Ready, City Manager BY: Community and Economic Development Department SUMMARY This is an update on the activities of the Palm Springs BUZZ Pilot Trolley program, which commenced service on December 19, 2014. STAFF ANALYSIS: On December 19, 2014, the Palm Springs BUZZ was launched with a star-studded event in the Downtown. Subsequently, the overwhelming feedback has been positive and ongoing efforts are being taken to fine tune service and promote the program. Levels of Service Prior to the program launch, it was difficult to gauge how much use the trolley system would receive. As of the drafting of this report, the Buzz has operated four weekends. MV Transportation, the Buzz operator, began collecting ridership data in the second weekend of operation because it represented a full weekend. Since that time patterns have emerged and ridership has grown steadily. The other active spots remain the Village Green downtown, on an active restaurant block, the Hard Rock Hotel and the Ace Hotel. The peak hour has shifted from the 3:00 hour in the first two weekends to the 7:00 hour (followed by the 8:00 hour) in the most recent week. Ridership has increased from 3,269 pickups in the first week to 3,877 in the most recent week, an 18.6% increase in two weeks. The New Year's Eve weekend was slightly higher than the Christmas weekend but benefited from having New Year's Eve service from 5 p.m. to 1 a.m. A total of 704 passengers were picked up during those 8 hours of service — about 88 passengers per hour. That rate is about 38% higher than the average per-hour rate of normal service. It was a successful experiment, even on a Wednesday evening. Marketinsa Efforts The next phase of the project to ensure success of the pilot program is through continued implementation of the marketing efforts. The BUZZ Loyalty program (the BUZZ Perk Card) entices riders to use the service and provides local businesses an opportunity to promote the program via provision of incentives and prizes to BUZZ loyalty members. The perk cards allow for passengers to scan and record their rides to earn larger incentives, but the card itself can be used as a discount card with participating businesses. Currently there are 36 businesses on the Perk Board. Symblaze also administers the trolley's Facebook page, BUZZ PS, which now has over 900 "Likes" and a very high level of user engagement. They have developed a dedicated BUZZ PS website, designed the program brochure, the BUZZ signs, and all collateral material including the route map. Media marketing also includes a range of advertisements including radio, print, on-line publications, billboards, retail and television. Our Tourism Department has worked closely with Symblaze in this effort. Per the City's agreement with the BUZZ operator, the BUZZ features a mobile app that works on all platforms (iPhone, Android, desktop PC's, etc.), which can be found at 02 City Council Staff Report January 21, 2015 — Page 3 Palm Springs BUZZ Update www.thebus.mobi. GPS tracking equipment has been installed on each BUZZ vehicle to give riders the estimated arrival time at each stop. Tahquitz Canyon Way Palm Springs, CA 92262 RE: Request to Discontinue the Palm Springs BUZZ Trolley Route into the Historic Tennis Club Neighborhood Dear Honorable Members of the City Council Trolley Subcommittee Councilmember Foat and Mayor pro tem Lewin; City Manager Ready and Director Raymond; Joan Forrer and I are writing to respectfully request the City of Palm Springs discontinue the Palm Springs BUZZ Trolley route through the Historic Tennis Club Neighborhood. The BUZZ Trolley route through the Tennis Club Neighborhood runs up W. Baristo Rd., right onto S. Tahquitz Dr., right onto W. Arenas Rd., right onto S. Belardo Rd., left onto W. Baristo and back to Palm Canyon, 11:00 a.m. to 1 :00 a.m., every 15 minutes, Thursday through Sunday. The route is approximately nine-tenths of a mile. Therefore, a BUZZ bus drives through the Tennis Club Neighborhood route and drives in front of our home on W. Arenas Rd. 56 times a day, four days a week until 1 :00 a.m. Further, the BUZZ buses will drive up W. Baristo, across S. Tahquitz and down W. Arenas in front single family homes, condominiums, apartments, garden apartments, a timeshare resort, small boutique hotels, and our home 11,648 times in a year. January 12, 2015 Page 2 of 17 Executive Summary The Palm Springs BUZZ Trolley (hereafter BUZZ or Buzz) Historic Tennis Club Neighborhood route up W. Baristo Rd., across S. Tahquitz Dr. and down W. Arenas Rd. should be discontinued for the following reasons. 1. The buses, route, frequency, and hours of operation although appropriate for the commercial core Buzz route (Palm Canyon and Indian Canyon) are not appropriate for the Tennis Club Neighborhood route because east of S. Cahuilla Rd. (toward the mountains), the ma'ority of the properties on the route are residential (single family homes, condominiums, apartments, and garden apartments). There is also a timeshare resort and small boutique hotels on the route. A bus route 14 hours a day for 4 days a week until 1 :00 a.m. in the morning is inconsistent and incompatible with Tennis Club Neighborhood residential land use. 2. The Tennis Club route is not consistent with the Noise Element of the General Plan which provides that transit vehicles [buses] produce vibration with the "perceived intensity of vibration impacts greater indoors" and that residential land uses are "especially sensitive to vibration." (General Plan, Noise Element, p. 8-3). The buses produce vehicle noise and a distinctive rumbling noise, and cause vibration to our home. The Tennis Club route is also not consistent with the General Plan where the City seeks to create safe and attractive neighborhoods and preserve the charm, feel, visual appeal and sense of place for neighborhoods. (General Plan, pp. 1-3, 2-28, 9-1 , 9-44, 9-45.) 