Ready, City Manager BY: Department of Planning Services SUMMARY The City Council will consider an appeal on behalf of Palm Springs, LLC, of the Planning Commission's decision to continue the review of the final development plans for Planned Development District 324, a proposal to develop a 150-room hotel and approximately 32,705 square feet of commercial retail space at 400 North Palm Canyon Drive and the failure of the Planning Commission to find the final development plan for Planned Development District 324 was in substantial conformance of the preliminary development permit as approved by the City Council. RECOMMENDATION 1. Open the public hearing and receive public testimony; 2. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, UPHOLDING THE APPEAL OF PALM SPRINGS, LLC, AND FINDING THE FINAL DEVELOPMENT PLAN FOR PLANNED DEVELOPMENT DISTRICT 324 IS IN CONFORMANCE WITH THE PRELIMINARY DEVELOPMENT PLAN FOR THE CONSTRUCTION OF A 150-ROOM HOTEL, ANCILLARY COMMERCIAL RETAIL AND FREE STANDING PARKING STRUCTURE LOCATED AT THE SOUTHEAST CORNER OF ALEJO ROAD AND NORTH ITEM NO.1�---- City Council Staff Report October 15, 2014--Page 2 5.1091-PD324—Appeal—Final PD Review PALM CANYON DRIVE AND FINDING THE PREVIOUSLY ADOPTED MITIGATED NEGATIVE DECLARATION NUMBER 2006109031 AS SUFFICIENT AND APPROPRIATE ENVIRONMENTAL DOCUMENTATION FOR THE FINAL DEVELOPMENT PLAN." BACKGROUND AND SETTING: The development of the subject property has been the subject of several proposals advanced by the Developer and reviewed by the City since 2006. (See Exhibit "A".) The current project is an application by Palm Springs, LLC, for Planned Development District 324 and consists of a 150-room hotel, approximately 32,705 square feet of ancillary commercial retail, restaurant and parking structures. The Planned Development District established the use, design standards and the configuration of the site plan. The property is approximately 4.1 acres of vacant land bounded by Alejo Road on the north, North Palm Canyon Drive on the west, North Indian Canyon Drive on the east, and existing commercial development on the south. The Developer is pursuing the review and approval of the Final Development Plan for Planned Development District 324. The Preliminary Planned Development Plan was previously approved by the Planning Commission on December 11, 2013, and by the City Council on April 2, 2014. Staff Review: There are no specific findings for a Final Development Plan, however, PSMC Section 94.03.00(E)(4) requires that the Final PD Plan be "substantially in conformance" with the approved preliminary PD plans. Based on this requirement and the AAC's review and favorable recommendations, staff recommended the Planning Commission find the project in substantial conformance with the preliminary PD. Staff's recommendation was predicated on several considerations. The Final Development plans maintain the same mixed-use character as the Preliminary PD project with a 150-hotel, retail/commercial, bar and restaurant uses. The ground level will feature approximately 32,705 square feet of commercial retail spaces, a restaurant and a bar. The amount of parking spaces provided by the applicant remains the same as with the preliminary PD. Pursuant to the parking requirements of the Palm Springs Zoning Code, the total required parking for the development is 226 spaces. The development will have 283 parking spaces; the amount is consistent with the preliminary PD. The applicant indicated that members of the public will have free access to the parking spaces. The proposed development still consists of a four-story building with the upper two stories used for hotel guest rooms and suites. The layout calls for the proposed 150 rooms to be distributed across the lot with private garden spaces around each room. The preliminary architectural design in a "desert contemporary" vernacular is retained in the final plans. Basic building massing and heights remains consistent and within the guidelines of the approved planned development district. Staff also determined that the proposed final development plans provided additional architectural details with refined 02 City Council Staff Report October 15,2014--Page 3 5.1091-PD324—Appeal—Final PD Review project information. Comments and recommendations from the AAC and the Planning Commission at the initial preliminary review were incorporated into the final development plans as well. Improvements in the final development plans from the preliminary include: 1. Refinement and elaboration of the building facades facing public streets- 2. Extension of canopy along Palm Canyon to increase shade on the retail tenant spaces and pedestrian sidewalk areas. 3. A more intimate arrival statement created for arriving guests to the hotel. 4. Significant emphasis placed on the building elevation, walkways and landscaping along Indian Canyon to provide a more pleasant pedestrian experience. 5. A public pedestrian connection was created for guests parking in the north parking structure, allowing easier access from Palm Canyon to the public parking garage. 