CITY COUNCIL STAFF REPORT DATE: November 19, 2014 CONSENT AGENDA SUBJECT: GRANT OF EASEMENT TO CALTRANS FOR MAINTENANCE OF TRAFFIC SIGNAL EQUIPMENT ON CITY PROPERTY AT THE INTERSECTION OF GENE AUTRY TRAIL (HWY 111) AND DISTRICT CENTER DRIVE, IN SECTION 18, TOWNSHIP 4 SOUTH, RANGE 5 EAST, SB&M; R1W FILE 14-24. Ready, City Manager BY: Public Works and Engineering Department SUMMARY Pursuant to Division 11, Chapter 2, Article 1, the California Vehicle Code directs the California Department of Transportation (CalTrans) to place and maintain appropriate signs, signals, and other traffic control devices to warn or guide traffic upon highways. In accordance with Section 21350 of the statute, the legislative body of a local agency may give consent to CalTrans to place and maintain signs, signals, and other traffic control devices as may be necessary to control or direct traffic, or to facilitate traffic flow, to or from state highways. This item gives CalTrans an easement on City property to maintain a new CalTrans traffic signal, equipment, and signage on the eastbound driveway approach to District Center Drive at Gene Autry Trail (Hwy 111). RECOMMENDATION: Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, GRANTING AN EASEMENT TO CALTRANS FOR MAINTENANCE OF TRAFFIC SIGNAL EQUIPMENT ON CITY PROPERTY AT THE INTERSECTION OF GENE AUTRY TRAIL (HWY 111) AND DISTRICT CENTER DRIVE, IN SECTION 18. TOWNSHIP 4 SOUTH, RANGE 5 EAST, SB&M; R/W FILE 14-24." STAFF ANALYSIS: On August 11, 2014 the City of Palm Springs Engineering Department was contacted by the Palm Springs Unified School District (PSUSD) requesting the City to grant an ITEM NO. City Council Staff Report November 19, 2014 - Page 2 Grant of Easement to Caltrans for Traffic Signal Equipment Maintenance easement to the California Department of Transportation (CalTrans) to install and equipment on Cit -owned property at the intersection of Gene maintain traffic signal y p p y Autry Trail (State Highway 111) and District Center Drive. The Conditions of Approval were approved by Planning Commission on February 10, 2010. TRAFFIC conditions ENG 59 & ENG 60 direct PSUSD to complete a traffic signal warrant analysis, and if required, install a new traffic signal at the intersection of District Center Drive and Gene Autry Trail. Since Gene Autry Trail is State Highway 111. PSUSD was directed to coordinate with CalTrans on the design and approval of the proposed traffic signal and striping. The westerly side of this intersection is a driveway that enters commerical businesses on property owned by the City of Palm Springs. Traffic detection loops, conduits, and pull boxes, along with appropriate traffic striping will need to be installed at the driveway entrance to facilitate the new traffic signal (see Figs. 1 - 4). PSUSD will pay for the new traffic signal and equipment. A maintenance easement is necessary to grant CalTrans the ability to maintain, replace, and repair the traffic loops, conduits, pull boxes, and additional equipment required to power the traffic signal situated within the property owned by the City of Palm Springs (see Exhibits A & B). Pursuant to aforementioned California Vehicle Code, Sections 21350, the City Council may give consent to CalTrans to place and maintain signs, signals, and other traffic control devices as may be necessary to control or direct traffic, or to facilitate traffic flow, to or from state highways. Staff recommends the City Council conditionally consent for a Grant of Easement to CalTrans for installation and maintenance of traffic signal equipment on City property as described in Exhibit "A" and shown on Exhibit "B", at Gene Autry Trail (State Highway 111) and District Center Drive, in Section 18, Township 4 South, Range 5 East, S.B.M. This conditional consent for a grant of easement is pending CalTrans final approval of the traffic signal plans (see Exhibits 1 & 2). FISCAL IMPACT: None. David J. Barakian David H. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, GRANTING AN EASEMENT TO CALTRANS FOR MAINTENANCE OF TRAFFIC SIGNAL EQUIPMENT ON CITY PROPERTY AT THE INTERSECTION OF GENE AUTRY TRAIL (HWY 111) AND DISTRICT CENTER DRIVE, IN SECTION 18, TOWNSHIP 4 SOUTH, RANGE 5 EAST SB&M; R/W FILE 14-24. WHEREAS, the City Council of the City of Palm Springs, California, ("City') is authorized by Division 11, Chapter 2, Article 2, of the Vehicle Code of the State of California ("the statute"), that directs the California Department of Transportation ("CalTrans") to place and maintain appropriate signs, signals, and other traffic control devices to warn or guide traffic upon state highways; and WHEREAS, the City has directed the Palm Springs Unified School District ("PSUSD") to conduct a warrant analysis for a traffic signal at the intersection of Gene Autry Trail and District Center Drive; and WHEREAS, the warrant analysis does constitute a need for a traffic signal at the intersection of Gene Autry Trail and District Center Drive; and WHEREAS, Gene Autry Trail is also State Highway 111 (Hwy 111) which falls under the jurisdiction of Caltrans for signs, signals, and other traffic control devices as necessary to control or direct traffic, or to facilitate traffic flow, to or fROm state highways; and WHEREAS, the westerly portion of this intersection is a driveway to businesses on property owned by the City of Palm Springs, said driveway will require loops, conduits, cables, pull boxes and other equipment to be maintained by CalTrans as necessary to control or direct traffic; and WHEREAS, pursuant to Section 21350 of the statute, the legislative body of a local agency may give consent to CalTrans to place and maintain signs, signals, and other traffic control devices as may be necessary to control or direct traffic, or to facilitate traffic flow, to or from state highways; and WHEREAS, the City Attorney has reviewed and approved the Grant of Easement and the City Council has decided to grant consent to CalTrans for maintenance of loops, conduits, cables, pull boxes and other equipment as necessary to control or direct traffic, or to facilitate traffic flow, to or from Gene Autry Trail (Hwy 111) through a Grant of Easement ---through a Maintenance Agreement pending approval by the City Attorney; 06 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council does hereby find that the warrant analysis does constitute a traffic signal at the intersection of Gene Autry Trail and District Center Drive. Section 2. The City Council does hereby find Gene Autry Trail is also State Highway 111 which falls under the jurisdiction of California Department of Transportation (Caltrans) for signs, signals, and other traffic control devices as necessary to control or direct traffic, or to facilitate traffic flow, to or from state highways; and Section 3. That, the City Clerk is hereby directed to cause a certified copy of this Resolution, attested by him under the seal of the City, to be recorded in the Office of the County Recorder of Riverside County.
