Ready, City Manager BY: Public Works & Engineering Department SUMMARY This action will reject all bids received on June 25, 2015, for the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20, and Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21, and authorize re-bidding. RECOMMENDATION: 1. Reject the bids received on June 25, 2015, from ACS Engineering, Inc., Golden Valley Construction and Fata Construction & Development for the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20, and Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21; and 2. Authorize re-bidding the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20, and Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21. STAFF ANALYSIS: The City Council previously appropriated funding in the amounts of $900,000 from the Measure J Capital Project Fund for replacement and upgrading of the existing electrical system along Palm Canyon Drive, and $45,000 from the Measure J Capital Project Fund for replacement and upgrading of the existing irrigation system along Palm Canyon Drive. The construction drawing for the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20 were prepared by MRC Engineering, Inc., with the scope of work being to replace the underground electrical infrastructure for decorative street lights, ITEM NO. City Council Staff Report September 2, 2015-- Page 2 Reject Bids—CP14-20 and CP14-21, Palm Canyon Dr. Electrical and Irrigation Improvements palm tree lights, and provide additional electrical service to support Village Fest vendors on Palm Canyon Drive. In addition, the construction drawings for Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21 were prepared by Michael Buccino Associates and the scope of work is to replace the existing irrigation system also along Palm Canyon Drive. These two capital projects have been combined into one project for bidding. Staff prepared project specifications and the construction documents for advertisement and bidding for the for the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20, and Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21 (the "Project"). The Project was advertised for bidding in The Desert Sun on May 23 and 30, 2015, respectively. On June 25, 2015, the Procurement and Contracting Division received three construction bids from the following contractors: Company Location Bid Amount ACS Engineering, Inc., Irvine, CA $865,316.00 Golden Valley Construction Palm Springs, CA $876,886.95 Fata Construction & Development Riverside, CA $1,925,818.50 The engineering estimate for the Project is $880,000. The low bidder satisfied the requirements in the contract bid documents, however, staff is recommending that the City Council reject the bids received to allow for revisions to the plans to incorporate value-engineering (cost reduction) measures identified by staff to help further reduce the cost of the project. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; therefore, the Palm Canyon Drive Electrical System Replacement, City Project No. 14-20, and Palm Canyon Drive Irrigation System Improvements, City Project No. 14-21, are considered categorically exempt from CEQA, and a Notice of Exemption has been prepared and with the City Council's approval will be filed with the Riverside County Clerk. A copy of the Notice of Exemption is included as Attachment 1. 02 City Council Staff Report September 2, 2015-- Page 3 Reject Bids—CP14-20 and CP14-21, Palm Canyon Dr. Electrical and Irrigation Improvements FISCAL IMPACT: A total of $945,000 was previously budgeted by the City Council from the Measure J Fund (Fund 260). Currently, the remaining budget available for the project is $627,215.47 after deducting prior expenses incurred for replacing existing light poles throughout the Downtown area. It is anticipated that the revised plans will allow for a lower overall cost by incorporating value-engineering (cost reduction) measures identified by staff. The electrical infrastructure in the Downtown area is failing due to the age of underground conduits and wiring. Also included in the scope of work is to take advantage of the tree well irrigation project on the North end and upgrade the electrical infrastructure from Alejo to Tamarisk.