6. A bulkhead was designed behind screening in the parking structure to block vehicle lights. o _ r' t �d•>rjr SITE PLAN AAC Review of Preliminary PD Plan: On October 7 & 21, 2013, the AAC reviewed the preliminary development plans and asked the applicant to consider the following: • A wraparound of the ground level retail on the south side; • Improve the overhang on the east side of the project; • Add bulkhead on the east to block vehicle lights; and • Provide additional corner options on the northwest section of the site. The applicant incorporated the comments into the final plans and the AAC recommended approval to the Planning Commission. 03 City Council Staff Report October 15,2014--Page 4 5.1091-PD324—Appeal—Final PD Review AAC Review of Final PD Plan: On August 25, 2014, the Architectural Advisory Committee (AAC) reviewed the project and recommended approval with the following condition: 1. The maximum front panel separating store front fagade along North Palm Canyon Drive shall be 8 feet long. Any individual tenant improvement involving the front panel fagade exceeding 8 feet shall be subject to review by the AAC. First Commission Review on September 10, 2014: At its public hearing meeting of September 10, 2014, the Planning Commission reviewed the proposed project. The Commission was generally favorable with the direction of the project, however, the Commission voted to continue the Final PD review and requested further refinements to the project and asked for the following additional detailed exhibits and materials for the next hearing: 1. A new 3-D exhibit of south side elevation and building elevation. 2. Address hotel guest experience at the ground level. 3. An exhibit illustrating additional detail of parking structure. 4. A landscaped site plan with walkways around parking areas with access to Palm Canyon, Alejo and Indian Canyon. 5. Exhibits illustrating screening and appearance of the 10-foot gap on the south side elevation. 6. Exhibit pointing out application and placement of materials on the exterior. 7. "Blow-ups" of street level views / close up of portions of buildings. 8. Visual renderings detailing scoring of concrete and how it will appear. Second Commission Review on September 24, 2014: At the second hearing held on September 24, 2014, the Commission reviewed the above-referenced materials and exhibits but voted to continue the hearing to a date uncertain. The decision to continue the item was based on the commission's findings that there were a number of items that remained unresolved from the conditions of approval of the Preliminary Planned Development Plan. The three major unresolved elements identified by the Planning Commission are as follows: 1. The relationship of the project to the street and public sidewalk on the Indian Canyon and Alejo street frontages: The vast majority of the lineal frontage on the Indian Canyon and Alejo frontages is occupied by parking structures, driveways and service access points, which presents a "back of house" aesthetic to these two streets. The wall height and long expanses of these frontages requires a much more articulated and sensitive design, as was displayed in the preliminary PD plan. The commission also reiterated concerns about glare and light spillage from the garage openings after dark, and did not feel that the applicant had adequately addressed these concerns identified in the initial review. 2. The height and bulk of the building: In discussing the massing of the project, the Planning Commission noted that the height of the structure on the Palm Canyon frontage would be approximately 45 feet at the front setback line, with even greater height along the Indian Canyon frontage. The commission members described the upper-level elevations as "overbearing" and "heavy," and found 04 City Council Staff Report October 15,2014--Page 5 5.1091-PD324—Appeal—Final PD Review them to be inconsistent with the step-backs required by the city's Downtown Urban Design Plan. The commission opined that further design work was necessary to bring the project into conformance with adopted requirements. 3. Materials and detailing: As shown on the submitted application, the exterior materials utilized on the project will be primarily limited to smooth-finished white plaster and glass. The commission voiced a concern that the material palette was extremely limited for 4.1 acre project, and that the preliminary PD plan utilized a larger variety of colors, materials, and textures, which added greatly to the richness of the project. Commissioners noted that they were generally supportive of the minimalist design as proposed, but that a greater variety of color, texture and pattern was needed to be consistent with the preliminary plan. APPELLANT'S APPEAL: On September 30, 2014, a letter of appeal was submitted to the City on behalf of the developers, Lawrence and Graeme Rael. Below are the grounds for appeal and Staff's response: 1. The Planning Commission did not make proper findings required by law at its September 10, 2014 meeting but continued the project. Following that meeting, Mr. Lawrence Rael met with staff and provided all additional materials necessary to address the concerns of the Commission at that time, even though the Commission ignored the directions of the staff at that hearings which directions were specific to them to determine if the project plans were in substantial conformance with the approvals received from City Council on April 4, 