Grant Agreement: This Grant Agreement between the Department of Housing and Urban Development(HUD)and the above named Grantee;is made pursuant to the
authority of Title i of the Housing and Community Development Act of 1974,as amended,(42 USC 5301 ct sal.).The Grantee's submissions for Title I assistance,the
I-IUD regulations at 24 CFR Pan 570(as now in effect and as may be amended from time to time),and this Funding Approval, including any special conditions,
constitute part of the Agreement. Subject to the provisions of this Grant Agreement,HUD will make the funding assistance spexiftcd here available to the Grantee upon
execution of the Agreement by the parties. The funding assistance specified in the Funding Approval may be used to pay costs incurred after the date specified in item
4 above provided the activities to which such costs are related are carried out in compliance with all applicable requirements. Pre-agreement costs may not be paid with
funding assistance specified here unless they arc authorized in HUD regulations or approved by waiver and listed in the special conditions to the Funding Approval:
The Grantee;agrees to assume all of the responsibilities for environmental review,decision making,and actions,as specified and required in regulations issued by the
Secretary pursuant to Section 104(g)of Title f and published in 24 CFR Part 58. The Grantee further acknowledges its responsibility for adherence to the Agreement by

8. CDBG Special Conditions
(a) The period of performance for the funding assistance specified in the Funding Approval
("Funding Assistance") shall begin on the date specified in item 4 and shall end on
September 1, 2026. The Grantee shall not incur any obligations to be paid with such
assistance after September 1, 2026.
(b) The Recipient shall attach a schedule of its indirect cost rate(s) in the format set forth
below to the executed Agreement that is returned to HUD. The Recipient shall provide
HUD with a revised schedule when any change is made to the rate(s) described in the
schedule. The schedule and any revisions HUD receives from the Recipient shall be
incorporated herein and made a part of this Agreement, provided that the rate(s)
described comply with 2 CFR 200, subpart E.

Instructions: The Recipient must identify each agency or department of the Recipient that
will carry out activities under the grant, the indirect cost rate applicable to each
department/agency (including if the de minimis rate is used per 2 CFR §200.414(f)), and
the type of direct cost base to which the rate will be applied (for example, Modified Total
Direct Costs (MTDC)). Do not include indirect cost rates for subrecipients.
(c) In addition to the conditions contained on form HUD 7082, the grantee shall comply with
requirements established by the Office of Management and Budget(OMB) concerning
the Dun and Bradstreet Data Universal Numbering System (DUNS); the System for
Award Management (SAM.gov); and the Federal Funding Accountability and
Transparency Act as provided in 2 CFR part 25, Universal Identifier and Central
Contractor Registration; and 2 CFR part 170, Reporting Subaward and Executive
Compensation Information.
(d) The grantee shall ensure that no CDBG funds are used to support any Federal, State, or
local projects that seek to use the power of eminent domain, unless eminent domain is
employed only for a public use. For the purposes of this requirement, public use shall not
be construed to include economic development that primarily benefits private
entities. Any use of funds for mass transit, railroad, airport, seaport or highway projects
as well as utility projects which benefit or serve the general public (including energy-
related, communication-related, water-related and wastewater-related infrastructure),
other structures designated for use by the general public or which have other common-
carrier or public-utility functions that serve the general public and are subject to
regulation and oversight by the government, and projects for the removal of an immediate
threat to public health and safety or brownfield as defined in the Small Business Liability
Relief and Brownfields Revitalization Act(Public Law 107-118) shall be considered a
public use for purposes of eminent domain.
(e) The Grantee or unit of general local government that directly or indirectly receives
CDBG funds may not sell, trade, or otherwise transfer all or any such portion of such
funds to another such entity in exchange for any other funds, credits or non-Federal
considerations, but must use such funds for activities eligible under title I of the Act.
(f) E.O. 12372-Special Contract Condition- Notwithstanding any other provision of this
agreement, no funds provided under this agreement may be obligated or expended for the
planning or construction of water or sewer facilities until receipt of written notification
from HUD of the release of funds on completion of the review procedures required under
Executive Order(E.O.) 12372, Intergovernmental Review of Federal Programs, and
HUD's implementing regulations at 24 CFR Part 52. The recipient shall also complete
the review procedures required under E.O. 12372 and 24 CFR Part 52 and receive written
notification from HUD of the release of funds before obligating or expending any funds
provided under this agreement for any new or revised activity for the planning or
construction of water or sewer facilities not previously reviewed under E.O. 12372 and

(g) CDBG funds may not be provided to.a for-profit entity pursuant to section 105(a)(17) of
the Act unless such activity or project has been evaluated and selected in accordance with
Appendix A to 24 CFR 570 - "Guidelines and Objectives for Evaluating Project Costs
and Financial Requirements." (Source - P.L. 113-235, Consolidated and Further
Continuing Appropriations Act, 2015, Division K, Title II, Community Development
Fund).

