SUMMARY
The City Council will consider approval of an amendment to an existing Conditional Use
Permit for a monopole cell tower first issued in 1996 eliminating imposed time limits and
approving the addition of three (3) flush mounted antennas on an existing fifty-five (55)
foot tall monopole.
RECOMMENDATION:
1. Open the public hearing and receive public testimony.
2. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AN AMENDMENT TO AN
EXISTING CONDITIONAL USE PERMIT ELIMINATING IMPOSED TIME LIMITS,
APPROVING THE ADDITION OF THREE NEW PANEL ANTENNAS, AND
APPROVING A CEQA CATEGORICAL EXEMPTION FOR AN EXISTING CELL

ISSUES:

• T-Mobile requested that condition #3 be eliminated, with the CUP approval
continuing until the use ceases to exist.

PROJECT DESCRIPTION:
The subject cell tower is located within the Builders Square lumber yard adjacent to a
parking lot behind an existing in-line retail building. The original cell tower was
constructed in 1996 as part of Case 5.0719 CUP for Pacific Bell allowing for a single
concrete gray color pole with three white antennas at a height of fifty-five (55) feet. The
equipment containment area is accessed from within the lumber yard surrounded by a 6
foot tall block wall.
In the original Planning Commission and City Council resolutions a condition of approval
stated the following:
3. "The Conditional Use Permit shall be valid for period of (5) years from the effective
date of approval. Five (5) extensions of time for a period of five (5) years for each
extension may be granted by the Planning Commission upon demonstration of good
cause and if the Planning Commission finds that under the conditions imposed the
use will not have any adverse or negative environmental, health, safety or other
effect on surrounding properties."
The current owner of the tower, T-Mobile has requested that this condition be
eliminated. Recent approvals of Conditional Use Permits for cell towers have not
placed a time limit on the approvals.
In addition, the cellular carrier is seeking approval to upgrade the tower service by
adding three (3) new antennas, eight (8) feet long mounted four (4) feet underneath the
existing antennas. The new antennas will be flush mounted to the monopole by a
bracket painted to match the existing color. The equipment enclosure at the base of the
tower will not increase in size.
PLANNING COMMISSION REVIEW
The Planning Commission reviewed this project on June 24, 2015, and voted 4-0-2 to
approve the elimination of the time limit, and approved the addition of three (3) new
panel antennas subject to conditions of approval.
Architectural Advisory Committee
The Architectural Advisory Committee (AAC) reviewed the application on June 8, 2015,
and voted 5-0-1 to recommend approval as submitted.

Above development standards may be found in Sections 92.15.03 and 93.23.08(C)(2)(iii)of the Zoning Code.
Antenna Height: Pursuant to Section 92.15.03 (C-M Zone) of the PSZC, the height and
placement limitations of communication antennas within Commercial and Professional
Zones are required to comply with the provisions governing broadcast receiving
antennas or Section 93.23.08(C)(2)(c)(iii) of the PSZC; according to this Section, "no
part of the antenna structure shall extend to a height of more than twenty-five (25) feet
above the highest point of the roof of the principal building on the property." The C-M
zone permits a maximum building height of thirty (30) feet allowing for the monopole
structure as built at fifty-five (55) feet to conform. The new proposal to add three (3)
antennas below the existing panels will not increase the monopole height.
REQUIRED FINDINGS:
Conditional Use Permit The City Council must make certain findings in order to
approve this Conditional Use Permit pursuant to Section 94.02.00 of the Palm Springs
Zoning Code; those findings are analyzed by staff below:
a. The use applied for at the location set forth in the application is properly one for
which a conditional use permit is authorized by the City Zoning Ordinance.

Pursuant to Section 94.02.00(A)(2)(f) of the Palm Springs Zoning Code, a
commercial communications antenna is authorized within the C-M zone with the
approval of a Conditional Use Permit.
b. The use applied for is necessary or desirable for the development of the
community, is in harmony with the various elements or objectives of the General
Plan, and is not detrimental to existing uses or to future uses specifically permitted
in the zone in which the proposed use is to be located.
The General Plan designation of the subject site is Neighborhood Commercial
(NCC). The General Plan does not specifically regulate the installation and
operation of wireless communication facilities; however, the use as proposed is
compatible with this designation as it supports cellular needs of the surrounding
commercial and residential uses and the development of adequate cellular phone
levels of services for the benefit of the community.
There are no other telecommunication facilities located within the immediate area
of the proposed site. Further, the slim-line monopole is located within a lumber
yard surrounded by similar industrial and commercial uses. The monopole
equipment is contained within a 6 foot tall block wall and will not increase in size
with the addition of three (3) new antennas. Therefore, the proposal is unlikely to
be detrimental to existing or future uses permitted in the zone, since it will be
located in a similar environment.
C. The site for the intended use is adequate in size and shape to accommodate said
use, including yards, setbacks, walls or fences, landscaping and other features
required in order to adjust said use to those existing or permitted future uses of the
land in the neighborhood.
The height of the existing tower at fifty-five (55) feet is within the required setbacks
for the C-M zone. The use occupies only a small portion of the larger Builder
Supply lumber yard site behind an existing 6 foot tall block wall. Therefore, the
site for the intended addition of three (3) new antennas will accommodate the
proposed facility.
d. The site for the proposed use related to streets and highways is properly designed
and improved to carry the type and quantity of traffic to be generated by the
proposed use.
The only traffic generated from the said use to and from the site will be for
maintenance, and the existing infrastructure is anticipated to accommodate the
traffic necessary for the maintenance of the facility.