2014. Staff is in agreement with the Commission's requirement for additional materials and exhibits following the initial review on September 10, 2014. At this meeting, the Commission wanted to see exhibits illustrating pedestrian connectivity within the ground floor and points of access to the three streets bounding the project site. Also, the Commission asked for additional exhibits showing the south side elevation and how the approximate 10 foot gap between the hotel and the existing buildings on the south side is treated. A request by the Commission to modify the mass of the building at the Final Development Plan review would be in keeping with Section 94.03.00(G), so long as the submitted Final PD Plan does not differ significantly from the approved Preliminary PD Plan. As submitted, the size of the building is consistent with the previously approved preliminary PD Plan. Changes made to the landscape plans were in response to directions from the AAC; the appellant earlier indicated that fully developed final landscape, irrigation and exterior lighting plans will be taken back to the AAC for review and recommendation to the Planning Commission. The updated preliminary landscape plan was reviewed by the AAC and the AAC was supportive of the revisions and directions. 2. The Planning Commission did not make findings as required by law at the September 24, 2014 meeting. Messrs. Rael respectfully disagree fl City Council Staff Report October 15,2014--Page 6 5A 091-PD324—Appeal—Final PD Review with the Planning Commission's conclusion that the project is in need of further aesthetic redesign. More importantly, Messrs. Rae/ believe that the Planning Commission did not make proper findings as required by law, specifically, that the project is in substantial conformance with approved development standards, and must therefore be approved. The Planning Commission is now attempting to further redesign the project, over the recommendations of both staff and the Architectural Advisory Committee (AAC'). This action by the Planning Commission goes beyond what is required of its law. Prior to and during the Planning Commission meeting of September 24, Planning Staff evaluated the developers' proposal for the final development plan approval and determined that the submittal meets the requirements of the Palm Springs Zoning Code, Section 94.03.00(E)(4), (Final Development Plan — Approval by Planning Commission); namely, the final development plan is in in substantial conformance with the approved preliminary development plan. Furthermore, based on past practices, staff also concluded that the submitted materials and exhibits were consistent with the established list created by the Planning Department (See Attachment 3). Staff notes that it is within the Commission's purview to request additional materials, exhibits, and time for clarifications before decisions are made on a significant project such as the Port Lawrence project. To this end staff worked with the appellant to provide all the required exhibits and materials following the initial review and in staffs opinion, the revised material substantially complied with the Commission's requests 3. As explained above, the Report prepared by staff plainly stated that the final development plans maintain the same mixed-use character and the same architectural design as the Preliminary PD project, with hotel, retail/commercial, bar and restaurant uses. The basic building massing and heights remain consistent and within the guidelines of the approved planned development district. Furthermore, the preliminary architectural design, which was a "desert contemporary" vernacular, remains the same and has been reviewed by the AAC and recommended for approval. The appellant's assertion regarding staffs conclusion in the Commission's report is accurate. The Planning Commission, however, did not make a finding that the Final PD Plans are substantially in conformance with the preliminary PD Plan. In this case, staff analysis and conclusion that there is sufficient evidence on the record for the Council to determine that the final development plan is in substantial conformance with the preliminary development plan is based on Code requirements and past precedents of similar cases. CONCLUSION After receiving public testimony, the City Council may adopt the attached resolution upholding the appeal and finding that the final development plan is in conformance with the preliminary development plan. Should the Council determine that sufficient 06 City Council Staff Report October 15,2014--Page 7 5.1091-PD324—Appeal—Final PD Review evidence exists to uphold the Planning Commission's decision, a new resolution would be presented at the next regular City Council meeting. NOTIFICATION A courtesy notice of the appeal hearing was advertised in the Desert Sun and was mailed to property owners within 500 feet of the subject property. As of the writing of this report, staff has not received any written correspondence. FISCAL IMPACT: No Fiscal Impact. David H. On October 4, 2006, the City Council adopted a Mitigated Negative Declaration (MND) and approved Preliminary Planned Development PD 324 and Tentative Tract Map 34190, On July 9, 2008, the Planning Commission recommended approval of an amendment to the