SPECIAL CONDITIONS
Executive Order 12372
The special condition for the Community Development Block Grant Program, Funding Approval Agreement
(HUD 7082), concerning the review procedures under Executive Order 12372 — Intergovernmental review of
Federal Programs and HUD's implementing regulations 24 CFR, Part 52, restricts the obligation or expenditure
of funds for the planning or construction of water or sewer facilities until the completion of the review process
and receipt of written notification of a Release of Funds from HUD. In the event that the grantee amends or
otherwise revises its Consolidated Plan/Action Plan to use funds for the planning or construction of water or
sewer facilities, a written Release of Funds notice from the Department must be obtained before obligating or
expending funds for such activities.
In addition to the conditions contained on form HUD 7082, the grantee shall comply with requirements
established by the Office of Management and Budget (OMB) concerning the Dun and Bradstreet Data
Universal Numbering System (DUNS), the Central Contractor Registration (CCR) database which was
converted to the System for Award Management (SAM), and the Federal Funding Accountability and
Transparency Act as provided in 2 CFR part 25, Universal Identifier and Central Contractor Registration, and 2
CFR part 170, Reporting Subaward and Executive Compensation Information.
The grantee shall ensure that no CDBG funds are used to support any Federal, State, or local projects that seek
to use the power of eminent domain, unless eminent domain is employed only for a public use. For the
purposes of this requirement, public use shall not be construed to include economic development that primarily
benefits private entities. Any use of funds for mass transit, railroad, airport, seaport or highway projects as
well as utility projects which benefit or serve the general public (including energy-related, communication-
related, water- related and wastewater-related infrastructure), other structures designated for use by the general
public or which have other common-carrier or public-utility functions that serve the general public and are
subject to regulation and oversight by the government, and projects for the removal of an immediate threat to
public health and safety or brownsfield as defined in the Small Business Liability Relief and Brownsfield
Revitalization Act (Public Law 107-1 18) shall be considered a public use for purposes of eminent domain.
The Grantee or a unit of general local government that directly or indirectly receives CDBG funds may not
sell, trade, or otherwise transfer all or any such portion of such funds to another metropolitan city, urban county,
unit of general local government, or Indian tribe, or insular area that directly or indirectly receives CDBG funds
in exchange for any other funds, credits or non-Federal considerations, but must use such funds for activities
eligible under Title I of the Housing and Community Development Act of 1974, as amended.

information in IDIS with each drawdown of funds, but minimally on a quarterly basis. In
addition, a number of en grantees have numerous older activities which continue to be in an open

status —every effort should be made to close out such activities as applicable.
Environmental Review Procedures: All activities included in the Plan are subject to some
degree of environmental review under provisions codified at 24 CFR part 58. Funds for
activities that are not determined to be exempt may not be obligated or expended unless a
Release of Funds has been approved in writing by HUD in the prescribed manner.
Signa¢e at Proieet Construction Sites: To the extent that the Grantee posts signage at HUD
funded projects under the enclosed agreements, the Grantee should ensure that HUD is identified
on such signage.
ESG Funds Subject to Environmental Review: ESG funds may not be expended for activities
in projects that have not been previously environmentally cleared. Funds may be expended only
after HUD approves in writing your compliance with environmental regulations at 24 CFR part
58. If your jurisdiction intends to use ESG rehabilitation funds for shelter sites, please note the
certifications on the Request for Release of Funds and Certification form (HUD-7015.15).
Participation of ESG Recipients in HMIS: The requirement to participate in an HMIS
(Homeless Management & Information System) according to the final HMIS notice applies to
homeless providers receiving ESG funds only if that provider is located in a jurisdiction covered
by a Continuum of Care (CoC) with an HMIS. Entitlement communities are not required to
establish an HMIS for homeless providers receiving ESG funds in jurisdictions not covered by a
CoC HMIS.