e. The conditions to be imposed and shown on the approved site plan are deemed
necessary to protect the public health, safety and general welfare, including any
minor modifications of the zone's property development standards.
The project is unlikely to have a significant impact on the proposed project site or
its immediate surroundings. Conditions to ensure the protection of public health,
safety and general welfare are required to be fulfilled by the applicant for approval
and include, but are not limited to, removal of antenna upon use-change or
abandonment of the subject property and compliance with all Federal Airport
Administration requirements among others.
ENVIRONMENTAL DETERMINATION:
Section 21084 of the California Public Resources Code requires Guidelines for
Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines
are required to include a list of classes of projects which have been determined not to
have a significant effect on the environment and which are exempt from the provisions
of CEQA. In response to that mandate, the Secretary for Resources identified classes
of projects that do not have a significant effect on the environment, and are declared to
be categorically exempt from the requirement for the preparation of environmental
documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects
include the minor alteration of private structures, facilities, or mechanical equipment
involving negligible expansion of use. The request to add three new cell tower
antennas to an existing cell tower in an effort to upgrade cell service is considered a
Class 1 project that is categorically exempt from CEQA pursuant to Section 15301.

MONOPOLE LOCATED AT 490 EAST SUNNY DUNES
ROAD, ZONE C-M (CASE NO. 5.0719 CUP)."
THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. Crown Castle representing T-Mobile Wireless, ("Applicant") has filed an
application with the City pursuant to Sections 92.15.03 and 93.23.08(C)(2)(c)(iii), of the
Palm Springs Zoning Code (PSZC) for the installation of three (3) new antennas located
on an existing fifty-five (55) foot tall monopole located at 490 East Sunny Dunes Road,
Zone C-M, Section 23.
B. On July 3, 1996, the City Council approved Conditional Use Permit 5.0719 CUP
granting approval of a new monopole at fifty-five (55) feet tall with three (3) antennas.
Condition of Approval # 3 imposed a five (5) year time limit on the CUP approval
allowing for five (5) additional five (5) year time extensions. The applicant has
requested the time limits imposed by Condition of Approval #3 be eliminating, allowing
the CUP to continue until the use ceases to exist.
C. On June 8, 2015, the Architectural Advisory Committee met and voted to
recommend approval of the project to the Planning Commission as submitted.
D. On June 24, 2015, the Planning Commission held a public hearing and voted to
recommend approval of the project to the City Council as submitted.
E. On September 2, 2015, a public hearing on the application for was held by the
City Council in accordance with applicable law. The City Council carefully reviewed and
considered all of the evidence presented in connection with the hearing on the project,
including, but not limited to, the staff report, and all written and oral testimony
presented.
F. In accordance with Section 15301 "Existing Facilities," of the California
Environmental Quality Act (CEQA), Class 1 projects include the minor alteration of

use. The request to add three new cell tower antennas to an existing cell tower in an

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning Services, the Director of
Building and Safety, the Chief of Police, the Fire Chief or their designee, depending on
which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
ADMINISTRATIVE CONDITIONS
ADM 1. Project Description. This approval is for the project described per Case
5.0719 CUP, except as modified by the conditions below.
ADM 2. Reference Documents. The site shall be developed and maintained in
accordance with the approved plans, date stamped April 23, 2015, including
site plans, architectural elevations and colors on file in the Planning Division
except as modified by the approved by conditions below.
ADM 3. Conform to all Codes and Regulations. The project shall conform to the
conditions contained herein, all applicable regulations of the Palm Springs
Zoning Ordinance, Municipal Code, and any other City, County, State and
Federal Codes, ordinances, resolutions and laws that may apply.
ADM 4. Minor Deviations. The Director of Planning or designee may approve minor
deviations to the project description and approved plans in accordance with
the provisions of the Palm Springs Zoning Code.
ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the
City of Palm Springs, its agents, officers, and employees from any claim,
action, or proceeding against the City of Palm Springs or its agents, officers
or employees to attach, set aside, void or annul, an approval of the City of
Palm Springs, its legislative body, advisory agencies, or administrative
officers concerning Case 5.0719 CUP. The City of Palm Springs will promptly