Vesting Condominium Map to the City Council. On July 30, 2008, the City Council approved an amendment to the Vesting Condominium Map. On October 28, 2009, the Planning Commission approved a one-year time extension from October 4, 2008 to October 3, 2010. On September 22, 2010, the Planning Commission granted a one-year time extension request from October 3, 2011 to October 2, 2012. On August 8, 2011, the AAC reviewed a proposed amendment to the Preliminary PD and recommended approval with several comments to the Planning Commission. On August 10, 2011, the Planning Commission reviewed and approved a 175-room hotel and ancillary commercial retail use amendment but not the site plan as proposed. ON September 7, 2011, the City Council reviewed and approved the proposed amendment to the Preliminary Planned Development District for a 175-room hotel and ancillary commercial retail. ON October 7, 2013, the AAC reviewed the proposed amendment to the project approved by the Council on September 7, 2011, and provided comments to the applicant. On October 21, 2013, the AAC considered the project and by a unanimous vote recommended approval to the Planning Commission. ON December 11, 2013, the Planning Commission approved the proposed amended project and recommended approval to the City Council with conditions. B. On December 11, 2013, the Planning Commission approved an amendment of a previously approved Planned Development District 324 for the development of a 150- room hotel, ancillary commercial retail space and a parking structure. C. On April 2, 2014, the City Council approved a proposed amended project to develop a 150-room hotel, ancillary retail commercial and a parking structure. D. On September 10 and 24, 2014, the Planning Commission held a public meeting to review the final development plans for the project. E. On September 24, 2014, the Planning Commission voted to continue the review of the final development plan to a date uncertain with directions to the applicant to make additional changes to the project and to prepare and present additional exhibits and material for review by the Planning Commission. F. On September 30, 2014, Palm Springs, LLC, pursuant to Chapter 2.05 of the Municipal Code, filed an appeal of the Planning Commission's decision to the City Council as described in Recital A. G. A courtesy notice of the appeal hearing before the City Council to consider Case No. 5.1091-PD324-APL was given in accordance with applicable law. it CC Resolution No. October 15,2014 5.1091 PDD 324—Appeal Page 2 of 4 H. On October 15, 2014, a public hearing on the appeal was held by the City Council in accordance with applicable law. I. The City Council has carefully reviewed and considered all of the evidence presented in connection with the meeting on the appeal, including but not limited to the staff report, and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVES AS FOLLOWS: Section 1. The final development plan is consistent with the amended preliminary development plan previously reviewed under the provisions of the California Environmental Quality Act ("CEQA") and determined that such development plan is a "project" under CEQA. An updated traffic study and subsequent environmental analysis was prepared under the provisions of CEQA; a determination was made that the amended preliminary plan will not result in any new additional impacts beyond those that were previously identified and addressed and that adequate mitigation measures had already been incorporated into the project. In assessment performed in conjunction with the amended preliminary development plan, it was concluded that the mitigated negative declaration and the subsequent environmental analysis covered the issues the City addressed, including topics such as land use policies, safety, aesthetics, geological resources, noise effects, and traffic impacts during construction and operation of the project. In addition to the mitigation measures included in the mitigated negative declaration, conditions of approval in support of the subsequent environmental analysis and the previously adopted mitigated negative declaration have been included in the final development plan. The previously adopted Mitigated Negative Declaration No. 2006109031 is therefore determined as sufficient and appropriate environmental documentation for the final development plan. Section 2: Pursuant to Municipal Code Section 2.05.030, the appellant's stated grounds for the appeal includes the following: A. The Planning Commission did not make proper findings required bylaw at its September 10, 2014 meeting but continued the project. Following that meeting, Mr. Lawrence Rael met with staff and provided all additional materials necessary to address the concems of the Commission at that time, even though the Commission ignored the directions of the staff at that hearings which directions were specific to them to determine if the project plans were in substantial conformance with the approvals received from City Council on April 4, 2014. The Report prepared by staff supports a finding and determination that the final development plans maintain the same mixed-use character and the same architectural design as the Preliminary PD project, with hotel, retail/commercial, bar and restaurant