PROVISION, INSTALLATION AND MAINTENANCE OF ADVANCED
NETWORK (DATA) SERVICES AT PALM SPRINGS PUBLIC LIBRARY
AND WELWOOD MURRAY MEMORIAL LIBRARY.

SUMMARY
The Palm Springs Public Library is eligible to join a consortium to receive discounted,
high-speed Internet services through the California State Library, as administered by
Califa Group, a California 501(c)(3) Public Benefit Corporation. The City Council will
consider the approval of a service agreement with Califa to administer the consortium
contracts and provide the installation and service of high-speed Internet at the Palm
Springs Public Library and the Welwood Murray Memorial Library.
RECOMMENDATION:
1. Approve a Services Agreement with Califa Group to provide high-speed Internet at
the Palm Springs Public Library and the Welwood Murray Memorial Library, and
administer related consortium contracts with the California State Library and the
California Research and Education Network.
2. Authorize the City Manager or his designee to execute all necessary documents.
BACKGROUND AND ANALYSIS:
Work is underway to bring high-speed broadband to all of California's public libraries by
connecting them to the California Research and Education Network (CaIREN), a high-
capacity 3,800-mile fiber-optic-based network. This network is operated by CENIC, the
Corporation for Network Initiatives in California, a non-profit California corporation.

Library Service Agreement
Three organizations have joined together to undertake this work: the California State
Library, the Califa Group, and CENIC. Califa has been contracted by the California
State Library to create the contracts with participating libraries for the services that will
deliver high-speed broadband to libraries and enable them to use the CaIREN network.
Currently the Palm Springs Public Library and Welwood Murray Memorial Library
provide patrons with no-cost Internet service. The City's service is provided by Time
Warner Cable. Time Warner provides Internet speeds of 50 Mbps download and 5
Mbps upload and using the wireless connection the speeds drop to 15 Mbps download
and 2 Mbps upload. By joining the consortium, the libraries will be provided Internet
speeds of 1,000 Mbps for both upload and download.
The Service Agreement allows Califa to contract with CENIC to provide high speed
networking to the Palm Springs Public Library and Welwood Murray Memorial Library.
During the first contract, the service agreement is for a period of one year and four
months. Subsequent terms are renewable beginning July 1 for a length of one year.
CENIC is governed by its Charter Associates: California K-12 schools, California
Community Colleges, California State University, University of California, and private
universities Stanford, California Institute of Technology, and University of Southern
California. By joining this essentially "private" Internet, the Library would receive more
reliable service, 24/7 network monitoring to ensure the system is online and stable, and
would not be competing for technical support in the commercial marketplace. For the
end user, Internet access would appear to be the same as the commercially purchased
connection but the speed and reliability would improve considerably. In the long run,
the costs would be significantly less and the speed significantly faster.
Through this process, all fees must be paid up front each year but are eligible for
rebates which can take up to a year to receive. According to the rebate criteria, Palm
Springs Public Library and Welwood Murray Memorial Library are eligible to receive
80% rebates on circuits and 90% rebates on monthly Internet service fees from the
Federal Communications Commission (FCC). As part of this agreement, Califa will
process all rebate paperwork on behalf of the Library.
To access the high-speed network, the Library must connect to CaIREN. The nearest
CaIREN connection point is located in Palm Desert, CA at California State University-
San Bernardino, Palm Desert campus (PDC). To connect to CaIREN at PDC, the
proposed non-recurring cost has been quoted at $1,000.00. This fee is eligible for an
80% rebate at $800.00. Once the rebate is received, our out of pocket cost to connect
would be $200.00. Once we are connected to CaIREN, our monthly service charge
would be $1,500.00 for Palm Springs Public Library and $1,650.00 for Welwood Murray
Memorial Library, before rebates. Our out of pocket costs for Internet speeds of 1 Gbps
(1,000 Mbps), after a 90% rebate would be $150.00 and $165.00 monthly, respectively.
In order for the connection to run smoothly, the Library would be required to purchase a
new router, firewall and a LAN interface capable of handling Internet of that speed for

each location, with the equipment possibly eligible for grant funding through the
California State Library. This equipment is estimated to cost $25,000.00,
Palm Springs Public Library has existing contracts with Time Warner Cable for Internet
until July 30, 2016 and Wi-Fi until August 30, 2016. Monthly charges total $610.00;
$7,320.00 annually.
Welwood Murray Memorial Library has a contract with Time Warner Cable for Internet
and Wi-Fi until September 30, 2018. Monthly charges total $360.00; $4,320.00
annually.
The current total annual output for Internet services is $11,640.00.