3. The Buzz Tennis Club route is and will have a negative impact on the Tennis Club Neighborhood by changing the romantic and historic character, feel, style, charm and sense of place of the Neighborhood. A bus route with buses 56 times a day (14 hours a day x 4 times an hour = 56), 11,684 times a year (56 times a day x 4 days a week x 52 weeks = 11,648), harms the charm, character, and sense of place of the Neighborhood. 4. The Tennis Club bus route will have a negative impact on the properties on the Tennis Club route west of S. Cahuilla by effecting the quality of life and suppressing property values because of buses driving by these properties 11,648 times a year. 5. The Tennis Club Buzz route and bus stop No. 10 on S. Tahquitz across from Spencer's Restaurant and stop No. 11 on W. Arenas and S. Belardo are unnecessary and wasteful of resources. There are other stops six short blocks away on Palm Canyon from Stop No. 10, and one short block away from Stop No. 11. 6. Moreover, the Buzz bus continues to run and drive the streets of the Tennis Club Neighborhood until 1 :00 a.m. - 3 hours after Spencer's closes at 10:00 p.m. There is really nothing to do in the area of Stop No. 10 after 10.00 p.m. City Council Trolley Subcommittee et al. January 12, 2015 Page 3 of 17 Executive Summary (continued) 7. The Buzz buses make 12 circuits (3 hrs. x 4 circuits per hour) of the Tennis Club route, 48 circuits in 4 days after 10:00 p.m. Thus, the buses drive approximately 2246 miles in a year (0.9 mile x 12 circuits x 4 days a week x 52 weeks = 2246) to service the S. Tahquitz Dr. stop after 10:00 p.m. when the only restaurant in the area, Spencer's is already closed. 8. No timely notice and opportunity for input to object to the establishment of the Tennis Club route was given to residents and/or owners of property on the W. Baristo, S. Tahquitz or W. Arenas route by the City. Further no environmental, traffic or other type study was done by the City to measure the impacts on the homes, condominiums, apartments, garden apartments, timeshare resort/hotel and small boutique hotels on the Tennis Club route. 9. The BUZZ Trolley Historic Tennis Club bus route on W. Baristo, S. Tahquitz and W. Arenas has safety issues related to the following. (a) W. Arenas gets a steady and significant volume of pedestrian traffic in both directions all day and often late into the evening (especially during weekends, high season, Thursday nights, holidays and vacation periods), coupled with pedestrians walking their dogs, those exercising (i.e. runners), bike riders, rental bike riders, and the "Big Horse" horse-drawn carriage (September - July Thursday nights and weekends). (b) The tendency of pedestrians during the day and night time to walk on the roadway on W. Arenas even when a sidewalk is present. (c) The lack of sidewalks (either on both sides of the street or one side) between S. Belardo and S. Tahquitz in many places on W. Baristo and at places on W. Arenas. (d) There are no crosswalks on W. Baristo, S. Tahquitz or W. Arenas west of S. Belardo. (e) The often heavy pedestrian and vehicle traffic at the junction of W. Baristo Rd. and S. Tahquitz Dr. related to pedestrians and cars coming in and out of Spencer's Restaurant and the Palm Springs Tennis Club. (f) There are no operating street lights on W. Baristo or W. Arenas, thus pedestrian are hard to see at night. (g) W. Baristo is a two lane road with parallel parking on both sides of the street from S. Cahuilla to S. Tahquitz, W. Arenas is a two lane road with parallel parking on both sides of the street in many places. City Council Trolley Subcommittee et al. January 12, 2015 Page 4 of 17 Executive Summary (continuedl (h) The approximately 161 perpendicular vehicle parking spaces and/or driveways on private property which require vehicles to back out onto W. Baristo, S. Tahquitz and W. Arenas day and night. (i) The sheer frequency of the buses driving into these conditions 11,684 times over a year. 10.The BUZZ Trolley bus stop on S. Tahquitz Dr. (No. 10) has safety issues related to the following. (a) The location of the bus stop just after a curve in the road. (b) The often heavy pedestrian and vehicle traffic at the junction of W. Baristo and S. Tahquitz related to pedestrians and cars coming in and out of Spencer's Restaurant and the Palm Springs Tennis Club. (c) When a Buzz bus stops at the red curb the width of the bus (8 ft.) reduces the usable amount of the northbound lane of S. Tahquitz forcing vehicles passing the buses on the left to move over into part of the southbound lane of S. Tahquitz and oncoming traffic. (d) Cars passing the bus on the left will have no line of sight for passengers standing in front of or getting off the buses and those drivers would have very little time to react if a bus passenger or other pedestrian steps out suddenly into the road from in front of the bus. (e) The passenger landing area is a sloped driveway/sidewalk entrance which could cause missteps and injury to persons getting off and onto the Buzz buses. (f) The location of the BUZZ route bus stop sign on grass/lawn near the high red painted curb gives the impression that riders waiting for the bus should stand on the grass near the BUZZ sign. Grass is not an appropriate bus stop waiting area surface as it