SUBJECT: AUTHORIZE APPROVAL OF A PURCHASE ORDER IN THE AMOUNT
OF $37,960 TO WILLDAN ENGINEERING FOR PUBLIC WORKS
INSPECTION AND MATERIALS TESTING SERVICES FOR PUBLIC
IMPROVEMENTS ASSOCIATED WITH PARCEL MAP 36446
('DOWNTOWN PALM SPRINGS")

SUMMARY:
This action will authorize the City Manager to approve a Purchase Order in the amount
of $37,960 to the City's "on-call' public works inspection firm, Willdan Engineering, to
coordinate and provide construction inspection and materials testing services for public
sewer, street, and storm drainage improvements associated with the new public streets
to be constructed within Parcel Map 36446, ('Downtown Palm Springs').
RECOMMENDATION:
1. Approve a Purchase Order in the amount of $37,960 to Willdan Engineering, in
accordance with Agreement No. 6688, for construction inspection and materials
testing services for public sewer, street, and storm drainage improvements
associated with the new public streets to be constructed within Parcel Map 36446,
"Downtown Palm Springs"; and
2. Authorize the City Manager to execute all necessary documents.
STAFF ANALYSIS:
On December 2, 2009, the City Council adopted Ordinance No. 1764, adopting the
Museum Market Plaza Specific Plan (the "Specific Plan"). The original land use and
development pattern of the Specific Plan area, consisted of Blocks A through H, K1 and
K2, and new public streets comprising a total of 18.5 acres within downtown Palm
Springs.
On September 7, 2011, the City Council adopted Resolution No. 23018, authorizing the
City and the Developer to enter into a Project Financing Agreement ("PFA" —Agreement

No. 6144) applicable to the financing, development, redevelopment, creation and
refurbishment of public and private improvements within the Specific Plan area. The
PFA included, among other things, a Site Plan and Project Description depicting the
proposed improvements, including new public streets described as Museum Street,
Andreas Road, and the Belardo Road extension.
On October 17, 2012, the City Council adopted an Addendum to the Specific Plan
Environmental Impact Report ("EIR") allowing for implementation of a revised
Downtown Revitalization Plan ("Downtown Palm Springs"), and conforming the
revitalization plan to the Specific Plan. The revised layout for Downtown Palm Springs
envisioned in the approved amendment to the Specific Plan revised Block letter
designations as shown in Figure 1.

On December 19, 2012, the City Council approved Tentative Parcel Map 36446, and
associated development applications associated with the "Downtown Palm Springs"
project. Subsequently, on November 5, 2014, the City Council approved Parcel Map

36446 associated with the "Downtown Palm Springs" project, officially subdividing the
18.5 acre project site into 14 parcels and related public streets.
On April 1, 2015, the City Council approved Agreement No. 6688 with Willdan
Engineering for professional first class as-needed construction management and
inspection ("Owner's Rep") services associated with a variety of future Public Works
capital projects, and as-needed inspection services of various improvements related to
private land development projects. The "Downtown Palm Springs" project is a quasi-
public-private partnership between the City and the Developer, and in accordance with
the terms and conditions of the PFA, the Developer will construct the public
improvements on behalf of the City.
The Developer has completed the final design of various public improvements
associated with the "Downtown Palm Springs' project, including extension of public
sewers, construction of new public street improvements, and storm drainage
improvements. Construction of these new public improvements will soon commence,
and it is necessary to retain the services of our "on-call" construction management and
inspection firm to coordinate oversight of the construction of these public improvements
by the Developer.
Accordingly, staff requested proposals from its three "on-call" firms (Dudek Engineering,
Interwest Consulting Group, and Willdan Engineering), and recommends that the City
Council authorize the City Manager to approve a Purchase Order with Willdan
Engineering in the amount of $37,960 for the required public works construction
inspection and materials testing services; a copy of Willdan Engineering's proposal is
included as Attachment 1.
ENVIRONMENTAL IMPACT:
On June 13, 2008, the City of Palm Springs, acting as Lead Agency under the California
Environmental Quality Act ("CEQA"), issued a Notice of Preparation ("NOP") and Initial
Study for the preparation of a Draft Environmental Impact Report (the "Draft EIR") on
the Museum Market Plaza Specific Plan (Case No. 5.1204). The NOP was circulated
for public review from June 16 through July 17, 2008. The Draft EIR was subsequently
circulated for public review from October 22 through December 17, 2008. In
accordance with the CEQA Guidelines, on November 18, 2009, the City Council
adopted Resolution No. 22625, certifying the Final Environmental Impact Report (State
Clearing House No. 2008061084) (the "Final EIR") for the Museum Market Plaza
Specific Plan (Case No. 5.1204), including amendments to the 2007 General Plan and
Palm Springs Zoning Code, making certain findings relating to the environmental effects
identified in the Final EIR, and adopting a Statement of Overriding Considerations and a
Mitigation Monitoring and Reporting Program. The City Council subsequently
reaffirmed and re-adopted Resolution No. 22625 on December 2, 2009.
On October 17, 2012, the City Council adopted Resolution No. 23238, approving an

