FROM: Department of Planning Services SUMMARY This is a request for a Zone Text Amendment to allow, prospectively only, new carport structures located in the multi-family (R-2 and R-3) zoning districts to encroach into front or side yard setbacks, subject to landscaping and aesthetic requirements. RECOMMENDATION 1 . Open the public hearing and receive testimony; and 2. Waive the reading of the ordinance text in its entirety and read by title only, and introduce for the first reading of Ordinance No. , "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 92.04.03 AND 93.01.00 OF THE PALM SPRINGS ZONING CODE (PSZC) RELATING TO NEW CARPORT STRUCTURES IN THE R-2 (LIMITED MULTIFAMILY RESIDENTIAL) AND R-3 (MULTIPLE-FAMILY RESIDENTIAL AND HOTEL) ZONING DISTRICTS;" and 3. Approve the filing of a Notice of Exemption pursuant to Section 15305 of the CEQA Guidelines. ITEM NO. A) City Council Staff Report 5.1368 ZTA July 1, 2015— Page 2 of 4 BACKGROUND INFORMATION Related Relevant Actions by Planning, Building,`Fire etc. The Planning Commission reviewed two variance applications for carports at multifamily properties; the commission tabled the items 01/28/15 and directed staff to prepare a Zone Text Amendment to allow carports to encroach into required setbacks subject to design and review requirements. The Planning Commission voted 7 to 0 to recommend approval of the 04/22/15 proposed amendment, subject to minor modifications to the proposed standards and review process. ANALYSIS In January 2015, the Planning Commission reviewed two Variance applications to allow new carport structures within required setbacks for existing multifamily developments. The Planning Commission tabled the items as the criteria for approval of the variances were not met, and directed staff to propose regulations that would potentially allow carport structures in specified multifamily zoning districts to encroach into required setbacks, with landscape and/or aesthetic standards that would reduce the visual impacts of the structures. Many of the older multifamily properties in the City of Palm Springs do not have covered parking facilities or only provide limited covered parking. While covered parking is largely unnecessary for the seasonal population, it becomes a necessity as the percentage of year-round population increases. In order to encourage reinvestment in the City's multifamily housing stock and provide a competitive housing product, the relaxation of certain setback requirements for new carport structures may assist in improving and upgrading existing multifamily properties. The proposed amendment is prospective only, does not apply to single family R-1 zones, and does not address or legalize any existing non-conforming and non-permitted carport structures. The proposed amendment would allow new unenclosed carport structures for multifamily R-2 and R-3 zoned properties to encroach into front and side yard setbacks along local and collector streets (as defined by the General Plan), but does not allow the encroachment along major or secondary thoroughfares. The intent of this exclusion is to maintain a well-landscaped appearance along the City's principal thoroughfares. The structures would require a minimum five-foot setback from the property line, so as to allow adequate room for a landscape buffer area and screen wall or hedge, and would be limited to a maximum of ten feet in height so as to minimize visual impact. Specific requirements are proposed for plantings within the buffer area, to include drought-tolerant shade trees spaced at 25-foot intervals and ground cover plantings to cover 50% or greater of the overall buffer area square footage. No turf grass would be allowed in the landscape buffer area, so as to reduce water usage. 02 City Council Staff Report 5.1368 ZTA July 1, 2015—Page 3 of 4 The approval process for new proposed encroaching carports would be via a Minor Architectural Review, and would be reviewed by the Architectural Advisory Committee (AAC) and the Planning Commission. In addition to the standard criteria for architectural reviews, the design of the carport structures would be reviewed for consistency with the architecture of the principal building. An additional criterion would be added to encourage that the carport structures be designed and oriented for the immediate or future placement of solar panels. FINDINGS —ZONE TEXT AMENDMENT PSZC Chapter 94 does not list specific findings for approval of zone text amendments; however, proposed ordinances should be consistent with and implement the goals of the General Plan. The proposed ordinance is consistent with the following goals and policies of the General Plan: • Housing Element, Goal HS2: The proposed ordinance assists with the implementation of Goal HS2, in that it encourages the repair and improvement of existing multifamily properties and provides beneficial amenities to residents. • Community Design Element, Goal CD 15: The proposed ordinance assists with the requirement for well-designed off-street parking areas, in that