uses. The basic building massing and heights remain consistent and within the guidelines of the approved planned development district. Furthermore, the preliminary architectural design, which was a "desert contemporary" vernacular, remains the same and has been reviewed by the AAC and recommended for approval. Section 3: The City Council finds and overturns the decision of Planning Commission to continue the review process of Final Development Plan for Planned Development District 324 and further finds that the final development plan is substantially in conformance with the previously approved preliminary plan development 324 for the construction of a 150-room hotel, ancillary commercial retail space and parking structure on approximately 4.1 acres of vacant land located at southeast corner of North Palm Canyon Drive and Alejo Road, subject to the previously approved Conditions of Approval and other applicable provisions of the Palm Springs Municipal Code. By way of this letter, pursuant to Palm Springs Municipal Code Chapter 2.05 et seq. Messrs. Rael are hereby appealing the Planning Commission's decision made on September 24, 2014 (Appeal to City Council). The Project was most recently presented to the Planning Commission on September 24, 2014 for approval of the Final PDD. At that time, staff provided a detailed report supporting approval of the Project and provided a detailed staff report explaining that the applicant's Final PDD plans are in substantial conformance with the previously approved Preliminary PDD plans. Thus, staff requested Planning Commission approval of the Final PDD. The above notwithstanding, on September 24, 2014, the Planning Commission voted once again to continue the Project. The Planning Commission appears to have recommended a continuance believing that the Project is in need of further aesthetic modifications. Messrs. Messrs. Rael respectfully disagree with the Planning Commission's conclusion that the Project is in need of further aesthetic redesign. More importantly, Messrs. Rae] believe that the Planning Commission did not make proper findings as required by law; specifically, that the Project is in substantial conformance with approved development standards, and must therefore be approved. The Planning Commission also did not make proper findings required by law at its September 10, 2014 meeting but continued the project. Following that meeting, Mr. Lawrence Rael met with staff and provided all additional materials necessary to address the concerns of the Commission at that time, even though the Commission ignored the directions of the Staff at that the hearings which directions were specific to them to determine if the project plans were in substantial conformance with the approvals received from City Council on April 4, 2014. The Planning Commission is now attempting to further redesign the project, over the recommendations of both staff and the Architectural Advisory Committee ("ACC"). This action by the Planning Commission goes beyond what is required of it by law. As explained above, the Report prepared by staff plainly stated that that the final development plans maintain the same mixed-used character and the same architectural design as the Preliminary PDD project, with hotel, retail/commercial, bar and restaurant uses. The basic building massing and heights remain consistent and within the guidelines of the approved planned development district. Furthermore, the preliminary architectural design, which was a "desert contemporary" vernacular, remains the same and has been satisfactorily refined and articulated in the Final PDD plans, which have been reviewed by the ACC and recommended for approval. Based on the foregoing, we believe the Project is in substantial conformance with approved design standards, and that the Project therefore satisfies all the requirements necessary for approval. We look forward to providing the City Council with further detail at such time as this appeal is heard. LAWRENCE RAEL, Applicant, commented on the history of the project, commented on the setback to the revised project, and introduced his project team who outlined the project. 26 l City Council Minutes April 2, 2014 Page 4 MATTHEW BOUSQUETTE, commented on the impact of this building to the surrounding properties and how the project works with the surrounding properties, requested the A/C units and trash bins be moved to another area of the site. ROBERT FARRAN, Palm Springs, stated his opposition to the proposed amendment to the PDD and requested the City Council delay approval and the impact to the surrounding properties due to trash and electrical placement in proximity to the surrounding properties. JOY BROWN MEREDITH, commented on the meetings with the businesses in the Downtown area, stated the project has evolved into a beautiful project, and stated Main Street has voted in support of the project. FRANK TYSEN, stated the amended project is more appropriate to the community than the previous projects, commented on the attributes of the project, and stated his support for the project. LAWRENCE RAEL, Rebuttal, commented on the location of the trash and air conditioning units, and requested the City Council approve the project. No further speakers coming forward, the public hearing was