Addendum to the Final EIR for the Museum Market Plaza Specific Plan (Case No.
5.1204), and identifying the implementation of a revised Downtown Revitalization Plan
("Downtown Palm Springs") as conforming to the Museum Market Plaza Specific Plan.
Included as part of the Downtown Revitalization Plan is the development of various
public streets and related improvements; therefore, construction of the new public
streets and related improvements, as a "Project' under CEQA, has previously
completed environmental review as required by the CEQA Guidelines, and no further
environmental review is required.
FISCAL IMPACT:
Sufficient funds are available in the Measure J Capital Improvement Fund, in Account
No. 260-4500-59424 (Downtown PS Redevelopment Expense).

Subject: (REVISED) Proposal for Construction Engineering Services — Tract
36446 (Sewer, Brick Pavers, Street Work)
Dear Mr. Khamphou:
Willdan Engineering is pleased to submit this revised proposal to provide professional
construction engineering services for the subject project. Willdan's revised proposal
includes the public works inspection and material testing of the sanitary sewer, drainage
improvements, street improvements, brick pavers, and storm water monitoring. It is our
understanding the City is in need of a qualified senior level construction inspector to
monitor the work. We are proposing to utilize the services of Alberto Rosiles, Senior
Public Works Inspector to provide the requested construction engineering services. Mr.
Rosiles will be on the project part-time and has over 35 years of public works
construction experience.
Wilidan's proposal is based on a 100 working day construction schedule and provides
for part-time monitoring of the work. The following is our proposed scope of work and
estimated fee:
SCOPE OF WORK
The construction observation services are generally performed in accordance with the
provisions of the latest editions of the Standard for Public Works Construction "Green
Book," Project Special Provisions, Caltrans Standard Specifications, and the Public
Work Inspector's Manual. Following is a listing of the inspection services that will be
applied to the project.
1. Conduct a field investigation of the project area to become familiar with the
existing facilities and the project environment.
2. Become familiar with traffic control plans, construction schedule, construction
sequence, and permit requirements from other agencies.

3. Meet with Agency staff to review the scope of work and establish project
schedules.
4. Provide part-time construction observation of the work to monitor materials and
methods towards compliance with plans, specifications, and contract documents,
and address and document non-conforming items as they are discovered.
5. Monitor compliance with Cal OSHA requirements and compliance with all local,
state, and federal regulations, including but not limited to, Clean Air Act and
Clean Water Act (NPDES).
6. Meet with the contractor at the beginning of each day and review proposed work
plans, including specific details that may affect progress.
7. Conduct weekly jobsite meetings and other meetings with Agency staff,
merchants, engineer, public relations personnel, contractor, and construction
administrator, as needed.
8. Observe construction safety and public safety and convenience and report
discovered discrepancies to construction administrator and Agency; however, the
Contractor is solely responsible for site and public safety.
9. Maintain copies of all permits needed to construct the project and enforce special
requirements of each.
10. Maintain detailed daily diary on construction progress showing site conditions,
weather conditions, traffic control measures taken by the construction contractor,
labor, equipment, and materials used during the day, and major incidences
occurring each day.
11. Prepare clear and concise letters and memorandums, as needed.
12. Maintain field file bound workbooks during construction, daily and weekly reports,
working day reports, photographs, BMP forms, and other documentation.
13. Review the Contractor' as-built corrections and ensure record drawings were
provided to the Agency.
14. Prepare punch list at substantial completion and follow up.
15. Upon project completion, provide the finished set of project workbooks to the
Agency.
16. Monitor contractor's operations for conformance with the approved WQMP.