notify the applicant of any such claim, action, or proceeding against the City
of Palm Springs and the applicant will either undertake defense of the matter
and pay the City's associated legal costs or will advance funds to pay for
defense of the matter by the City Attorney. If the City of Palm Springs fails to
promptly notify the applicant of any such claim, action or proceeding or fails to
cooperate fully in the defense, the applicant shall not, thereafter, be
responsible to defend, indemnify, or hold harmless the City of Palm Springs.
Notwithstanding the foregoing, the City retains the right to settle or abandon
the matter without the applicant's consent but should it do so, the City shall
waive the indemnification herein, except, the City's decision to settle or
abandon a matter following an adverse judgment or failure to appeal, shall not
cause a waiver of the indemnification rights herein.
ADM 6. Maintenance and Repair. The property owner(s) and successors and
assignees in interest shall maintain and repair the improvements including
and without limitation all structures, sidewalks, bikeways, parking areas,
landscape, irrigation, lighting, signs, walls, and fences between the curb and
property line, including sidewalk or bikeway easement areas that extend onto
private property, in a first class condition, free from waste and debris, and in
accordance with all applicable law, rules, ordinances and regulations of all
federal, state, and local bodies and agencies having jurisdiction at the
property owner's sole expense. This condition shall be included in the
recorded covenant agreement for the property if required by the City.
ADM 7. Time Limit on Approval. Approval of this Conditional Use Permit shall be
valid for a period of two (2) years from the effective date of the approval.
Extensions of time may be granted by the Planning Commission upon
demonstration of good cause. Once constructed, the Conditional Use Permit,
provided the project has remained in compliance with all conditions of
approval, does not have a time limit.
ADM 8. Right to Appeal. Decisions of an administrative officer or agency of the City
of Palm Springs may be appealed in accordance with Municipal Code
Chapter 2.05.00. Permits will not be issued until the appeal period has
concluded.
ADM 9. Comply with City Noise Ordinance. This use shall comply with the provisions
of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code.
Violations may result in revocation of this Conditional Use Permit.
ADM 10. Conditional Use Permit Availability. The applicant shall provide a copy of this
Conditional Use Permit to all buyers and potential buyers.
PLANNING DEPARTMENT CONDITIONS
PLN 1. Signage. Signage is prohibited on the exterior of the monopole structure.

PLN 2. Time Limit. Time Limit imposed as part of the original July 3, 1996 CUP
approval shall be eliminated with no restrictions or further review required if all
Conditions of Approval are maintained.
PLN 3. Previous CUP Approval. All Conditions of Approval associated with the
original July 3, 1996 CUP approval shall remain in effect except for Condition
#3 which has been eliminated.
PLN 4. New Equipment. This CUP approves the placement of three (3) new
antennas eight (8) feet long mounted four (4) feet underneath the existing
antennas flush mounted.
PLN 5. Outdoor Lighting Conformance. Exterior lighting shall conform to Section
93.21.00, Outdoor Lighting Standards, of the Palm Springs Zoning Code.
Manufacturer's cut sheets of all exterior lighting shall be submitted to the
Planning Department for approval prior to the issuance of building permits.
No lighting of hillsides is permitted.
PLN 6. Outside Storage Prohibited. No outside storage of any kind shall be
permitted except as approved as a part of the proposed plan.
PLN 7. Outdoor Display of Merchandise. Unless specifically permitted by Land Use
Permit, all driveways and parking areas shall remain clear of merchandise
display at all times. Violations to this condition may result in fines, CUP
revocation proceedings or other actions as deemed appropriate by the City.
PLN 8. Modification or Addition. If the communication antenna(s), monopole or
equipment cabinets are ever proposed to be modified in any manner such as
the inclusion of other antennas, satellite dishes and / or other support
equipment, the proposed modifications shall be submitted to the Director of
Planning Services for review and approval prior to installation.
PLN 9. Obsolete Technology. If the technology regarding the communications
antenna(s) changes in where the antenna(s) and / or equipment cabinets as
approved become obsolete, then the antenna shall be removed.
PLN 10. Property Use and CUP. If the use of the subject property is ever changed,
the City reserves the right to modify or revoke this Conditional Use Permit
application pursuant to Section 94.02.00(I) of the Zoning Code.
PLN 11. Antenna Structure Height. The maximum height of the commercial
communications antenna structure shall not be altered from existing fifty-five
(55) feet, as measured from finished grade to the highest point of the
structure.
PLN 12. Valid Lease Agreement Required. If the lease agreement between the
property owner and the applicant expires and is not renewed, the CUP will