closed. Councilmember Foat requested the Applicant address the creation of the road and the trash enclosure, the width of the buffer area and clarify that no vehicle access would be allowed in the buffer. I Mayor Pro Tern Hutcheson commented on the ancillary trash unit and suggested that the provision be eliminated, requested the Applicant address the current landscaping on the lot, the number of bike racks, the public benefit, the public access to parking and the number of parking spaces, and any charge or free public parking. Councilmember Lewin requested the Applicant address the controlled 15 foot alley way, requested the Applicant consider decorative grates on the tree wells, stated his support for the lack of a water element, the proposed shade overhang on Palm Canyon, requested a retractable overhang for summer months, the use of other type of shade trees on Palm Canyon, and commented on traffic circulation and the exit on Indian Canyon. Councilmember Foat requested the Applicant address the ancillary trash enclosure, requested the City Council consider the removal of the median on Alejo, the look of the project from the Park and Alejo, and the location of the air conditioning. Councilmember Lewin commented on the location of the ancillary trash enclosure, and requested Staff address the proposed Alejo median. MEMBER FREDRICKS asked if there was a more detailed landscape plan. PRINCIPAL PLANNER ROBERTSON answered that there is one as stated in the staff report. CHAIR FAUBER invited the applicants to present their case. GRAHAM RAEL explained the attributes the project would bring to the City of Palm Springs. JOSEPH SMART, architect, summarized the proposed project objectives and the Board's previous comments and concerns. BORIS MATHIS, architect, explained the improvements to the plans and the additional architectural designs. RON GREGGORY, landscape architect, detailed the proposed landscape design. BORIS MATHIS answered that the plan has a center division. 4 30 Architectural Advisory Committee Minutes August 25,2014 MEMBER HIRSCHBEIN stated that he would like to see a site plan with Palm Canyon Drive's elevations. He also asked if there was a reason as to why the retail space did not expand to the property line. BORIS MATHIS explained that the City Council had made it a condition to have a 10 foot gap. The purpose is also to provide an additional access point other than the parking lot. MEMBER HIRSCHBEIN stated that the 10 foot gap disrupts pedestrian flow. BORIS MATHIS maintained that the addition space is not necessary for the overall proposed project. MEMBER HIRSCHBEIN questioned how much space lies between the store fronts and the property lines. BORIS MATHIS answered that there is a 10 foot setback. MEMBER FREDRICKS asked if the tree box sizes would remain the specified size. RON GREGGORY explained that the boxes are shown with their minimum size and have potential to be larger. MEMBER SECOY-JENSEN asked if there had been another restaurant added. PRINCIPAL PLANNER ROBERTSON stated that there is still one tenant restaurant and the other shown is outdoor seating for the hotel's restaurant. This would not affect parking. MEMBER SECOY-JENSEN expressed her excitement for the project and reminded the applicant that the wooden louvers could become an eye sore if not done properly. MEMBER SONG stated that the overall look of clean white linear shapes is disrupted by the wooden trellis. JOSEPH SMART said the wooden trellis adds on as a compliment to the design. CHAIR FAUBER asked if there would be additional wood structures beside the trellis. BORIS MATHIS answered there would not be any other structures. The wooden trellis is a piece of furniture. 5 31 Architectural Advisory Committee Minutes August 25,2014 MEMBER SONG questioned if the floor to ceiling glass store front would provide an excessive amount of sunlight. She also questioned if the proposed project has too many elements that may not end in a cohesive manner. Additional renderings are needed to provide a better understanding. BORIS MATHIS showed some details on the presentation. MEMBER HIRSCHBEIN asked why the pilasters that separate the store fronts were 30 feet wide. BORIS MATHIS said the purpose was to distinguish each establishment. CHAIR FAUBER asked if the guest room doors were also going to be wooden. Also if the roof that was coming down to the pavement would be one plane, BORIS MATHIS answered that the guest room doors would be wooden and the roof would be one continuous plane of the cement plaster. CHAIR FAUBER asked how much control would be placed on the facade of the store fronts. He also asked if the fountain would have small structures. BORIS MATHIS said the objective of the proposed project is to maintain a cohesive project with minimal change to the proposed project designs. The fountain would not have small structures it is only water splashes. MEMBER SONG asked if more of the natural stone structures could be placed and why the location of the faux turf was set as it was. RON GREGGORY answered that they did not want the stones to become places to have people sleep on and the turf cannot be where it will have car wheel disturb it. MEMBER SECOY-JENSEN moved to approve as submitted to planning commission. PRINCIPAL PLANNER ROBERTSON