17. Provide weekly BMP paperwork and monitor contractor's designated QSP &
QSD for conformance with Board Order No. R7-2013-0011, NPDES No. CAS
817002. (See attached Willdan BMP report for example of report to be used by
Willdan's proposed inspector.)
18. Material Testing — See attached Exhibit A for a breakdown of Willdan's material
testing fee and scope of work.
PROJECT TEAM
Willdan proposes the following team members.
Mr. Elroy Kiepke, CBO, PE— QSP/QSD Compliance Officer. Mr. Kiepke presently
serves as a City Engineer for Willdan. He joined Willdan in July 1979 to assist in the
formation of the Building and Safety Division. As the division grew, he became the
Division Manager for Plan Check Services and City Engineer for some of Willdan's
client cities. Mr. Kiepke began his professional career with the County of Los Angeles
in June 1969. He received training in building plan check and subdivision plan check
before taking permanent positions in the Subdivision Section and Building and Safety.
Mr. Alberto Rosiles, Senior Public Works Observer has over 30 years of experience in
the construction industry here in southern California. Mr. Rosiles' experience includes
street rehabilitation projects in various cities where his responsibilities included quality
control, quantity calculations, and project management. His areas of expertise includes
A.C. heater remix, A.C. rubber paving, overlay, P.C.C., slurry seal, underground
facilities, cast-in-place pipe, A.C. and P.C.C. batch plant inspection, roadways,
highways, bridges, landscape, and vertical construction.
Mr. Larry D. Brown, will serve as the additional as-needed public works inspector. Mr.
Brown's 27 years' of field experience includes drainage facilities, railroad grade
crossings, highway and landscape improvements, traffic signals and signing projects,
and underground utility construction, as well as commercial and residential development
projects. Mr. Brown served as public works observer for the Cities of Hesperia, Moreno
Valley, and Temecula, and was responsible for review of plans and specifications prior
to construction, to ensure compliance with city standards. He also conducted field
observations of the improvements. Mr. Brown's construction administration experience
includes: coordinating activities with contractors, utility companies, and other agencies;
processing change orders, progress payments, and other construction documents;
investigating citizen complaints, and resolving field problems; and reviewing plans,
specifications, and estimates packages for compliance with city.

Our proposed not-to-exceed fee for the Scope of Work identified above is $37,960.00
and is based on a construction timeline of three months (100 working days). Invoices
will be submitted monthly with back-up information substantiating all charges to date.
All work associated with this proposal will be performed pursuant to Wilidan's current
City of Palm Springs on-call construction engineering contract. The following is

CPN 13488, Certified Recreation Center Master Plan Expansion- Construction Services, City of
Nuclear Gauges Technician Fountain Valley, California. Senior Public Works Observer. The work effort
included design and construction management services to rough and mass grade the
31 Years' Experience site for constructing roadways, parking lots, pedestrian walkways, sports facilities, and
amenities. These amenities included landscaping, irrigation, playing fields, stadium
facilities,jogging paths, a maintenance building, and lighting. The project amenities
are spread over 76 acres near the Mile Square Park area. Willdan's design team
provided construction support and construction staking services throughout
construction. Our construction management team provided program management,
construction management, inspection, and materials testing for this $17.5 million
project.