If the Library chooses to remain with Time Warner Cable, keep the existing Internet
speeds and not participate with Califa, the five-year total cost of keeping Time Warner
Cable as the Internet and Wi-Fi provider is $58,200.00. If we choose to join Califa, our
after-rebate costs are $66,270.00 over five years, even while phasing out the existing
Time Warner contract. As time goes on, the savings continue to grow.
FISCAL IMPACT
The City of Palm Springs would be required to pay all costs to connect to CaIREN and
all monthly service fees for high speed broadband service. The Library would receive
rebates of 80-90% but rebates could take up to a year to receive.
The City may be required to continue paying existing Internet service contracts with
Time Warner Cable until their terms conclude. However, if approved and upon the
successful implementation, City Staff will contact Time Warner and attempt to negotiate
cancelling the service or the transfer the service to another City facility.
During the first year, out-of-pocket expenditures, before rebates, are expected to be
$75,440.00. The expenditures will not occur until Fiscal Year 2015-16, and if approved
by the City Council, City Staff will increase the Library Services budget for FY 2015-16
for the additional appropriation.

FOR THE PROVISION, INSTALLATION AND MAINTENANCE OF
ADVANCED NETWORK (DATA) SERVICES
This Agreement, hereinafter referred to as "Agreement", is entered into as of
March 18, 2015 by and between Califa Group, a California public benefit corporation, hereinafter
referred to as"Califa" and the Palm Springs Public Library hereinafter referred to as "Library". Califa
and Library are sometimes referred to in this Agreement individually as "Party" and collectively as
"Parties". All written communications between the parties shall be addressed as follows unless and until
amended in writing by the respective party.

WITNESS THAT
WHEREAS, Califa, on behalf of the California State Library, has contracted with CENIC to
provide high speed networking to libraries in California; and
WHEREAS, Library desires to contract with Califa to obtain one or more data circuits to
connect Library to the CENIC high speed broadband fiber network, CaIREN, and, if specified in
appendix #1, attached, to connect libraries to other sites as identified in said appendix for the
purpose of connecting to CaIREN, and, if specified in the attached appendix #2, to purchase
equipment;
NOW THEREFORE, Palm Springs Public Library and Califa enter into this Agreement:
1. Relationship between the Parties
It is the purpose of this Agreement to set forth the terms and conditions applicable to the provision
of communications and related network services to Library.
2. Services to be Provided
The primary communications infrastructure provided by CENIC is the California Research and
Education Network ("CalREN"). Among the services that CENIC will provide to Libraries
are use of CaIREN and contracting for and provision of data circuits supplied by network service
providers.