is subject to deterioration with use. (g) The probability that late night bus riders getting off and on the buses had been drinking and possibly intoxicated increases the probability of missteps and injury under the above conditions. (h) The bus stop on S. Tahquitz Dr. after 10:00 p.m. has the potential for noise disturbances and/or crime since there is nothing to do after 10:00 p.m. at the stop when Spencer's closes at 10:00 p.m. and the late night ridership is likely to have been drinking and possibly intoxicated. (End of Executive Summary) City Council Trolley Subcommittee et al. January 12, 2015 Page 5 of 17 I. The BUZZ Trolley Route Through the Historic Tennis Club Neighborhood The Palm Springs Buzz Trolley system began running on December 19, 2014 for a one-year trial period. It currently runs from 11:00 a.m. to 1:00 a.m (14 hours), every 15 minutes, Thursday through Sunday. The Buzz buses leave the core route (Palm Canyon and Indian Canyon), and come up W. Baristo, right onto S. Tahquitz and then down W. Arenas, then right onto S. Belardo then left onto W. Baristo, and right back to South Palm Canyon. (See Attachment A, Buzz Trolley Route, January 2015 January; and, Attachment B, Aerial Photograph of the Tennis Club route.) W. Baristo has an uphill slope and W. Arenas a downhill slope for the route. The Tennis Club route is approximately nine-tenths (0.9) of mile long. There is a Buzz bus stop (No. 10) across from Spencer's Restaurant, on the east side of S. Tahquitz Dr. just after the curve and another on S. Belardo Rd., at W. Arenas (No. 11). On Thursday nights, during VillageFest, the route into the Tennis Club Neighborhood is modified, starting on S. Belardo rather than South Palm Canyon, then right onto W. Baristo, right onto S. Tahquitz, right onto W. Arenas, and right onto S. Belardo, then left onto Baristo and back on the core route on Palm Canyon. Joni and I do not oppose the use of S. Belardo for the Thursday night route modification. (See Attachment A.) Joni and I live at 457 W. Arenas Rd., Palm Springs. We live on the newly established BUZZ Trolley bus route into the Historic Tennis Club Neighborhood. Joni purchased our home in the late 1990s. Our home lies mid-block on W. Arenas with S. Patencio Rd. to the west and S. Lugo Rd. to the east. (See Attachment B, Aerial Photograph - red dot added to indicate the location of our home on W. Arenas.) In the immediate vicinity of our home is an apartment building to our west, a condominium complex to our east, a small boutique hotel across the street, and two condominium complexes on either side of the small hotel. We are not aware of any prior transit bus or free bus route on W. Arenas at anytime prior to the Buzz route. Joni has lived in our home for 18 years and I for four and a half years. We are both retired. Joni owned and ran restaurants on the north shore of Lake Tahoe for 30 years. I was a Level I Reserve Deputy Sheriff for Placer County Sheriff's Department for 10 years, at the Tahoe City Substation. Subsequently, for approximately 15 years I was an outside research attorney for the County of Santa Barbara, County Counsel's Office, Litigation Division. The County of Santa Barbara was my only client. City Council Trolley Subcommittee et al. January 12, 2015 Page 6 of 17 The Historic Tennis Club Neighborhood is a registered Neighborhood with the City of Palm Springs Office of Neighborhood Involvement, established in 2005. (General Plan, p. 9-45.) The Historic Tennis Club Neighborhood is bounded by S. Belardo to the east, Tahquitz Canyon to the north, the mountains to the west, and Sunny Dunes to the south. The Neighborhood also includes Tahquitz Canyons Estates located at the west end of Ramon Rd. It is our belief that the BUZZ buses are 2014 Supreme Classic American Trolleys and are approximately 30 feet long and 8 feet wide and may carry up to 22 passengers seated, places for wheel chairs, and may carry up to 15 passengers standing. 1 Our home on W. Arenas has a front lawn and porch. We spend considerable time on the lawn and porch with Lucy, our 3-1/2 year old Golden Retriever. Moreover, our living room and office connect directly to the front porch so year-round we enjoy a view of the mountains, and interacting with our friends, visitors and strangers who walk by our house and stop to chat and talk to and pet Lucy. Many of the seasonal visitors who have been coming to the Tennis Club Neighborhood for years come back every year and stop at our front yard to see, greet, talk to and pet Lucy. Joni had another Golden Retriever named Lucy when Joni first purchased and moved to W. Arenas, and for those 12 years some of the same current seasonal visitors would stop every year to see the previous Lucy. Joni, Lucy and I often stay out on the front lawn and/or porch well into the evening. Until the Trolley service started, we were unaware that the Buzz Trolley route would come in front of our house on W. Arenas, four days a week, from 11 :00 am to 1:00 a.m. (14 hours a day), every fifteen minutes. Now, a Buzz bus comes by our house 56 times a day, and 224 times over four days and will drive by 11,648 times in a year. We are members of the Palm Springs Tennis Club, eat at Spencer's and many of the downtown restaurants. Joni and I plan on living in our home the rest of our lives. Most days Joni and I walk to the Tennis Club or downtown, often with Lucy. On the days the Buzz buses run, to be honest, we have not enjoyed the anticipation of having to share the environment with a bus driving by every 15 minutes. Since the Buzz buses began running into the Tennis Club Neighborhood Joni and I have started to especially look forward to Monday, Tuesday and Wednesday when we know there will be no buses 56 times a day and the Neighborhood is back to its normal routine. 