M.Alberto Rosiles Dillon Road Grade Separation Project, City of Coachella, California. Construction
Continued Inspector. The project involved the construction of a new bridge at Dillon Road and
the existing UPRR tracks. The new structure carries Dillon Road traffic over Indio
Boulevard and the UPRR's two existing tracks by means of a reinforced concrete
bridge. In addition,the project involves the following specific items of work: new
traffic signals, construction of approach fills for the new bridge, installation of new
curbs and gutters, installation of new signing, construction of new drainage facilities,
and other appurtenant work. It is anticipated to take approximately 14 months and
$22 million dollars to construct the new bridge.
Intersection Widening at Brookhurst/Ellis, City of Fountain Valley, California.
Construction Inspector. This widening project involved underground utilities, traffic
signal modification, added sidewalks, retaining walls, and street rehabilitation. Project
also included relocation of OCW D new vault and striping. Mr. Rosiles was
responsible for public works inspection, management, and assisting the City Engineer.
Newhope Street Extension, City of Fountain Valley, California. Resident
Inspector. The project included the extension of Newhope Street from Talbert Avenue
to Interstate 405. The main features of the project included demolition of multiple
businesses, median construction, landscaping, storm drain construction, sidewalks,
traffic signal modifications, signing, striping, and Caltrans coordination for the
northbound 405 ramp widening and remodeling.
Talbert from Brookhurst to East City Limit, City of Fountain Valley, California.
Construction Inspector. Project involved public works inspection of complete
driveways, replacement road widening overlay, new medians (AC AHRM),
management, and assisting the City Engineer.
Edinger/Harbor, City of Fountain Valley, California. Construction Inspector. This
project involved widening, new median islands, bus stop pads, removing and
remodeling handicap ramps, sidewalks, signal loop installation and striping. Mr.
Rosiles was responsible for all public works inspection, management, and assisting
the City Engineer.
FY 2000-01 Slurry Seal and Street Resurfacing, City of Lake Forest, California.
Construction Inspector. Street resurfacing projects are part of the City's annual street
maintenance program. Project elements included crack sealing and base repairs,
asphalt concrete overlays, slurry seals, adjusting surface utilities to grade,
replacement of traffic loops, re-striping and reestablishing City survey control points.
Brookhurst Street Rehabilitation and Resurfacing, City of Fountain Valley,
California. Construction Inspector. Project involved the construction inspector staff
augmentation services on Brookhurst Street from Talbert Avenue to Warner Avenue,
and from Heil Avenue to North City limits project. The project required expertise in the
removal and disposal of existing asphalt concrete/aggregate base roadway section,
cold milling, placing asphalt concrete leveling course and base course, asphalt rubber
hot mix(AHRM), adjusting survey well monument covers, utility covers and manholes
to grade, PCC curb, gutter, driveway approaches, access ramps and median,traffic
delineation, signs, and signal loops.
1-215, Beltway, Section 7B, 8 and 9, Drainage Facilities, Clark County, Nevada.
Construction Inspector. This $56 million project consisted of the construction of major
drainage facilities, interim frontage roads and partial highway along a 6.4 mile
alignment of the future Beltway around the valley. The drainage facilities accounted
for$24 million of the project. Drainage improvements included the installation of cast-
in-place box culverts ranging in size from 10'X10'to 23'X10' in lengths from 500'to
2,800', reinforced concrete pipe from 18"to 96",trapezoidal channels, rectangular
channels, and transition structures.