Califa, on behalf of Library, will contract with CENIC for such data circuits. Specific circuits and
their costs are included in the appendix attached. Califa will assure that CENIC notifies the Library
of installation requirements and necessary maintenance instructions. Neither CENIC nor Califa shall
be responsible for operating or maintaining software, equipment or cabling that connects equipment
not provided by CENIC for the services unless specifically agreed to in writing by GENIC.
3. Term and Termination of this Agreement
(a) TERM OF THIS AGREEMENT. This Agreement shall be in effect from March 18, 2015
through June 30, 2016. This agreement will automatically renew unless one party notifies the
other at least 60 days in advance of June 30, 2016 and each June 30 of each renewal period.
(b) TERMINATION. Termination prior to the end date stated above shall result in Library
having to pay any circuit telecommunications carrier termination charges resulting from early
termination of the Service.
(c) UNABLE TO CONNECT. This Agreement is considered null and void if CENIC is unable
to connect Library to CaIREN.
4. Payment
Payment for services shall be due within thirty(30) days of receipt of a Califa invoice reflecting
provision of the services for which the invoice is sent; or as otherwise agreed to by Library and
Califa. Library will put forth reasonable efforts to make payments within thirty(30) days after
receipt of invoice.
5. Miscellaneous
(a) CONDITIONS OF USE. Library agrees to conform to the CENIC Appropriate Use Policy
located at http http://www.cenic.org/p=2081/and to any specific conditions of use imposed
by subcontractors providing communications services to CENIC as may be in force at the
time such services are made available per an Addendum to this Agreement. If such
conditions of use are modified and Library believes it can no longer conform to their
requirements, Library shall have one hundred eighty(180) days to terminate the affected
service without penalty. If Library does not elect to terminate the service, Library must
conform to the revised conditions of use or be subject to termination of the service by
CENIC.
(b) CONFLICTING CLAUSES. If any clause in this Master Agreement is in conflict with a
clause in an Addendum to this Agreement, the language in the Addendum shall take
precedence but only for the service defined in that Addendum.
(c) FORCE MAJEURE. Neither party will be responsible for performance of its obligations
hereunder where delayed or hindered by war, riots, embargoes, strikes involving third parties,
acts of Local Access Providers or of its vendors, or suppliers, acts of unrelated third parties,
accidents, cable cuts, act(s) of God or any other event beyond its reasonable control.
(d) GOVERNING LAW. The laws of the State of California shall govern this Agreement.
6. Entire Agreement
This Agreement and any Addenda contemporaneously or subsequently executed by the parties
constitute the entire Agreement between the parties regarding the subject matter of this Agreement
and supersede all prior written or oral agreements with respect to such. This Agreement may not be

modified orally, and no modification shall be binding unless in writing and signed by authorized
representatives of both parties.
7. General Provisions
7.1 Nondiscrimination:
(a) During the performance of this Contract, Califa and its subcontractors shall not deny
the Contract's benefits to any person on the basis of religion, color, ethnic group
identification, sex, age, physical or mental disability, nor shall they discriminate
unlawfully against any employee or applicant for employment because of race,
religion, color, national origin, ancestry, physical handicap, mental disability, medical
condition, marital status, age (over 40) or sex. Califa shall insure that the evaluation
and treatment of employees and applicants for employment are free of such
discrimination.
7.2 It is expressly agreed and understood by the parties hereto that if any provision of this
Agreement is held to be or invalid under any applicable statute or rule of law, it is deemed
to that extent to be omitted. However, the balance of the Agreement shall remain in full
force and effect.
7.3 Rights and Remedies: The rights and remedies of Library provided herein shall not be
exclusive and are in addition to any other rights and remedies provided by law.
8. Indemnification. Library shall indemnify Califa, its trustees, officers, agents and employees
harmless from and against any and all liability, loss, expenses (including reasonable attorneys'
fees), or claims for injury or damages arising out of the performance of this Agreement, but only in
proportion to and to the extent such liability, loss, expense, attorneys' fees, or claims for injury or
damages are caused by or result from the negligent or intentional acts or omissions of Library its
officers, agents, or employees.
Califa shall indemnify Library, its trustees, officers, agents and employees harmless from and
against any and all liability, loss, expenses (including reasonable attorneys' fees), or claims for
injury or damages arising out of the performance of this Agreement,but only in proportion to and to
the extent such liability, loss, expense, attorneys' fees, or claims for injury or damages are caused
by or result from the negligent or intentional acts or omissions of Califa, its officers, agents, or
employees.
9. Dispute Resolution. All disputes between the parties hereto with respect to their rights and duties
hereunder, excepting only indemnity claims, shall be resolved through binding arbitration pursuant
to Code of Civil Procedure Section 1280, with the non prevailing party responsible for the arbitrators'
fee but in all other respects with each side bearing its own costs and attorney's fees.

