Kropitzer Joint Revocable Living Trust. The City Council will consider the adoption of a Resolution accepting the gift for the Library Trust Fund. RECOMMENDATION: Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACCEPTING A GIFT FROM THE HAROLD AND LORRAINE W. KROPITZER JOINT REVOCABLE LIVING TRUST FOR THE LIBRARY TRUST FUND." STAFF ANALYSIS: The Palm Springs Public Library has received notification that the Library is a beneficiary of the Harold and Lorraine W. Kropitzer Joint Revocable Living Trust. At the passing of Harold Kropitzer in October 2013, the terms of the trust have gone into effect. Once the estate is settled, beneficiaries will receive cash donations. The Palm Springs Public Library Trust Fund gift is estimated to be over $100,000.00. The following request has been made according to "Memorandum of dispositive provisions of trust," Article 5, "Distributions after the surviving trustor's death:" Section 5.2.7: The remainder of the trust estate in equal shares to the following nonprofit organizations: ITEM NO. The Palm Springs Public Library is able to meet the requirements of the gift and use the funds as stipulated by the Kropitzer Trust. At their October 23, 2014 meeting, the Library Board of Trustees unanimously accepted the gift. FISCAL IMPACT: No fiscal impact. WHEREAS, the Palm Springs Public Library gives great benefit to the residents and visitors of Palm Springs, California. WHEREAS, the Library Trust Fund is available to provide additional resources to the Palm Springs Public Library. WHEREAS, the Harold and Lorraine W. Kropitzer Joint Revocable Living Trust has designated the Palm Springs Public Library Trust Fund as a beneficiary of their estate. WHEREAS, the Harold and Lorraine W. Kropitzer Joint Revocable Living Trust requests that the funds be used for the construction or setting aside of a quiet reading center for senior patrons in the main library or, if this is not feasible, for the purchase of nonfiction adult books written in English. WHEREAS, the Palm Springs Public Library is able to provide either the construction or setting aside of a quiet reading center for senior patrons in the main library or, if this is not feasible, for the purchase of nonfiction adult books written in English. WHEREAS, the City of Palm Springs is appreciative to Harold and Lorraine W. Kropitzer for their generous donation and receives this donation on behalf of the Palm Springs Public Library Trust Fund. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The gift to the Palm Springs Public Library Trust Fund by the Harold and Lorraine W. Kropitzer Joint Revocable Living Trust is hereby approved. SECTION 2. The City Manager is authorized to execute all documents related to this Agreement. ADOPTED THIS 5TH DAY OF NOVEMBER, 2014.
