Ready, City Manager BY: Department of Planning Services SUMMARY The City Council is receiving this report on a request for a Street Name Change application to rename Crossley Road and Golf Club Drive to Lawrence Crossley Road. The Planning Commission held a public hearing on the application at their meeting of July 22, 2015, and recommended approval of the request to the City Council. Pursuant to Palm Springs Municipal Code (PSMC) Section 14.08.100, the City Council may take such action as it deems appropriate upon the recommendation of the Planning Commission, and failure to take action within 60 days after submission of the Planning Commission's recommendation shall be deemed denial of the application. Should City Council wish to take affirmative action on the street name change request, specific direction to schedule a public hearing on the item is required. RECOMMENDATION: 1. Receive and file the report on the Planning Commission's recommendation for approval on a street name change of Crossley Road and Golf Club Drive to Lawrence Crossley Road (from Ramon Road to E. Palm Canyon Drive), (Case No. 5.1376 SNC). 2. If Council desires to further consider the requested name change, staff recommends waiving the 60-day requirement for City Council action on the street name change application pursuant to PSMC Section 14.08.100, and direction to schedule a noticed public hearing for a future meeting date. ITEM NO. City Council Staff Report September 2, 2015-- Page 2 Crossley Road &Golf Club Drive Street Name Change Case 5.1376 SNC BACKGROUND INFORMATION: Related Relevant Actions by Planning, Building, Fire, etc. The Department of Planning Services received a petition from 04/22/15 residents of the Lawrence Crossley Neighborhood Organization and the Palm Springs Black History Committee to rename Crossley Road and Golf Club Drive to Lawrence Crossley Road. The Planning Commission discussed the Street Name Change 05/13/15 application and requested the Planning Director to initiate the renaming process. The Planning Commission continued the discussion of the Street 05/27/15 Name Change application and its impacts to residents on Golf Club Drive. Staff was requested to report back with the number of addresses impacted along Golf Club Drive. The Planning Commission adopted Resolution #6507, establishing a 06/10/15 public hearing date of July 22, 2015 for discussion of the Street Name Change application. 07/09/15 Notices were mailed to 709 addresses regarding the Planning Commission public hearing on the proposed name change. 07/22/15 The Planning Commission voted 7 to 0 to recommend approval of the Street Name Change application. ANALYSIS: The request to change the name of Crossley Road and Gulf Club Drive was initiated by the residents of the Lawrence Crossley Neighborhood Organization and the Palm Springs Black History Committee. A petition was delivered to the Department of Planning Services on April 22, 2015, signed by 318 residents of the City supporting the name change request. The Planning Commission initiated discussion on the matter at the May 13, 2015, Planning Commission meeting. The proposed name, "Lawrence Crossley Road," is to honor the contributions of Lawrence Crossley, a prominent African-American businessman and developer. Mr. Crossley first came to Palm Springs in the mid-1920's to work as a chauffeur for P.T. Stevens, developer of the El Mirador Hotel. Mr. Crossley was one of Stevens' most trusted employees, and began managing many of his projects. Mr. Crossley was responsible for the design of the El Mirador golf course, and later managed the Whitewater Mutual Water Company. Over time, Mr. Crossley became a successful businessman, and developed a subdivision off 34th Avenue originally built for African- American families. He was a trusted friend of Chief Francisco Patencio of the Agua Caliente Band of Cahuilla Indians, and became an advocate for Native American rights. Mr. Crossley died in 1961.1 Polm Springs Legends, Greg Niemann, 2008,p. 184-186. .. V h City Council Staff Report September 2, 2015 -- Page 3 Crossley Road & Golf Club Drive Street Name Change Case 5.1376 SNC Crossley Road and Golf Club Drive have a combined length of approximately 1.37 miles, and serve as a Secondary Thoroughfare (undivided and divided) as classified by the Circulation Element of the City's General Plan. The street runs north/south, and begins at East Ramon Road and ends at East Palm Canyon Drive. The northern segment of the street is named Crossley Road, and changes to Golf Club Drive south of the intersection at 34th Avenue. Street names are reviewed and approved by a number of public agencies, including the City of Palm Springs Police and Fire Departments, the Riverside County Sheriff's Department, and the U.S. Postal Service. The proposed change of name to Lawrence Crossley Road has been reviewed by these agencies and no concerns have been noted. The proposed change of street name will impact addressing, mailings and wayfinding for existing residents and business owners. The number of residents and businesses impacted by this change is described below for each