Appendix #1
Provision, Installation and Maintenance
Of Advanced Network (Data) Services:
Reimbursement of Circuit Costs
This Appendix lists the circuits contracted for by CENIC on behalf of Califa and the Library for
connecting CENIC's fiber optic backbone to Library and for connections that are not direct connections
to CENIC's fiber optic backbone, e.g. direct connections between libraries. Library understands that
CENIC will bill Califa, and Califa will bill Library, for actual costs of circuits charged by network
service providers, including taxes and surcharges and without markup. Prior to approval of CENIC's
Library consortium E-rate application by the FCC's E-rate contractor, not all applicable E-rate and CTF
discounts will be reflected on invoices. After the E-rate application for any given year is approved, the
network service provider will coordinate with CENIC to provide appropriate credits and such credits
will be passed from CENIC to Califa and from Califa to the Library. Library further understands that the
exact discounted cost of circuits will not be known until after the E-rate consortium application is
approved. Therefore, a range of circuit costs is shown below, with the understanding that the actual
discounted costs will fall within the range and until the actual discounted costs are realized, the Library
is liable for the highest cost shown. The actual start date of the service, and therefore of circuit costs,
will be dependent on coordination among GENIC, the Library and the network service provider.
The circuit being provided by the network service provider is a switched "cloud" circuit, with two billed
elements, or links.

High Speed Broadband in California Libraries
A Project of the California State Library, Califa, and CENIC
Executive Summary
Work is underway to bring high-speed broadband to all of California's public libraries
over the next two years by connecting them to the California Research & Education
Network (CaIREN), a high-capacity 3,800-mile fiber-optic-based network designed to
meet the unique requirements of over 20 million users, including the vast majority of K-
20 students together with educators, researchers, and others working in California's
vital public-serving institutions. This network is operated by CENIC, the Corporation for
Network Initiatives in California, a non-profit California corporation that connects
California to the world—advancing education and research statewide by providing the
world-class network essential for innovation, collaboration, and economic growth.
Because libraries are central to their communities, connecting them to CaIREN will
effectively provide all of California's 38 million residents with high-performance access
to the myriad resources that constitute 21 st century digital citizenship, and will provide
California itself with all of the economic benefits of a fully digitally empowered
population.
Three organizations have joined together to undertake this work: the California State
Library, the Califa Group, and CENIC.
The California Legislature is providing funds for the California State Library to join
CENIC as a sixth Charter Associate on behalf of California libraries. Califa has been
contracted by the California State Library to create the contracts with participating
libraries for the services that will deliver high-speed broadband to libraries and enable
them to use the CaIREN network. CENIC will connect libraries to CaIREN, affirming
libraries' essential role in the world's largest education system. Public libraries will join
CENIC's five other charter associates, which include the California K-12 system,
California Community Colleges, the California State University system, California's
Public Libraries, the University of California system, Stanford, Caltech, and USC.

I. Background and Key Facts
The State of California has a long tradition of supporting public libraries to ensure that
all Californians have access to the information resources they need to be successful
through their local library, no matter where they live. Starting with the passage of the
California Public Library Services Act (PLSA) in 1975 and subsequently, the California
Library Services Acts (CLSA) in 1977, public libraries and cooperative public library
systems have provided the mechanisms for sharing resources, helped coordinate
information services, and facilitated communication and delivery among libraries.
During the 1990s, most public libraries were in the midst of adapting and improving their
services via the Internet. Since then, libraries have wanted to expand Internet-based
services to better serve their patrons.
In 2013, the California State Legislature and Governor charged the California State
Librarian to "prepare a needs assessment and spending plan to connect local public
libraries to a statewide high-speed Internet network," including as an option CENIC's
California Research & Education Network.
According to the resulting report, "High-Speed Broadband in California Public Libraries:
an Initiative of the California State Library,` prepared by the California State Library,
Califa, the California Library Association and CENIC, the current state of connectivity for
California's public libraries is dire.
• Three-quarters of California's public libraries have low-speed connectivity of 20
Mbps or less — slower connectivity than what is found in most homes, and this
connectivity must serve thousands of patrons as well as the library itself in its
own operational activities. Fourteen times more libraries operate at a mere 1.5
Mbps than operate at 1 Gbps.
• Two-thirds of California's public libraries are using their connectivity at or over
capacity — effectively rendering the connection useless for serving the public or
operational activities. The proliferation of mobile devices, especially in
underserved areas, promises to make this already impossible situation even
worse.
• California's public libraries are paying an exorbitant $14 million for this woefully
inadequate connectivity, according to a conservative estimate of costs.
• Less than half of all jurisdictions take advantage of E-rate or CTF discounts that
would help them shoulder these costs due to the administrative overhead
required to apply. Only one-quarter take advantage of both.