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM SPRINGS, CALIFORNIA APPROVING
AN AMENDMENT TO AN EXISTING CONDITIONAL USE
PERMIT CASE NO. 5.0719 CUP ELIMINATING IMPOSED
TIME LIMITS AND THE ADDITION OF THREE NEW
PANEL ANTENNAS TO AN EXISTING MONOPOLE
LOCATED AT 490 E. SUNNY DUNES ROAD, ZONE C-M.
THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS:
A. Crown Castle representing T-Mobile Wireless, ("Applicant') has filed an
application with the City pursuant to Sections 92.15.03 and 93.23.08(C)(2)(c)(iii), of the
Palm Springs Zoning Code (PSZC) for the installation of three (3) new antennas located
on an existing fifty-five (55) foot tall monopole located at 490 East Sunny Dunes Road,
Zone C-M, Section 23.
B. On July 3, 1996, the City Council approved Conditional Use Permit 5.0719 CUP
granting approval of a new monopole at fifty-five (55) feet tall with three (3) antennas.
Condition of Approval Number 3 imposed a five (5) year time limit on the CUP approval
allowing for five (5) extensions of time for a period of five (5) years. The applicant
wishes to eliminate this previous condition allowing the CUP to continue until the use
ceases to exist.
C. On June 8, 2015, the Architectural Advisory Committee met and voted to
recommend approval of the project to the Planning Commission as submitted.
D. On June 24, 2015, a public meeting on the application for architectural approval
was held by the Planning Commission in accordance with applicable law. The Planning
Commission has carefully reviewed and considered all of the evidence presented in
connection with the hearing on the project, including, but not limited to, the staff report,
and all written and oral testimony presented.
E. Pursuant to the California Environmental Quality Act (CEQA Guidelines, the
proposed project is Categorically Exempt under Section 15303(a) (New Construction or
Conversion of Small Structures).
F. Pursuant to Zoning Ordinance Section 94.02.00, Conditional Use Permit the
Planning Commission finds.
a. The use applied for at the location set forth in the application is properly one for
which a conditional use permit is authorized by the City Zoning Ordinance.

Pursuant to Section 94.02.00(A)(2)(f) of the Palm Springs Zoning Code, a
commercial communications antenna is authorized within the C-M zone with the
approval of a Conditional Use Permit.
b. The use applied for is necessary or desirable for the development of the
community, is in harmony with the various elements or objectives of the General
Plan, and is not detrimental to existing uses or to future uses specifically permitted
in the zone in which the proposed use is to be located.
The General Plan designation of the subject site is Neighborhood Commercial
(NCC). The General Plan does not specifically regulate the installation and
operation of wireless communication facilities; however, the use as proposed is
compatible with this designation as it supports cellular needs of the surrounding
commercial and residential uses and the development of adequate cellular phone
levels of services for the benefit of the community.
There are no other telecommunication facilities located within the immediate area
of the proposed site. Further, the slim-line monopole is located within a lumber
yard surrounded by similar industrial and commercial uses. The monopole
equipment is contained within a 6 foot tall block wall and will not increase in size
with the addition of three (3) new antennas. Therefore, the proposal is unlikely to
be detrimental to existing or future uses permitted in the zone, since it will be
located in a similar environment.
C. The site for the intended use is adequate in size and shape to accommodate said
use, including yards, setbacks, walls or fences, landscaping and other features
required in order to adjust said use to those existing or permitted future uses of the
land in the neighborhood.
The height of the existing tower at fifty-five (55) feet is within the required setbacks
for the C-M zone. The use occupies only a small portion of the larger Builder
Supply lumber yard site behind an existing 6 foot tall block wall. Therefore, the
site for the intended addition of three (3) new antennas will accommodate the
proposed facility.
d. The site for the proposed use related to streets and highways is properly designed
and improved to carry the type and quantity of traffic to be generated by the
proposed use.
The only traffic generated from the said use to and from the site will be for
maintenance, and the existing infrastructure is anticipated to accommodate the
traffic necessary for the maintenance of the facility.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning Services, the Director of
Building and Safety, the Chief of Police, the Fire Chief or their designee, depending on
which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
ADMINISTRATIVE CONDITIONS
ADM 1 . Project Description. This approval is for the project described per Case
5.0719 CUP, except as modified by the conditions below.
ADM 2. Reference Documents. The site shall be developed and maintained in
accordance with the approved plans, date stamped April 23, 2015, including
site plans, architectural elevations and colors on file in the Planning Division
except as modified by the approved by conditions below.
ADM 3. Conform to all Codes and Regulations. The project shall conform to the
conditions contained herein, all applicable regulations of the Palm Springs
Zoning Ordinance, Municipal Code, and any other City, County, State and
Federal Codes, ordinances, resolutions and laws that may apply.
ADM 4. Minor Deviations. The Director of Planning or designee may approve minor
deviations to the project description and approved plans in accordance with
the provisions of the Palm Springs Zoning Code.
ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the
City of Palm Springs, its agents, officers, and employees from any claim,
action, or proceeding against the City of Palm Springs or its agents, officers
or employees to attach, set aside, void or annul, an approval of the City of
Palm Springs, its legislative body, advisory agencies, or administrative
officers concerning Case 5.0719 CUP. The City of Palm Springs will promptly 20

