Subject: ADOPTION OF A RESOLUTION AUTHORIZING THE CITY OF PALM
SPRINGS TO APPLY FOR CALRECYCLE GRANTS FOR A FIVE YEAR
PERIOD

SUMMARY
The action requested is to approve of a resolution that permits the City of Palm Springs
to apply to the Department of Resources Recycling and Recovery (CalRecycle) for
grant funding for the next five years.
RECOMMENDATION:
Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM SPRINGS, CALIFORNIA, SUPPORTING AND AUTHORIZING SUBMITTAL
OF APPLICATIONS FOR ALL CALRECYCLE GRANTS FOR WHICH THE CITY OF
PALM SPRINGS IS ELIGIBLE AND AUTHORIZING THE CITY MANAGER OR
DESIGNEE TO EXECUTE ALL SUCH APPLICATIONS AND AGREEMENTS."
BACKGROUND:
Assembly Bill 939 (AB939) was passed in 1989 as a response to an increasing
shortage of landfill capacity throughout California (and the nation) and an upsurge in
interest in conserving California's natural resources. It requires all cities and counties
within the state to reach a 50% waste reduction goal by the year 2000 and beyond, with
1990 being used as a base year for waste generation data.
AB 939 requires a 50% reduction of material being transported to landfills. The
Department of Resources Recycling and Recovery (CalRecycle), formerly known as the
California Integrated Waste Management Board (CIWMB), was authorized to establish
grant programs to provide opportunities to divert waste from landfills. In order to apply
for grant funds from CalRecycle, the City of Palm Springs must adopt a resolution.

CalRecycle established several grant programs designed to encourage activities that
promote reducing the amount of waste going to landfills. The following is a list of some
of the areas in which CalRecycle grant programs are available.
• Proper Sharps and Medical Waste Disposal
• Used Oil Recovery Programs
• Household Hazardous Waste
• Illegal Dumping and Hazardous Waste Clean-up or Abatement
• Local Government Waste Tire Cleanup and Amnesty Event Grants
• Rubberized Asphalt Concrete (RAC) Grants
CalRecycle administers various grants in furtherance of the state of California's efforts
to reduce, recycle and reuse solid waste generated in the State thereby preserving
landfill capacity and protecting health, safety and the environment. CalRecycle's grant
application procedures require an applicant's governing body to declare by resolution
certain authorizations related to the administration of CalRecycle grants. The attached
resolution approves the submittal of CalRecycle applications for the next 5 years and
identifies the City Manager or his/her designee as the officer authorized to sign
agreements, contracts and request for payment.
ENVIRONMENTAL IMPACT:
The requested City Council action is not a "Project" as defined by the California
Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the
whole of an action, which has a potential for resulting in either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the
environment. The requested action is to adopt a Resolution authorizing submittal of
applications to CalRecycle, and is exempt from CEQA pursuant to Section 15378(b), in
that a "Project" does not include: (5) Organizational or administrative activities of
governments that will not result in direct or indirect physical changes in the environment.
FISCAL IMPACT:
Unknown at this time, but adoption of the Resolution allows the City to submit grant
applications to CalRecycle leading to additional revenue to be received from various
CalRecycle grant programs over the next 5 years.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA,
SUPPORTING AND AUTHORIZING SUBMITTAL
OF APPLICATIONS FOR ALL CALRECYCLE
GRANTS FOR WHICH THE CITY OF PALM
SPRINGS IS ELIGIBLE AND AUTHORIZING THE
CITY MANAGER OR DESIGNEE TO EXECUTE ALL
SUCH APPLICATIONS AND AGREEMENTS.
WHEREAS, Public Resources Code sections 40000 et seq. authorize the
Department of Resources Recycling and Recovery (CalRecycle) to administer
various grant programs (grants) in furtherance of the State of California's (state)
efforts to reduce, recycle and reuse solid waste generated in the state thereby
preserving landfill capacity and protecting public health and safety and the
environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the application, awarding, and management of the grants;
and
WHEREAS, CalRecycle grant application procedures require, among other
things, an applicant's governing body to declare by resolution certain
authorizations related to the administration of CalRecycle grants.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm
Springs authorizes the submittal of applications to CalRecycle for all grants for
which City of Palm Springs is eligible; and
BE IT FURTHER RESOLVED that the City Manager, or designee, is hereby
authorized and empowered to execute in the name of the City of Palm Springs all
grant documents, including but not limited to, applications, agreements,
amendments and requests for payment, necessary to secure grant funds and
implement the approved grant project; and
BE IT FURTHER RESOLVED that these authorizations are effective for five (5)
years from the date of adoption of this resolution.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE that the City Council of Palm Springs endorses and supports the
resolution authorizing the City of Palm Springs' application for all CalRecycle
grants for the next five years.