added that no more comments could be made as this would be the final decision for the Architectural Advisory Committee. The board may add conditions to its approval. Any significance change will be subject to additional review by the board. HAGY BELZBURG, project architect, presented a computer simulation of the proposed project relating to the reduction of density for the hotel creating small bungalows and allowing continuation of the retail fabric down the street. Mr. Belzburg addressed the height, setbacks, massing, rooms, swimming pools, courtyard connectiv'dy and desert landscaping. BOB HELBLING, commented that this project is even better and liked the idea of the modem bungalow concept; he spoke in favor of the project. KIM WESTBROOK, commercial developer, spoke in favor of the proposed project and commended the applicant. 4 ] Page 33 1 Planning Commission Minutes December 11,2013 JOY MEREDITH, downtown business owner and president of MainStreet, commented that having this new project connecting downtown and uptown would be incredible. She said that lots of changes have been made and spoke in support of the project. FRANK TYSEN, said architecturally nice features, however, is concerned with the scale of the building and project should have an E.I.R. and more discussion on public benefit. He questioned adding another 150 rooms to the city. LAWRENCE RAEL, applicant, thanked all the speakers for their comments and was available to answer questions from the Commission. There being no further appearances the public hearing portion was closed. Commissioner Calerdine said the plans look really exciting and asked the architect to walk them through one of the plans from the lobby to the third or fourth floor hotel rooms next to Amado. Commissioner Roberts thanked the applicant for a great new design. He asked about the design on level two and why consideration was not taken for retail opportunities on Indian Canyon. Mr. Belzburg addressed his concerns and explained the concept of the project. Vice-Chair Hudson noted that the parking portion is split into two areas and questioned if the northern parking will be controlled or paid for parking. Mr. Rael responded that discussions have been on-going with the City in designing this parking and they were working on a negotiated agreement to make the north parking public and the south side will be valet parking. Vice-Chair Hudson asked if there will be access to the _parking from Indian Canyon. Mr. Rael answered as it is currently designed no; but there may be something that might be able to be incorporated into the project. Vice-Chair Hudson expressed concern that the bungalow village will not be visible from the street and commented on the lack of activity given to Indian Canyon. He feels the Indian Canyon elevation needs more attention to the pedestrian streetscape. Commissioner Weremiuk reiterated concern about access from the retail parking on Palm Canyon. She expressed concern with the lack of pedestrian streetscape on Indian Canyon and would like to see trees that provide shade and encourage walking. Commissioner Klatchko concurred with the comments from the Commissioners and suggested perhaps lowering the plateau about five feet on the north end to give better Visibility of the hotel rooms from the street. He has the same concems with the north parking and pedestrian access. It would be helpful for more access points for parking. 5 1 P a g e 34 7i Planning Commission Minutes December 11, 2013 Chair Donenfeld commented that it is unfair to expect the developer to make Indian Canyon more viable; that is the City's responsibility. The maximum front panel separating store front fagade along North Palm Canyon Drive shall be 8 feet long. Any individual tenant improvement involving the front panel fagade exceeding 8 feet shall be subject to review by the AAC. The comments below were made by the AAC at the preliminary review. The applicant has since incorporated the comments into the final plans. •' Consider a wraparound of the ground level retail on the south side • Improve the overhang on the east side of the project. • Add bulkhead on the east to block vehicle lights • Provide additional corner options on the northwest section of the site. Plan Conformance: The proposed final development plans provide additional architectural detail and include refined project information. Differences between the preliminary and final development plans include: • Refinement and elaboration to the building facades facing public streets • Extension of canopy along Palm Canyon to increase shade on the retail tenant spaces and pedestrian sidewalk areas. Palm Canyon Drive. For years now, the north end of the block has been vacant. This has resulted in a marked decrease of traffic on the block, since most people do not want to visit a vacant lot. (Go figure.) Please help get this project moving forward. I have no interest in the location, other than a need to see something there. The empty lot is killing my tenants, driving my rents lower, and costing the city money in lost tax revenue. And it is ugly. I know we have all sorts of laws, passed for obscure reasons, that, frankly make no sense to the average person, but at some point, it is time to pull the trigger and get projects moving forward.