notify the applicant of any such claim, action, or proceeding against the City
of Palm Springs and the applicant will either undertake defense of the matter
and pay the City's associated legal costs or will advance funds to pay for
defense of the matter by the City Attorney. If the City of Palm Springs fails to
promptly notify the applicant of any such claim, action or proceeding or fails to
cooperate fully in the defense, the applicant shall not, thereafter, be
responsible to defend, indemnify, or hold harmless the City of Palm Springs.
Notwithstanding the foregoing, the City retains the right to settle or abandon
the matter without the applicant's consent but should it do so, the City shall
waive the indemnification herein, except, the City's decision to settle or
abandon a matter following an adverse judgment or failure to appeal, shall not
cause a waiver of the indemnification rights herein.
ADM 6. Maintenance and Repair. The property owner(s) and successors and
assignees in interest shall maintain and repair the improvements including
and without limitation all structures, sidewalks, bikeways, parking areas,
landscape, irrigation, lighting, signs, walls, and fences between the curb and
property line, including sidewalk or bikeway easement areas that extend onto
private property, in a first class condition, free from waste and debris, and in
accordance with all applicable law, rules, ordinances and regulations of all
federal, state, and local bodies and agencies having jurisdiction at the
property owner's sole expense. This condition shall be included in the
recorded covenant agreement for the property if required by the City.
ADM 7. Time Limit on Approval. Approval of this Conditional Use Permit shall be
valid for a period of two (2) years from the effective date of the approval.
Extensions of time may be granted by the Planning Commission upon
demonstration of good cause. Once constructed, the Conditional Use Permit,
provided the project has remained in compliance with all conditions of
approval, does not have a time limit.
ADM 8. Right to Appeal. Decisions of an administrative officer or agency of the City
of Palm Springs may be appealed in accordance with Municipal Code
Chapter 2.05.00. Permits will not be issued until the appeal period has
concluded.
ADM 9. Comply with City Noise Ordinance. This use shall comply with the provisions
of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code.
Violations may result in revocation of this Conditional Use Permit.
ADM 10. Conditional Use Permit Availability. The applicant shall provide a copy of this
Conditional Use Permit to all buyers and potential buyers.
PLANNING DEPARTMENT CONDITIONS
PLN 1 . Signage. Signage is prohibited on the exterior of the monopole structure. 21

PLN 2. Time Limit. Time Limit imposed as part of the original July 3, 1996 CUP
approval shall be eliminated with no restrictions or further review required if all
Conditions of Approval are maintained.
PLN 3. Previous CUP Approval. All Conditions of Approval associated with the
original July 3, 1996 CUP approval shall remain in effect except for Condition
#3 which has been eliminated.
PLN 4. New Equipment. This CUP approves the placement of three (3) new
antennas eight (8) feet long mounted four (4) feet underneath the existing
antennas flush mounted.
PLN 5. Outdoor Lighting Conformance. Exterior lighting shall conform to Section
93.21.00, Outdoor Lighting Standards, of the Palm Springs Zoning Code.
Manufacturer's cut sheets of all exterior lighting shall be submitted to the
Planning Department for approval prior to the issuance of building permits.
No lighting of hillsides is permitted.
PLN 6. Outside Storage Prohibited. No outside storage of any kind shall be
permitted except as approved as a part of the proposed plan.
PLN 7. Outdoor Display of Merchandise. Unless specifically permitted by Land Use
Permit, all driveways and parking areas shall remain clear of merchandise
display at all times. Violations to this condition may result in fines, CUP
revocation proceedings or other actions as deemed appropriate by the City.
PLN 8. Modification or Addition. if the communication antenna(s), monopole or
equipment cabinets are ever proposed to be modified in any manner such as
the inclusion of other antennas, satellite dishes and / or other support
equipment, the proposed modifications shall be submitted to the Director of
Planning Services for review and approval prior to installation.
PLN 9. Obsolete Technology. If the technology regarding the communications
antenna(s) changes in where the antenna(s) and / or equipment cabinets as
approved become obsolete, then the antenna shall be removed.
PLN 10, Property Use and CUP. If the use of the subject property is ever changed,
the City reserves the right to modify or revoke this Conditional Use Permit
application pursuant to Section 94.02.00(I) of the Zoning Code.
PLN 11. Antenna Structure Height. The maximum height of the commercial
communications antenna structure shall not be altered from existing fifty-five
(55) feet, as measured from finished grade to the highest point of the
structure.
PLN 12. Valid Lease Agreement Required. If the lease agreement between the 2
property owner and the applicant expires and is not renewed, the CUP will