of the street segments: Crossley Road • Number of properties addressed on Crossley Road (includes both developed and undeveloped parcels): 26 • Number of existing businesses addressed on Crossley Road: 8 Golf Club Drive • Number of residential properties addressed on Golf Club Drive: 216 • Number of existing businesses addressed on Golf Club Drive: 12 PSMC Chapter 14.08 establishes the procedures for processing Street Name Change applications. Upon receipt of an application, the Planning Commission must adopt a Resolution of Intention at least 30 days prior to a noticed public hearing to consider the change of name. The Resolution of Intention (Resolution #6507) was adopted by the Planning Commission at the meeting of June 10, 2015. For the noticed public hearing, the code requires that notices be posted in three public places along the affected street at least 10 days prior to the scheduled hearing, and a newspaper ad must be published 15 days prior to the hearing. In accordance with these requirements, staff posted four signs along the Crossley Road and Golf Club Drive rights-of-way and placed an ad in the Desert Sun newspaper. Although not required by code, individual hearing notices were sent to 709 addresses of property owners within 500 feet of the Crossley Road/Golf Club Drive right-of-way. Notices were also sent to all known businesses and the homeowners' associations of condominium complexes adjacent to Crossley Road and Golf Club Drive. Staff received a total of 59 comment letters and emails in response to the public hearing notices; of those comments, one respondent was in support of the change and 58 respondents were in opposition to the proposed name change. The Planning Commission held the formal public hearing on the application on July 22, 2015. Upon taking public testimony and reviewing the submitted petition and written correspondence on the matter, the Planning Commission voted 7 to 0 to recommend approval of the application. As a condition of the approval, the Planning Commission recommended that dual street signs be in place for a period of five years to assist in the transition to the new street name. PSMC 14.08.100 identifies the action to be taken by the City Council with regard to street name changes, and states: The city council may, pursuant to California Government Code Section 34091.1, take such action as it deems appropriate upon the recommendation of the commission, and failure to take action within sixty days after submission of the commission's recommendation shall be deemed denial of the application. (Ord. 914 § 10, 1971:prior code § 7691) The intent of this staff report is to file a report of the Planning Commission's recommendation of the street name change. To the extent that the City Council wishes to take affirmative action on the street name change, specific direction by the City Council to take action on the item will be required. Although a Public Hearing on the item is not required by California Government Code Section 34091.12, staff recommends that to the extent the City Council wishes to take affirmative action on the item, that a Public Hearing on the item be scheduled at a future date, and that for the purposes of compliance with the 60-day time limit for taking action on the item required by PSMC 14.08.100, that such time limit be waived by nature of the City Council's action taken with the filing of this report and the direction so given to schedule a public hearing on the matter. Alternatively, absent specific direction to staff to take affirmative action on the item, after the filing of this report and the lapse of 60-days from the Planning Commission's recommendation adopted July 22, 2015, pursuant to PSMC 14.08.100, the action will be deemed denied. 2 California Government Code Section 34091.1 only requires the adoption of a Resolution to facilitate a street name change, and states: Whenever the legislative body finds that a name should be adopted and applied to any city street, or that the existing name of any city street should be changed, the legislative body may adopt a resolution designating a name for, or change the name of, such street. 04 City Council Staff Report September 2, 2015-- Page 5 Crossley Road 8 Golf Club Drive Street Name Change Case 5.1376 SNC ENVIRONMENTAL IMPACT: The requested City Council action is not a "Project" as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The requested action is to receive a report on the Planning Commission's recommendation on a street name change application, and is exempt from CEQA pursuant to Section 15378(b), in that a "Project" does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. SlPage 07 City of Palm Springs Planning Commission Minutes June 10,2015 Motion: Commissioner Roberts, seconded by Commissioner Lowe. Commissioner Roberts verified that this motion does not include Golf Club Drive; that it's about the residential community and does not put want to put a hardship on the business community. Planning Director Fagg verified that the resolution does include Golf Club Drive. The Commission discussed the impact of the street name change