1 The Buzz Trolley is a bus as defined by the Vehicle Code, sections 233 (a), 408, 34500. The Buzz is described as a bus numerous times in the June 18, 2014 City Council Staff Report (Trolley Services Operator Pilot Program Contract Award). City Council Trolley Subcommittee et al. January 12, 2015 Page 7 of 17 To be clear, Joni and I fully support the core route for the BUZZ Trolley serving the commercial core of Palm Springs, and we support the hours of operation, frequency of service and the size of the buses for that core route on Palm Canyon and Indian Canyon. Moreover, we do not oppose the buses using S. Belardo Rd. during VillageFest on Thursday nights. However, Joni and I feel the BUZZ Trolley route, buses, frequency and hours of operation, although very appropriate for the main Buzz route on Palm Canyon and Indian Canyon Drive, the route, buses, frequency and hours of operation are completely inappropriate for the Historic Tennis Club Neighborhood for many reasons and respectfully should be discontinued. II. Negative Impacts of the Buzz Route, Schedule and Buses On The Historic Tennis Club Neighborhood's Character, Feel, Style, Charm and Sense of Place The Historic Tennis Club Neighborhood has a reputation as a romantic, walkable, historic neighborhood. The Neighborhood has its own character, feel, style, charm, historical development patterns and sense of place. Joni and I feel a bus route and buses every 15 minutes on W. Baristo, S. Tahquitz and W. Arenas till 1 :00 a.m. in the morning negatively changes the feel and nature of the Neighborhood. For one example, having a bus route and transit buses drive through the neighborhood on W. Baristo and W. Arenas is inconsistent with the romantic and peaceful horse drawn carriage that uses W. Baristo and W. Arenas, September through July on Thursday night and weekends. The horse drawn carriage fits the romantic nature and history of the Neighborhood. Joni and I greatly enjoy seeing the carriage come by our house at a leisurely pace. Joni and I believe the Buzz bus route, buses, frequency and hours of operation up W. Baristo, across S. Tahquitz and down W. Arenas is and will continue to have a negative impact on the Historic Tennis Club Neighborhood and the homes, apartments, garden apartments, condominiums, the timeshare resort/hotel and small boutique hotels on the Tennis Club route. Unlike the core route where the Buzz runs through the Central Business District and the commercial core of Palm Springs (hotels, business, restaurants, stores, etc.) and serves a real purpose running along Palm Canyon and Indian Canyon, the route on W. Baristo, S. Tahquitz and W. Arenas has a majority of the properties on the route west of S. Cahuilla with residential uses (single family homes, condominiums, garden apartments and apartments). City Council Trolley Subcommittee et al. January 12, 2015 Page 8 of 17 The vast majority of properties along W. Baristo, from S. Cahuilla to S. Tahquitz are single and multiple residential uses with: seven (7) single family homes, one (1) garden apartment complex (R-G-A-8 zoning), three (3) condominium complexes, and one (1) apartment complex. There is also a portion of a fractional timeshare resort (Palm Springs Tennis Club Resort) on upper W. Baristo.2 Along S. Tahquitz Dr. from W. Baristo to W. Arenas is the Palm Springs Tennis Club Resort. On W. Arenas, from S Tahquitz to S. Cahuilla is mixed use, with seven (7) condominium complexes, two (2) apartment complexes, one (1) single family home, one (1) three unit rental property, eight (8) small boutique hotels and a portion of the fractional timeshare resort/hotel (corner of S. Tahquitz and W. Arenas). Therefore, the larger portion of the properties along the route west of S. Cahullia into the Historic Tennis Club are residential and not small hotel. The only restaurant on the route is Spencer's Restaurant, operating from 8:00 a.m. to 10:00 p.m. Moreover, having a bus route through the Tennis Club Neighborhood is not consistent with the City's General plan where the City seeks to create safe and attractive neighborhoods and preserve the charm, feel, visual appeal and sense of place for neighborhoods. (See General Plan pages 1-3, 2-28, 9-1, 9-3, 9-44, 9-45.) Joni and I talk to many of the patrons from Spencer's, patrons staying at the Palm Springs Tennis Club Resort, residents of the condos, apartments and small hotels in the neighborhood because they walk be our house and stop to pet our dog Lucy. It is our opinion those persons are unlikely to use the Buzz bus stop at Spencer's, since they all enjoy walking to and from downtown. Z The first short block on the Tennis Club route on W. Baristo is S. Palm Canyon to S. Belardo. This block in not within the Tennis Club Neighborhood. This block is in the commercial core of Palm Springs and is designated Central Business District by the General Plan. The next block west on Baristo is Belardo to S. Cahuilla. This block is in the "Tennis Club District" which was established by the Palm Springs Downtown Urban Design Plan. (DUDP, p. 34.) The Tennis Club District runs three long blocks north to south, bordered by Tahquitz Canyon to the north, Ramon Rd. to the south, S. Belardo Rd. to the east and S. Cahuilla Rd. to the west. With a few exceptions, the Tennis Club District has hotels. Although the District is within the borders of the Tennis Club Neighborhood, as