Planner (Coyle) stated that staff recommends approval of this
Type II Conditional Use Permit for a forty-nine (49) foot high
communication antenna and monopole subject to conditions;
proposed to be located at the southeast corner of Builders
Supply, 490 E . Sunny Dunes; this is one of the four sites
applicant is proposing within the City limits to provide
antenna; there are currently 5 buildings with 2 parking lots
on subject site; to the north there is an existing substation
with 5 power poles, all of which are approximately 49 feet
high; existing pole will be 46 feet high, constructed of
concrete, with a 9 foot high cross-pole antenna with 2 BTS
units and an electrical telephone service pedestal at the
base; since existing power poles are all approximately 49 feet
high, staff recommends that this communications antenna not
exceed this height; also recommending that mechanical
equipment at base of pole be screened from view via a solid
masonry wall ; staff received a letter from applicant ' s
representative with comments to several of the conditions .
Commissioner Marantz stated that application requests a 55
foot high pole .
Planner stated this is correct , but staff is recommending a 49
foot high pole .
Chairman Foster asked at what minimum height would be
operable .

Planner stated that applicant' s representative indicated
height would be 55 feet for this location, based on the
topography of the terrain and existing buildings within the
area.
Director stated that it is unclear to staff why this site
needs to be 55 feet high, yet on a building in close proximity
the height was 37 feet .
Chairman Foster opened the Public Hearing.
Robert Medina, authorized representative of Pacific Bell
stated that according the survey information the Motel 6 site
referred to is approximately 15 feet higher at ground
elevation than the Builders Supply site, which would bring
them up to 52 feet (37' + 151 ) ;
Director stated he would check the survey information and
asked if it could be operable at 49 feet .
Medina stated that these designs are based on models
performed, and they also do drive tests to measure the
strength of the signal; project had been initially proposed at
60 feet with their typical 6-panel antenna (design was
subsequently changed) ; if this signal at this site isn' t
adequate, they would be unable to make a hand-off to another
site, and there would be a hole in the system; considers the
existing power pole height of 49 feet to be in the same height
range as the 55 feet they are requesting; stated they would be
willing to put landscaping along some of the setback areas on
subject site to soften the effect as a trade-off .
Frankie Brown stated that he lives at 670 Calle Palo Fierro,
and the proposed pole is between him and the mountain (his
favorite view) ; feels the pole is an eyesore, and would rather
not see it installed; questioned if it would create additional
traffic; stated concern about what it would do electronically,
and hopes there would be a more in depth study.
Chairman Foster closed the Public Hearing.
Chairman Foster requested the applicant to return to answer
further questions .
Applicant stated that they will be doing PCS with core
services being mobile telephone and paging; their license is
for any wireless application; signed agreement with IBM and
are developing software with a new laptop computer line that
will work with their facilities, with a telephone being the
receiver; the government created this license since it is
necessary with our global economy; will not increase vehicular
traffic; all cellular facilities generate electromagnetic
fields; currently the FCC and American National Standards
Institute has set limits , which they are substantially below; 8

measurable magnetic field from site to residence of Mr. Brown
would be equivalent to that of a portable telephone, less than
that of a microwave oven; and substantially less than
generated from a standard power pole.
Commissioner Duffy asked if a 49 foot pole would be possible .
Applicant stated that their engineer feels he can make it work
at 55 feet ; doesn' t feel the 5 or 6 foot difference between
their requested height and the 49 foot power poles would be
noticeable .
Commissioner Fontana asked about the concrete base and its
proposed color, and finish of the pole; stated proposed pole
is much less offensive than existing power poles ; feels that
with right selection of materials the impact against the
mountain could be mitigated.
Applicant stated that there are some color choices for the .
bases ; will make every effort to make it blend, and suggested
leaving the pole without the seal coat, and could come back
and paint it a single color.
Commissioner Marantz stated that the proposed site is inside
the lumber yard and the base will not be seen from the street .
Director stated that base backs up to an adjoining property
that has a chain link fence; that this is an industrial area;
checked the topographical survey of the Motel 6 site referred
to previously, and it is approximately 12 to 15 feet different
in grade, and agrees with applicant' s statement regarding this
fact .
Commissioner Mills stated that if the application is approved
he would prefer a matte finish, and feels the natural gray
concrete would probably be best; stated it is very close to a
residential area and even as unobtrusive as it is, questions
whether close proximity to a residential area is a proper
location considering we are requiring people to underground
power poles ; doesn' t feel this is proper, although
aesthetically it much less obtrusive than telephone poles ;
feels there must be another way to solve problem; this may be
an economical way versus a technological solution that doesn' t
require a pole .