low walls and drought- tolerant landscape materials will be required to screen off-street parking from adjacent rights-of-way. • Community Design Element, Goal CD24: The proposed ordinance assists with providing safe and attractive multiple-family development through the use of landscaping and screening for off-street parking facilities, and through the requirement for an architectural review process to ensure that new amenities complement existing structures. SUMMARY AND RECOMMENDATION The proposed amendment will allow for the development of shaded parking facilities in required setbacks in multifamily zoning districts as a means to encourage reinvestment in the City's multifamily housing stock and to provide a competitive housing product. Locational requirements and design requirements are proposed as a means to protect and enhance the appearance of the City's rights-of-way. The proposed regulations are consistent with the City's General Plan; consequently, staff recommends approval of the proposed amendment. 03 City Council Staff Report 5.1368 ZTA July 1, 2015— Page 4 of 4 ENVIRONMENTAL ANALYSIS Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15305 "Minor Alterations in Land Use Limitations," Class 4 projects consist of minor alterations of land use limitations which do not result in any changes in land use or density. Therefore, in accordance with Section 15305, staff has determined that the Zone Text Amendment (5.1368 ZTA) is considered categorically exempt from CEQA, and with the City Council's approval, staff is prepared to file a Notice of Exemption with the Riverside County Clerk; a copy of the Notice of Exemption is included as an attachment to this report. NOTIFICATION A public hearing notice was published in accordance with the requirements of State law and local ordinance. As of the writing of this report, staff has not received any comment on the proposed amendment to the zoning code. City Attorney Summary This Ordinance allows new carport structures in multifamily zoning districts to encroach into required front and side yard setbacks upon the approval of a Minor Architectural Review. Design requirements have been included to require drought tolerant landscaping and low walls to screen the carport structure and off-street parking area. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS: A. The proposed zone text amendment (Case 5.1368 ZTA) is considered Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305, "Minor Alterations in Land Use Limitations," of the CEQA Guidelines because the proposed zone text amendment does not propose any changes to land use or density. B. The City Council hereby finds that adoption of the proposed Zoning Ordinance Text Amendment would: 1. Encourage reinvestment in the City's existing multifamily housing stock by allowing the construction of new carport structures at properties that would not otherwise be allowed to construct covered parking. 2. Allow existing multifamily developments to add or increase covered parking as an amenity for residents, and provide a competitive housing product. 3. Protect against visual impacts by requiring drought-tolerant landscaping and screening of encroaching carport structures. C. The adoption of the proposed Zoning Ordinance Text Amendment would be consistent with the intent of the Zoning Ordinance and the City's General Plan as it provides an incentive for reinvestment and improvements to existing multifamily housing stock. SECTION 1. Amend Section 92.04.03(E)(1a) of the Palm Springs Zoning Code to read: E. Yards 05 Ordinance No. _ Page 2 1. For general provisions, see Section 93.01.00. a. The front of a garage or carport shall be located not less than twenty-five (25) feet from the property line abutting the street from which such garage has vehicular access, and not less than twenty-five (25) feet from the opposite side of the alley from which such garage has vehicular access. Carport structures may be permitted to encroach into required setbacks per the provisions of Section 93.01.00(F). SECTION 2. Add Section 93.01.00(F)(11) of the Palm Springs Zoning Code to read: F. Permitted Projections into Required Yards. 11. In the R-2 and R-3 zoning districts, unenclosed carport structures may be permitted to encroach into required front and side yard setbacks, subject to the following requirements: a. No carport structure shall be allowed to encroach into a required setback along a major thoroughfare or secondary thoroughfare. b. Unenclosed carport structures may be permitted to encroach up to five (5) feet from a front or side property line along a local/collector street frontage. The encroachment is only permitted for carport structures which serve parking spaces that are accessed by an internal driveway, and is not permitted for parking spaces which take direct access from a public street. C. The carport structure shall adhere to the provisions of the intersection visibility and corner cutback requirements contained in Section 93.02.00(D). d. Carport structures shall have a height not greater than ten (10)feet. e. A minimum five-foot wide landscape buffer is required between the carport structure and the front or side property line. The landscape buffer shall include the following: i. Drought-tolerant shade trees planted at twenty-five (25) feet on center. The trees shall have a minimum six (6) foot clear trunk upon installation. 