to Golf Club Drive and deliberated. COMMISSIONER ROBERTS WITHDREW HIS MOTION. Commissioner Calerdine requested that broader language be included in the public hearing notice to allow an opportunity to get the Golf Club homeowners comments. Commissioner Middleton said she would like to see this name change to Lawrence Crossley. However, she expressed concern that opposition would be stirred up on the southern side of the road since no feedback has been received from them. Commissioner Calerdine suggested providing outreach to the two major condominium complexes on Golf Club Drive. ACTION: Approve the resolution of intention to change the name of Crossley Road and Golf Club Drive to Lawrence Crossley Road and establish a public hearing date. Chair Klatchko opened the public hearing: JEFFREY FOWLER, resides on Golf Club Drive, noted this change would be costly for businesses on Golf Club Drive; however, encouraged adding the name Lawrence Crossley to a new street in the city. JAMES KING, provided details regarding street name changes made in Riverside and requested approval. CLEMENT LUMLEY, said the change is important and requested the street name change include the entire street from Hwy. 111 to Ramon Road. DANIEL ALGAZI, DA Computers, explained that older GPS systems will never be updated. TRAE DANIEL, spoke about Lawrence Crossley's achievements in the city and indicated that people will be inconvenienced for a short period of time. There being no further speakers the public hearing was closed. Commissioner Roberts commented that although this would be a major inconvenience he is in support of changing the entire street name. Commissioner Middleton noticed that this will be a big inconvenience to homeowners and suggested keeping dual names for 2 - 3 years from East Palm Canyon to Ramon Road. Commissioner Calerdine noted that this would be a major inconvenience and suggested the dual street names for at least 5 years so that all mapping systems will include the name change. Commissioner Lowe supports that Lawrence Crossley needs to be recognized but more than just having a street named after him. He noted the significant impacts on businesses and suggested a stronger recognition could be done such as a naming new street possibly Main Street (downtown) for more coverage and no impact on businesses. 10 City of Palm Springs 5 Planning Commission Minutes July 22,2015 Commissioner Weremiuk concurred with Commissioner Lowe and suggested a plaque would be greater recognition or naming the proposed Main Street downtown. MAX VAHID, VA Consulting, rep enting the property owner, clarified that this project is a modification of the existi pproved map with a reduction of the townhomes. He indicated that the flood s m is still a part of the project and would like to keep the current entitlements in a the new one is not approved. MIKE COLE, o r & managing partner, explained that a significant amount of money has been sp on submittal of the new map that includes a reduction in density. He stated th a commitments that came with the project - the storm drain and debris basin a critical part of the project and it has taken them a while to look at the ec mics and market place to determine that they could remove the townhomes. I V;J RESOLUTION NO. 6507 A RESOLUTION OF INTENTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, TO CHANGE THE NAME OF CROSSLEY ROAD AND GOLF CLUB DRIVE TO LAWRENCE CROSSLEY ROAD AND ESTABLISHING A PUBLIC HEARING DATE FOR CONSIDERATION OF THE STREET NAME CHANGE (CASE 5.1376 SNC). THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS: A. On April 22, 2015, residents of the Lawrence Crossley Neighborhood organization and the Palm Springs Black History Committee appeared before the Planning Commission and submitted a petition requesting that the Planning Commission consider renaming Crossley Road and Golf Club Drive to Lawrence Crossley Road. B. On May 13, 2015, the Planning Commission received a report from the Department of Planning Services regarding the number of property owners that would be impacted and the costs associated with the street name change, and continued the item to the June 10, 2015 meeting for further investigation. C. The Planning Commission carefully reviewed and considered all of the evidence presented at its meeting of June 10, 2015, including but not limited to the staff report, supporting memos, and all written and oral testimony presented, and directed staff to initiate the public hearing process for the street name change pursuant to the requirements of Palm Springs Municipal Code (PSMC) Chapter 14.08. THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS RESOLVES: SECTION 1. Pursuant to PSMC Section 14.08.050, the Planning Commission herby adopts this resolution of intention to change the name of Crossley Road and Golf Club Drive to Lawrence Crossley Road and sets the public hearing date to consider Case 5.1376 SNC for July 22, 2015. SECTION 2. Pursuant to PSMC Section 14,08.060, the Director of Planning Services shall publish this resolution of intention to change the name of Crossley Road and Golf Club Drive to