I am pleased to inform you of your jurisdiction's Fiscal Year(FY)2013 allocations for the
Office of Community Planning and Development's(CPD) formula programs,which provide
funding for housing,community and economic development activities, and assistance for low-and
moderate-income persons and special populations across the country. President Obama signed
Public Law 113-6 on March 26, 2013,which includes FY 2013 funding for these programs. Your
jurisdiction's FY 2013 available amounts are:

As you are likely aware,the President was required by law to issue a sequestration order on
March 1, 2013, canceling approximately$85 billion in budgetary resources across the Federal
Government for the remainder of the federal fiscal year. The above amounts reflect the
approximately 5 percent cut attributable to sequestration, as well as the impact of annual changes to
individual FY 2013 program appropriation levels and the updated American Community Survey
data upon which some of the formula calculations are based.
We understand that sequester related budget reductions may make FY 2013 a difficult period
of adjustment for many of our grantees. The reduced funding levels may require grantees to
restructure programs and further prioritize or better target available resources. CPD is committed to
doing all we can to support you as you face these challenges. If you would like assistance in
redesigning or restructuring your programs,you or the head of the agency that administers your
program may request technical assistance through your local CPD Office Director.

Enclosure A- Consolidated Plan Advice and Guidance
ESG Funds Allocated in a Two-Stage Process: Please keep in mind that ESG funds were
allocated in a two-stage process: (1) $160 million was immediately allocated under the existing
Emergency Shelter Grants regulations; and(2) $90 million,was allocated once the new
Emergency Solutions Grant regulations were published. At the time of the second allocation,
ESG grantees were required to complete a substantial amendment to their Consolidated
Plan/Action Plan, as necessary.
HUD will allow you up to 90 days after the date of this letter to provide HUD with a substantial
amendment to show that your plan contains the necessary provisions to administer ESG
assistance in accordance with part 576. If you do not do so, HUD may consider you a high-risk
recipient and monitor your grant for compliance with the new program requirements.
If HUD later finds that you have made any obligations or expenditures in violation of the new
program requirements,HUD may disallow the costs and require you to repay the funds.
Therefore,you are strongly encouraged to be sure that HUD is satisfied that your amended plan
complies with the new requirements before you begin obligating and expending FY 2012 funds
on ESG activities.
Integrated Disbursement&Information System (IDIS): Grantees are encouraged to update
information in IDIS with each drawdown of funds,but minimally on a quarterly basis. In
addition, a number of grantees have numerous older activities which continue to be in an open
status—every effort should be made to close out such activities as applicable.
Environmental Review Procedures: All activities included in the Plan are subject to some
degree of environmental review under provisions codified at 24 CFR part 58. Funds for
activities that are not determined to be exempt may not be obligated or expended unless a
Release of Funds has been approved in writing by HUD in the prescribed manner.
Signage at Proiect Construction Sites: To the extent that the Grantee posts signage at HUD
funded projects under the enclosed agreements, the Grantee should ensure that HUD is identified
on such signage.
ESG Funds Subject to Environmental Review: ESG funds may not be expended for activities
in projects that have not been previously environmentally cleared. Funds may be expended only
after HUD approves in writing your compliance with environmental regulations at 24 CFR part
58. If your jurisdiction intends to use ESG rehabilitation funds for shelter sites, please note the
certifications on the Request for Release of Funds and Certification form (HUD-7015.15).
Participation of ESG Recipients in HMIS: The requirement to participate in an HMIS
(Homeless Management& Information System) according to the final HMIS notice applies to
homeless providers receiving ESG funds only if that provider is located in a jurisdiction covered
by a Continuum of Care (CoC) with an HMIS. Entitlement communities are not required to
establish an HMIS for homeless providers receiving ESG funds in jurisdictions not covered by a
CoC HMIS.

Special Conditions:
The terms of the Grant Agreement include the following special conditions:
1. The Grant Agreement between the U.S. Department of Housing and Urban Development
(HUD) and the above named Grantee, is made pursuant to the authority of Title XTT of the
American Recovery and Reinvestment Act of 2009 (Public Law 111-5) (the Recovery Act).
The Grantee acknowledges that the CDBG-R grant is one-time finding.
2. The Grant Agreement is governed by and the Grantee shall comply with the requirements of
the Recovery Act; the Notice of Program Requirements for Community Development Block
Grant Program Funding Under the American Recovery and Reinvestment Act of 2009, 74
Fed. Reg. 21816 (May 11, 2009) available at htt ://www,hud.Qov/recover /cdblock.efm (as
now in effect and as may be amended from time to time) (the Notice); Title I of the Housing
and Community Development Act of 1974, as amended (42 USC 5301 et seq.) (as modified
by the Notice); and, the HUD regulations at 24 CFR part 570 (as now in effect and as may be
amended from time to time) as modified by the Notice (the Regulations). The Grantee's
submissions, the Notice, the Funding Approval/Agreement (form HUD-7082) and the special
conditions described herein are incorporated by reference and constitute part of the Grant
Agreement. Submissions include the CDBG-R action plan substantial amendment, including
the certifications and assurances and any information or documentation required to meet any
grant award conditions. In the event of conflict between a provision of the Grantee's
submissions and any other provision of this Grant Agreement document, the latter shall
control.
3. The Grantee shall comply with governmentwide guidance and standard award terms
established by the Office of Management and Budget (OMB) concerning the implementation
of the Recovery Act, including Requirements Jor Implementing Sections 1512, 1605, and
1606 of the American Recovery and Reinvestment Act of 2009.for Financial Assistance
Awards, 74 Fed. Reg. 18449 (April 23, 2009) (to be codified at 2 CFR Part 176) (as now in
effect and as may be amended from time to time). Notwithstanding the foregoing, the