06 Ordinance No. Page 3 ii. Drought-tolerant ground cover plants, covering at least 50% of the landscape buffer area upon maturity. The remaining area may include decomposed granite or other similar inert ground cover materials. No turf shall be permitted in the required landscape buffer area. iii. A decorative masonry wall with a minimum height of three (3) feet shall be located at the rear of the required landscape buffer to screen the carport structure from the street. The wall shall be located no closer than five (5) feet from the adjacent property lines, and shall adhere to the comer cutback provisions listed in Section 93.02.00(D). In lieu of a masonry wall, a drought-tolerant hedge may be planted between the required landscape buffer and the carport structure. The hedge shall have a minimum height of three (3) feet upon installation, and shall form a 75% opaque barrier within two years of planting. iv. Irrigation systems for the landscape buffer areas shall be limited to drip irrigation, and shall use a "smart" controller or WaterSense-labeled controller designed to reduce water usage. f. Carport structures which encroach into a required front or side yard setback shall be subject to the minor architectural review application process, as described in Section 94.04.00(E)(2)(a). The application shall be referred to the Planning Commission for review and action. In addition to the review criteria listed in Section 94.04.00(D), carport structures shall be evaluated for the following: i. Consistency of form, color and materials with the principal building(s) on the subject site; and ii. The design and orientation of the carport structures to allow for the installation of solar panels. SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. 07 Ordinance No. _ Page 4 PASSED, APPROVED, AND ADOPTED this day of 2015. E i Commissioner Calerdine commented that allowing carport structures for the medium density apartments along Andreas (north side of Tahquitz) may be a big improvement. Commissioner Roberts expressed concern that carports could have a significant impact to the architecture and their neighbors. He thinks the Commission should review these instead of the AAC. Commissioner Weremiuk concurred and requested the following verbiage: • Drought tolerant inserted front of the word "ground cover' • Plantings have drip irrigations and installation of Smart meters. Commissioners Middleton agreed that having these come for review before the { Commission for a trial period on the aesthetics is prudent. Vice-Chair Klatchko agreed and felt uncomfortable delegating this to the AAC. The AAC should review first and then come to Commission. Commissioner Roberts suggested placing these on the consent calendar. ACTION: Recommend approval to the City Council with the recommendations made by the Commission. As part of that mission,we want to provide covered parking for the 20%of owners who are doing without. This letter,with accompanying documentation, is intended to provide Palm Springs Planning Commission with data needed to make a determination to approve a Variance for the construction of additional carports at the above location. Details of the Project: The Palms (aka Palm Villas)was built in 1979 • Covered parking(carports)were constructed for 83 but not all 88 homeowners, which was not in compliance with the Original Approved Condominium Plan(Exhibits 1 and 2) o Including: 2 covered parking spaces outside the gated security entrance on Compadre Road(security issue) (Exhibit 3) • 2 partially covered spaces in the main entrance parking area (Exhibit 4) • 4 spaces which can block or hinder emergency access of fire or medical personnel near walking entrances to condominiums (Exhibit 5) 8 spaces totally without covers on the East side of parking property leaving an unbalanced/unfinished look to the property( Exhibit 6) • Creates and inequality in the condominium setting as all homeowners pay the same association dues(Exhibit 7) At this time,to deal with the above immediate issues to resolve the above issues,the HOA of the Palms is requesting a twenty-five foot variance along the Theresa property line to build two (2)carports covering 18 existing parking spaces inside our gates. (Exhibit 8) This will address the flawed situation established at the time of original construction in 1979/80. The Palms' Environmental History: In 2007,The Palms embarked on a series of projects to update our property and buildings. That was when conditions were in need of much repair. Our 88 owners came together and paid more than $1- million to have the roofs redone.To enhance conservation,we upgraded to proper roofing materials and colors to reduce heat absorption and