C-M ZONE, SECTION 23.
WHEREAS, Pacific Bell, (the "applicant") has filed an application
with the City pursuant to Section 9402.00 of the Zoning Code for a
Conditional Use Permit for a installation of a communications
antenna at 490 E. Sunny Dunes Rd. , C-M Zone, Section 23; and
WHEREAS, notice of a public hearing of the Planning Commission of
the City of Palm Springs to consider Applicant's Application for
Conditional Use Permit No. 5.0719 was given in accordance with
applicable law; and
WHEREAS, on June 12, 1996 a public hearing on the application for
Conditional Use Permit No. 5.0719 was held by the Planning
Commission in accordance with applicable law; and
WHEREAS, at the conclusion of its public hearing on June 12, 1996,
the Planning Commission adopted Resolution No. 4501, recommending
that the City Council approve Conditional Use Permit No. 5.0719
subject to the findings and conditions stated in Resolution No.
4501; and
WHEREAS, notice of a public hearing of the City Council of the City
of Palm Springs to consider Applicant's Application for Conditional
Use Permit No. 5.0719 was given in accordance with applicable law;
and
WHEREAS, on July 3, 1996 a public hearing on the application for
Conditional Use Permit No. 5.0719 was held by the City Council in
accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report, and all
written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1• Pursuant to CEQA, the City Council finds as
follows:
The project is categorically exempt from the requirements of
CEQA pursuant to Section 15303 which states that construction
of new small equipment is exempt from CEQA.
Section 2: Pursuant to Zoning Ordinance Section 9402.00, the
City Council finds that:
-a. The proposed monopole and communications antenna at the
location set forth in the application is properly one for
which a broadcasting transmitter is authorized by the City
Zoning Ordinance as a Type II Conditional Use Permit.
b. The proposed monopole and communications antenna, is in
harmony with the various elements or objectives of the General
Plan, and is not detrimental to existing uses or to future

uses specifically permitted in the zone in which the proposed
use is to be located.
C. The site for the monopole and communications antenna is
adequate in size and shape to accommodate said use, including
yards, setbacks, walls or fences, landscaping and other
features required in order to adjust said use to those
existing or permitted future uses ,of the land in the
neighborhood.
d. The site for the proposed monopole and communications
antenna will not impact streets and highways properly designed
in the subject area.
e. The conditions to be imposed and shown on the approved
site plan are deemed necessary to protect the public health,
safety and general welfare, including any minor modifications
of the zone's property development standards.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby approves of Conditional Use Permit No.
5.0719, subject to those conditions set forth in Exhibit A, on file
in the City Clerks office which are to be satisfied prior to the
Final Inspection unless other specified.
Section 1: Pursuant to Government Code Section 65863.5, the
City Council recommends that the City Clerk, within
30 days from the Project approval, notify the
County Assessor of said action.

July 3, 1996
CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below
shall be completed to the satisfaction of the City Engineer, the
Director of Planning, the Chief of Police, the Fire Chief or their
designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into
shall be in a form approved by the City Attorney.
PLANNING:
1. The proposed development of the premises shall conform to all
applicable regulations of the Palm Springs Zoning Ordinance,
Municipal Code, or any other City Codes, ordinances and
resolutions which supplement the zoning district regulations.
Ia. The owner shall defend, indemnify, and hold harmless the City
of Palm Springs, its agents, officers, and employees from any
claim, action, or proceeding against the City of Palm Springs
or its agents, officers or employees to attach, set aside,
void or annul, an approval of the City of Palm Springs, its
legislative body, advisory agencies, or administrative
officers concerning Case 5.0719. The City of Palm Springs
will promptly notify the applicant of any such claim, action,
or proceeding against the City of Palm Springs and the
applicant will either undertake defense of the matter and pay
the City's associated legal costs or will advance funds to pay
for defense of the matter by the City Attorney. If the City
of Palm Springs fails to promptly notify the applicant of any
such claim, action or proceeding or fails to cooperate fully
in the defense, the applicant shall not, thereafter, be
responsible to defend, indemnify, or hold harmless the City of
Palm Springs. Notwithstanding the foregoing, the City retains
the right to settle or abandon the matter without the
applicant's consent but should it do so, the City shall waive
further indemnification hereunder, except, the City's decision
to settle or abandon a matter following an adverse judgement
or failure to appeal, shall not cause a waiver of the
indemnification rights herein.
2. Commencement of use or construction under the Conditional Use
Permit shall be within two (2) years from the effective date
of approval. Extensions of time may be granted by the
Planning Commission upon demonstration of good cause.
3. The Conditional Use Permit shall be valid for a period of (5)
years from the effective date of approval. Five (5) extensions
of time for a period of five (5) years for each extension may
be granted by the Planning Commission upon demonstration of
good cause and if the Planning Commission finds that under the
conditions imposed the use will not have any adverse or
negative environmental, health, safety or other effect on
surrounding properties.