described above the land uses on the Tennis Club Neighborhood route change significantly west of S. Cahuilla (one block west of S. Belardo) compared to the first two blocks on W. Baristo west of South Palm Canyon. City Council Trolley Subcommittee et al. January 12, 2015 Page 9 of 17 Joni and I feel the buses, route and frequency of service are incompatible and inappropriate with the steady pedestrian use of the streets in the Neighborhood. W. Arenas gets a steady and significant volume of pedestrian traffic in both directions all day and often late into the evening (especially during weekends, high season, Thursday nights, holidays and vacation periods), coupled with pedestrians walking their dogs, those exercising (i.e. runners), bike riders, rental bike riders, and the Big Horse horse- drawn carriage (September - July Thursday nights and weekends). With all due respect, Joni and I do not see how buses on the streets of the Historic Tennis Club Neighborhood every 15 minutes until 1 :00 a.m., or 11,684 times a year enhances the Tennis Club Neighborhood, makes it safer or preserves its charm and historic sense of place. III. The BUZZ Bus Route and Bus Stop in The Tennis Club Neighborhood Are Not Necessary and Not an Efficient Use of Resources The almost 1 mile (approximately 0.9 mile) route into the Tennis Club Neighborhood is a waste of resources and fuel, serves a very limited purpose, provides little benefit weighed against the costs and is unnecessary for the following reasons. 1. Assuming am approximately nine-tenths (0.9) of a mile Buzz route into the Tennis Club Neighborhood, 56 times a day, for four days a week for 52 weeks, the buses are driving approximately 10,483 miles in a year to service the stop on S. Tahquitz Rd. (No. 10), which is across the street from Spencer's Restaurant and the Palm Springs Tennis Club, and stop No. 11 on S. Belardo at W. Arenas. 2. First, the route into the Tennis Club Neighborhood and the bus stop across from Spencer's is unnecessary, since it is a short walk (six short blocks) from either end of S. Tahquitz Dr. to the stop at Arenas and South Palm Canyon (Stop No. 9) and/or Buzz Stop No. 12 on Palm Canyon. (See Attachment B, Aerial Map.) Buzz stop No. 11 on W. Belardo at W. Arenas is unnecessary since stop No. 9 is one short block away. 3. Moreover, using S. Lugo Rd. as the cut off point, for those residents, visitors and others living or staying at locations east of S. Lugo it is approximately the same distance (3 short blocks) to walk to the South Palm Canyon stops than to the Spencer's stop. The same is true for those at the the north end of S. Patencio. It is a short 4 block walk to either Spencer's stop or down to Stop No. 9. 4. For those residents west of S. Lugo and S. Patencio, if they walk west to the Spencer's stop and they wait any longer then say - 7 to 10 minutes for a bus, they could have already walked down to Palm Canyon. The same goes for persons staying at Colony 29 at the far north end of S. Tahquitz Dr. City Council Trolley Subcommittee et al. January 12, 2015 Page 10 of 17 5. Moreover, Joni and I talk to many of the patrons from Spencer's, patrons staying at the Palm Springs Tennis Club Resort, residents of the condos, apartments and small hotels in the neighborhood because they walk by our front yard going to or from downtown and often stop to pet our dog Lucy. It is our opinion those persons are unlikely to use the Buzz bus stop at Spencer's, since they all enjoy walking to and from downtown. 6. The only restaurant on the Tennis Club route is Spencer's. Spencer's closes at 10:00 p.m. There is literally nothing to do on S. Tahquitz after Spencer's closes. The Tennis . Club Pro Shop closes at 5:00 p.m. and the iron gates behind Spencer's leading to the Pro Shop are locked at 9:00 p.m. 7. The Buzz buses continue to drive the Tennis Club Neighborhood route up to the Spencer's stop (No. 10) for 3 more hours until 1 :00 a.m. Therefore buses drive 12 more circuits of the Tennis Club route, 48 circuits in 4 days and the City is using approximately 2246 miles worth of fuel to keep the S. Tahquitz stop open after 10:00 p.m., when Spencer's is already closed for the night. 8. As Palm Springs is a city to encourage walking and fitness, saving resources and not wasting resources, the City is using approximately 10,048 miles worth of fuel a year (0.9 miles x 4 times an hour x 14 hrs. a day x 4 days a week x 52 weeks a year = 10,048 miles) to keep BUZZ bus stop No. 10, at S. Tahquitz Dr. and stop No. 11 open 14 hours a day, four days a week. (See Attachment A, Buzz Route.) Respectfully, to make our position clear, Joni and I are asking the City to discontinue the BUZZ Tennis Club route completely. We would continue to oppose the Tennis Club route running in the Tennis Club Neighborhood even if the City reduced the number of days and hours of service to BUZZ bus Stop No. 10 at S. Tahquitz Dr. We also would oppose merely changing the route within the Neighborhood, west of S. Belardo Rd. IV. Procedural Background of the BUZZ Trolley Route First, Joni and I want to thank the City Council Trolley Subcommittee, City Council, and Stakeholder Trolley Committee for all the work and effort to get the BUZZ Trolley up and running. As we noted above, we fully support the Buzz for the core route on Palm Canyon and Indian Canyon and hope it is successful. However, Joni and I feel that there was procedural unfairness and differential treatment for those persons living and owning property on the Tennis Club route versus the core route constituents (i.e. Trolley Stakeholder Committee) in