell, the existing ordinance has absolutely no consequences for violators. I propose the first fine of one week rental income, the second fine would be two weeks of rental income and the third fine would be a month of rental income with a one year suspension period of no renters in that home. Also, as I understand it, the age for being able to rent a home in Palm springs is 18......this should be changed to the age of 24. 1 was raised in a home where there were consequences for misbehaving....If I lied or said a bad word, I got my mouth washed out with Ivory soap. We need to hold adults accountable for their actions or in this case, inaction when they knowingly and consistently ignore an ordinance that is supposed to protect our neighborhoods. Please hear our requests for real consequences. Our neighborhood of 350 homes now has 48 vacation rentals.One out of every 7 houses with more on the way! A portion of these houses repeaterllydisrupt the neighborhood with noise and traffic.The impact on our quality of life is significant;noisy parties with amplified music, shouting drunks, rude people, increased traffic,and parking congestion that leads to safety concerns over the passage of emergency vehicles. The City of Palm Springs has a vacation rental ordinance. It isnotbeing enforcer.. Despite hundreds of calls to the hotline each year, NO tines have ever been levied against owners, guests or property management companies other than for-non- response."There is no accountability and the problems continue. Deepwell property deeds restrict property use to private residences. No business use is permitted. We have a right to expect the City to protect us from the assault of noisy vacation rental homes.These violators rob us of the right to the peaceful enjoyment of our homes and may ultimately impact property values.