Despite the recognized benefits of and increasing patron demand for innovative library
programs, limited connectivity prevents California librarians from offering programs and
services that would be of value to their patrons. Videoconferencing, streaming media,
content creation, specialized software, longer sessions on terminals, and unlimited
wireless access are badly needed by many of California's libraries, but insufficient
bandwidth thwarts these libraries' efforts to fulfill their vital roles in community research
and education. In order to empower libraries — particularly in challenged areas —to
play these roles, better connectivity is critical.
II. Bringing High-speed Broadband to California Libraries
Work is underway to bring high-speed broadband to all of California's public libraries
over the next two to three years by connecting them to CaIREN, the California Research
& Education Network, a high-capacity network designed to meet the unique
requirements of over 20 million users, including the vast majority of K-20 students
together with educators, researchers and other vital public-serving institutions. This
network is operated by CENIC, the Corporation for Network Initiatives in California.
CENIC connects California to the world—advancing education and research statewide
by providing the world-class network essential for innovation, collaboration and
economic growth.
Three organizations have joined together to undertake this work:
The California State Library(liibrary.ca.gov) serves as the central reference and
research library for the state government; preserves and disseminates information and
provides technical assistance and development opportunities to California's public
libraries. The California State Library is funded by the California State Legislature to set
direction for this project and provide oversight
The Califa Group (www.califa.org) is a non-profit library consortium of over two
hundred libraries in California. They pioneer technology projects, negotiate discount
rates for technology purchases on behalf of member libraries, and manage state-wide
projects on behalf of the California State Library. Califa, acting as the administrative arm
of the California State library, develops contracts with participating libraries for circuits
and use of the CaIREN network.
CENIC(www.cenic.org), the Corporation for Education Network Initiatives in California,
designs, implements, and operates CaIREN, the California Research and Education
Network, a high-bandwidth, high-capacity Internet network specially designed to meet
the unique requirements of its members which include all higher education institutions
and K-12 schools in the State. CENIC is connecting libraries to CaIREN as a sixth
Charter Associate (in addition to its existing five Charter Associates as detailed below),

bringing them high-speed broadband and including them in the network that connects
research and education organizations across the state, and through its own connections
to other advanced networks beyond California, to colleagues in the US and around the
world. As for all of its members, CENIC will provide network design, procure circuits,
arrange for state and federal discounts, purchase and install equipment, and maintain
and monitos network connectivity to each library.
CENIC's Charter Associates are part of the world's largest education system and
include:
1. the more than 10,000 California K-12 schools, districts, and County Offices of
Education.
2. the 112 California Community Colleges,
3. the 24-campus California State University system,
4. the 10-campus University of California system, and
5, private universities Stanford, Caltech, and USC.
CENIC also provides connectivity to other leading-edge institutions and industry
research organizations around the world, serving the public as a catalyst for a vibrant
California.
As a sixth Charter Associate, with the California State Library acting as the libraries'
interaction point with CENIC, California's libraries will be added to the fabric of
education institutions already connected to CaIREN. As a result, libraries will have the
capability to collaborate more seamlessly with one another as well as draw on content.
expertise, and opportunities from schools, colleges, and universities, extending these
capabilities to individual libraries and library patrons statewide and thereby enhancing
access to information, research, and credit/non-credit distance learning.
Because libraries are central to their communities, this will effectively provide all of
California's 38 million residents with high-performance broadband access to the myriad
resources that constitute 21 st century digital citizenship, and will provide California itself
with all of the economic benefits of a fully digitally empowered population.
As CENIC is governed by its Charter Associates, California's public libraries will also
obtain representation on the CENIC Board of Directors, enabling them to collaborate
more deeply with their research and education colleagues in the K-20 communities as
well as participating in network planning and technology-focused discussions and
advocacy.