the City's process which established the bus route into the Historic Tennis Club Neighborhood. City Council Trolley Subcommittee et al. January 12, 2015 Page 11 of 17 The Tennis Club route is and will have a negative impact on the Tennis Club Neighborhood, effecting the quality of life and no doubt property values of those properties who where given a transit bus route and buses driving by their properties 56 times a day, and 11,684 times a year where no bus route ever existed before. The process to establish such a route would need to be fundamentally fair and provide equal treatment and access for all those persons and property impacted by the Tennis Club route. Respectfully, for the reasons described below, we feel that did not happen when the decision was made to put the Buzz route through the Historic Tennis Club Neighborhood. 1. The City did not give us notice a bus route would be placed in front of our home with a bus coming by 56 times a day, Thursday through Sunday, until 1 :00 a.m., 11,648 times a year. The City routinely provides notice to those living within a 500 foot radius of a project (i.e. a City proposed amendment to the General Plan to change a General Plan zoning designation of parcels from Small Hotel to Central Business District). No noticed City Council hearing about establishing the bus route through the Tennis Club Neighborhood was noticed or held, and no public vote was held. 2. If Joni and I had known about the Tennis Club route the first time the City proposed the idea within the Trolley Subcommittee and/or Stakeholder Trolley Committee, Joni and I would have opposed the idea for all the reasons stated here. It is our understanding that no person living on the Tennis Club route (on W. Baristo, S. Tahquitz or W. Arenas) was on the Stakeholder Trolley Committee. 3. It is our understanding and belief that core route constituents (including the Stakeholder Trolley Committee made up of hotel managers) apparently had input and access to the process from the beginning yet to our knowledge we believe there was no equivalent access and input or timely notice given to the individual residents and property owners along W. Baristo, S. Tahquitz and W. Arenas. 4. 1 have found no publicly disclosed reference to or discussion of the route for the Buzz going up W. Baristo Rd., across S. Tahquitz Dr., and down W. Arenas Rd. in any of the City Council video, minutes and agenda archives. (a) The November 20. 2013 City Council Staff Report on the Trolley project describes the likely core route (Palm Canyon and Indian Canyon) with no mention of the Tennis Club route. (b) The June 18, 2014 City Council Staff Report regarding the Pilot Program Contract, again describes the route as generally the core route. No mention of the Tennis Club route. (c) The July 16. 2014 Staff Report has no description of a route. City Council Trolley Subcommittee et al. January 12, 2015 Page 12 of 17 (d) During the September 3, 2014 City Council meeting during Councilmember Comments, Coucilmember Foat discussed that the route had been kind of outlined by the Subcommittee. However, no description of the route was provided. (e) During the October 1. 2014 City Council meeting discussing the Symblaze contract, Councilmember Foat asked how will "strangers to our city" know where to get the Buzz, if they are standing on Indian [Indian Canyon] how will you know or "standing on Baristo" and "pick it up." The "Baristo" comment could be interpreted a number of ways. Nevertheless, it does not describe a route into the Tennis Club Neighborhood. (f) The December 17, 2014 video archive of the City Council meeting depicts that during the "City Manager's Report", City Manager David Ready stated generally that the Buzz Trolley is starting on Friday [December 19, 2014]. Mr. Ready showed slides/pictures of the Buzz Trolley signs used for the Buzz stops and noted that there will be about 30 of them [signs] throughout the City on Indian and Palm Canyon. No mention of the Tennis Club route or the S. Tahquitz Dr. stop was made by Mr. Ready. 5. Joni and I are not aware of any environmental study or traffic study conducted by the City for the W. Baristo, S. Tahquitz, or W. Arenas route on the impacts of placing a bus route with buses running past homes, condominiums, apartments, a timeshare/ hotel resort and small hotels 11 ,684 times a year (56 times a day, four days a week, every 15 minutes from 11 :00 a.m. until 1:00 a.m.) 6. As perceived from our home the buses produce vehicle noise and a distinct rumbling noise. In addition, the buses produce vibration into and of our home. Moreover, the frequency of the buses at 56 times a day is a consistent generator of the effects about every 15 minutes. The City of Palm Springs General Plan recognizes that transit buses are a common source of vibration and that residential land uses are "especially sensitive to vibration." 3 3 The General Plan, Noise Element, at page 8-3 states: "Vibration can be felt outdoors, but the perceived intensity of vibration impacts is much greater indoors, due to structural shaking. Some of the most common sources of vibration come from trains, transit vehicles, construction equipment, airplanes, and trucks. Several land uses are especially sensitive to vibration, and therefore have a lower vibration threshold. These uses include, but are not limited to, concert halls, hospitals, libraries, vibration-sensitive research or manufacturing operations, residential areas, schools, and offices." [bolded italics emphasis add.] City Council Trolley Subcommittee et al. January 12, 2015 Page 13 of 17 V. The BUZZ Bus Route on W. Baristo Rd., S. Tahquitz Dr. and W. Arenas Rd. and Safety Issues Joni and I believe that the placement of the bus route on W. Baristo, S. Tahquitz and W. Arenas involves safety concerns for the following reasons. A. Physical Conditions Different: The size of the Buzz buses, frequency and hours of operation were designed for the commercial core route (Palm Canyon and Indian Canyon) where the physical road conditions are very different than on the Tennis Club route (W. Baristo, S. Tahquitz and W. Arenas). 