University, Indiana Engineer for some of Willdan's client cities. Mr. Kiepke began his professional career
with the County of Los Angeles in June 1969- He received training in building plan

American Society of Civil UPRR's two existing tracks by means of a reinforced concrete bridge. In addition, the

NPDES Permit Compliance, City of Agoura Hills, California. City Engineer.
Responsible for attending meetings, reviewing and proposing Ordinances, preparing
reports, and communicating with the community to maintain the Cities NPDES
compliance efforts. This activity went from the issuance of the early permit in 1990
through August 1997- Mr. Kiepke has worked extensively with the City on compliance
with NPDES permit for separate storm sewer systems. He has been instrumental in
preparing ordinances for improving management practices for projects which
discharge to the storm drain. On behalf of the City, he attended meetings and
attended seminars to gain a better understanding of how to better shape the
program's goals.
NPDES Permit Compliance, Cities of Rosemead, Paramount, and Bell Gardens,
California. Mr. Kiepke due to his familiarity and availability, took over the permit
programs for the above cities in October 1997, and continues his efforts in this area.
This includes preparation of the Site Visit database for each city budget report
preparation and attendance at Watershed meetings representing the cities.
Cities of Calimesa, and La Catiada Flintridge, California. Mr. Kiepke as part of the
City Engineering responsibility, administered the NPDES Programs for these cities.
The Calimesa assignment involved review of the Riverside County permit.

Larry D. Brown, RCI
Supervising Public Works Observer
Education Mr. Larry D. Brown is responsible for construction administration and observation of
Post Certification and a wide range of public works improvement projects. Mr. Brown's field experience
Continuing Education includes drainage facilities, railroad grade crossings, highway and landscape
Program, San Bernardino improvements, traffic signals and signing projects, and underground utility
Valley College construction, as well as commercial and residential development projects. Mr. Brown

Los Angeles Prior to joining the Willdan team, Mr. Brown worked for more than 7 years in the field
Macco Trench Shoring of soils and materials testing and inspection. His experience includes soils and
materials testing on mass grading projects, utility trenches, storm drains, and street
Toxler Nuclear Soils Testing projects, as well as concrete inspection, and asphalt inspection and control.

Roger's Lane Street Improvement, City of Highland, California. Supervising
Public Works Observer. The Roger's Lane improvements included infill asphalt
paving, curb and gutter, new sidewalks, driveway relocations, adjustment of existing
mailboxes, utility relocation and adjustment, crack filling, slurry seal, and other
appurtenant work. Willdan provided construction management, material testing,
survey and public works observation for the project.
Public Works Observation, City of Murrieta, California. Supervising Public Works
Observer. Willdan is providing public works observation for various projects
throughout the City of Murrieta. The projects may involve asphalt pavement overlay,
street reconstruction, sidewalk construction, curb and gutter installations, sanitary
sewers, RCP storm drains, slurry seals, traffic signal modification and new
installations, and other appurtenant work.
Cactus Avenue Bridge Widening, March Joint Powers Authority. Supervising
Public Works Observer. This project involved providing public works observation
services for the Cactus Avenue Bridge Widening. Willdan's duties included tracking of
weekly meeting minutes, preparing detailed construction reports, monitoring NPDES
compliance, providing as-built plans, maintain approved submittal log, maintain
approved shop drawing file, maintain photographic record, and other appurtenant
work.
Seminole Trunk Sewer Improvements, Morongo Band of Mission Indians,
Banning, California. Supervising Public Works Observer. This project involved
providing public works observation services for the Seminole Truck Sewer Line. The
project involved the installation of a new 12-inch VCP sewer line in Seminole Drive
and serviced the Tribe's new Administration Building.

The proposed private development will consist of construction of Sewer,Storm Drain, and Street Im-
provements. It is our understanding that required Quality Control (QC)will be provided by the developer
and Willdan Geotechnical (Willdan) will provide Quality Assurance(QA) on behalf of the City of Palm
Springs.
In a CA position,Willdan will provide geotechnical review and oversight for of testing operations.The
services will consist of:
• Review of all geotechnical reports;
• Attending the construction kick-off meeting;
• Review of the applicant's geotechnical testing operation during construction to assure that the
work is in conformance with the acceptable standard of practice and approved project specifi-
cations;
• We will attend construction meeting as requested and make periodic site visits on an as needed
basis; and
• Review and approve final soils and material testing reports.
Our estimated fee for above services is$7,700.00 based on a project duration of 100 working days. Fol-
lowing is a breakdown of our estimated fee.