Lawrence Crossley Road in a newspaper of general circulation at least 15 days prior to the July 22, 2015 public hearing date. SECTION 3. Pursuant to PSMC Section 14.08.070, the Director of Planning Services shall provide for posting of this resolution of intention in at least three (3) public places along Crossley Road and Golf Club Drive at least 10 days prior to the July 22, 2015 public hearing date. 12 Planning Commission Resolution No. 6507 Case No. 5.1376 SNC Page 2 SECTION 4. Pursuant to PSMC Section 14.08.080 and 14.08.090, the Planning Commission shall hear and consider the proposal to change the name of Crossley Road and Golf Club Drive to Lawrence Crossley Road, and any objections to the proposal, at the July 22, 2015 public hearing. At the conclusion of the public hearing, the Planning Commission shall make a recommendation to the City Council on the proposal. SECTION 5. Pursuant to PSMC Section 14.08.110, the Planning Commission hereby waives the requirement for an application fee for the street name change application. ADOPTED this 10" day of June, 2015. I do not feel there is any compelling reason to make such a change. The stated reason for this, as I have read, is to mend racial tensions from the past. This idea is preposterous at best. During the time 1 have been a resident of Palm Springs I have never heard of any racial problems in the City which would benefit from an action such as this proposal. Mr. Crossley's work with relocation of displaced residents was over fifty years ago. The fact that Crossley Road exists today pays tribute to the contributions of Mr. Crossley. To rename a portion of Golf Club Drive will not do anything to add to this. In fact it will simply cost money to the city in resigning the street and to the many residents who live in complexes along Golf Club Drive. There are several large developments on Golf Club Drive, such as Esprit(120 units), where addresses will have to be changed, checks reprinted, businesses notified, official documents and deeds reissued and the like. The petition that is started by the Lawrence Crossley Neighborhood Assocation is ill conceived. It breeds more negative feelings to those effected than it does honor this man. Perhaps a more fitting thing would be a marker at one of the intersections along the current Crossley Road. A plaque or statue, perhaps a"Lawrence Crossley Day"proclamation from the mayor? Certainly. But changing this street name brings with it more problems than settles a "perceived"unrest that the sponsor feels exists. Lastly. I will make the point that many of the tourists who play our public Tahquitz Golf Club find their way much easier when looking for Golf Club Drive. It is time to look forward and treat all our citizens as our neighbors regardless of the street on which we live. Where I previously lived in Minnesota there was a street called Crossley and the name in old English meant meadow. So when I moved to Golf Club Drive and close to Crossley Road I did not think much about the road name. Our concern was that we had been recently notified that it was the intent to change the name of 34`' Street to Shore Bridge Lane. This street is approximately 3 to 4 blocks long and is the only street (according to information at the meeting) that carries a number instead of a name in the city of Palm Springs. As you are probably aware, at some point there is a new proposed development going in at the end of 34th and no doubt the developer would prefer a more "attractive" name for this street. Bordering on 34`h St. is The Fairways HOA, Tahquitz Creek Villas HOA, and Crossely Neighborhood—none of which address off of 34`h Because of the configuration of the area, it is often difficult for people to find these neighborhoods. I bring this up because changing the name at this point will only add to the confusion and bring up another raft of problems. The proposed name for this street has been suggested as Shore Bridge Lane. While on the surface, this name seems innocuous enough, in fact, directly north of the area at Crossely is Dinah Shore Drive. That would mean we have two streets that run parallel to each other with VERY similar names. All three of these communities have a number of retired individuals living within them and it is not uncommon to occasionally have need of an ambulance to transport people on an emergency basis to the hospital. An incorrect emergency run down Dinah Shore Drive would result in the vehicles (fire, police, ambulance) would mean that once they committed to crossing the Dinah Shore Bridge, they would need to run all the way into Cathedral City before they could turn around and backtrack to their actual destination—a waste of precious time in an emergency situation. At the Planning Commission session, it was determined that there should be a meeting with the communities involved and, it was determined that the Fairways complex had not received notice of any of this. Attached are t some emails that address this—the first was sent to the Tahquitz Board members by me to bring them up to date on the meeting with Planning. Then on July 13, 2015, I received a