1. The core route is either 4 lanes (2 lanes in each direction with parallel parking on both sides), four lanes one-way, 3 lanes one-way with parking on both sides or 4 lanes with two lanes in each direction but no parking on the sides, but turn lanes. The Tennis Club route are all two lane roads (one lane in each direction) with parallel parking on each side of the roads except where there are red marked curbs and driveways. We believe the buses are approximately 30 feet long and 8 feet wide. The maneuvering room for the buses on the Tennis Club route is limited compared to the core route. 2. Driving west on W. Baristo there is no sidewalk for most of the distance from S. Cahuilla to S. Patencio on the south side of W. Baristo (2 blocks). There is no sidewalk on the south side of W. Barisro from Tennis Club Dr. to S. Tahquitz Dr. and there is no sidewalk on the north side of W. Baristo from San Jacinto Dr. to S. Tahquitz. Therefore, there are no sidewalks on either side of W. Baristo from Tennis Club Dr. to S. Tahquitz. Thus, pedestrians are forced to walk in the street on upper W. Baristo. This location routinely gets heavy pedestrian and vehicle traffic from Spencer's Restaurant and the Palm Springs Tennis Club because their entrances are at the junction of upper W. Baristo and S. Tahquitz. The core route appears to have adequate sidewalks. 3. Driving east on W. Arenas there is no sidewalk for a short distance on the south side of W. Arenas just down from S. Tahquitz, no sidewalk for a short distance on the south side of Arenas at S. Patencio and no sidewalks on either side of the street for a short distance east of S. Cahuilla. 4. In many locations along the Tennis Club Buzz route a large number of vehicles are parked on private property perpendicular to the road and must back out into the street, which include approximately 9 spaces and/or driveways on W. Baristo Rd., the approximately 40 parking spaces in front of the Palm Springs Tennis Club Resort timeshares on the east side of S. Tahquitz and the approximately 112 parking spaces and/or driveways on both sides of the street on W. Arenas. Thus, the buses operating every 15 minutes are likely during day and night time operations to encounter vehicles that will back into the street at any time of the day or night. This condition does not exist in the core route. City Council Trolley Subcommittee et al. January 12, 2015 Page 14 of 17 B. Uses of the Streets Different: The size of the Buzz buses, route, frequency and hours of operation were designed for the commercial core route (Palm Canyon and Indian Canyon) where the use of the roadways by pedestrians and others are very different than on the Tennis Club route (W. Baristo, S. Tahquitz Dr. and W. Arenas). 1. It is our observations over the years that the Tennis Club Neighborhood is a walking neighborhood. Patrons going to or from Spencer's, the Palm Springs Tennis Club, Palm Springs Tennis Club Resort, the condominiums, apartments, residences and small hotels in the neighborhood walk up and down W. Arenas on a daily and nightly basis on their way to or from downtown. 2. It is our observations over the years that W. Arenas Rd. gets a steady and significant volume of pedestrian traffic in both directions all day and often late into the evening (especially during weekends, high season, Thursday nights, holidays and vacation periods), coupled with pedestrians walking their dogs, those exercising (i.e. runners), bike riders, rental bike riders, and the Big Horse horse-drawn carriage (September - July Thursday nights and weekends); 3. It is our observations that these pedestrians on W. Arenas often walk in the streets, on the street side of cars parked parallel even where there are sidewalks on one or both sides of W. Arenas. 4. As described in detail above, sidewalks are not continuous on either W. Baristo or W. Arenas and in one place for each street there are no sidewalks on either side of the streets. Therefore, even those pedestrians wanting to use sidewalks are forced to walk in the street at times on W. Baristo and W. Arenas or forced to cross the street to a continuous sidewalk on the other side of the street. 5. There are no sidewalks on either side of Baristo from S. Tahquitz down to Tennis Club Dr. and cars routinely parallel park on either side of W. Baristo at that location and there is routinely heavy pedestrian and vehicle traffic in that location from Spencer's and the Tennis Club, especially during peak lunch and dinner hours and events. For pedestrians walking on both sides of the road at this location at the same time, the buses have to move to the center of the road to pass pedestrians or come to a complete stop until the pedestrian traffic passes. 6. With pedestrians on W. Arenas routinely choosing to or having to walk on the roadway, and pedestrians on W. Baristo being forced into using the street on upper W. Baristo (S. Tahquitz to Tennis Club Dr.) the Buzz buses do and will encounter numerous pedestrians walking on the roads of the Tennis Club route. This is not a condition found on the core route. 