Grantee shall comply with Section 110 of the CDBG Statute concerning the Davis-Bacon
Act. The Grantee shall comply with reporting requirements established by HUD and OMB
(including all revisions to such reporting requirements), as well as Sections 1511, 1515, and
1553 of the Recovery Act (including implementing guidance).
4. The Grantee shall at all times maintain an up-to-date copy of its Grantee Submission,
including all amendments approved by HUD, on its Internet website as required by the
Notice. The Grantee shall maintain information on all drawdowns, deposits, and
expenditures of grant funds and program income under this Grant Agreement and any other
records required by applicable law, in its files, and shall make such information available for
audit or inspection by duly authorized representatives of IIUD, HUD's Office of the
Inspector General, the Recovery Act Transparency Board, or the Comptroller General of the
United States,
5. In addition to other lawful remedies, HUD reserves the right to restrict access to grantees'
CDBG-R funds for delinquent, incomplete, or inaccurate reporting. This includes the right to
suspend access to the Integrated Disbursement and Information System (IDIS) should the
Grantee fail to comply with quarterly CDBG-R reporting requirements.
6. The Grantee may take advantage of the pre-award costs provisions at 24 CFR 570.200(h) to
incur pre-award costs associated with the development of the substantial amendment to the
action plan beginning May 5, 2009. The Grantee may also incur costs prior to the grant
award for specific activities as of the date the CDBG-R action plan substantial amendment
was submitted to HUD.
7. The Grantee is advised that providing false, fictitious or misleading information with respect
to CDBG-R funds may result in criminal, civil or administrative prosecution under I8 U.S.C.
§ 1001, 18 U.S.C. § 1343, 31 U.S.C. § 3729, 31 U.S.C. § 3801 or another applicable statute.
The Grantee shall promptly refer to HUD's Office of the inspector General any credible
evidence that a principal, employee, agent, contractor, sub-grantee, subcontractor, or other
person has submitted a false claim under the false Claims Act or has committed a criminal or
civil violation of laws pertaining to fraud, conflict of interest, bribery, gratuity, or similar
misconduct involving CDBG-R funds.
8. In any contract involving the use of CDBG-R funds, the Grantee shall include, and require its
subrecipients and contractors to include, a project sign provision consistent with criteria
established by the Secretary.
9, The Grantee shall have until September 30, 2012, to expend the entire CDBG-R Grant
Amount. CDBG-R funds not expended by September 30, 2012, will be recaptured by HUD.
10, The Grantee shall extend all applicable terms and conditions of this grant award to
subrecipients and contractors, including obtaining a DUNS number (or updating the existing
DUNS record), and registering with the Central Contractor Registration (CCR).
11. The Grant Agreement may be amended in writing by HUD. In considering proposed
amendments to this Grant Agreement, HUD shall review, among other things, whether the
amendment is otherwise consistent with the Recovery Act, the Housing and Community
Development Act, the Notice and the Regulations.

SPECIAL CONDITIONS
Executive Order 12372
The special condition for the Community Development Block Grant Program, Funding ApprovalAgreement
(HUD 7082), concerning the review procedures under Executive Order 12372 — Intergovernmental review of
Federal Programs and HUD's implementing regulations 24 CFR, Part 52, restricts the obligation or expenditure
of funds for the planning or construction of water or sewer facilities until the completion of the review process
and receipt of written notification of a Release of Funds from HUD. In the event that the grantee amends or
otherwise revises it's Consolidated Plan/Action Plan to use funds for the planning or construction of water or
sewer facilities, a written Release of Funds notice from the Department must be obtained before obligating or
expending funds for such activities.
