HomeMy WebLinkAbout10/21/2015 - STAFF REPORTS - 2.I.DATE: October21, 2015 Citv Council Staff Report CONSENT CALENDAR SUBJECT: APPROVAL OF PLANS, SPECIFICATIONS AND ESTIMATE (PS&E) AND AUTHORIZATION TO BID FOR THE SAFE ROUTES TO SCHOOL PROJECT, CITY PROJECT NO. 08-10, FEDERAL AID PROJECT NO. SRTS-5282 (039) FROM: David H. Ready, City Manager BY: Public Works & Engineering Department SUMMARY: The Public Works & Engineering Department received a federal grant in the amount of $382,500 through the Safe Routes to School ("SRTS") program from the California Department of Transportation ("Caltrans") for design and construction of various improvements in the vicinity of Cahuilla, Cielo Vista, Katherine Finchy, and Vista Del Monte Elementary Schools, and Raymond Cree Middle School. The plans and specifications are completed, and in accordance with 7.03.040 of the Procurement and Contracting Code the Council is required to approve and adopt plans, specifications and working details, and authorize the bid request for all public projects in excess of $100,000. Approval of plans, specifications and estimate will allow staff to proceed with bidding of this capital project, with an estimate cost of $350,000. RECOMMENDATION: Approve the plans, specifications and estimate and authorize staff to advertise and solicit bids for the Safe Routes to School Project, City Project No. 08-10, Federal Aid Project No. SRTS-5282 (039). STAFF ANALYSIS: In July 2008, the Public Works and Engineering Department applied to Caltrans for the SRTS Program funding for infrastructure improvements at four elementary schools and one middle school in Palm Springs. The application provided details on a collaborative community -based project at five school sites in the City, designed to increase the safety of students walking and biking to and from school. The City requested $382,500 in federal funding for this project. ITEM NO. A City Council Staff Report October 21, 2015 — Page 2 Approval of PS&E and Authorize for Bid CP 08-10, Safe Routes To School In October 2008, after a competitive review, Caltrans approved the requested funding amount. A total of 481 applications were submitted by local agencies from around the State, and only 119 were approved for funding. The project includes construction of pedestrian safety improvements: curb and gutter, sidewalk, ADA curb ramps, crosswalks, bulb -outs, chokers, countdown signals, and bike lanes along school routes in the vicinity of Cahuilla, Cielo Vista, Katherine Finchy, and Vista Del Monte Elementary Schools, and Raymond Cree Middle School. Staff has prepared the plans and specifications for bidding this project, and coordinated with property owners along Calle Palo Fiero regarding the proposed sidewalk construction and its impact to existing front yard landscaping and other improvements. Letters were sent to the affected property owners on September 17, 2015 included as Attachment 2. Staff has answered telephone inquiries about the project and is not aware of anyone opposing the project. With the exception of a few red curbs installed at intersections to provide for safety or sight distance requirements, this project will not remove any existing street parking. The City operates under a "Master Agreement" with the State of California, through its Department of Transportation ("Caltrans"), identified as the "Administering Agency — State Agreement No. 08-5282" for use of federal funds on City projects. Under the terms of the Master Agreement, the City is required to comply with certain State and federal requirements, including pre -approval and authorization to proceed with construction prior to bidding a project. Staff has successfully coordinated with Caltrans to obtain authorization to proceed with construction of the Project; a copy of the Caltrans authorization letter is included as Attachment 3. The contract bid documents were prepared by the Public Works & Engineering Department and are ready to formally solicit construction bids for the Project. With the City Council's approval, staff will advertise the project in the Desert Sun, submit the Notice Inviting Bids to plan rooms, and provide the bid documents available free of charge to prospective bidders. A copy of the contract bid document for the Project is on file with the Public Works & Engineer Department. The specifications identify the following tentative schedule for the bid process: Notice Inviting Bids to be posted: Deadline for receipt of bids: Contract awarded by City Council: ENVIRONMENTAL IMPACT: October 22, 2015 3:00 PM, December 1, 2015 December 16, 2015 Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes 2 City Council Staff Report October 21, 2015 -- Page 3 Approval of PS&E and Authorize for Bid CP 08-10, Safe Routes To School of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities; therefore, the Safe Routes to School Project, City Project No. 08-10, is considered categorically exempt from CEQA, and a Notice of Exemption has been prepared and has been filed with the Riverside County Clerk. A copy of the Notice of Exemption is included as Attachment 4. On August 12, 2013, Caltrans, acting as the lead agency pursuant to the National Environmental Policy Act ("NEPA"), made an environmental determination that the Project does not individually or cumulatively have a significant impact on the environment as defined by NEPA and is excluded from the requirements to prepare an Environmental Assessment ("EX) or Environmental Impact Statement ("EIS'), and has considered unusual circumstances pursuant to Section 6004 of 23 CFR 771.117(b). On the basis of this determination under federal delegation pursuant to Chapter 3 of Title 23, United States Code, Section 326 and a Memorandum of Understanding ("MOU") dated June 7, 2013, executed between the Federal Highway Administration ("FHWA") and the state of California, Caltrans has determined that the Project qualifies for a Categorical Exclusion in accordance with 23 CFR 771.117(c) pursuant to activity (c)(3). On May 28, 2015, an administrative environmental Re -Validation was approved by Caltrans. Copies of the NEPA Categorical Exclusion and environmental Re -Validation forms are included as Attachment 5. FISCAL IMPACT: The City has received $344,000 in federal aid funds for construction of the Project, as shown in the Caltrans authorization; these funds will be allocated to the Capital Project Fund (Fund 261) in Account No. 261-4491-50299. Caltrans previously approved $38,500 in Design funds in the 2011-2012 Fiscal Year. The final construction estimate is $350,000. Staff is recommending that an additional appropriation of $36,000 be allocated from the Gas Tax Fund (Fund 133) from unscheduled capital projects (Account 133-4298-50000) to a new account for the Project in Account 133-4298-50299 to account for the estimated shortfall. City Project No. 08-10 Dear property owners: Via Registered Mail — Return Receipt The City of Palm Springs has obtained a federal grant as part of the "Safe Routes to School (SRTS) Program, 2-nd Cycle", to improve students' safety around four elementary schools in Palm Springs. Surveys were conducted among students, parents, teachers, law enforcement and community members, which provided valuable information and suggestions regarding changes that would increase safety in schools vicinity and school routes. An important part of this SRTS project is the construction of new concrete curb & gutter and sidewalk along the west side of Camino Real between San Lorenzo Rd. and Calle Palo Fierro. There is no existing sidewalk on this segment of Camino Real, and the students walking to and From Cahuilla Elementary School are forced to walk in the street, a very unsafe condition. Our records show that you are the owners of the property located at 792 E Mesquite Ave (APN No. 508-192-030) in Palm Springs, which is adjacent to this project and will benefit from the new sidewalk construction. We have prepared construction plans for a 5 foot wide sidewalk behind the curb, within the City's right-of-way, which is at 40 feet from the road centerline. Within the City's right-of-way there are landscaping and other private improvements, which will need to be relocated or removed. The purpose of this letter is to show you the construction plan and to identify what private improvements will need to be relocated or removed. Our intent is to coordinate with each property owner to minimize any impacts to front yard landscaping and other improvements as a result of this project. In order to construct the sidewalk, the existing landscaping improvements will require removal or relocation. If we proceed as planned, some items will be removed by our construction contractor. However, plants will not be transplanted by our construction contractor, unless it is done so by a private arrangement between you and the contractor, or done by others prior to our project.