7. The core route (Palm Canyon and Indian Canyon) has numerous controlled pedestrian crosswalks for pedestrians crossing the core streets. The Tennis Club route has no crosswalks of any kind west of S. Belardo. City Council Trolley Subcommittee et al. January 12, 2015 Page 15 of 17 8. There are no operating street lights on W. Arenas or W. Baristo west of Belardo. Pedestrians are hard to see on the W. Arenas and W. Baristo route at night. The core route is well light with street lights. 9. The Tennis Club neighborhood and especially W. Arenas is a favorite path for bike riding. Last year a bike rental shop opened near the northeast corner of E. Arenas Rd. and Indian Canyon. 10.The Big Horse Carriage Company operates from September to July in downtown Palm Springs on Thursday night and weekends, and uses W. Baristo and W. Arenas and comes by our house often at a leisurely and romantic pace. 11.The frequency of operation, where the buses will drive through the Tennis Club Neighborhood 11,648 a year increases the number of possible encounters between the buses and pedestrians, bike riders, horse carriages and vehicles backing into the street and creates a higher probability of an unsafe condition and encounter that could produce an accident and/or injury. VI. The BUZZ Trolley Stop No. 10 on S. Tahquitz Dr. and Safety Issues Joni and I believe that the Buzz bus stop (No. 10) just after the curve on S. Tahquitz Dr. has safety concerns for the following reasons. 1. The bus stop was placed on S. Tahquitz Dr. just after the curve after turning right onto S. Tahquitz Dr. from W. Baristo Rd. The buses stop with the forward portion of the bus at the slopped driveway/sidewalk for valet parking spaces, with the rear of the bus extending along the high red painted curb. 2. Moreover, during many times of the day and evening there is significant vehicle use of W. Baristo heading west to get to Spencer's Restaurant and the Palm Springs Tennis Club. To get to the front entrance of Spencer's drivers coming up W. Baristo must drive past a stopped bus and/or the bus stop to turn left off of S. Tahquitz Dr. into the valet and drop-off circle at Spencer's and the Tennis Club's front entrances. 3. There is no stop sign at the junction of W. Baristo and Tahquitz Dr. therefore drivers proceeding west on W. Baristo who may not notice the bus at the stop (or even those who do see the bus) may proceed around the curve and around the bus and be surprised to encounter pedestrians directly crossing S. Tahquitz Dr. to get on the bus or riders disembarking from the bus who cross in front of the bus or cross immediately after the bus departs to go to the Tennis Club or Spencer's. City Council Trolley Subcommittee et al. January 12, 2015 Page 16 of 17 4. When a Buzz bus stops at the red curb the width of the bus (8 ft.) reduces the usable amount of the northbound lane of S. Tahquitz Dr. forcing vehicles passing the buses on the left to move over into part of the southbound lane of S. Tahquitz Dr. and possibly oncoming traffic. 5. Cars passing the bus on the left will have no line of sight of passengers standing in front of or getting off the buses and would have very little time to react if a bus passenger or other pedestrian steps out suddenly into the road from in front of the bus. 6. Passengers/riders on the bus when disembarking are stepping down onto a sloping westward driveway sidewalk used to access parking spaces for valet parked cars. Likewise passengers getting on the bus are stepping off of a sloping westward driveway sidewalk. Thus, the passengers are not steeping off a flat surface to enter the bus nor onto a flat surface when getting off the bus. The sloped concrete could cause missteps and/or injuries. 7. Riders getting Off or 4Il the bus after 10:00 p.m. at the Spencer's stop are likely to have been drinking and/or intoxicated and the sloping concrete may cause missteps and/or injuries. 8. The "BUZZ Trolley" bus stop sign at the Tahquitz stop, is placed on a grass/awn area with no sidewalk and with a high red painted curb. Persons unfamiliar with the stop could easily assume that is the stop location and wait for the buses arrival standing on the lawn and possibly near the high red curb. These conditions and placement of the sign could increase the possibility of missteps and injury. 9. The location of the BUZZ route bus stop sign on grass/lawn near a high red painted curb gives the impression to riders waiting to get on the bus that they should stand on the grass near the BUZZ sign for pickup. Lawn is not an appropriate surface for a bus stop waiting area. Lawn is an unstable surface subject to deterioration with pedestrian use, especially if wet. 10.It is probable that the riders using the Buzz Trolley system from approximately 10:00 p.m. until 1 :00 a.m. may be persons going to or from bars, lounges or parties. It is reasonable to conclude that a good portion of those riders will have been drinking and possibly intoxicated. This increases the likelihood of noise disturbances and/or crime when those riders disembark for any reason at the Spencer's bus stop (Stop No. 10 on S. Tahquitz Dr.) anytime after 10:00 p.m. Spencer's closes are 10:00 p.m. 11.Finally, the frequency of operation, where the buses will drive the BUZZ Trolley route and stop at the S. Tahquitz (Stop No. 10) dropping off or picking up passengers, or drive by it without stopping, with a combined total of 11,648 times a year, creates a higher probability of an unsafe condition causing an injury. City Council Trolley Subcommittee et al.