create a more compatible look for our neighbors. Once this was successfully completed, we repaired and preplaced wood accents and siding, painting them colors more compatible with our roofing tiles. The Palms was among the first Associations in Palm Springs (with high visibility at 3155 East Ramon Road)to seek City Permits to reduce water by converting to Desert Landscaping. (Exhibit 9)The first steps were taken on Theresa Drive,followed by Ramon Road and Compadre easements. Also, we reduced water in our interior spaces implementing complimentary areas of desert landscaping and greenbelts between our buildings. We enhanced our security with cameras, LED walkway and security lighting and pole lighting,while committing to "dark skies" conservation methods. We converted all 1980s "lollipop' light fixtures to LED down lights. (Exhibit 10) We added several walls to replace rusting fences and,we hope, have enhanced the security of our neighborhood. (Exhibit 11)) We are in the process of updating our pools with solar thermal heating/cooling systems to be more efficient in our water and electric conservation. Additional landscape projects are projected over the next several years. We will be replacing our streets and parking area with new pavement sometime after 2017. All of these projects are active contributions to our community in positive ways. In alignment with our continuous improvement goals,we are requesting the commission's endorsement of our efforts to improve the balanced use of our parking areas and provide consistent amenities to ALL 88 of our homeowners. On March 3, our committee filed a 'Request for Variance' to obtain approval from City Planning to build 18 carports to partially complete the design of the original approved (1979) building plans for The Palms (aka Palm Villas)which were not adhered to. This amendment provides the vehicle to be successful in our task and allows us to move forward and request Permits to build the carports. On March 3, our committee filed a 'Request for Variance'to obtain approval from City Planning to build 18 carports to partially complete the design of the original approved (1979)building plans for The Palms (aka Palm Villas)which were not adhered to. This amendment provides the vehicle to be successful in our task and allows us to move forward and request Permits to build the carports. The Palms is a condo association working diligently to enhance the beauty of our complex, conserve natural resources, ensure safety for our residents and make a positive contribution to our neighborhood community. As part of that mission, we want to provide covered parking for the 20%of owners who are doing without. The Palms' Environmental History: In 2007,The Palms embarked on a series of projects to update our property and buildings. Our goal is to be more environmentally conscious and a good neighbor to our neighbors on Ramon Road, Compadre Road and Theresa Drive. In a time of transition, we were known as the condos with the blue tarps covering our roofs. That was when conditions were in need of much repair. Our 88 owners came together and paid more than $1-million to have the roofs redone. To enhance conservation, we upgraded to proper roofing materials and colors to reduce heat absorption and create a more compatible look for our neighbors. Once this was successfully completed, we repaired and preplaced wood accents and siding, painting them colors more compatible with our roofing tiles. The Palms was among the first Associations in Palm Springs (with high visibility at 3155 East Ramon Road)to seek City permits to reduce water by converting to Desert Landscaping. The first steps were taken on Theresa Drive,followed by Ramon Road and Compadre easements. Also,we reduced water in our interior spaces implementing complimentary areas of desert landscaping and greenbelts between our buildings. We enhanced our security with cameras, LED walkway and security lighting and pole lighting,while committing to "dark skies" conservation methods. We converted all 1980s "lollipop' light fixtures to LED down lights. We added several walls to replace rusting fences and,we hope, have enhanced the security of our neighborhood. We updated our pools with solar thermal heating/cooling systems to be more efficient in our water and electric conservation. Additional landscape projects are projected over the next several years. We will be replacing our streets and parking area with new pavement sometime after 2017. All of these projects are active contributions to our community in positive ways. If approved, associations will be permitted to construct additional carports without going through a great deal of red tape. In many cases these additional carports will correct errors that occurred during construction and the resultant inequities which condominium owners have been living with for years. If approved, it will eliminate a setback restriction which, in some cases, had no bearing and did not affect aesthetics, but required association compliance regardless of circumstances.