call from Ms. Hintz advising me that we needed to meet next week. I advised her that several of my board members were on vacation and that we needed to delay the meeting and to get Fairways HOA involved in the process since they too would be affected. She said she would discuss and advise accordingly. The second group of attachments are the group of emails that followed. Our concern is that for some reason, there seems to be an immediacy here that this get accomplished without full community involvement and that there are a number of issues that seem to be overlooked in favor of expediency of getting this done. Our first position is that the name should not change from 341h Street. It involves cost on the part of the city, confusion to residents and friends including deliveries, vendors, visitors, emergency services, etc. Also, there is a cost to individuals to update their GPS systems and that will take time and in many cases will not happen on a speedy basis in a retirement community where people just do not always update such things in a timely manner. Our second position is that the two names—Dinah Shore Drive and Shore Bridge Lane—running parallel to each other will undoubtedly lead to confusion and may end up resulting in a medical emergency situation delay or a delay in services to prevent a break-in, fire, whatever. We feel this project is not being discussed with all the groups involved and the resulting time, expense and potential liability to the city, the builder and developer have not been fully considered. Sumner President, Tahquitz Creek Villas. 2 After our "interesting" meeting with the Planning Commission last week and their decision to put off any vote until we and Lawrence Crossly Neighborhood "got together", I got a call this morning from the Planning Commission wanting to know if we could meet next week. I told them that we needed to delay owing to the fact that a couple of board members were out of town. I also noted that it seemed from our meeting last week that no one was representing the Fairways complex and that they were located right on the corner of Crossly and 34th. Also. they have well over 100 units in the complex and I felt that they should have a voice in this. The lady agreed with me and noted that she would contact Fairways to see what their availability was for doing a meeting and when. My guess is that we may delay for one or two weeks and that will probably be it. When we get together with all, I think we should have two positions. The first being that we do not want the street to be renamed at all. The fall back position would be that we do not want it named Shore Bridge Lane (or whatever) being so close to Dinah Shore Drive and the potential for emergency vehicles having trouble locating someone who is in trouble and taking the wrong road and going all the way to Cathedral City before they could turn around -time, maybe a life, and possibly property damage from a fire, etc. All of which could put the city in line with the builder for a liability claim(s). Let me know your thoughts. I will keep you posted on the potential session with others- prior to the Planning Commission meeting. Terry Hello Mr. Sumner, I spoke with the Planning Director and he indicated that Fairways' entrance to the complex is located on Crossley Road and not on 34"' Avenue. Also, the Planning Commission gave direction to return for review on August 12"; therefore I will need to set up this meeting prior to their meeting. The street runs the entire length of their southern boundary and they are between Dinah Shore and the proposed Shore Lane (34th Street) rename - which would mean potential confusion for their residents in the event of an emergency service,just as much as Crossly Neighborhood, the new complex and Tahquitrz Creek Villas. Having two "Shore" names on streets that run parallel to each other is not a good idea. In the event of a medical emergency or any other emergency in any of these adjacent communities increases the potential for a delay in response and a potential serious result. This certainly could prompt a legal action against the city, the builder of the new complex, etc. And, in this day and age legal suits are not all that infrequent. Again, I would request a delay in this discussion until we can get community input. Terry R. Lawrence Crossely was successful and influential in Palm Springs, and certainly the fact of him being black attests to race being a non-issue in our city's development and administration at a time when it was a very volatile s=al issue. However, I was quite early, no one was present, doors were locked and I read a posted notice that said this topic was to be continued on Aug. 12 with a planning commission recommendation to the council. I assumed the meeting was canceled. The response was overwhelmingly opposed to the name change of Golf Club. I feel that the City Council should not move forward with name change, or the every least the council should schedule a public hearing. am not opposed to honoring Mr. Crossley, but I believe that has already been done when the city named Crossley Road after him.