4. If the communications antenna, monopole and lease area are
ever proposed to be modified in any manner such as the
inclusion of other antennas, satellite dishes and/or other
support equipment, the proposed modifications shall be
submitted to the Director of Planning and Building for review
and approval prior to installation.
5. If the technology regarding the communications antenna changes
in where the fifty-five (55) foot high antenna is obsolete,
then the monopole and antenna shall be upgraded or removed.
6. If the use of the subject property is ever changed, the City
reserves the right to modify or revoke the conditional use
permit application.
7. The maximum height of the monopole and communications antenna
shall be fifty-five (55) feet.
S. The LNA Cabinet and BTS units located within the lease area
for the monopole and antenna shall be adequately screened from
view with a solid masonry wall.
9. The monopole shall be treated as a natural concrete and the
antenna painted to match the monopole. The color of the
monopole and antenna shall be approved by the Director of
Planning & Building prior to installation.
10. If the monopole and antenna are ever abandoned or if the
conditional use permit ever expires, the monopole and antenna
shall be removed immediately.
11. This project shall be subject to Chapters 2.24 and 3.37 of the
Municipal Code regarding public art. The project shall either
provide public art or payment of an in lieu fee. In the case
of the in-lieu fee, the fee shall be based upon the total
building permit valuation as calculated pursuant to the
valuation table in the Uniform Building Code, the fee being
1/2% for commercial projects or 1/4% for residential projects
with first $100,000 of total building permit valuation for
individual single-family units exempt. Should the public art
be located on the project site, said location shall be
reviewed and approved by the Director of Planning and Building
and the Public Arts Commission, and the property owner shall
enter into a recorded agreement to maintain the art work and
protect the public rights of access and viewing.

must be secured.

Reasons why project is exempt: The project qualifies as a Categorical Exemption pursuant to Section 15301 `Existing
Facilities" of the California Environmental Quality Act. Per the General Rule exemption criteria, the City first determined
that the activity is a project subject to CEQA (Guidelines Section 15378(a)(1)), but after review of the project determined
that it does not have the potential for causing a significant effect on the environment.
In accordance with Section 15301 "Existing Facilities," Class 1 projects include the minor alteration of private structures,
facilities, or mechanical equipment involving negligible expansion of use. The request to add three new cell tower
antennas to an existing cell tower in an effort to upgrade cell service is considered a Class 1 project that is categorically
exempt from CEQA pursuant to Section 15301.
The subject project site has a General Plan designation of I (Industrial) and is zoned C-M (Commercial - Manufracturing)
zone. This project is consistent with both the General Plan and Zoning. The subject site has not been identified as a site
that has value as a habitat for endangered, rare or threatened species. The approval of this project would not result in any
significant effect relating to traffic, noise, air quality, or water Quality. The site will be served by Southern California Edison
Company (Electric), Veolia Water Company (Sewer), Desert Water Agency (Water), Verizon (Telephone), Southern
California Gas Company(Gas), and the City of Palm Springs Police And Fire Departments.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will
hold a public hearing at its meeting of September 2, 2015. The City Council meeting begins at
6:00 p.m., in the Council Chamber at City Hall, 3200 East Tahquitz Canyon Way,
Palm Springs.
The purpose of the hearing is to consider an application by Crown Castle representing
T-Mobile Wireless, for an amendment to a Conditional Use Permit eliminating the term limit
and the addition of three new panel antennas to an existing 55 foot tall monopole located at
490 East Sunny Dunes Road, Zoned C-M.
ENVIRONMENTAL DETERMINATION: This project is categorically exempt from
environmental review pursuant to Section 15301 (Class 1 — Existing Facilities) of the California
Environmental Quality Act (CEQA).
REVIEW OF PROJECT INFORMATION: The staff report and other supporting documents
regarding this project are available for public review at City Hall between the hours of 8:00 a.m.
and 6:00 p.m., Monday through Thursday. Please contact the Office of the City Clerk at
(760) 323-8204 if you would like to schedule an appointment to review these documents.
COMMENT ON THIS APPLICATION: Response to this notice may be made verbally at the
Public Hearing and/or in writing before the hearing. Written comments may be made to the City
Council by letter (for mail or hand delivery) to:

Any challenge of the proposed project in court may be limited to raising only those issues
raised at the public hearing described in this notice, or in written correspondence delivered to