III. Steps to Connectivity
The following list shows the steps necessary for a library to obtain connectivity to
CaIREN. Several libraries began this process in 2013 and are already connected to
CaIREN as pilot sites. The next group of California libraries to be connected began this
process in Fall 2014 and are expected to be connected to CaIREN during the 2015-16
fiscal year. A third group of libraries may begin the process as early as May of 2015,
• Phase 1: Information Gathering: Libraries are briefed on the opportunity,
technical information and network designs are discussed with libraries.
Network design decisions are agreed upon by libraries and CENIC.
• Phase 2: Letters of Agency Submitted: Libraries give permission for
CENIC to seek bids for Internet service on their behalf.
• Phase 3: Quotes Presented and Reviewed: Through a Request for
Proposals (RFP) process, CENIC obtains quotes for services from
providers on behalf of participating libraries. These quotes are presented
to libraries for their review. Prices on high-volume purchases like these
are often lower than the state negotiated CalNet rates and represent a
significant savings for libraries.
• Phase 4: Contracting: Once participating libraries accept quotes, the
process of preparing a contract for service begins. Contracts for Internet
service are between the library and Califa.
• Phase 5: Bulk Purchase of Hardware: Hardware requirements are
collected from libraries, and needed equipment is aggregated into one
bulk purchase to ensure the maximum volume discount available thanks
to an equipment discount negotiated by CENIC on behalf of its members.
Equipment is delivered to libraries, and they are billed for this equipment
by Califa.*
• Phase 6: Installation/Deployment: Services are ordered, library sites are
prepared to receive the new equipment and circuits, CaIREN Hub sites
are prepared and equipped, equipment is received and installed; services
and equipment are turned on, tested, and put into production.
`*Note: The California State Library is offering a grant program to help pay for
one-time costs including equipment (routers and/or switches). These grants are
managed and awarded by the California State Library.

IV. Anticipated Results
When libraries are digitally enabled, they can achieve great things. A digitally
empowered public library can:
• Function as an anchor institution by providing wireless and kiosk/desktop access
to the Internet, thus effectively providing all of their patrons with the most
advanced 21 st century connectivity.
• Bring the world into the library for the enrichment and advancement of patrons,
including employment and healthcare information, business opportunities, arts
and cultural events, and more.
• Empower patrons to become active producers of content and not just consumers
with rich media and maker spaces, local history digitization projects, and many
others.
• Enjoy increased access to new and cost-effective operational capacities such as
cloud computing and storage, Voice-over-IP, travel-saving videoconferencing.
• Participate in the infrastructure planning and advocacy that CENIC represents to
its members in addition to the advanced networking services that it provides, thus
enabling libraries to truly function as the vital part of the larger research and
education community that they have always been.
Despite their past and current deficit in connectivity, California's public libraries have
developed many ideas on how they would serve their patrons and larger communities
with the kind of 215t century connectivity that this project will provide. Reports detailing

On behalf of Time Warner Cable, I am writing to request that this item, 2L Agreement with
Califa for library network services, be pulled from consent and referred out to a competitive bid.
As you may be aware, TWC Business Class provides broadband services to the city and area
businesses. We are currently serving the City with competitively-priced services and we offer
fiber services up to 10 Gb.
Unfortunately, we were not given a chance to bid on the proposed service upgrades. Therefore,
we respectfully request this item be pulled from consent and referred out to a competitive
bidding process. An RFP would assure the City it is securing the necessary services at the best
value.
